Walk away. You're going in cuffs. Okay. It's going to be that simple. >> Okay. I have no idea. >> You're not going anywhere. Okay. Listen. Don't listen. Listen. Look at me. Look at me. >> Last chance. >> All right. Come on out. Come on out. >> Come on over here. Are you able to walk a straight line? >> Yeah. >> Get that from the vehicle. Okay. >> Yeah. On February 10th, 2026 in Key West, Florida, a hit-and-run investigation at a suspect's residence ended an arrest, an obstruction charge, and a refusal to sign a traffic citation. Two additional encounters, a DUI stop in Florida, and a suspended license arrest in Tyrone, Georgia, each ended in handcuffs after subjects cited a parent in the legal profession as grounds for non-compliance. This is that compilation. What makes these three stops analytically significant is that every act of resistance was framed as legally advised and every one of those claims was legally wrong. >> Where is he going? >> Uh, she'll be one sec. Police Department. >> Okay. >> You doing all right? >> Yeah. >> Okay. You have an ID on you? >> Yes. >> All right. Is this your vehicle? >> Yes. >> Registered to you? >> Yes. >> Okay. >> Why are you here? >> Okay. Just step out the vehicle for me. Okay. So, we can speak. >> Why would I speak to you right now? >> Okay. So, right now we're investigating a hidden run. Okay. So, I just want to speak to you outside of your vehicle so you can explain to me what you remember or whatever happened and then we can go from there. It could it doesn't have to be a hit and run. It could be a traffic crash if you're willing to exchange information. So, if you don't mind providing me with your license, registration, and insurance. >> First of all, I have nothing to speak to you. Okay. >> Second of all, I'm not running of anything. >> Okay. Well, you're not free to leave. So, >> third, what are you searching for? >> I'm not searching. I am investigating. There's a difference. You're not going to close the door unless you're just going to go on cuffs. Okay. I'm giving you a verbal command to provide me with your warrant. I don't need a warrant to speak to you. I'm investigating investigating >> a traffic crash. More so a hit and run. Okay. Where' she say she had damage at? >> In the back of her vehicle. >> Check the front of hers. >> Yeah. Her front, right? >> Okay. Okay. I'm going to explain this to you one more time. You are not free to leave. I need your license. >> Okay. Let me close your mic. >> Okay. Close it. If you walk away, you're going in cuffs. Okay. It's going to be that simple. >> Okay. I haven't You're not going anywhere. Okay. Listen. Don't really know it. Listen. Listen. Look at me. Look at me. >> Look at me for what? >> You want to go to jail? >> For what? >> For a hidden run. You crashed into someone's car and didn't stop. Okay. >> That's fine. We can play that game then. It was that was that easy. All you had to do was give me your stuff. All right. Listen, >> I live like in this. >> I know. That's fine. The thing about it is is you're sitting here laughing. Okay. I'm usually not like this. I'm simply trying to investigate this and just turn it into a traffic crash. But you don't want to give me your information. All I needed was your license. >> Information. You didn't ask. >> I did. I said license, registration, and >> you didn't give me a chance. >> I gave you a chance, but you pull your phone out. >> Chances, man. >> And I warned you. And then you tried to close your door on me and I sat there politely and requested these documents. It was It could have been that simple. So, are you willing to give me those documents? >> I have everything in my car. So, if I take these handcuffs off you, are you going to give me the documents? >> Sure. >> Cuz if not, I'm just going to plain take off. You just >> But the thing is, since I'm giving you commands and you're refusing to obey my command as a law enforcement officer. Okay. Like I told you, I'm investigating a traffic crash. Okay. >> So, if I remove the cuffs, are you going to give me your >> You do whatever you need to do. The car is there and my house is right there next behind me. You do whatever. >> Okay. So, I'm going to take the cuffs off you and then I'm going to need you just to give me the information whatever you need to do >> and then we go from there. All right. >> Sure. You do whatever you need to do. This is very, very random. >> It's not random. >> It is random. >> We're not here for no reason. >> I'm not here for a reason as well. >> So, I simply was asking >> I'm not here for a reason, sir. >> For your license, registration, explain. >> You do whatever you need to do. You didn't explain me to >> You didn't explain me to You just run with him at me to get whatever you need. Go ahead and give me your license, registration, insurance, please. Right. >> Did you guys call me from somewhere? >> No, we got a call about your vehicle. >> From who? >> Somebody called saying that you >> That's very personal. >> Personal? How? >> I don't know. Can you tell me? >> I don't know. I didn't say it. You said it was personal. So, I'm trying to I'm trying to understand where you're coming from. Like a parcel if there's like a three vehicles of like a police has to be a personal thing >> like like >> I live like right here >> like personal against you. >> I don't know >> think like so you're saying like we're coming for you. >> I don't see how that could be >> nothing to do with nobody. >> Right. But again >> I'm new in this neighborhood. >> Okay. I can tell. >> So what did I do to somebody if I'm new? >> What we're investigating is a hidden run. A hidden run means you >> can I can I can I explain to you please sir. >> What's your name? Yvana. Right. >> Yes. >> Can I explain it to you without you interrupting me? >> Sure. >> Okay. So a head run is in simple words when you collide into something or another vehicle and you leave without providing information. >> Do you have a body? >> Yep. That's why it's blinking >> camera. >> That's why it's blinking red. >> Sir Mr. Oh, >> you have a camera there. >> So, you know who the >> run >> is. >> I'm not the running person. >> So, you have your running. >> You have a new camera. >> Okay. >> So, you investigate your camera. Who? The running person. >> I don't investigate my camera. I investigate what? >> I know my rules and my laws in this US. >> You know your rules and your laws. Um I I think this isn't a rule of law thing. This is a traffic crash. So right now we are investigating that due to the fact that someone isn't just going to call and say that their vehicle got struck >> and give your license plate and the description of your vehicle. >> You know whatever you need to do. >> I will >> I will do whatever you need to takes to defend myself. And you have a camera there. >> For sure. That's what That's why it's blinking red. >> Required to have it on. >> I'll do my thing. >> Yes, ma'am. So, what's next? >> What's next is just we're doing a traffic crash right now as I've explained. >> Okay. Yep. Here's some glass over here. >> She kind of angled in here. Like I thought she was going to pull into the drive. [snorts] >> Yeah. Okay. Thank you so much. >> Yeah. So, she definitely hit that trailer. >> I wanted to be a police in one year, but I don't think I would consider that career anymore. >> I understand. A lot of people just don't understand the circumstances of >> I'm more like of a human human being >> right >> in the right >> but I think in my period I'm probably not looking for that area anymore >> right to each his own you know >> it's such a >> it's not what you see on TV >> no >> I'm living the reality right now >> yeah this is this is realistic when >> when people don't listen to the commands that officers give >> then we have to act in such way you know >> yeah I was quite polite with you. >> I'll be honest with you getting something. That's fine. And I didn't treat you like you weren't. I can care less if you were. You were. >> And you could cause me. >> I know. Cuz I have the right to. When you're refusing >> when you're refusing to obey my my verbal commands, I have the right to put you in handcuffs. >> You have the >> power over everything else. >> I don't. >> You do? because they're going to deal over your power and you're working for it. Is it worth it? >> Excuse me. >> Is it worth it? >> Excuse me. >> Is it worth it? >> Is it worth what? >> Your peace. >> My peace. I have peace every night. I sleep very well after a shift. >> You have a trailer over there. >> So, here's a trailer. There's glass like right there. Right on the corner. >> Looks just like that glass over there. So, okay. Just stay right here. Stay right here. Stay right here. Come here. Come here. Come here. Stay over here. Please >> don't touch me. >> Stay over here. Please don't touch me. >> Stay over here. Please >> do not >> stay over here. Please. >> Stay over here. >> Just stay right here. >> Because I'm telling you to stay here. >> But why are you pushing me? >> Because you're not listening. >> My door. >> Okay. I'm telling you to stay here. >> You're a man of your words. >> What? >> Go yourself. You belong over there. I just wanted to close my door. >> Okay. So, you could have said that, but I told you to stay here. >> My a man of the law. >> This is how we look. >> Got a lot of time. >> Just relax. >> Here. We're going to sit here. >> Give this officer your phone number. Put your phone down. >> Calling people on your phone. >> I know, but my dad is >> I don't care. So, just give him your phone number, please. >> Do Stop with the phone. >> I know. But what is your phone number? >> I don't know. I need my dad. I don't know your phone number. >> You don't know your phone number? >> No, my dad has no money my know my >> Okay. So, you can pull up your phone. >> You can pull up your phone number on your phone. Don't call your dad. >> But let me I have to call him because it doesn't know my >> that you will look it up on this. Don't Don't pull my thumb. Don't pull my thumb. Okay. Stay right here. >> You can look it up in your phone under my settings. You don't need to call anybody. >> Like right here. This is my house. >> Okay. Well, we're not calling >> and I park here all every time. >> Okay. So, you don't know your phone number is what you're saying. Is that correct? >> I can also just get it later. >> Yeah, that's what I was going to say. >> Okay, I'll get it later. No big deal. >> Listen to me, okay? I need you to relax and I need you to just listen. >> No, I don't need to relax. You're accusing me something that I never done. >> So, listen. >> And you're following me like with three police cars that I never done. >> So, listen. That's Officer Florence, the one who the >> again listen. He explained to you the crash scenario. So, now his crash investigation is over. Okay. >> Okay. Yeah. What does me >> now? Now we're going to start a different investigation. Okay. >> Oh, so this is your whole plan of the entire time. >> Just wait here for a second. Stay over here. Stay over here. >> Yeah. Yeah. >> Stay over here. >> Listen to simple instruction. >> Just stay here, please. >> I'll stay here. Okay. So, right here. Just stay right there. I'll stay here. Just stay right there. Just stay right there because you're not listening. You have the right to remain silent. Do you understand these rights I've explained to you? >> No, I have a lawyer that needs to talk to you. >> Okay. So, do you do you understand these rights I've explained to you? >> I have a lawyer. >> Okay. So, that's not the question. The question is if you understand your rights that I've explained to you. >> My lawyer will talk to you. >> Okay. So, I'm going to assume that you do understand and you know you want to talk to a lawyer. So, you don't want to talk to us right now. >> My lawyer will talk to you. >> Okay. So, you don't want to answer any questions? >> Can I have this card? >> No, you can't have. Do you even know this law by by heart? >> So listen. So listen. >> No. Can I have your card back? >> No, you can't. Okay. >> Okay. No. >> So you don't want to answer any of my questions or talk to me? Is that correct? No. >> No. You're not free to go. So you don't want to answer any of my questions or talk to me? >> No. No. Maybe tomorrow when I speak to my lawyer, he'll speak to you. >> What do you have in your hand there? Turn around. Put your hand behind your back. Do you want anything else to go with you, Jay? Out of your car. Do you want anything else? >> You need for me to go to the jail that makes you money. >> Nothing's going to make me money. >> Please have a seat. >> Oh, thank you, sir. So romantic. >> I will make my phone and call my father. >> Okay. You'll be allowed to make a phone call in a little bit. >> I need to call him. >> Well, that's not happening now and let him know what the how I know because none of this [ __ ] happen. You tell me another thing. You're telling me another thing. You're bringing me here like on J like I'm a criminal. No, you said please give me my phone. >> I'm not going to give me your phone. >> Give me my phone right now. That is called my lawyer right now and my dad and my dad need to know what the is going on right now. And you're not bringing me for another one [ __ ] thing that you need to >> So listen >> clock in for. So listen, you see this line right here in these spots. >> So that is to do soiety exercises right now. >> Stay seated, please. >> No, no, I'm good. >> So you understand, >> sir? And it >> Okay, so you understand? >> I understand. >> Okay, good. >> So there's no trust to my lawyer or my dad >> when um we're done. Yes, you you going to be afforded opportunity to my dad before before I die that you have to tell me all the things that I have to do here. I would like to say goodbye at least to my dad. [snorts] >> Okay. Like I said, when we're done, you're going to be afforded to call whoever you wish. When we're done, why not now? >> Because that's not how it works. So I want to call him now and tell me why I should be doing now because apparently you're doing something the opposite that something that I have been not done. I've been here in cubs which is something incorrect sir Mr. >> What's that now? >> Yeah. >> Do you have a question? Go ahead. >> Nope. Never have a question. >> Okay. >> Just observing you with your own cuteness. Do whatever you need to do. >> Okay. I need you to sign this >> accused for thinking. >> Yes. Exactly. You're being You're being accused. Okay. You're not being convicted. Okay. That's not this. That's not this right here. >> I need to get in contact with >> We're not going to go You will have that opportunity. Okay. >> Run from >> You will have that opportunity right now. You're being charged and these are the charges. >> The charge went over it with you numerous times. Okay. We're not going to litigate it here. >> I have a need to speak to my dad. He's a lawyer. And if he says sign this document, >> so your dad isn't here right now. You're an adult. The decision is yours. >> Okay. No, I need to speak to him. I need >> So, you're not going to speak to anybody right now? Right now, you're going to make the decision of either signing or not signing. >> Okay. So, you're going to sign them? >> I don't know yet. Okay. No, we're not going to do this. We're not going to Give me those papers. Give me those papers. Give them to me. >> Are you going to sign them? Yes or no? >> Hold on. >> Yes or no? >> Maybe. I don't. >> No. Not maybe. Yes or no? >> Stand by. >> Five. Four. >> I'm counting down to one. Once I get to one, I'm going to assume that you're not going to sign them. Officer Osmond of the Key West Police Department arrives at a residential address to investigate a hit and run. Under Florida statute section 316.027, any driver involved in a crash resulting in damage to an attended vehicle must remain at the scene and exchange identifying information. Departure without doing so converts a traffic incident into a criminal offense. The subject's immediate response, calling her father, introduces the central theme of this video. Under Terry versus Ohio, 392US1968, a driver contacted during a lawful investigatory stop is not free to outsource the encounter to a third party. When the subject attempts to re-enter her vehicle and refuses Officer Osman's commands, the encounter reaches a constitutional threshold. Under Pennsylvania versus Mims 434US1061977, a law enforcement officer who has made a lawful traffic stop may order the occupant to exit the vehicle as a matter of course. The order requires no additional justification. It is not a request. Failure to comply provides independent legal authority for escalation, and the handcuffs that follow are the direct legal consequence of defying that command. When Mr. Andrade arrives on scene, both subjects continue invoking the father's attorney status as a legal shield. Under Burkimer versus McCarti 468US 420 1984, ordinary traffic stops do not constitute custodial interrogation for Miranda purposes until formal arrest. Neither subject had any right to counsel merely because they were stopped. When Miranda warnings are subsequently delivered and Mr. Andrade invokes his right to counsel. Officer Osman correctly ceases all investigative questioning. That invocation is the one legally accurate moment in the encounter. What it does not do is suspend the administrative requirements of the stop. The citation dispute that follows illustrates the critical distinction between Fifth Amendment protections and a general right to non-ooperation. A traffic citation signature under Florida law is not an admission of guilt. It is a written promise to appear in court under Hibel versus 6 Judicial District Court of Nevada 542US1 177 2004. States may compel identification and basic administrative compliance during a valid Terry stop. Refusing to sign does not eliminate the citation. It creates a separate basis for additional charges and compounds legal exposure. >> Standing here for 5 minutes drink tonight. >> I hated this. I'm having a PTSD. >> From what? >> From what? >> Yeah. >> I was a child. >> I'm sorry to hear that. Why would this trigger that? >> Asking for help. This is not triggering it, but I'm trying to get to my boyfriend's house. Please. >> So, you haven't had anything to drink? All right. All right. If you were going to step out of the vehicle, I want to make sure you're not under the influence and we'll have you on your way. All right. >> I'm not allowed to. >> You're not allowed to? What do you mean? >> Why aren't you allowed to? >> I'm not allowed to at this point. My dad's a lawyer. >> Your dad's a lawyer? >> And I'm not allowed to. >> Okay. Well, even as a lawyer, he would tell you if you're ordered out of a vehicle that you should that you have to comply. >> He's told me otherwise. >> No, he wouldn't tell you that. That you don't have to come out if you're told to. >> I mean, he's a piece of [ __ ] So, >> that's what it sounds like he would say. Yeah, he's he's giving you bad information. So, if you would go and step out if you're not under the influence, you'll be on your way. >> Okay. >> All right. So, come on out. >> I'm not allowed to. So, >> no. Go ahead and step out. >> I'm not allowed. >> Explain to me why you're not allowed to. >> Don't kill me. >> He's not going to kill you. He would tell you if he was giving you sound legal advice, he'd tell you when you're ordered out of a vehicle to step out. >> Come on up. >> I'm not allowed to. >> Last chance. >> I'm not allowed to. >> All right. Come on out. Come on out. Come on over here. Are you able to walk a straight line? >> Yes. Can you balance on one foot? >> Yes. >> All right. You want to bring your feet together for me? You're going to follow the red light with your eyes only. You're going to keep your head still. Do you understand? >> Yes. >> Keep your head still. >> What's going on? >> Do we have to call fire rescue? >> Passed all. >> You passed what? >> I tried. I ped all the time. >> For what? Hey, just Hey, Dad. It's a trick. >> All right, Miss Gilbert, let me explain something. All right. this this episode that you're having. While I understand that it might be genuine, we still have an investigation to do. >> The more you're exasperating, I can smell the odor of an unknown alcoholic beverage coming off of your breath. So, we got we got something to do here. >> And if you got to go to the hospital, we can continue the investigation there. Miss Gilbert, do you wish to do the exercises with me? Yes. [laughter] >> All right. If you would come to your feet, please. I still have to do the pen light test. All right. All right. The instructions are the same as before. Follow the red light with your eyes only and keep your head still. >> Now, place your right foot in front heel touching toe. When I tell you to begin, I want you to take nine heel totoe steps. Take the series of small steps to turn around and then take nine heel to toe steps back. Once you start, you don't stop. You keep your arms at your sides and you count your steps out loud. >> We respect your time, so we remove the small talk. Subscribe to Crime Scrutiny for fast, nononsense body cam. Do you remember what you were instructed to do? >> Nine steps. >> Nine heel to toe steps and then what? Then the turnaround that I showed you and nine heel to toe steps back. >> All right, for this next exercise, it's going to be the one leg stand. All right, you can go ahead and step off the line or you can just stand. You can just stand right there, too. That's fine, too. >> You guys are over it. Do whatever you have to do. >> We're still giving you a chance. What are you talking about? >> Shaking your head. I need to >> I'm not shaking my head. >> Whenever you're ready, go ahead and bring your feet together just like mine are. >> I'm sorry to waste your time. [snorts] >> Not wasting my time. I'm I'm on the clock. >> You got me in the middle of >> the middle of what? >> You look back in your video footage. I told you. >> No, you didn't tell me anything. I don't know what you're talking about. Do you wish to continue the exercises, ma'am? I just kidding. >> I don't understand what you're asking for help with. >> How to deal with this? >> To deal with what? >> PTSD. >> To deal with PTSD. >> I just told you. >> You didn't tell us that. >> Well, I told him. >> I would suggest that you seek counseling for that, but during a DUI investigation isn't the time to to deal with that. >> Was not during it. >> No, I'm saying >> you walked up to me and I told you all. >> Okay. And that's not what I said to you. I said I suggest you seek counseling for that, but during a DUI investigation is not the time to deal with it. >> This is a DUI investigation. >> Okay. I'm going to ask you one last time, Mackage. >> Do you wish to participate in standardized field sobriety exercises? >> Yes. >> All right. So, when you're ready, go ahead and stand up. >> Okay. [laughter] Okay. >> Stand up. >> Please come to your seat. Bring your feet together, hands at your sides. This is going to be the one leg stand. When I tell you to begin and not before, then you're going to raise one foot approximately 6 in off the ground. While you're doing that, you're going to keep both knees straight. You're going to look down at your raised foot and you're going to count out loud. 1,001 1,002 and so on until I tell you to stop. Okay? Just watch me. Just do exactly what I'm showing you. Both knees are straight. My toes are pointed out. My hands are at my sides. And I'm looking down at my foot. This is all you have to do for 30 seconds. Do you see what I'm doing, Miss Gilbert? I'm not doing this. >> You're not doing it. All right. You're being placed under arrest. You're driving under the influence. >> Okay. >> And as well as um obstructing an officer camera, I'm sorry. >> Yep. We got four cameras out here. >> Well, you didn't remember anything. So, >> you didn't cooperate, so that's where we're at with that. All right. Go. >> The second encounter involves a DUI investigation. The officer, having detected indicators of alcohol impairment, asks Miss Gilbert, to step out of the vehicle to conduct standardized field sobriety testing. Miss Gilbert refuses, citing her father, a lawyer, as the source of her authority not to comply. Under Pennsylvania versus Mims, the officer's authority to order Miss Gilbert from the vehicle upon a lawful stop is absolute. No competent attorney would advise a client to defy that order. Her refusal to exit does not protect a constitutional right. It creates new criminal exposure for obstructing a law enforcement officer. Under Florida statute section 843.02, Florida statute section 316.1932. The implied consent statute establishes that operating a motor vehicle on Florida roads constitutes automatic consent to lawful chemical testing upon a DUI arrest. Ms. Gilbert's refusal to complete field sobriety tests and provide a breath sample triggers an automatic one-year administrative license suspension upon first refusal independent of any criminal conviction. Her on camera admission that her collapse was deliberate, a self-described trick, is admissible as a party admission and as direct evidence of consciousness of guilt. She constructed the prosecution's obstruction case in a single sentence on camera without any prompting. The application of force throughout the Gilbert encounter is evaluated under Graham versus Connor 490US 386 1989 which requires assessment from the perspective of a reasonable officer at the scene weighing the severity of the offense the immediacy of any threat and whether the subject is actively resisting. Miz Gilbert's refusal to exit followed by deliberate simulation of a medical emergency provided the officer with an ongoing and escalating basis for physical control throughout the encounter. The arrest for DUI and obstructing an officer was both tactically justified and legally defensible. The third encounter shifts to Tyrone, Georgia on August 24th, 2024. Officer Hail of the Tyrone Police Department initiates a stop for a cell phone violation under Georgia code section 40-6-241, Georgia's hands-free law. Upon running the license through dispatch, officer Hail receives a suspended status effective May 13th, the same date the driver, Kayiah Willis, claims her license was reinstated. The resulting arrest is governed by Herring versus United States 555US 135 2009 which holds that officers acting in good faith on official database records do not violate the Fourth Amendment even when those records later prove erroneous. Officer Hail was legally required to act on what dispatch confirmed the passenger is Fonnie Willis, the district attorney for Fulton County, Georgia. She makes no attempt to invoke her official position to influence the outcome. She coordinates vehicle retrieval through proper channels and allows Officer Hail to complete his duties without interference. This is precisely the correct conduct for a public official in this situation. The side of the road is not a courtroom and a traffic enforcement officer is not subject to override by a passenger's professional title. A contrast that could not be sharper against the strategy employed in the first two encounters. >> Take a seat. >> Hi, man. How you doing? I'm officer Hail with the Tyrone Police Department. Uh the reason I stopped you, I figured you probably know I saw you on your cell phone back there at the red light. Was there a reason you were on your cell phone while you were driving? >> Yeah, my mom was checking on because I'm pregnant. >> Gotcha. Okay, >> that's it. >> Um, can I get your driver's license, please? Yeah. Um hang time for me. Okay. Not bad. >> 24. Um, do me a favor. Uh, can you step out of the car for me and uh come talk to me back here in the back of the vehicle? >> So, >> Mhm. >> your license is showing suspended. M >> were you it's Were you aware of that? >> No, because I just paid my stuff off and got my license back in May. >> Gotcha. Well, it's it's showing it's been suspended since the 13th of May. >> That's when I got my that's when I got it back, though. Like >> Gotcha. Well, that's that's what it's showing in the system and we just had that confirmed through our dispatch. Um so, right right now you don't have a >> cuz I just I just took care of some stuff in May. >> Gotcha. Um Who's Who's this in the car with you? >> That's my sister. >> That's your sister. Is she a valid driver's license? >> Mhm. >> I'm not even sure if it was suspended, but I know I didn't have a valid driver's license in Georgia cuz I got a state ID in Texas and I apparently can't have one in both. >> Put your hands behind your back for me. >> You arrested me? >> You're under arrest right now for driving under suspended license. >> Can you call Can you tell Can I tell my sister? >> Yeah. I am going to let you talk to her and with your permission and stuff going to let her if that's fine with you take your vehicle and stuff and get that removed from the vehicle. Okay. >> Yeah. >> Okay. >> Two fingers right there. Uh, should be one sec. Sorry. Get your hair caught up in here. Okay, let me see. >> I might I'll check. So, if not, it'll stay here and we'll have somebody pull up. I'll stay with you. >> Gotcha. >> All right. So, any So, let me sort of explain what's going on. She's you're being arrested right now for driving on suspended. Um I know you think you took favor back in May. I'm not sure what sort of happened with that. All we can really tell right now is that your license is suspended. It's show it has um now as far as the process and everything like right now it's basically like a traffic citation as far as the arrest. You're going to know your bail out and everything by the time you get there. Oh, you're not going to have to wait to go before a judge or anything like that. So, you >> most likely depending on how long it takes her at the jail, depending on how busy they are at the moment, you could probably be out in a handful of hours here. Don't quote me on that, but that's typically how it goes. Just depends on how busy they are. Okay. Um, do do you have any sort of questions or comments or concerns or anything like that? Just like I can answer for you right now. All right. Turn around. I'm going do a brief pat down. You don't have any weapons or any contraband or anything like that on you at all. And you're just going to poke me stick me or hurt me anyway. All right. Um, walk me over here. I'm going just go ahead and go on and stuff. Sorry. Um, I'm going to reach over and seat belt just for safety here. Sorry. >> Yeah. >> On the 13th and they issued it issued >> it on the 14th. That makes no sense. >> That's That's what it's showing. >> You see that? That doesn't make sense. Like I'm not getting upset with you, but like that's stupid. That's a processing issue. it if I I'm not saying that doesn't happen. If if it does, that's going to be something you're having to work out uh when you go to court for your um for here for this. They all it's telling me right now is your license suspended. I had that confirmed through our >> dispatch. You can see it right there. That's that's all that's all we have to go by. >> That's fine. >> All righty. I'm going to close the door. Just watch out. Don't want to hit your knee here. Okay. >> Talk to me soon. Yeah, he's on the way. Let me see. Let me talk to him. Mom's calling again. Casey's coming to get it. Mom. Mhm. My boyfriend's coming. >> Gotcha. What's What's his name? Just so I can put that down. >> Marshall Carson. C A R L O G E G N O C >> T A R S O N. >> Yeah. >> Awesome. And um he said he said your your phone's in the car. >> She has it right now. >> Oh, got Oh, that's that's the one that uh Corporal's on. >> That's the one my corporal's using right now. >> Yeah. >> Okay. >> Again. Maybe I should just send him where you're going since you're >> Yeah, I'm going to send him where you're headed. Look, mama looking like us. The windshield's a little dark. [laughter] [clears throat] >> Hey, how are you? >> Doing well. How are y'all? >> Mom, dad, who? What's >> this? Nice to meet you. Pleasure. Nice to meet you. What? >> So, um, apparently Oh, >> he likes me. Apparently her license is suspended >> for something. She doesn't tell us what ford or why or where or that something. She have to call DMV. She's gone over to pay county jail which is right in the fell square. It's 145 Johnson Avenue. Normally I would say a couple hours is the process. It just depends on how busy they are and like that. Okay. Um the driving on the suspended basically a traffic citation. She's got to have her fingerprints done, picture taken, then she can make her bonds. You can pay it cash, use a bondsman, be 10%, whatever. They've got a list of people over there, too, that >> you can choose from and use whatever she >> So, the vehicle's registered, excuse me, registered to her. >> Um, I don't know if it was on a flock head or if the officer observed some kind of traffic infraction. It wasn't me. I didn't make traffic stop. He's already gone and got her going. Okay. So whatever the case may be, when you run the the tag, it obviously gives us the vehicle information and the registered owner and it's already in the system that she's has the invalid license yet. So upon that, we just verify that it is that person driving or stop the car first at that point. >> General assumption that the registered owner is the driver of the vehicle. >> You know, if you stop and it's not, okay, have a nice day. But uh in this case, she was. So >> So this are the keys to the car here? Yes, >> everything's here. Everything's in there. >> She has three numbers. I believe she gave it your number of JC and a third name. I didn't think she'll make sheow to get three phone calls when she Yeah. Once >> once they get the process done, she can make a couple phone calls and call you guys and say, "Okay, I'm ready. This is how much it is." Whatever. I want to say off the top of my head, I think driving on suspended license is about 1,200 bucks >> somewhere right in that area. Every municipality is different, you know, give or take a little bit, but somewhere around there. So, >> um, >> thank you for that. >> You're welcome. Any other questions, comments, concerns? >> I got to make sure you got it. >> Huh? for obvious reasons. purple the rest of the world. No, >> you want to go ahead and get it now. >> Okay, you're on the line. Open back the door up for me to get him. All right, MS. Um, here's going to be the citation today for driving on suspended license. Uh, I'm just going to give you a warning on the the cell phone. Um, I'm not going to have you you've been cooperative and everything with me, so I'm not just make sure we're driving. we're we're staying off of that and not and if we need to make a stop and make a call or text or something, make sure we're pulling off and doing that instead of doing that while we're operating the motor vehicle. Okay. Um, can you do me a favor and sign for me here right next to the X for the citation for driving suspension? Back to where you were here. Also, I think I might know what sort of happened with your suspension license. Uh, I think like you said, it was suspended at one time and then you went through the process of getting it fixed, but when you had gotten it uh pulled over or suspended for driving on suspended license, that also created another license suspension for driving on suspended license. So, that's I think what sort of caused that to happen. the bond amounts not super high or anything like that. You don't got uh it's believe it's gonna be 800 which it's not that bad and plus you don't got to wait to go for a judge or anything like that. Um it is going to be a must appear on the citation. So your court date for that is going to be October 24th day the bond >> um yeah you got to pay the whole bond amount for that to to be released. Um but that's going to be something you have to work out with the jail staff. uh it is going to be must appear for the citation for October 24th. That court date is going to be on there. If you have any other questions or anything like that, you can call the number and uh on the back of the citation and they can sort of answer you any questions or concerns or anything you have. Okay. Got you have any questions or comments or concerns or anything for me right now? All right. I understand it's it's inconvenient and everything and not so but >> following the three encounters in this compilation, the legal outcomes are as follows. Mr. Andrade was arrested on charges arising from the hit and run investigation and obstruction of an officer under Florida statute section 843.02. Case disposition was not publicly available at time of analysis. Ms. Gilbert was arrested for driving under the influence and obstructing an officer. Her refusal to submit to a breath test results in an automatic one-year administrative license suspension under the implied consent statute independent of any criminal conviction. Criminal disposition was not publicly available at time of analysis. Kanaya Willis was arrested for driving on a suspended license under Georgia Code section 40-5-121. If records confirm prior reinstatement, that defense must be raised in court. Case outcome was not publicly available at time of analysis. Officer Osman of the Key West Police Department receives a B+. He conducted a lawful stop, correctly applied Pennsylvania versus Mims across both subjects, escalated to handcuffs only after repeated non-compliance, and ceased interrogative questioning immediately upon Mr. Andrade's invocation of council textbook Miranda execution. The deduction reflects an overly extended negotiation phase during the citation dispute. A clearer, earlier assertion of statutory authority under Florida statute section 843.02 would have shortened the encounter without altering its legal outcome. Mr. Andrade receives a D. His conduct reflects a cascading series of legally counterproductive decisions. Invoking a family attorney's credentials creates no exemption from mandatory traffic stop obligations. His refusal to produce required documentation. His attempt to reenter the vehicle in defiance of a lawful order. His confusion of fifth amendment protections with a general right to non-ooperation. And his refusal to sign the citation. Each decision compounded his legal exposure beyond the one before it. The absence of physical violence is the sole factor preventing a lower grade. The officer in the Gilbert encounter receives an A minus. He demonstrated exceptional patience. Correctly applied MIMS throughout and accurately documented Miz Gilbert's self-inccriminating admission regarding the simulated medical episode. A statement with significant evidentiary value for both the DUI and obstruction charges. The minor deduction reflects the extended time spent attempting to reason with the subject during field sobriety testing. Once the legal basis for arrest was established, the encounter should have moved to custody more decisively. Miss Gilbert receives an F. Her claim that her attorney father instructed her not to exit the vehicle is not a legal defense. It is factually implausible. No licensed attorney would advise a client to defy a lawful Mim's order. Her deliberate simulation of a medical emergency followed by her on camera admission that it was intentional constitutes consciousness of guilt and active obstruction under Florida law. Her conduct provided the officer with probable cause obstruction evidence and a consciousness of guilt admission in a single interaction. Officer Hail of the Tyrone Police Department receives an A. His stop was initiated on lawful probable cause, executed with exceptional professionalism, and concluded with a constitutionally defensible arrest. He explained the reason for the stop clearly, ran the license promptly, confirmed the suspension through dispatch, and handled the presence of a high-profile passenger without deviation from standard procedure. He allowed Fonnie Willis to retrieve the vehicle without improper deference. No significant concerns. Kayiah Willis receives a B+. She was cooperative under arrest despite a legitimate frustration. The belief that her license had been reinstated before the stop. Her composure throughout was commendable. She complied with all arrest procedures without escalation and did not attempt to leverage the passenger's official status to influence the outcome. The B+ reflects the underlying cell phone violation under Georgia code section 40-6-241 that initiated the stop, which was unlawful regardless of the license question. Fonnie Willis, passenger and district attorney for Fulton County, Georgia, receives an A. She made no attempt to invoke her official position during the stop, coordinated vehicle retrieval through proper channels and allowed officer hail to conduct his duties without interference. This stands in direct contrast to the strategy employed by the subjects in the first two encounters who treated family legal connections as a substitute for compliance with lawful authority. Lesson one, invoking a family member's legal credentials is not a legal defense. Under Terry versus Ohio 392US1 1968, officers conducting a lawful investigatory detention may compel identification and basic compliance regardless of the subject's family background or professional connections. In all three encounters, subjects who cited a parents legal expertise as a basis for non-compliance found that expertise provided no protection from the legal consequences that followed. Lesson two, Pennsylvania versus Mims means you must exit your vehicle when ordered to do so. under 434US1061 1977. The exit order upon a lawful stop requires no individualized suspicion and carries no exceptions based on personal belief or family advice. Both Ms. Gilbert and the subject in incident one refused this order. Both refusals created new criminal exposure for obstruction independent of whatever the original stop was for. Lesson three. Miranda protects you from interrogation, not from arrest procedures. Under Miranda versus Arizona 384US 4361 1966, invoking the right to council ends custodial interrogation. It does not end booking, citation processing, or field sobriety testing. Mr. Andrade's invocation of counsel was legally correct. His belief that it suspended his obligation to sign a traffic citation was not. The fifth amendment is a shield against compelled self-inccrimination. It is not a pause button for administrative law enforcement procedures. Lesson four, implied consent is not optional. Under Florida Statute Section 316.1932, operating a motor vehicle constitutes automatic consent to chemical testing upon a lawful DUI arrest. Miss Gilbert's refusal did not prevent the DUI charge. It guaranteed an automatic one-year administrative license suspension in addition to criminal exposure. and her on camera admission regarding the simulated collapse added an obstruction charge the officer had not anticipated at the start of the encounter. Lesson five, dispatch records establish probable cause in the field under Herring versus United States 555US1 135 2009. An arrest made in good faith reliance on official database records is constitutionally lawful even when the underlying record later proves inaccurate. Kaya Willis may have a legitimate administrative defense. That defense belongs in a court supported by documentation before a judge not on the shoulder of a road presented verbally to an officer who is legally obligated to act on what official systems confirm.
