of an unattended bag in Terminal 4 probably within the past hour or two on November 21st, 2024 Broward County Sheriff's deputies responded to a disturbance at Fort Lauderdale Hollywood International Airport involving a Spirit Airlines passenger the encounter raises three distinct legal questions a Fourth Amendment property claim a disorderly intoxication charge and the outer limits of First Florida Statute Section 8 56.0 11 prohibits being intoxicated in a public place while causing a public disturbance the statute requires two elements intoxication and a contemporaneous public disturbance both were present on camera a deputy directly observed and verbally noted signs of intoxication the subject sustained screaming across a crowded airport concourse satisfies the disturbance element officers had probable cause under this statute no later than the five minute Mark the more contested charge is disorderly conduct under Florida Statute section 8 77.03 that statute requires conduct that corrupts public morals outrages public decency or disturbs the peace of witnesses the subject's use of racial slurs in a busy public terminal moves this analysis toward the fighting words doctrine established by the Supreme Court in Chaplinsky versus New Hampshire in 1942 the court held that words which by their very utterance inflict injury or tend to incite an immediate breach of the peace are not constitutionally protected however in city of Houston versus hill decided in 1987 The Supreme Court reaffirmed that profanity directed at law enforcement officers alone does not automatically constitute fighting words or criminal disorderly conduct the distinction here is that the subject directed racial slurs not only at officers but at identified bystanders sustained in public before multiple witnesses that combination substantially strengthens a disorderly conduct charge beyond what Houston versus hill Shields okay so let me go to jail Florida I don't care I didn't with final authority over aircraft safety and passenger carriage ground coordination between airline staff and law enforcement to deny boarding is consistent with this authority the subject had no constitutional right to board the flight the removal was legally sound at the time of this analysis no public court records document whether criminal charges were filed the subject was removed from her flight and rebooked to the following day no arrest was captured on footage a prosecution under the disorderly intoxication statute would be more legally durable than one under disorderly conduct alone given the broader First Amendment protections that apply to verbal only conduct the primary deputy receives a B+ he maintained verbal de escalation for 14 minutes issued documented warnings before invoking arrest authority and correctly investigated the property complaint the deduction probable cause under section 8 56.0 11 was established by minute 5 delayed enforcement prolonged a public disturbance in a crowded terminal unnecessarily Officer Castillo receives a B professional and appropriate in a secondary support role the deduction his name was stated aloud and captured on footage available for public distribution an unnecessary identification exposure that proper radio protocol would have prevented Spirit Airlines staff receives a C plus the decision to remove the subject from the flight was legally correct the deduction the initial property complaint was not systematically investigated before officers arrived and internal radio descriptions of the subject as the drunk girl reflect a failure of professional objectivity the subject receives a d her underlying property complaint was legitimate and entitled to police response however the sustained use of racial slurs threats to cut up and refusal to provide basic information converted a legitimate grievance into probable cause for criminal charges under Florida law her cognitive disorientation confusing Chicago in Florida in consecutive sentences on a phone call documented on camera a state incompatible with air travel and was her own undoing three lessons from this encounter first a legitimate grievance does not license criminal conduct a theft allegation entitles a victim to a police report not to sustain racial abuse of bystanders second officers should invoke available statutory authority earlier when probable cause is established not as a failure of patience but as a duty to other members of the public third officer identification transmitted on audio during a
