On July 25th, 2025, [music] officers responded to a call of a domestic dispute where the calling party stated his girlfriend was refusing to let him leave. >> Hello, police department. >> Hello, >> Derek. >> Yeah, >> Derek, I'm officer. >> You can hang up. >> Okay. >> Yeah. >> So, what's going on, man? >> Um, well, my girlfriend was out at the bars. I was here trying to go to sleep and she came home I assume drunk. She claims she's not. Okay. >> Although I don't think that's true. Um it was a whole fight that we had. It got out of hand and then she I was trying to leave. >> I was just trying to remove myself from the situation. She wouldn't let me leave. She was blocking the you know uh my doorway and I wasn't trying to you know I didn't put my hands on her. I wasn't trying to do anything like that. >> Clearly you can tell she put her hands on me quite a bit. So I was just trying to get my way around. That's when I threatened to call the cops. She got even more violent. I locked myself in the bathroom. I decided to call the cops. I mean, I called you guys. And then that's pretty much where we're at. >> Do you need medical attention? >> I I think I'm okay. I mean, it's just kind of a big gash that I could see. But >> is it okay if I go inside to talk to her? >> Uh, yeah. Do you want to come down? >> Were you talking? >> Yeah. >> Is it okay if I go back? >> Yeah, that's fine. Okay. I just want to be transparent. I'm on the phone with my friend because >> Okay, let's >> this got out of hand and like you look at him and you look at me. I genuinely did not hurt him. >> So, how did tonight start? >> When I started, I guess I texted him and it made him. >> You texted him? >> I texted him and was the text about >> it was just about like, you know, I was out and about with my friends. I was like, "Why can't you text me with wondering where I am, you know?" And then I come home and I'm I am berating him and like, "You don't even care that I'm out with my friends. Anything could have happened to me. Like, you don't even text me." And I'm like standing in front of the door. I did not touch him. >> What door were you standing in? >> I'm standing there and I'm like, "You can't just leave this conversation." But I would never hurt him genuinely. And I'm actually really shocked that he called the police. To be honest, I'm like on the phone with my friends, genuinely appalled. I don't know what to say right now, even to you, like even explaining this. Like, what is this going to do? But like I I don't want to hurt him. I never wanted to hurt him. I never tried to hurt him. I tried to block him from leaving the door. [snorts] I don't know if that's like a crime or whatever. I'm just like, you can't run away from us talking. Whatever. He ran away to the bathroom and he's basically the cops and that's genuinely what happened. [snorts] >> Do you guys um both share the same room? >> Yeah. Well, we have separate rooms, but we like share a room. >> Okay. Um and then you said you were locking the door. Can you go in a little more detail about >> Yeah, he was like trying to leave the door and I'm like I'm like the door. I'm like Derek, you can't run away from like what we're talking about. >> I didn't hurt him. I didn't >> I didn't like assault him or anything. >> I'm standing in front of the door. Like I don't know. I genuinely am like in shock right now because I can't believe he even like like this is like weird. >> Um [snorts and clears throat] when you were standing in front of the door, it was this one you said right here. >> Yeah, it was this right here. >> Okay. [snorts] Um were the doors like that? >> Yeah. No, they were closed. They were closed. close. >> Yeah. And I was like standing in front of it being like like why are you trying to run away? Like d and he was like I'm just going to call the cops. And I was like okay cool. Call the cops. They're going to see a girl crying and then what? Like you know what I mean? [snorts] Um, when you were blocking the door at any point, did you came up to me and I was like, "Stop." Like, "Stop." But I I never like pushed him or like touched him or anything like that. Like I didn't. >> Okay. [snorts] Um, did it get physical at all at any point? >> It got physical to a point where like he was like, "Let me out. Let me out." And I was like, "No." No, but I never like not even like pushed him out of the way. I was standing in front of the door and that's you know I was blocking him from leaving but I never like touched him or like pushed him or anything like that. >> Okay. So you said it was physical he >> to a point where he was trying to like get out of the door. Yeah. Yeah. >> Okay. >> How was he trying to get out of the door? >> He was like trying to reach for the door handle and I was like no like stop. I was just like, "Stop. Like, stop. Like, you can't just like run away, blah, blah, blah." So, I guess like verbally like, yeah, I was verbally assaulting him. But >> yeah, literally. [snorts] >> What were you doing when he was trying to reach for the door from yelling at him? >> I was yelling at him and standing in front of the door. >> Okay. >> Yeah. Okay. So, what time did she get home at? >> Um, what time is it? >> About 5:15. >> Probably like close to 4. >> Close to 4. Okay. Did the argument start like right away or? >> Yeah. I mean, technically it started over the phone beforehand over text, but it was pretty mild at that point. >> And what was the argument about? >> It was me not complimenting her Instagram story. So, >> Okay. >> Yeah. >> And then it just kind of continued from there. >> Yeah. Exactly. >> Okay. And then once she got home, you guys continued arguing in person, >> correct? You said things just kind of started escalating. So that's when you were trying to leave. >> Um was she standing in front of this door or >> No, my our bedroom upstairs. >> So you guys were in the bedroom, >> correct? Yeah. >> Okay. So how did it get to the point that you ended up getting scratched? >> So I was trying to, you know, again, we went back and forth. She's saying things, I'm saying things, and then she started to get a physical. Um >> how so? and she would kind of grab my wrists and try to like she was trying to like she was trying to like rein me in, but at the same time I was just trying to remove myself from the situation entirely. Even if I didn't sleep on the couch or whatever, I was just trying to like get out of that bedroom. >> And that's when she put her hands on me. Um yeah, around the wrist. And then she kind of started shoving me from there. I was still laying in the bed, by the way. So I was like in the bed under the covers. She was kind of pushing me. And then that's when I tried to get out of the bed and she like basically climbed on top of me and she was just trying to hold me back. I was trying to go either into the bathroom or make my escape out of the bedroom >> and that's when she was again just >> kind of like flailing about and again I was just trying to create distance. I did not hit her whatsoever. I was trying to be very cautious about that. Yeah. Um because then she started saying a lot of crazy stuff like about calling cops on me when I didn't do anything at least in this particular situation. And then >> so then I felt like okay I feel like I should probably call you guys cuz I don't want anything you know on my end. So okay >> basically that's where we're all hurting right now. >> Um >> maybe just that that scratch my back but >> So how did you get the ones in the back? Was that like when she was like I think she like there hugging you. You said >> she was kind of like reaching around >> because at first I didn't even feel it. I just saw that because then as you can see my uh tank top here, she was grabbing around me at one point in the bathroom and had latched onto this, ripped it off. So I didn't even see this until I had seen myself in the mirror. >> But she had also at one point when I was trying to walk out of the bedroom door, she punched me somewhere in the shoulder. I think like somewhere in the trap or something. >> Yeah, I can see some. It's like bruising or scratches right there. Okay. And she just punched you one time. Yeah, just the ones. >> Okay. >> Um, and then you were just eventually able to get into the bathroom and that's when you called us, >> correct? >> And have you been there ever since? >> Yeah. >> Um, since you called us, has anything else happened? >> No. Uh, she I mean she's been talking back and forth with me and then I believe she she's on the phone with someone. I think it was her friend. Okay. um trying to I don't know either try to leave or what but >> and honestly that would be ideal if she could just be at another place like at someone else's house like a friend's house or whatever >> cuz being here is just not ideal. >> Has this ever happened between you guys before? >> No. >> Um I don't know if this is allowed. I have an Uber outside. Like I'm trying to leave. I don't want to like concern myself with this any further. >> We'll deal with that in a second. You're going to have to have your Uber wait. Okay. No, no worries. >> You want to just just um stay on the stairs for >> Okay. Okay. >> She was out drinking. >> Um I would go ahead and just cancel that. >> I I want to step down here. [cough] [snorts] So, I'm going to take off his purse right now. You are under arrest for battery on the household. Okay. >> Are you serious? If he attempts to fight or flee first. >> So, is it does he get anything or no? >> His side of the story and your side of the story are both going to be documented. All right. So, what do I do? Um, right now you do nothing. >> If he doesn't press charges like this, >> he doesn't have the choice to press charges. >> It's the state that >> when it comes to domestic violence in New Mexico, the state presses charges. So Derek, are you like actually serious right now? >> Don't Don't touch him. >> Well, I'm just like I how why do I not get a say in what I did or not? Because I didn't touch. You told me what you said. >> But I told you that I didn't touch him. >> But there's two sides of the story, right? There's physical injuries. >> But how do you know that's even for me? You know what I mean? >> Okay. >> Well, the judge is going to do the next. >> It's like one of the very few things we have in New Mexico. >> Do you want me to do it first here? Do you want >> Am I able to take it? Yeah. >> Yeah. Can you take it with me? Maya, are you able am I am able to like get out tonight or for someone to come get me? >> Um, >> it's Friday. You might be let out later today and given a court date, there's a possibility. Um, >> there's like no way of me getting out of this period, right? >> No, cuz the state so anything that's um physical [snorts] and >> so even if there's like literally no proof that I did that to him, there's like no way cuz I I'm just I don't want to fight this. So, we have a reason to believe that it did. There's physical injuries. So, at this point, even if we're not present when it happens, the state of New Mexico, we have to make an arrest when there's um someone saying that something [snorts] physical happened and so if I say something physical matching, >> right? So, if I say something physical happened, is he going to jail right now? >> You're going to jail. We >> Well, no. I for sure I'm not trying to like >> Okay. So, I'm not going to go back and forth on on whatifs and all. >> No. Yeah. 100%. I'm just like, >> and then we're going to have to take this. >> They're really like >> All right, let's keep going. >> I'll be right back. >> I'm just like so confused because I don't understand how it just goes in his favor completely, you know? >> He has giant scratches on his back. >> But like again, I'm not trying to like I'm not trying to like fight this or anything. Of course, like I'm trying to make this as easy as possible. I just don't understand how like let's just say he got those yesterday. I didn't like I didn't touch >> They look fresh. Those weren't those are definitely fresh. Okay. So, I didn't touch him. You know what I mean? So, what do I do? >> So, you talk to the judge. Judge makes the final say on what's going on. >> So, regardless, like I'm just like done even though I didn't do anything. >> All right. Go ahead and face the unit. Separate your feet for me. Yes, please. Yes, please. Do you have anything that's going to poke or poke me? So, I really have like nothing I can do about this. I'm so confused with you guys. >> Like, I just want it to be explained to me. I'm really not trying to feel like >> So, if I'm talking to both of you guys >> Yeah. >> You're saying something's going to get physical. He's something. >> Exactly. So, like, >> hold on. Face the unit, please, and separate your feet. >> Yeah. >> He has physical injuries that that show for what he said. So, that's why you'd want to go. So if I if I were to hypothetically like have injuries on me that >> can you keep your separated me >> I'm just like I don't >> say the opposite and he has injuries that show you. So that's why you're going to jail right now. >> I'm not >> No, I I get it. I completely get it. I'm not trying to blame you guys. I'm just like I'm going to >> step to the side then get in the car. Yeah. Um, >> probably a dumb question, but with this whole process, I know that I don't have to say in terms of pressing charges because of the severity, I suppose, but man, yeah, I guess I don't even know what to ask. I'm just like I, you know, I don't want to like up her life, you know what I mean? >> The suspect was charged with [music] domestic violence and aggravated battery on a household member.
