You're under arrest. >> No, you're under arrest nothing. Ow. I'm not under arrest. Get off of me. >> Stop resisting. Grab this arm. >> No. >> [laughter] >> Easy. >> On August 14th, 2025 officers at Orlando International Airport responded to a TSA checkpoint disturbance involving a woman traveling with two young children. A screening dispute escalated into a criminal arrest raising questions under the First Amendment federal aviation law and Fourth Amendment arrest standards. >> What's going on? >> She's swearing at us and being disruptive and accusing us of all kinds of >> What's going on? >> discrimination and everything. >> Oh, sir, come over here. Let me tell you what's going on. >> Tell me what's up. >> They want to be disrespectful and racist. >> Racist? >> Yeah, that's exactly what you did. >> What? >> I'm going to call the police. Can I ask you >> I my kids right here. They had other people go around me. They told me to take everything out of my bag. >> And that's racist? >> And that's racist? You actually let other people and other ethnicities go around me that had >> I never saw anything. I just came up here. >> Oh, you never saw anything. You never saw anything. >> That's the type of deal. I just heard you swearing at us. >> You just heard me swearing at them. >> disturbing >> I never swore at any of them. I said she >> So, do we have to pull video in here that you swear? >> Yes. >> You didn't curse at them? >> No, 100%. Pull it. >> Hm? >> Pull it now. Pull it now. Pull it. Sir. I never swore to you. I just said that. Cuz I would never >> Did you hear her swear? >> say that >> What's your idea? >> in front of my kids. in front of my kids. >> Ma'am, deal with the police officer. >> I'm not doing nothing. You're discriminating and treating me and I want to actually make a report. >> File any report you want. >> Good. >> Oscar 989, go ahead. What's your ID, please? >> Oscar 989. >> Where is your supervisor at? Excuse me. >> I don't have anybody here with me right now. >> No, he wasn't even there. >> Exactly. >> We're not moving. >> Yeah, let's do that. >> She won't tell me what she's saying. >> Okay. >> For what? For what? I said I don't want to >> I got a 22 at my 20 lane five and I'm 10-4. >> JetBlue? >> I do not need a back. >> Sir, do I know your name? >> Can you find out what airline she's on? >> Ma'am, we need to know where you're flying to. >> India. >> Can I find out what your name is? >> Ma'am, we'll give you all that information. >> So come here so I can find >> What airline are you flying? >> Does it matter? That's what he asked me. That's what he got to say. >> we've said enough. >> I think I don't need an understanding of he needs to understand >> you for something twice and you told me no. >> He just asked me where I'm flying. I don't think it's a >> You know what you're doing. Just so you know, you're digging yourself but you're digging yourself a hole. I needed your ID and you told me no. >> No, you don't need nothing. I need your name and I need his name. Thank you very much. So >> What did you hear her say? What curse words? >> Um Yeah. If it's her then she's been doing this since the beginning. She's skipped the line and calling everybody racist. Um I would assume it's already everything literally from the beginning. When I asked her to back this watch and and say that it's the kids bag and I never said anything about her bag. She took out her stuff. I said but who's the parent guardian of these children? You or somebody else? I need a parent or adult with them. I said nothing on my part. This is just my job straight. >> I know my rights. My rights. And I'm going >> Like you said, you keep on digging yourself further and further in. >> You're not going to be flying now. She's probably not going to be flying today cuz the supervisor guessed it was JetBlue. She's like I'm not telling you she's on JetBlue. I got you. Supervisor on the way. What's JetBlue? >> Oh, yeah. >> Let me search for the supervisor out there. >> What happened? >> What's going on? >> Man, I don't know what is going on with me. I don't know what is going on with me. I think this woman is a musician and I don't What do you mean? Because they were making me open all my bags. They had other people going through. Well, and not only that, okay, I understand you got to do your due diligence and whatever it is that you got to do, but there was a man that came in, he said he has an iPad in his thing, he passed us. Why didn't you make him take his iPad out? Why didn't you make him go No, if you're going to do what you're doing to me, I'm going to do kids. I get it that people are smuggling kids, but like these are my kids. >> Were they having a problem with the kids? >> No, they were like, "Oh, open everything. I I need you to open everything." I'm like, "You didn't really need to go that that You know what I mean? Like that deep." >> You sound like you're from New York. >> I am. >> I'm from New York. That's I could tell. I was like, "You sound like you're from New York." >> I was like it wasn't that necessary that what she was doing was not necessary. >> So, it was just the the fact that she was having to open all the bags? >> Open all the bags and she was letting other people go. And then she was like, "Oh, what did No, well, I told him no." And then she was like, "Oh, you're talking about him." And he was like, "I can't believe that I swore at them." I said, "So." He said, "We want to pull the tape." I said, "I never swore at you, sir." I never swore at you. So, you want to pull the tape? Pull it. >> Did you say >> That's what he was saying. >> He said, "If you call the cop over," he said he wants to pull the tape. I said, "Pull the tape." >> So, what was the problem? >> So, it was the girl that was initially >> talking to him. >> Okay. >> And I told her that she was unnecessary for what she did. She said, "You're still going." I said, "You're unnecessary." I was like, "All people are struggling right now. And I was like, "And you do this You you want to give other people passes, but you do this for your own >> Did they Let me ask you this, did they ask you for your ID right here? >> No. >> They never asked you for your ID? >> Nope. Till we checked in. That was it. And then they said that I have to open all my I need my lights. That's why I said what you're doing is wrong. And that's why I told her. I was like, "You finding wrong." >> You're straight right now. >> Cuz they have cuz they do have a right to go through the bag. >> They have a right to >> I get I get I get what you're saying in terms of it was just you. It was just you. >> Yes. >> Okay. >> All right. >> We got one more bag of hers over here still. >> Where? >> That one. >> Okay. >> I called Jeff the supervisor. >> Okay. >> I don't know if they were being too disruptive all the way through. So, when I came over Sarah was we were over there. Sarah told me that the lady was not being cooperative, you calling names, >> And then they were >> And then she just started yelling and discussing. And then uh I just asked her directly which way you going? Are you done? You going anywhere later? And then she just got worse, called racist. She's a victim of the law. I accused her of more than that. I said "You're being disruptive." >> Yeah, we don't know that. >> That's right. And she won't tell me what airline she's on. >> Okay. >> The supervisor's coming from Jeff. I'm assuming they're going to come. >> Okay. >> Usually Jeff is pretty good. >> Okay. >> The subject's allegation carries legal weight. Under Title VI of the Civil Rights Act of 1964, TSA, as a federally funded agency, is prohibited from applying screening procedures in a racially disparate manner. Her demand to pull checkpoint surveillance footage was the legally correct first move. It was also her last. Florida has no general stop and identify statute. At this stage, no arrest had been initiated. The subject's refusal to produce ID was legally defensible. Her request for badge numbers was appropriate and within her rights. >> Are you guys >> This is clear. >> This is clear? >> Yeah. >> Let me give this back to her, though. >> Yeah. she can >> All right, if you want to go ahead and put this in here for the kids. >> They're calling rain. >> They're calling rain. They're calling rain. >> No, I think that they're calling rain because they think cuz they got to do discriminate against me and I said something about it. >> Yeah, this is what she does all the time. >> Oh, yeah? >> Yeah, and I guess like somewhere else. >> Yeah. >> I have this phone number. All right, no. >> So, when Sheriff Lee come by, just tell him everything you told me of what happened cuz they're going to decide what happened. >> calling rain. That's what they're doing cuz they had in mind that this is racist. You heard me. I heard you. >> Okay, I just want to make sure cuz I got >> Thank you. >> Okay. >> No, she's calling rain. They're calling rain. And they got the officers over here in the white racist home. They all made me open my [ __ ] >> kiddo? >> Huh? What kind of game did you play, kiddo? I played Call of Duty and GTA 5. >> You played GTA? What you about to do? Have you played Deadpool yet? >> It doesn't matter. They're calling rain. >> It's fire. >> I'm going to I want everybody on my team. >> Do you play Fortnite? Okay, how do you like the new one? >> I know. >> it, too? >> I know. I want everybody to >> I see you guys. >> rain because they got racist They wanted to get a [ __ ] job. >> I'll be back. Just hang out here for a second. >> If we go out, we're going to be talking about racism. I'm going to >> You want to >> I'm going to >> Hold on. Hold on. Hold on, hold >> lied and said something to me. Oh, but then I said that >> on you? Get the recordings. I never said anything negative >> Stop cuz I don't want I don't want it to get Don't escalate. Just stop. >> want it to get >> Stop. Stop from here. Talk from here. Have a civilized conversation. I don't care what you call me. Have a civilized conversation. >> Just like he did Okay, I he said >> Okay, let's speak with him. >> It doesn't matter where I'm going. >> You're not going up to the ramp. You're not getting up >> I'm leaving. >> Are you not >> You need to go to jail. >> Airport. Airport. If you want to leave. >> Sure, I'm leaving, you racist >> Are you listening? >> freaking rat. >> Do you want to go to jail or to >> You said that I swore on my kids. >> You didn't swear on me. I said you used profanity. >> Never I have those conversations. >> I'm done with you. >> I was in the domestic violence No, I never swore in front of >> All right, kiddos. Let's grab your stuff. We'll see you now. Come. >> You did this to me. >> Listen. I'm trying to >> I'm waiting for the checks to And then you can't >> I don't care. Let me go. Why am I going to go up there so you have to turn me around? Does that make sense? >> You're not allowed to go up there. So, that's what I'm >> Thank you. So, let me exit the airport like you said. >> You want to exit? Come on, I got you. >> Thank you cuz I can't fly. You said I can't go, right? >> We didn't say anything. >> You said I can't >> Listen. Listen. Listen. >> He kept asking me what I am >> Listen. >> Are you listening to me? >> I'm sorry. >> Shablu was on their way to come and talk to you. That's why I told you to just hang tight. >> I was trying to go back to New York. >> I know, but I don't want you to make it worse to the point where now you get trespassed. >> Hold on. I I know, but if you're telling me I can't go there >> Can you listen? Can you listen? If you keep going where you keep escalating this, they'll trespass you in the airport. You won't be able to fly out here. You're going to lose money on the flight. Now you got to repay for you and your kids. Then you got to pay for a Uber to go to a whole another airport. I don't want you to go through that. So that's what I'm trying to say. If you want If you want, we can go and talk to the JetBlue supervisor. It's not a problem. You have a right to >> So I'm going to go over there and there's a possibility they're going to turn me down, right? >> I don't know that. I really don't. I'm not going to lie to you. So if you want, I'll take you over >> me that they can walk me down to JetBlue and it's a possibility that they let me on the flight. But there's a possibility also. So I'm like, why should I walk up to the flight to get turned down and then come back down the line? >> go ahead and talk with them then. Come on. Let's go cuz you said you wanted to exit. I'll walk with you. I'll walk with you. >> Hold on. You said walk. >> Yeah, I'll walk with her to JetBlue. Come on. Come on, kiddos. Huh? >> They're walking here now. >> They're walking here now? Oh, okay. JetBlue's coming. >> They're going to see if they want to let me on the plane. That's what they're saying that >> Go ahead. JetBlue's coming. Just hang tight for a second. >> My name is >> She's not flying. >> She's not flying with us. She's going to be >> No problem. I need your name. >> Okay. >> I need your >> I need your name. >> You cannot be next to me. >> Ma'am. It's my alcohol. >> I smell alcohol. >> No, I was not. This is the excuse you guys use. >> No, it's the >> there and done that. I work for the police department. >> The only excuse is that >> that you had a racist You had racist employees. She's not flying with us. >> No problem. I don't I don't know what is going to go on. >> You can't do anything. Exactly. >> Yeah, this is going to be written up. She's not welcome to fly with you. >> The critical inflection point is JetBlue's refusal. Under 49 U.S.C. section 44,902, a commercial airline may refuse any passenger deemed a safety risk without a court order, without advanced notice, and without law enforcement involvement. That refusal is the legal event that changes everything in this encounter. Florida statute section 810.08 requires only two elements for trespass, a lawful directive to depart, and a refusal from any authorized party. The airline's order satisfied both elements. Law enforcement did not need to issue a separate directive. The subject's airside access expired the moment JetBlue declined transport. Florida statute section 843.02 defines resisting without violence as obstructing the lawful execution of a legal duty. An exit escort following a valid trespass threshold is a lawful duty. Pulling away during that escort meets the statute. The resisting charge is legally sound on the facts captured. The First Amendment protected every word she spoke. Profanity, accusations of racism, demands for accountability. Cohen versus California and City of Houston versus Hill both establish that criticism of officers is protected speech. What the First Amendment does not protect is a physical refusal to comply with a lawful order to vacate a restricted federal zone. >> Okay. >> And what's your name? >> My name is Beatriz. >> Thank you. >> Just like you >> Excuse me. >> Let me >> No. >> All right, kiddo. Let me walk you out. >> No. >> Ma'am. Ma'am. >> Beatriz, you cannot take pictures of my ID. >> You took pictures of me. >> No, I did not >> Yes, you took pictures of me. >> No. >> No, it's a freedom land. >> Okay. Ma'am. >> All right, let's go. >> Ma'am. You took pictures of my information, right? Ma'am. >> What's your name? >> Ma'am, let's stop. >> your name. >> Let's go. You can get that at check point. >> her name. I need her name. >> You can get that outside the check point. You can GET IT OUTSIDE THE CHECK POINT. STOP. >> GOING over there. >> Stop. >> What did she just took information from me? >> want to get trespassed? >> took information from me. >> Stop. >> You just took information. Excuse me. You're a supervisor. >> I'm >> Thank you. And I'm acting conducting myself. >> So, let's go. >> Okay. I don't want to say I would like to know her name. Can we I would like to know your name. Ma'am. >> Let's let's let's go. Let's go out. You can record. That's fine. But, let's go. >> have to escort me. I'm just trying to find out who you are. Who you are. >> Let's go. >> She's over there. I'm not conducting myself in any type of way. >> We're going to head on out. >> Yeah, we're going to head on out. >> Let's go. Let's go. Let's go. >> No, I'm not doing nothing. They got mad and he was a racist. >> Perfect. Perfect. >> Good. And he was the other racist. >> to tell you to keep walking because you're going to get trespassed and you're not listening. >> She just canceled my ticket. >> Yeah, she did because you're not listening. >> I don't know her. So, you don't know me. I >> You can go ahead and head on out. >> Okay. I have rights. I have >> Just like you have rights, I have rights, ma'am. What? From what? Because your officers felt some type of way and they got emotional. >> I tried. I tried. >> No. >> I tried. I'm trying to get her out of here so she's not getting any further issues out here. >> And she's the cause of it. And wanted to do an enhance right here. >> Let's go. >> The big corporate of it all. This one right here. >> You can go ahead. We have plans not coming. You can go ahead. You can go ahead. You can go ahead. >> You cannot trespass in nothing. Get the hell out of here. I have a ticket. We're leaving. We've been set to leave. You held us uh against our will. >> Who held you? >> You held us against our will. >> exit. Let's exit. >> Come on. >> I expect you >> Let's go. >> So, you're good? >> You're harassing me. You're harassing me. You're harassing me. Please leave me alone. You already got my things. You already He's trying to make it seem like I'm trying to break in. Hit him. What do you mean they're harassing me? There's four men. >> Four men get me I'm leaving. No, no, no, no. >> Easy. >> Ah! >> Don't do that. Don't do that. >> Don't do that. >> Don't do that. >> Don't do that. >> Don't do that. >> They're getting it. Now they're just doing Give my kids You're not going to leave my kids. You know, I'm not doing nothing. You're I said the back >> hand behind your back. Put your hand behind your >> Put your hands behind your >> And stop resisting. Put your hand behind YOUR BACK. >> HELLO. >> PUT your hands behind your behind your back. Y'all feel like you're a man right now. Feel like a man right now. You feel like a man right now. Feel like a >> Sir, they're going to seatbelt you in and stuff. Don't damage the truck cuz then you got to >> The responding officer receives a B. 13 minutes of documented de-escalation, proportional force, and clear communication of consequences before any physical contact. Grade held from an A for failing to formally request TSA surveillance footage, the one step that could have resolved the factual dispute, and protected the department in any subsequent civil proceeding. The subject receives a C+. Her discrimination complaint may carry merit through civil channels under title six. However, remaining in a secured federal zone after multiple lawful directives delivered both elements of trespass and the predicate for a resisting charge. A legitimate civil grievance became a criminal record. TSA receives a B- minus. Procedurally sound on response, but the origin screening decision, whether disparate treatment occurred, was never examined. The allegation is on the record. The footage exists. No one requested it. JetBlue receives a B plus for correctly exercising federal refusal authority. Though the unverified alcohol observation carries pretext risk in civil court. Three lessons. First, if secondary screening is applied discriminatorily, document it exit cooperatively and file with the TSA Office of Civil Rights. Confrontation inside a secured federal zone converts a civil grievance into a criminal record. The legal remedy exists outside the checkpoint, not inside it. Second, once an airline refuses transport, federal statute terminates airside access immediately. Staying is trespass by operation of law, regardless of intent, regardless of whether officers have yet issued a directive. The statute acts automatically upon refusal. Third, minor children present during an escalating encounter do not provide a legal shield. They guarantee separation. Every decision made under those conditions carries consequences that extend beyond the individual making them. If there is a police interaction or legal topic you would like analyzed, leave it in the comments below. Thank you for watching. >> I'm not going to >> May I look at some other >> They're just telling you >> Man, it's over. That's it. It's over. You don't need to listen. That's it. It's over. It's over.
