On September 13th, 2025, officers on patrol were dispatched to a welfare check where the calling party stated there was a running vehicle stopped on the road in front of their house. All right. Uh, it's in drive, man. >> Is it? >> Yeah. So, I got the spikes out there. Wait for her to leave that way. I'm not going in that car if it's in drive and try opening up the driver's side door. Hello, I'm Officer Andrew there with the Albuquerque Police Department. I'm going to let you know right now there's spikes in front of your car. >> If you try to leave, you're going to run over the spikes. Can you put the vehicle in park? >> Put the vehicle in park. Put it in park. >> You're not going to damage your vehicle. I don't want you to do that. Okay. >> Could you open the door and step on out here? I'm a little bit concerned about your driving right now. >> I'm I'm not going to >> Don't reach in your pockets, please. Get your hands out of your pockets. Get your hands out of your pockets. >> Perfect. Step on out here. >> Hi, I'm Officer Andrew there with the Albuquerque Police Department. Take your hands out of your pocket. Just step on out. I'm not moving. I'm not moving the car at all. >> Perfect. I don't want to damage your car. So, I didn't lie to you. You step over here to the sidewalk. So, your vehicle was in drive. You're unconscious right over here. So, I'm going to let you know this is a traffic stop. Okay. Main concern is that maybe that you've been drinking. Could you take your hands out of your pockets, please? All right. Do you have anything in your pockets I should be concerned about? You mind if I check? No, no, no, no. I don't want to get search. >> Okay. I'm going to search you for weapons, though, cuz you keep reaching your hands in your pockets. Anything else inside there? I don't care about. It's just weapons. You have any weapons on you? >> No. I got some bullets on on my my right pocket. >> Some bullet. That's it. No firearm on you. No, >> you could check it. >> Okay. I'm I'm going to I'm just going to check for weapons. Okay. Okay. >> Wallet. Bullets. Okay. All right. Uh, have you had anything to drink today? >> No. No. I was uh just arguing with my girlfriend earlier and stuff, you know. >> Okay. >> And like I just been having some trouble my girlfriend. >> So came over here just to get away and sleep. >> Yeah. Um, >> I was just trying to argue with my my my girlfriend uh with with the girls around me and everything, you know. >> All right. Uh, is there a reason why your vehicle was in drive and you fell asleep? >> No, I was just I was just park the car on uh >> normally when people turn their car on to say like >> just have it as shelter. my car got stolen and stuff and then that's why it like it has to stay on cuz I got to they broke the switch on it and stuff, you know. >> What about the open container that I saw in there of the Jose? >> Yeah. Yeah, it was uh my my girlfriend was drinking it. >> I'm seeing that you have some uh bloodshot watery eyes right now. >> Yeah. Yeah. No, no. >> Have you had any drinks in the past couple hours? >> No, I haven't. So you you should be able to perform standardized field sobriety test and be perfectly fine. Correct. >> But I wasn't not even driving or nothing. >> Well, the vehicle was in drive. The vehicle did move forward when you moved your foot off the brake. You were in full control of it. So >> I was parked on the side of the >> Are you willing to submit the standardized field soiety test? >> Um, not really because I was not even driving the car. >> Okay. All right. So, I want you to go from my point of view. What we have here is we have a a vehicle where a person is unconscious in the front. I was back here for a couple minutes. You got called in by somebody else. We actually had ACS come over here, look at you, then drive away. You've been here for a while. >> Okay. So, we have an unconscious person behind the wheel of a motor vehicle. We have it and drive. We have redshot watery eyes. And then we have an open container of Joseé Quervo in the >> that's been back there for a while. >> It's not in the back. It's in the front. >> There's a mess. Yeah, there's a mess everywhere. >> So you can see where I think that you might not be safe to drive. >> Which is why I offer to do standardized field sobriety test because if you're fine, great. I say, "Hey, take that empty, toss it in the trash, toss it in the back seat so you can't reach it, and then you're good to go." That's that's my whole thinking about it. Okay. >> Do you happen to have an ID on you? >> I don't have an ID on >> that wallet in that pocket right there. >> I have an ID on >> Okay. What's your name then, sir? >> Eddie. >> Huh? >> Eddie. >> Eric, spell it. >> Eddie, >> can you spell your first name? >> E D I E is my first name and my last name. P is my last name. >> Okay. Uh, also it doesn't appear as though this vehicle has any insurance. Is there insurance on the vehicle? >> Yeah, there is insurance on the vehicle. >> All right. When I ran it, it said unknown. >> Typically on the side of the road, I was not moving. I was not doing >> The vehicle was moving. Okay. So, are you willing to submit to some standardized field soiety test? >> Not moving. Come on, bro. >> Are you willing to submit to some standardiz? >> It's a simple question. >> That was not >> I want to make sure you're okay to drive, bro. >> Are you willing to submit to some standardized field soiety test? Like I'm I'm on the side of the road. I'm not moving. Do not do me like that. >> So the answer is yes or no. >> No. >> You're not willing to. >> Okay. At this time you're under arrest. >> No. I'll do you the soiety test. >> Like I'll do you the soriety test, but like me parked on the side of the road. Don't do me like that, bro. >> All right. At this point, I've asked you several times. You stated no several times. >> No. No. I'll do >> I believe that you're intoxicated. >> I'm not intoxicated. >> Stop. Bro, I'm on the side. >> Bro, I'm on the side of the road. >> Bro, let me do a sober test on me. >> Am I going to let me do it? >> You have another option to do a uh breathalyzer test. Okay. >> At this time, you are under arrest. I believe you're under the influence of intoxicating >> intoxicating beverages. What? Bro, really? >> Yes. On the side of the road? >> 100%. Do you have anything on you that's going to hurt folks? Stick me in anyway, >> bro. Turn your face away from me. Do you have anything? >> No. No. Let me do my sobriety test then. It's >> too late. >> Too late for what? >> To do the sobriety test. >> To do what? For real? >> Yes, 100%. >> For real? >> Uh, really, bro? For what? What am I doing to you? >> You are under arrest >> for what? For a DWI. >> For what? For being on the side of the road. >> For a DWI? >> For being on the side of the road. being on the side of the road. Really? >> This is your argument that you get to make in court. This is not an argument you get to make with me right here on the side of the road. >> You're not even giving me a chance, dog. >> I gave you chances. Several chances. >> You're not giving me a chance, bro. >> Walk to my car. >> Can I do a sobriety test or no? >> Walk to my car >> or no? >> Can I do the soiety test? >> You had your chances. >> Can I have somebody get my car? >> My car. Don't turn towards me. >> Can I get Can I have somebody get my car? We're going to discuss that in a second. I don't like you turning towards me, >> bro. Like, I'm on the side of the road for a reason. >> I gave you a >> Do not be on the road. >> Have a seat inside my car. Do not be on the road, bro. >> Have a seat inside the car. Disgusting. >> No. >> Stop it, brother. >> You're going to get into a lot of pain. >> I'm not. >> I'm not going to hurt you if you were. I'm not going to get in my car. I'm not trying to hurt you guys. >> Get in my car. Oh god, I can smell your breath. Okay. >> Get in the car, bro. Get in the car. Have a seat, please. Kick your legs in. Kick your legs in. >> But like really on the side of the road. On the side of the road. You're not going to give me a chance. >> Kick your legs in or I'm going to pull you in from behind. It's not going to feel good. >> No, I'm I'm I'm going to go in. Don't worry. >> Okay. Do it then. >> Get in. >> Can I have a call? Can I at least have a call? >> You'll get your call. Can I get my call, bro? >> You can call my car. Come on. That's the only car my my girl and her daughters have to write in. >> Can she come get the car? >> Going to warn you one more time if you I'll put I'll put it in, but can I just have my girl come get that car? >> We're going to discuss that in a second. >> Is there anything inside the vehicle we need to be concerned about? >> Bro, I'm not even driving for >> Is there anything inside the vehicle we need to be concerned about? >> You cannot search my car. >> All right. I'm going to have to do an inventory search. No consent to search my car. >> You don't got no consent to search my car. >> The suspect was arrested for having an outstanding warrant and later charged with DWI, having an open container, illegal possession of a firearm, and concealing identity.
