remember all suspects are innocent until proven guilty and as always enjoy the video on January 16 2017 a woman called 9-1-1 stating that a man had stuck his hand out of a car's sunroof and fired a gun into the air in the middle of a gas station while responding to the scene officers saw the suspect's vehicle go past them in the opposite direction the officers turned around and initiated a traffic stop get back in your car get back in the car get back in the car sit down come here turn around you got a gun on you man why they call him saying does anybody in the car have a gun come back here man you got at least two more occupants in there all right hook them up put cuffs on you just for your safety in mind man you want to put your hands behind your back what's going on bro yeah somebody okay is there a pistola in the car where at right who's in the vehicle your wife and your son they're not going to reach for it okay does she speak English Hey Thomas where y'all at hang on I'm approaching people let me see your hands hands up again we're at 177 Aldine Bender it's gonna be on the north side of the freeway before you get to Pier Valley I got the pistol we got one in the bag everything's under control One in the Chamber everything what are you doing with the pistol flashing around at the store did you shoot it oh sure why why would somebody be calling on somebody in your vehicle can you take my glasses off why would somebody be calling the police somebody gave your plate your vehicle that somebody said that you pulled a gun out I'm on my way home sir okay so what happened that's all I know okay well somebody called the police were y'all at that Shell gas station y'all were coming from there or around that area did you move around that area Okay somebody called the police and said that a male driving this vehicle gave the plate number and everything said they pulled a pistol out did he pull was there some kind of road rage incident he pulled the gun out and showed it to somebody we just went to the Shell station whatever was the Shell station but we went to the gas station back there and we bought a lottery ticket at the Shell station yes sir we bought it so I just asked you two seconds ago were you at the Shell station you said no I'm just saying if it was a gas station okay but you just said in your story that you went to go buy a lottery ticket at the Shell station so how did you not know it was the show because I wasn't paying attention you have an ID on you please how old are you buddy 12 okay nobody's following me down no no we're just we're just we just got to investigate because somebody called we just got to make sure that person that called you know they don't say that he pointed a gun at him and stuff like that so okay as of right now he's not arrested okay we're just attaining them I mean he first of all we pulled him over he opened the door immediately got a car you'd never do that okay I know he's trying to get away from his gun but he just didn't want us to get in trouble but and so I guess he's driving uphill now the person just discharged the weapon into the air out of the uh sunroof did he shoot it out of the sunroof no sir ma'am don't lie to me doesn't get you in more trouble did he shoot it yes or no he did shoot it okay why did he shoot it just because he did yeah wait what did was he pissed off at somebody or what no it wasn't toward anybody he just shot it not towards anybody okay flyable and that's clear the wife just admitted to me he just shot the gun up in the air I want to change it to a discharge firearm yeah I mean they're that's all I'm looking for he said it was in center console but she said yeah he fired it through the sunroof up in the air yeah discharged fire in the City Line That's the charge of the city yeah um okay um that's fine we'll see if anybody else comes over here as far as the reporting anything but you know you got your ID ma'am okay sorry hey Brad just run her and then get her or just run her out to get her phone number foreign we're on the phone with the D.A right now um uh so discharge the fire and City Limits is a misdemeanor charge okay it's not felony or anything so the da is going to tell us yes or no on that if it's a yes and we'll probably take you for that um we'll let you take the car we won't tow the car so you have your son and everything and I think he also has some like little city traffic warrants with us like four maybe until he'll sit on those so he's gonna let y'all take the car so I'm gonna have him sign it okay um and then go from there all right I'm not sure it's just it's a misdemeanor I don't know how long I don't know I couldn't tell you you know maybe a week maybe half a week I don't know it just all depends on what the judge does I'll probably see a judge tomorrow morning or Tuesday morning and then go from there maybe get Bond I don't know so uh you know it's not a very serious crime but still it's very negle again especially having your kid in the back seat you know I mean it's just not smart Okay so yeah and and like I said he's lucky because we knew he had a gun you know kind of aggressively and walking towards us that's not a good thing to do that I do not want to you know shoot somebody like that you know yeah I know what you mean because my first I did same thing yeah my light was out and I I got out and he was like don't you ever do that yeah yeah it's not good so I pulled over before so that freaked me out and I I got out yeah and that's understandable I mean I knew why he jumped out is because he didn't he doesn't want us to go to the car see if there's a gun there you know so and it happens all I mean I know so but I'm glad you were truthful with us and stuff like that because we were going to find either way and if you would have lied more and more we could have got a charge on you so I know um oh I have your ID right yes sir okay I'll get all that all right just just sit down with him and just try to I know he's going to get upset but just try to break it down to him as as he wants to crack really bad right yeah yeah just you know you just kind of let him know Halo This is a learning experience you don't do what your dad just did okay well your dad did was dumb all right and you know probably most of the time he wasn't going to get caught but we were right there so um yeah just explained to him you just don't let that happen you know don't let him be in those shoes okay okay all right bro I need your signature step out for me you step out your right hand or left-handed right all right come over here it's 29 year old Michael Ortega was arrested on one misdemeanor count of discharging a firearm in the metro area ultimately all charges were dismissed but the suspect would end up getting convicted for DUI and as of the editing of this video is currently in jail for aggravated assault with a deadly weapon so basically exactly what you would expect all right keep your palms this way it's going to feel more comfortable [Music] oh hold on okay now keep your palms together there you go it should feel better you're welcome hold on one sec yeah I mean it's not really the fact that you don't have to have a license on you when you have it in your car it's just that you shot it in city limits you know that's that's the charge you know I don't know what a lot of your wife already gave you up on camera yeah so you can't really fight it go ahead yeah I'll let her walk over here another thing is too man you got your kid in the back you know you don't even be doing that with the kids back and uh also I know you probably didn't know we knew you had a gun on a traffic stop don't don't jump out of your door like that that's a good way to get shot okay and I do not want to shoot somebody like that okay because in my mind when I get dispatched when I hear that drop right there I know you have a gun okay because of how I got called in and you're gonna kind of jump out like that when normal people don't do that I don't know if you have a gun in your hand or what are you planning on shooting me or what you know what I mean so that's why I had my gun out and I was ready to you know go if you were ready to go you know so I don't know what was going to happen so next time just stay in your vehicle all right all right I'm gonna have I'm
