investigatory stop based on reasonable 501 US 429 1991 officers may approach individuals in airports without converting the encounter into a seizure under Florida Statute Section 8 56.0 11 the state must prove the subject was intoxicated in a public place under Graham versus Conner 4 90U S 3 86 1989 under city of Houston versus Hill 4 82 u s 4 51 and exposes the department to civil liability under 42 USC section 1983 the lead officer receives a C plus his early de escalation approach was textbook patient open ended the subject receives a B minus she cooperated with the ID request on August 1st, 2023 airport police responded to a disorderly passenger removed from a Southwest Airlines flight the crew reported she made multiple attempts to open the aircraft's rear emergency hatch and physically shoved a flight attendant interference with a flight crew member a federal felony carrying up to 20 years in federal prison officers resolved this incident as a local misdemeanor that decision warrants serious scrutiny the initial detention was legally sound articulable suspicion of criminal activity a crew's first hand report of emergency hatch tampering provides far more than the minimum threshold Terry requires the stop was consensual at first contact under Florida versus Bostic provided a reasonable person would feel free to leave that threshold crossed the moment officers announced arrest everything after that moment is judged under custodial standards the arrest charge was disorderly intoxication and either endangered herself or others or was boisterous or indecent the subject's visible disorientation her inability to recall her conduct aboard the aircraft and her repeated noncompliance in a public terminal provide arguable probable cause for the charge as stated that part holds up what does not hold up is the officer's stated basis for arrest that she was quote not obeying failure to comply with an officer's instruction is not standing alone a criminal offense in Florida or in most American jurisdictions probable cause must be grounded in criminal conduct non compliance is not a crime this articulation is legally deficient turning to use of force the physical arm escort and subsequent handcuffing are evaluated force must be objectively reasonable from the officer's perspective at the moment of the decision not assessed with 2020 hindsight a non compliant visibly intoxicated subject repeatedly pulling away from escort in a public transportation venue falls within the threshold Graham permits the force level was appropriate the First Amendment analysis is straightforward 1987 profanity and verbal insults directed at law enforcement officers are constitutionally protected speech full stop the subject's use of the words douchebag and asshole cannot serve as independent grounds for arrest or as justification for punitive conduct this brings us to the most serious professional failure in this footage while handcuffed hands restrained behind her back the subject made repeated requests for an officer to remove hair from her face the officer explicitly denied that request stating on camera that his refusal was a direct consequence of her having called him a name that is retributive use of custodial conditions as punishment for protected speech it does not rise to a constitutional violation but it violates basic professional conduct standards the most legally significant and most overlooked moment in this footage occurs at approximately 13 minutes into the encounter the subject while in custody states quote they might as well just put a gun in my head whether this language represents genuine suicidal ideation or an expression of extreme frustration officers are not trained to make that distinction any statement reasonably suggesting self harm during custodial detention triggers a duty of care requiring formal documentation and welfare assessment under standard department mental health protocols no such response is observable in the footage the subject also states she is hearing voices this is a second independent mental health indicator it is also not formally addressed both failures create legal exposure for the department and represent a gap in officer training that warrants administrative review resolution focused the decision to initially release rather than arrest was correct force during the arrest remained within constitutional limits however the deficient probable cause articulation the retributive post arrest conduct and the failure to respond to mental health indicators collectively demonstrate that professional competence broke down precisely when it was most needed once the subject was in custody provided coherent information under questioning and did not escalate to physical violence against officers despite sustained provocation her post handcuff conduct was legally sound her liability stems from her conduct aboard the aircraft conduct she does not appear to fully recall and from her repeated refusal to walk in the directed direction which provided the proximate basis for the arrest she could have avoided the lesson from this encounter is threefold first when a physical assault on a flight crew member is reported federal jurisdiction attaches immediately local officers must recognize when an incident exceeds their charging authority and contact the FBI or TSA without delay second probable cause must be articulated in terms of criminal conduct not behavioral noncompliance that distinction is not semantic it is constitutional third once a detainee makes any statement suggesting self harm or disorientation the encounter becomes a welfare situation not merely a custody situation officers who conflate the two expose themselves their departments
