What begins as a routine police encounter soon takes an unexpected turn. As officers arrive and begin asking questions, the situation gradually becomes more complicated. With every conversation, more details start to surface, raising questions about what actually happened behind the scenes. >> Hey, come over here. Yes, sir. >> What do I do now? Mr. >> Kiss, you got a warrant for your arrest. Okay. For what? We'll let you know here in a minute. We have contact 1095. >> Okay. Can I know now? >> I will pull it up. Um >> I just went to court day for yesterday. >> You need you any shoes? >> Yeah, if you don't mind. >> What is that in here? >> I'm fine. >> You're fine? >> Okay. You need a shirt or anything? >> No. >> Are you sure you don't want to bring bring a shirt? >> So, can I find out why I'm being arrested? >> He's going to tell you here in a second. You got a warrant for your arrest. for what? >> Like I said, they tell you here. >> So, I'm logged. We don't want to tell you wrong, so we'll just tell you. >> You got anything on you that's going to focus against? >> No weapons or anything? >> Get in there. >> You're clear on our 1095. Can you confirm the warrant? Can I know what my warrant for while I'm transporting? He's going to read it out to you. >> All right. It's going to be for uh violation of him vines order. >> So, I'm not >> going to violate it. >> I was in I was not the officer who signed the warrants, but um >> your probation or >> I don't have a probation officer. I just went to family violence court yesterday. >> Okay. >> Yeah. So, how' I violate? >> You had a protection order with somebody? >> I don't have a protection order with anybody. >> Well, when you see >> I have bond condition. Okay. So, when did I violate my bonding condition? >> Uh, like you said, we're not none of us are the officers that that uh issued the warrant on you or took the warrant on you or had probable cause that that you violated that that bond condition, >> but an officer who did an investigation did have probable cause that you signed that presented it before a judge and the judge thought there was also >> So, this this might be you just get booked in, get a court date, get released. >> Uhhuh. Or or you might have to stay a couple days, have another uh bond date. >> My thing is I just went to court >> yesterday. Uh the No, it was Monday. >> Okay. >> Yeah. >> It's probably not related. >> Start from yesterday. >> Yeah. >> It it might have been something that happened over the weekend like like we said we don't know the we're already back out. >> I don't see why not, but that that's not something that Y'all came back in the field or whatever. >> Yeah. Yeah. That's the sheriff's department in the court system. So, that's already confirming. >> They're working on it now. >> Okay. >> Where's your cell phone at? >> Where is it at in the house? >> I don't know. >> Is there anybody else in there? >> Yeah, she's in there. >> What's her name? >> Yeah, you can get it. I'm already going to jail. >> What's her name? >> Jordan. >> Is Is Jordan the other half of that condition? He doesn't want us to go here cuz there's weed in here. >> He can't have my arms. >> Hey, Jordan. >> Yes, sir. >> Can you step over here for me? >> Um, are you like >> I just have a tower. >> Yeah, that's >> that's fine. Do you know where his phone is at all? >> Yes. >> Does he know it's in here? >> No, he doesn't know at all. >> Cool. That's him. appreciate it. >> Um, we might uh need to address the firearm, but I'll knock on the door here in a second. >> I'm definitely right now. >> Okay. No other firearms or anything in here? Yes, sir. >> Okay. >> Is Is Jordan the other half of the bond condition? >> Yeah, I'm already going to jail for it. >> It's part of the bond condition. >> No contact, but she didn't have anywhere to live. She got evicted from her house and we got children. >> Oh, okay. >> So, >> yeah. My kids living on the street and >> I mean I'm sorry I'm going to do whatever you want. >> Mhm. >> My neighbor used to she across the street uh the police officer Clark County and she stopped by about a week ago and she's like you know you have those conditions. I see your car over here. >> Yeah. >> She said and I have an officer about >> Yeah. See a car right there. >> Is that car guy? Yeah, >> I completely missed it when I pulled it. That's my Explorer over there. >> Yeah, I completely missed it when I pulled it. >> Were you aware that there's a gun in there? >> A gun in there? >> That firearm belongs to her. It's her. She actually alleged that I stole that firearm on the original case, but she found it because she misplaced it. Detective Ramy knows all about that as well. >> Yeah, ma'am. Ma'am, I'm sorry. Um, since we talked to you, I got to get your information. >> Do you have your uh license? >> Yeah. >> Y'all can give up if you need to for anything. >> Just leave it for now. It'll be fine. >> It's not my current address, but >> that's fine. >> I'm kind of homeless. I'm living with him. >> How long you been staying in here? >> About a month. >> A month. >> Yeah, I had to. >> Okay. >> And he was trying to do the right thing, but let me stay here. There's been no violent contact. Um, so we went to court the other day. We told the original like this was going to be changed into violent contact but it didn't happen. >> Yeah. But when the uh deputies came over here to explain to him how it works. They can't contact the deputies they serve in the paper. >> Oh yeah. I know they explain everything. >> It's it's really not. It's my fault though, you know. I mean I'm the one to say there's been no violence since. I get it. >> Yeah. But he's an adult so he can't make his decision. Say yes or no. >> That's kids. So when they're sleeping, I just shut the door. >> Your kids, >> they're my kids. He's, you know, he's >> taking. >> So >> the bond condition for me, she can have contact with me. She can be here. >> I if I'm not supposed to be here, she's here. >> Okay. On the court paperwork, if you just look up to the court doc, well, Sometimes it's slow for them to upload it onto the system. >> I know it's there cuz I've seen it. >> Oh, okay. >> She has a firearm that's registered to her that's in the case report that she reported stolen. >> Is it in the house? >> I don't know if it's in the house. If it is, it's in her pocketbook. But the thing is, Ramy's got the email where she emailed him and told him she found it. She was in the middle of being evicted and found it in a box. But she decided when she called y'all that she didn't know where it was at that I had it. I didn't have it. All my farms are in the possession of a coworker. They've been that way since the day I got arrested. >> Okay. >> Yeah, I guess I did. I was just a I guess the header like I have the actual bond conditions from the jail >> that >> Okay. >> Yeah, it's got your signature down there at the bottom. Is it still showing now warning out of there? >> Yeah, it still shows that like they even called when I was at the jail before I could leave. It was before CO and even when CO was still going on like I don't know they went to court dates and then they quit sending subpoenas to the house and I called the clerk and she said if we don't send you any more paperwork don't worry about it. >> Yeah. Well, the clerk's not going to be the one to figure out. But >> um yeah, whenever whenever all this is handled, just whenever you have the time, just call down there, call to the sheriff's department. >> Yeah. >> And just be like, "Hey, is this still showing?" And then if it is, like, "All right, who do I got to talk to? What do I got to do to get it taken care of?" cuz sometimes though uh I picked up a guy who um it was for something else but he had a warrant out of Walton County and uh it was pretty much it it was a failure to appear for a traffic ticket. like seat belt or cell phone, whatever it was. But they said that uh if he can pay it by phone or have somebody come up there and pay it, he doesn't have to be doesn't have to be booked for it. They're not going to pick him up. So in the next 5 minutes, don't you? I just want to make sure left in there. Yeah, we got a car. Within the next 5 minutes, he was able to get somebody to get up to the courthouse and pay it. >> And we just hung out for good 20 30 minutes. They're like, "Yep, it's good." We could have said, "But hopefully yours is as easy as that for that type of stuff." Well, I mean, when I was in jail, when I got locked up originally, like I said, they were had were going to hold me >> and they called Vigilant and they was like, "No, we don't want him." >> Yeah. Sometimes it's just the distance. I ain't going to try and come out of them. It's just like I'm not surprised, but uh I'm on a call right now. Can I call you back? >> Hey, how's it going? I'm going open this door. >> Hey, Mr. Kitchens, I got to read you something. Okay. >> Yeah. >> You have the right to remain silent. Anything you say can and will be used against you in the court of law. You have the right to talk to a lawyer. If you cannot afford to hire a lawyer, one be appointed to represent you before any question if you wish. Even if you don't want a lawyer now and agree to talk with us, you can at any time change your mind and ask for a lawyer or stop talking with us. >> Do you understand each of these rights explained to you? >> Having these rights in mind, do you wish to talk to us now? >> Sure. I can stop at any time. Correct. >> Yes, sir. >> All right. >> All right. So, you understand why we're out here with you today? >> Uh, violation of my bond condition. >> Okay. >> Sorry. I'm not going to let my kids live on the street. So, >> and and that's understandable. Yeah. And you can, you know, >> explain that to the court. >> I'm going to >> um >> I was just in court >> Tuesday. Yeah. >> No, >> on the 7th. Oh, Monday. >> Monday. Yeah. >> Okay. So, um, what can you tell me about Legacy Pawn Shop in Gateway? >> You went up there and took a pictures of firearms that I had pawned because I was trying to save her home. >> Okay. >> Yeah, I know about it. >> But that's all that happened. But none of those firearms are the ones that she alleged that was stolen. The ones she found. >> I know they weren't. >> Okay. But you understand you had a court order not to possess any firearms? >> Yeah. No, I had a court order. >> And you understand it's a felony for you to fill out a uh weapons form through the ATF? Why is it a felony for me to file out a weapons form? >> Um because you made a false report. >> How did I make a false report? >> Uh under this section, >> have you subject to court order including military protection order? I read protection order military. I'm sorry, >> but down here >> says as well. >> I didn't read it to be honest. If I thought I was doing something wrong, I'd already known that you had been up there and took pictures of the firearms. I had no idea. But >> so that is a felony to make a false statement. >> Okay. So you're being charged with that as well. >> Because this is a federal form through the uh ATF. >> Yeah. >> All right. >> I didn't know that. I couldn't go. That's firearm. And that's one reason why I was up there taking pictures of the firearms because you were not legally able to possess them. >> Why am I not legally able to possess firearms? >> There's a court order bond condition. >> Oh, just from this. Okay. I didn't Okay, I understand that. Yes, sir. I'm sorry. >> Okay. So, um >> So, what is the charge? >> So, the first charge was uh violation of family violence because y'all were seen together on video in on the 20 >> here now. >> Yes. And that's going to be additional charge for today's date. So, what about the day that your officer stopped by here and knew she was here? >> What day was that? >> I don't remember the exact date. >> So, I will look at that and if that is a thing, then that will be additional warrant >> for me. >> Yes. >> No, she wasn't here. They had seen her vehicle here. >> Oh, okay. Then, >> yeah. Yeah. >> Then then nothing would have come of that then. >> So, all right. So, um, where is the firearms that were recovered from Gateway Pond? >> They were recovered. >> Yes. A pistol, >> AR10. >> Um, I don't know. >> There's a rackool firearm pistol. >> I don't know. >> Okay. And the Great Lakes was the rifle that you pawned at Legacy. >> Yeah. And then also a Canic firearm pistol, the TP9 SFX. >> I don't know. >> Okay. >> If I was to be honest with you, I mean, you're just out of every person in this world of all the things you could be doing, I've never been in trouble for anything and I'm getting in trouble for providing housing for my family. And >> that that's not that's not what it is. >> That is completely it. >> Okay. So, if we were to search resident or your vehicle, will we locate that firearm? Do >> you a search warrant, which I'm sure you already have. The only firearm I know about is her firearm that she's in possession of that I was alleged to have stolen and I never touched and me and you went over this. >> Yeah. And you never got charged with that. >> I know. I mean, and you'll see why I didn't get charged because she has her firearm. >> I'm just trying to do the right thing. I wouldn't >> Yeah, I totally understand. And >> it don't seem like you do. It just seems like I'm being picked on. I mean, >> no. >> Wrong is wrong and right is right, but I mean, trying to provide for my children. I mean, to understand that I was doing something illegal, like malicious with the firearms. I was trying to pay their rent, but she still got evicted, but I don't know. >> Okay. What's her plan? Is she staying here? >> She's going to have to. And I guess if I can bond out today, I'll just have to go stay at a motel. So, will I have to get >> Oh, I don't know. You You potentially won't see or be bonded today because it's a family violence order. you'll have to see a judge and also the felony um you it'll go up to potentially a superior court judge to make that determination on the bond. But if if the case is she's going to stay here um and you allow her to stay here, >> I just want to make sure that you know it's documented that way she's allowed to be here. What do I do when I get out? >> Uh, that's totally up to you. Your >> responsibility. >> How will I get my belongings, my truck, things that >> So, you can work it out with the sheriff's office. Make a one time visit to recover your in possessions or whatever. Um, if she's not here, you should be able to come back here. >> Can I get my keys? >> Yeah. Yeah. They'll get whatever you need to take with you. >> I won't see a judge today. I'm not saying you won't, but with it being a felony for the ATF form, you will have to see a superior court judge. >> How does that normally work? >> Uh, usually they they set up >> uh within a certain amount of days they they see you and it all depends on your criminal history and all that whether they see you quicker or not. cuz I don't have basically I don't have a >> well um you were on a fast track with the last time um I guess you had an incident in 2019 with a family violence order or family violence >> uh I don't know where that was >> um also you filled out this form with a make an address >> that's what's on my license >> yes you you realize >> this is a temporary address for work that's my permanent address >> but Do you understand once you establish residency somewhere you have 30 days in the state of Georgia to change your your address unless you know you have other means like being in school things like that are you getting mail at that address? >> I have which address? >> Yes, that's my permanent address. That's why I make for them from my job is because I'm so many miles away from that address. >> Is that a family member's house or is that just personally your house? >> No, that's that's my mom's house. >> Okay. >> House. >> All right. Um, do you have any questions for me besides >> beside what are the charges >> right now? It's a violation of family violence order for being contact on the 25th with Miss Horton and also the felony um filling out this falsefully. >> So, it's making a false statement, which is a felony. >> And then today's incident, um, it's up to the officers for them locating you here with her, which is another violation. Well, I've already had a conversation with you before and you know I did a search warrant on your phone and you're still in contact with her even out of after getting out of jail. >> How how' you have a search for? The search warrant for my phone was from a month prior to the day I got out. >> Mhm. >> Okay. So, how did you know I had contact with her after I got out of jail? >> The search warrant with the download of the phone, >> right? But the search warrant, the only days that you were supposed to have access to was those days and that was to the day I got out of jail. You said that after I got out of jail, I had contact with her. How did you know that? >> I'd have to look back at it, but >> but I mean the only good for those days, right? >> And that's why you're not getting charged for that. >> So, >> but when we download a phone, it downloads everything. >> I got that. even deleted stuff. >> That's the mother, no children. >> So, she is biologically the mother. >> No, neither one of them children have a father and not biologically. I mean, I can't have children. So, >> I understand that. I I just didn't know if those were actually your biological or not. Okay. >> All right. Um, anything else? >> All right. Oh, when can I get my cell phone back? >> Uh, which one? >> The one that you got. >> So, they're holding it for evidence until your case is completed. Uh, now it should be uh switched from the solicitor's office to the DA's office, I believe. So, it'll be up to the DA's office. >> He's got another phone. >> Yeah. >> Okay. We'll go ahead and seize that as well. >> Seize my phone again? >> I mean, you're in contact with her. So, you're going to take my I just bought that phone because you took the last one. So, you're just going to take my cell phone. >> How? >> It's evidence >> of what? >> Uh, you and Miss Horton have >> you have a phone that is the same exact phone number that you can access all of that for. You don't have to take that phone. >> Okay. >> Can you do that for me? I mean, I'm asking. >> I'm I'm going to do my job. Okay. >> Thank you. >> That's fine. >> Have you took pictures of that? No. >> We can go in and talk if you would like. >> My kids are inside here. >> Okay. Um, is there anything in the house that I should be aware of? Cuz I smell the strong odor of marijuana. And if you got kids in the house, I would have to contact defects. >> And there was some smoke before they like they were here last night, but that was it. >> Who was here last night? >> My kids. >> Oh, is that >> They weren't here when that was happening. >> Okay. But I can smell it right now. >> Well, it wasn't smoke this morning. I promise you that. >> Mhm. >> Well, I didn't say it was smoke, but is there anything illegal in the house? >> I know. Yes, sir. >> I know. >> All right. So, you understand why we're here? >> Yes, sir. >> Okay. So, I didn't know about them coming out this morning. >> Uh, you mean them just now? Yes. >> Okay. >> So, I heard that they were, you know, out here at this location. Uh, yesterday I signed warrants on Mr. Kitchens. >> Okay. >> Um, so on the 25th, he attempted to go purchase firearms at Gateway or take pond items out of the gateway. >> Oh, I I've got those >> and I'm going to get to that. Okay. >> So, um, video shows you and him together on the 25th. >> No contact order. >> Yes. So, he's in violation of that. Um, also he falsified a federal form, which is the ATF form with the Bureau of Tobacco >> Farms. >> Yes. So, he was denied because of his court order, >> right? >> Um, and also he was seen later coming in with you on video and y'all making another form in order >> money. Yeah. >> Yes. And you ended up paying $800 to get three firearms. >> Yes. >> Okay. Where are those firearms right now? >> He pond them again. >> Okay. >> I don't know if it was the same place or not. >> So, what is this? One of the firearms. >> Yeah, that was mine person. That was never ponded. That's >> Is that the one that you thought he stole? >> Yeah. Found. >> Okay. >> Yeah. And I seen that you uh ponded it. >> This is ponded. His other can. He had a cannon, too, that got ponded. No, the one that you are in question that stolen was pawned on Hawthorne by you. >> Okay. Yeah, that was my ring and my >> And then you got it back. >> Yeah, specifically me. >> So, I was able to close that case because I was able to prove that you were in possession of it and based off your statement that um that he was in possession of it. But, um part of that investigation was to um anytime pawn shops get items, you understand? They take pictures. They report things to pictures and all that. Why he could >> the reason why that is is because he's in violation. He's not supposed to possess any farms. >> I understand. That's why don't understand why he Well, he could pawn them again. They're mine technically. So, I could have got rid of them. >> Well, technically it doesn't matter whose they are >> because state of Georgia, you don't have to register. >> Okay. >> A firearm. So, it doesn't matter if you purchase it and give it to him. But when you give him firearms when he's under a court order and you know that he's a court order >> and you make false statements on a ATF form >> is a felony and that's what he's getting charged with today. Now you going up there and filling out with him and they knowing that he was denied and you obtaining those firearms puts you into potentially criminal charges. >> Okay. So, I've notified the ATF. >> He was never in possession of them again, then? >> Uh, yes, he was, cuz he went to Legacy Upon and pawn the rifle again. >> And the other ones sold, I believe. >> So, you were legally able to get them, but he obtained them from you. >> I have text showing where he sold them without notifying me after the fact, just so you know. >> Okay. >> So, what what is this farm? >> It's my canon. >> Do you mind if I see it? >> Yeah, >> is it loaded? >> I have no idea. >> Okay. I haven't seen it like >> with with having children around. You think this is a good >> No, sir. >> So, you don't mind if I look at it? >> Yes, sir. >> All right. >> It was tucked away. >> Okay. >> I'm going to go ahead and unload it if you don't mind. >> No, it's not. >> Yeah. Can you look on that form with the firearm for a canic? >> Okay. Uh tango papa 9:00 extra. >> I've had this one kid put away, you know, whatever there last night. >> I move different places just to avoid, >> you know, process getting saved, but we're in the process of moving. That's the only reason we're living here. You know, he was trying to do the right thing. I was literally moving out next week without him, >> you know. All right. Um, so yes, he's going to be receiving another charge because you're here today. >> Yeah. >> So, like I've told you before, every time that you're around him, he knows that he's not supposed to. >> Yeah. He's trying to write things, but he didn't get >> 9 mm, right? Yeah. I'm going to go ahead and put this back. Um, >> I'm going put it right back. >> Yeah. You need to make sure it's very secure with having kids around. I'm put literally after they got back last night. >> Give me one second. Okay. >> If y'all can just stand by with her. >> How old are they? >> Today. No, I don't think so. More than likely, yes. Every day is a different day. Um, well, a violation is a violation, but every day is a different day and every day is a new violation. So, different encounters in the past, right? You know, you guys on video and all that, that's one count. Like today we see her heal with you, that's a different count. You got to make sure she understands that she can't you can't be around her. You know, if you keep on being around you, that's going to >> that's going to cause you, you know, >> jail time and, you know, core and all that. So, >> we just making sure she understands that. >> She understands that. >> Well, I don't think she does >> cuz she's here, so she doesn't understand that. >> Yeah. So, if you need phone numbers, um, we're going to have to write them for you here. So, that way you have the phone number. Do you know the phone numbers by heart? >> No. >> No, >> it's in your phone. Okay. We'll get your phone and we'll uh get numbers for you here. >> Okay. Anyway, I can put this shirt on cuz this part of the cup is like digging into my back. Which one? >> This one right here. That one there? >> Yeah. And it just when we it's going to be now we're not going to be able to uh put the shirt on as of right now. Um now we can loosen the cuff here in a minute. >> All right. So what's your plan for >> I'm moving out next week. >> Moving out next week? >> Yeah. >> Where are you planning on going? >> Grass. Not the same apartment complex if we had a house and then it could be me and the kids. Um we're planning on moving away from him period. Whether he goes out here for work. Um, but the house fell through yesterday afternoon. So, I have another one in house potentially going to be one, but it's a matter of I got to put him on leave at work too last week. So, you know, he's trying to help us. >> Where do you work? >> State Farm. >> State Farm. >> Remotely. >> Oh, remotely. >> Yeah. I work Storm duty. >> So, do you have a notepad you can take her information? >> Yeah. If you can give him all your information, the kid's name and date of birth. Um, just for our report. >> You're not calling Fox or anything, are you? Uh well >> at this point >> I would have to. Yes. >> Okay. >> Do you have any open investigations? >> No. I said one thing one time it was closed and it was because I called my daughter's name. >> So they are going to be I'm just saying they are going to be >> Oh I don't know. >> Okay. >> But because of the situation domestic violence stuff like that. Um I'm a mandated reporter. I smell the odor of marijuana. There's a firearm laying on the floor. It's not secured. >> You saying that you had it put up somewhere else? It was just further behind the couch and touched it. >> Yeah, you understand that's not a safe place where >> kids go behind couches. >> They just really want to sleep. But I understand what you're saying completely. >> Yeah. Anytime you have a firearm, we have a lot of calls where people seriously get hurt, especially kids. >> Right. >> So, I don't take that lightly. >> I understand. >> Okay. Not saying that you're wrong or anything, but I want to make sure >> we've seen those cases where they do wrong. >> How many did you get? >> Two. >> The first one. What's your name? Her name is Brenley Horton. B R Y N >> U Y N >> L E. >> Are Are they in the house right now? Yes, sir. Do you mind if I just go in and just >> put eyes on them? Make sure they're okay in the first room. >> Okay. You want to go? You want to go to the right? >> Yeah. Me, too. >> Yeah. They're sleeping. >> Yeah. >> Um, is good to transport or do you have any other questions? >> He wanted his keys and >> I can grab his keys if you weren't. >> They're on his family. Yeah. And he's good to transport now. >> Yeah. Um let's go ahead and seize the phone. >> Yeah. I got the phone with me in evidence. >> I'll do a search warrant. >> Okay. Um >> violation >> just for today or >> Well, he's got another warrant for felony making a false report or false statement with the ATF form. >> So that's already been done or Okay. So for the ABR today, it's just violence. >> Yeah. And y'all would sign warrants on that? Yep. Okay. Yep. violation today. I'll get the AVR knocked out for you. >> All right. Thanks. He's all right. >> All right. Put the belt on there. Let me check. Let me check the cuts real quick. All right. Those are good. Yeah. These are also good. Okay. All right. phone. Yep. Go. >> All right. Um, have >> a crack this back. >> Oh, yeah. trying to avoid them being honest. >> That's fine. >> Um, do you have any questions for me? >> No. >> Like I said, you're not in trouble. Um, but because of the the issue, >> he was doing the firearm thing. >> Yeah. And you being accessory or part of it, it it puts you in the mix. Um, at this point, I'm not charging you, but I'm not saying that that could not. >> But, um, I did contact ATF because I have to, >> right? and um him knowing that he was not to have firearms and was denied and bringing you back to obtain those firearms back potentially. Um or talk to you at least in in reference to that. Um but at this point, you know, he's he's got enough going on for him. I don't want to add more things, but um like I said, we're mandated reporters. When we see stuff, we have to to act. um you know their thing was to come over here and they didn't know that you were going to be here. So that just adds on top of what's going on with him. >> He would originally just got arrested for a gun. >> Well, no. Uh he would have got for the family violence order >> and then the no contact was on video. >> Yeah. Um, yeah, like I told, you know, the pawn shop, there's the only legal reason why he should not possess the firearm is because of the order. And he knows about the order that was signed on uh May the 7th. >> Okay. >> For him to be out on bond. Okay. >> So before that, the uh the courts were already looking at revoking his bond based on the pawning of the firearm back in June. I think it was June the 5th. >> June 25th, I think. >> No, no, no. There was another incident. Jesus when I sold mine. >> Yes, he sold those that y'all recovered. Uh he he had >> the first time I said it was the first time he sold him and he told me about after the fact when he was going to get >> and um you know you mentioning you wanting your firearms, things like that. Um and potentially it being a civil issue and stuff like that. I went ahead and documented all that. >> Okay. >> Because um if this were to come up later that you said that he sold your firearms, you know, they would be a record. >> Okay. But um you know like I told you there's no you don't have to register firearms in the state of Georgia, >> right? >> So even if you bought them and he had them before >> there's nothing but civil >> right >> that could be come of that. >> Okay. >> But when he is not able to possess that's when it >> crosses over to the criminal aspect of things. And that's where we're at today because before then it was just civil. But now that he was given a order by a judge not to have any firearms in his possession, he knew it. That was part of his release from jail. Um, you know, all that it it plays in a factor and working domestic violence and I don't know if you understand firearms are a big lethal ally factor in domestic violence. I understand why >> and it's not to say that we're going to have to him, >> but in general >> that is a factor that plays and we've had a several deaths here lately where it has turned >> lethal. Yes. >> And not just because of that, but you know, that's why the judge put these things in in a place to protect you as a victim and things like that. Um, I understand that you potentially are not wanting to press charges, but the state takes up the charges, >> right? >> So, it's not up to you at this point, but I did document everything that you provided me and told me, >> right? You know, >> so it is all in the report, what you stated, the emails you sent and everything like that. But, um, that that's a totally different case now, >> right? So, um, you know, moving forward, um, it was at the solicitor's level, >> but now because of the the firearm, it has upgraded to the the district attorney's office. >> Okay. >> Because it being a felony. >> So, somebody may or may not reach out to me or just >> Oh, they they may they may not um because they already have, you know, >> he went to court last week. Does that change everything, you know, I'm guessing? Well, when he went to court, um, they just advised him of what he needed to do. >> Mhm. >> And I guess he was not ready to move forward in his case. >> Yeah. He his gar. >> Yep. So, um, you know, they were going to move forward on that, I suppose. But right now, it's if >> it may take a little bit longer because there's multiple cases now. >> He's been over a while. >> Oh, I don't know. It's up to the judge. Um, I guess I might as well just stay here until you guys can notify me when he gets out. I'll just make sure. >> So, there's a thing called bine. Um, if you got a pamphlet, we'll give it to her. Um, that when he gets out, they'll notify you. >> Um, just be mindful while he's in jail. If he makes any calls to you or third party, he's still in violation of that family violence. >> I don't care if he calls me. I don't think he'll call me but >> well I mean if he does >> or bills like we have bills >> if he does call you >> it's just a violation >> it's a violation and those are recorded phone calls >> and they are monitor >> about bills like literally all our bills busy right now I guess it's on him I don't know >> honestly it at this point you need to find another means whether it be his attorney or something legal >> to go and communicate kind of that aspect >> use his the environment. >> But um just keep in mind that those phone calls are recorded. If you if he does contact you, he could face potential more charges for each time that he contacts you. >> So don't answer. >> So every time is a different incident. I'm not telling you what to answer. You're a grown adult, right? >> But you don't help his case. >> Yeah. And if he calls me, regardless, you're still trying to contact him. Um, if he gets out and comes back here, if you and him are here together, violation, >> it potentially could be a violation. I don't know because the judge has to make those decisions. But usually with bond conditions, he may have to not return to this address, may be on a leg monitor, may, you know, there's all kinds of options that the judge can put in effect. Um, but not saying that that's going to happen, but I've seen that potential. But if he is not to return here and he is here, it it just takes you know matter of time before >> would the judge person call me again like they did? >> I don't know. I removed myself before >> it being a superior court judge. I don't know if they would call you. >> Um and it all depends on his criminal history. Uh what the judge determines whether it's a bondable charge, whether they want to move forward, you know, all those things. It's up to the judge to make those determinations, but um as of right now, he's going to have to sit there until he talks to a judge, >> which could be tomorrow or Monday or something. >> Well, for the family violence violation, he would have seen a judge potentially today when they do bond hearing, >> right? or first thing tomorrow, >> but because >> but because him being charged with a felony today with filling out that form, um that moves it to potentially a superior court judge looking at the bond, which they're on no set schedule. They don't have bond hearings every day, >> right? Cuz superior court judge. >> Yes. And they do it potentially once every so often or not saying it's once a week, but they have their own schedule. they hear cases. But um do you have this case number for today? >> I can get it. Should be in here. >> Yeah. Right here. >> Okay. So um so that' be the case number for today. If you have any questions, um concerns >> um right, right? getting charged with the case, >> right? >> Right. I mean, that was one of the other >> um so like I said, I'm I'm going to contact defects just because of what I've seen. I'm a mandated reporter and I express my concerns on that. Um, not saying that you did anything wrong, not saying that you're guilty, >> but you know, when it comes to children, it it it's very concerning to not saying it's wrong, but just where I seen it, what you stated, >> well, it was further back and the couch is protecting small, but I still understand. I'm sure they could find a way. >> Kids drop candy and >> before they got up this morning, but >> but what if you if you didn't, you know, kids get up in the middle of the night, have to use the bathroom, they play around, they drop things and in crevices, cracks, and put them in their mouth and play with things. Um >> I just I know their behaviors, but I get there's always chance. >> Mhm. and and I'd rather be able to help educate and provide the resources than >> the other end because I'm all they have circumstances. >> Well, I I mean, would they be a reason why you're afraid of that? >> Well, I just want to leave my kids. I don't know. I've heard people lose their kids over some silly stuff like that before. >> Not Not over something like that. I I wouldn't believe. >> That would be my only concern. >> No. Their thing is to put eyes and just make sure that they're okay. Yeah, if we weren't really in this living situation, we would look even better, you know. >> But if you're going to leave a firearm and you have small kids, I would potentially invest in a safe or a child lock, which is a lock that goes through the barrel. >> Um, I know it's not ideal if you need it for protection. But there are other means to secure that. You know, being in your purse, being put in a drawer, those things are really not safe for kids access. Um, you know, I'm not telling you what to do. you're a grown adult, but higher, >> you know, kids can climb and stuff, but >> you know, we've we've experienced people putting on top of refrigerator and kids climbing on a chair to get things, you know, they they love to explore. And as you know, terrible twos and all that, they even hiding it. It's so that he didn't get in trouble cuz he didn't know I had it. So, >> well, he wouldn't have got in trouble and he's not getting in trouble today about it. >> Well, cuz well, I didn't want him to get even any temptation to possess it or put his fingerprints on it or anything like that cuz it was my gun. No, we we have already the u evidence. >> Well, I guess you would say that, but we already know what weapons he should or had in his possession. >> I'll tell you, I have his other can. >> Which one's that? >> The the 9mm. >> What does it look like? >> It's the tan and black one. The short the hand pistol. >> Okay. >> Um and then one of his rifles, I believe, is sold. And then the other one you all reconed. >> Okay. Well, he had two pistols that you got. >> Well, that was that's that was mine. Completely mine. >> Well, it wasn't the one that was on the report. >> Yeah, that that's the one I called in though. >> Yeah. Where's the other one? The other can. >> That's what I'm talking about. That's the other one that I have in storage and it's >> What about the radical firearms pistol? >> That's the special >> the one that you got on the 25th. >> Is that the Okay, so one of he the other one he privately stole and I don't know who to who. He did it without telling me. I don't know if there's a bill of sale. I don't know that. I was >> Well, I mean, you don't have to do a bill of sale like that. >> He said with somebody he works with. I know that much. >> Okay. Yeah, that's fine. >> He was in possession with everything he ponded. >> Mhm. >> Yeah. >> And and that's the only thing that we're, you know, we're we're glad that he pawned them not having in his possession, but then he obtained them again, which is kind of concerning. the man. So, >> and I mean, he can do whatever he wants, but there is consequences to that when a judge puts in an order. >> So, in other words, leave that firearm there. Don't I mean, I'm not going to go get it, but >> I I can't tell you what to do, but there's no reason why that firearm could not be obtained >> as long as it's by me and not him with me or anything like that. >> I'm not going to pay for it. >> I don't know what their policies and things are, but you would have to fill out another form, >> right? But you know, he would face more charges if he goes back up with a court order. >> Yeah. And while this case is open, he would have some kind of order until this case is resolved, >> which now it's a few different cases. So they're going to what I would imagine they would, you know, instead of having multiple cases, they may just be this all one. Okay. Um, do you have any questions for me? Um, I know I talked to you about the domestic >> that happened. I guess the first one with the lake and then the second one where y'all were driving back from >> Yeah. And then you made allegations that he hurt you and stuff like that. >> Well, they actually did like the police report they filled out. It's completely out of whack. like it's not even in order of what things it was the night before that I got the arm and some slippers or he shut the door on me. >> So, you know, his back was already turned. I don't know if he intentionally did it, but the point was he did it. >> Yeah. And I documented that >> and then um it says that he hit me or he slammed a door on my arm again at the house, but he never did that. >> Okay. Well, the officers took the statement that you gave him that night. >> Well, I never told them that he hit me with my arm, but Okay. >> or anything like that. I showed them the video, but >> All right. But I guess even like the spicer said there's no reason he should be talking to me like that. I think you told me that as well. >> Yeah. >> I mean he and the allegations I was concerned that he was talking to you and and uh I just want to be blunt with you. I did search for it on his phone. I did learn that y'all had an argument over a potential um and even what he said in the v uh video about him receiving some kind of Kirby. >> Yeah. >> Yeah. >> Um, so was that true? >> He does have it, but I don't have it. >> Okay. I don't know if he got it from somebody else. But >> was that the whole reason he was mad? >> Okay. That's what I was >> flared to both those arguments. >> And then he tried to make allegations that you were potentially um >> I want to be respectful. Yes. And then I I seen where he sent messages to your mother with those pictures. >> Those are old older stuff. Okay. >> Yeah. Um, >> I'd not done that in a long time. >> Those are old pictures. >> Okay. And um, >> and I only did that cuz I needed to survive at some point, but it wasn't like working a corner and I rarely did. >> Yeah. No, that's that's totally understandable. But I just want to make sure that you're aware and if you need any resources, you know, um, Project Safe is a great resource if you need anybody to talk to about anything domestic violence, you know, with what's going on. They can help walk you through the case. um what you need to do, what to expect. Um bond hearings um and their numbers on there. Um just potentially anything related to this case or the previous case with the domestic violence, they can help. >> Okay. >> And and our idea is not to separate y'all two >> cuz you have to do it with >> No. Yes. But we want to make sure you're provided the resources that way if y'all do stay together. Safety planning. um not just firearm but like safety planning like domestic violence like if you see that it's going to escalate because a lot of times people are triggered or see onset of what's about to come on whether it be drinking using >> um distress >> I would leave if you know that's what if you ever got >> but but at some point where you're legally not able to leave like what happened in the first incident where you left intoxicated >> you know we don't want to put you in that situation. So, there's resources out there if you see it escalating, they can work with you about safety planning to get you somewhere safe. Um, especially having kids, I would reach out to Project Safe. They're a great resource if you need assistance, if you need help talking to somebody, especially, you know, moving forward, you know, >> finding your next finding your next step or chapter. Um they're great resources to make sure that you and your kids are safe and not just put out on the street. Um they work with housing, different things. That way if he does get out or if you decide to stay with him, you know, they work with that. >> You're supposed to go to stay at the end of this month or I'm assuming he's allowed to stay. >> Oh, I don't know. That's up to the judge. >> Yeah. >> And potentially, you know, they can make conditions where that can happen. >> But it's a case by case scenario. >> Okay. The judge has to look at all that. Um, but again, I'm not here to >> You're doing your job. >> Yes. >> Um, I understand, you know, you're upset the last case. Um, but I did document everything you told me. >> Um, I did my job by you not providing and not saying not providing information, but the information you provided, I didn't have a lot to go on, >> right? But I had enough to move forward the state and I I obtained a search warrant for his phone. So his phone and all the contact in it >> is being held as evidence. >> Now the second one is too. I guess >> uh I'm going to look at that. Um >> there'll be contact between us. >> Okay. Um what kind of contact >> cuz we know since I've lived here um was here 5 months. >> Um mainly just that I mean at work we don't really talk. Um, there might be a little bit of arguing, but nothing crazy. Like no threats or nothing. >> It's just his gambling habit has been a lot of our problems. >> And that was a concerning. You sent me a text message with a picture and you scribbled out a lot. But that was very concerning what I read. >> Yeah. >> Which led me to my roommate too and somebody knew that I will say almost 99% of our problems have been resolved. And the reason our most incident is where the squate. >> Okay. But that that message that I'm speaking of, you scribbled out stating that um if he didn't give you part of the winnings that you would call the cops and you hit the drugs. >> I don't recall the message. >> Okay. I don't have it with me, but um you could potentially look at it. >> Do you? Okay, I'll go back and look. >> Um you know, even though you scribbled it out, I could still read what it stated. So, um, I just want to make sure you're aware if you do make false reports of a crime, right, >> that >> that is a charge in itself, >> right? >> So, just moving forward, I'm not saying that you did or didn't, but just the way that read is if he didn't give you half of the winnings or whatever it was, was it the $10,000 lottery that he won? >> I don't remember. I was going to say, but um I don't remember the message at all to be honest with you, but I was going to >> Yeah, it was a it was a like a collage of pictures. >> Okay. >> Um but in the bottom it basically told him um if he didn't happen to win or something to that effect that uh you would potentially call the cops on him. >> Okay. >> Between the incident or something or after the inc? >> No, this was that incident where the car and the drive from Barrow >> the pictures the injuries. Yeah. >> Okay. Okay. Oh, I know it was cuz that's the day you dropped me off at the gas station. Um, he'd gotten scratched off or whatever and I was scratching him off and he me at half. >> Okay. >> And then the argument happened and whatever. >> That makes it understandable. >> But I mean, I called the cops because I purely felt like I needed to that day. Um, but then, you know, I went back and looked at that video. I'm like, he didn't hit me. I was him going across my chest. That was on my phone. Um, >> but I mean at the time the officers had the information and signed warrants based on your testimony >> which was mainly about him setting the door. >> Well, I don't I don't know what was >> well the report that'sing charges him. >> Um, so I just want to make sure you know I clear up because you know you never know what domestic's really about and kind of finding out the reason helps move on. problems >> and and potentially problems >> and that could help um understand and get him the help that he needs. >> Need help cuz we come here yesterday. He kind of cut off his power and I've never been so low in my life and that's been and he is thinking that he has a problem. He needs the help and but he's in denial of his problem. So maybe him staying in jail will help him, you know, think about his choices. >> And and there's things that judge can place an order. Um I don't know if it's actually a gambling issue that they can address, but if he has issues and he's willing to assess the resources, there's resources out there if if he needs those, >> like if he's he drinks a lot, too. And and that's something I can ask the judge if that's the issue, you know, but at this point I don't know if it's really an issue because both incidences it didn't appear that he's intoxicated. >> No, he never gets drunk but he can drink about a handle a day. So I don't know consistently how >> much that does to him. I think he pulled himself together well. >> Um but I think that triggers him to go but I don't know for sure. But still knowing the reason helps >> a lot of it. Not even the interest of the family. >> It it helps understanding and like I was saying about safety planning. If you see that coming on, you can work on your next steps to keep from getting physical, verbal, things like that. You know, just seeing those kind of things help out. You know, like I said, we had a house left yesterday. Yeah. >> And I understand the incident potentially, I guess, before he stated that he was fixing to move in with you. >> Yeah, we got the apartment. We were able to get out of that lease. Um, and then I really didn't need to live in an apartment with my kids anyway. Um, you know, I've been looking for a house and I found one yesterday. So, I've got to buy another one. >> I will give you the address whenever I get moved. You're going to need it for paperwork. >> Well, I won't. the court made, but um >> you can report it, right? >> Yes, you can send it to email. Um you probably won't hear back from me. Um but I just want to make sure I come out and talk to you and be as transparent as I can. >> I know it's a difficult situation, >> but our goal is not to arrest people, >> but we have to protect people at the same time. >> And I get it. I mean, I I hate to see something happen and I didn't do what I was supposed to do and that happens a lot throughout, you know, the United States. So, um I hope you don't look at me as negative doing my job, but >> it's it's my job to present the facts and evidence to the court. It's up to the court to hear both your and his side and the state's side. So, um, you know, he'll have his chance to explain why he was doing the things he did, >> and it's up to the judge and whatnot to hear those things and make a decision. >> It's It's not up for me. >> Nothing about this is personal. Yes, sir. >> Nothing is up personal to this. I didn't go actively looking for these things, >> right? But because of things um you know the pawn shops and things they actually provide information >> so once these things are we know that they are not supposed to have firearms stuff like that we have to look into those things. >> Sorry. No. >> No. I I hate that, you know, it's the way it is with him being arrested, but it it protects you, the kid, and helps him get this resolved quicker. All right. >> It'll do him some good. I don't know. I don't know. There's nothing the negative stuff that comes from it. There's also positive stuff that's going to come from it. >> And and at this point, he's not convicted, >> right? He's just being accused, which you know, he'll have his time and his lawyers to determine those things. >> Okay. >> But, um, other than that, I'm going to get out of here, let you get back to your your day. >> Um, do you have any other questions or concerns? >> No, I'm just going to go safe today. >> Um, like I said, I would contact project safe. They can help you. Um, you don't have to. you're you're more than welcome to do what you want, but um you staying here, it it doesn't get you in trouble. Doesn't get the kids in trouble. He actually was trying to do >> the right thing and not leave his kid on, >> but um he's already stated that once he gets out, he's potentially going to stay in a hotel or something like that. So, >> I'll remove myself first. >> Not saying you have to, but if there's a court order, >> I understand. you know, potentially you would stay here and he still if you left, he still could not come back here. >> Okay? >> And unless he got that modified. Same thing with this protection order, >> uh, bond condition order, you know, you can always go to the courts to modify it, but >> you have to have a lawyer. I mean, that's the problem gambling instead of getting a lawyer. And um, I told them that cuz they showing you a lawyer in the window modified bond or we could have seen each other talk or whatever. tall at least. >> Not saying you could, but it would be up to a judge to determine that. >> But then, but your best bet they told me all along was like, "Can you feel the layer? Can you feel the layer?" And you put that off. >> No, I think Yeah. >> Um, but yeah, in the future, I would just, you know, be mindful any, you know, cuz right now y'all are going to have a domestic violence relationship the rest of your life because y'all live together. So it doesn't matter if you're here in Athens, in Buford, anywhere, that order is uphold throughout the state. >> Okay? >> And even other states honor that order. >> So regardless where y'all go and the next time that you have a incident where it becomes physical or police get called out, that's still domestic violence, >> right? >> Yeah. So it doesn't matter where you go as long as y'all are living. Even if y'all separate, that's still y'all have a family violence relationship established. >> So just keep that in mind. You know, just leaving Athens is not going to stop potential. >> Um >> Oh, no. It's there forever. I mean, yeah, you might get that part. >> Yeah. And right now he has something prior that um >> I'm aware of I'm aware of Morgan County. So >> Okay. And um I I don't know about that. What what is that intel? >> It's from gosh 2019. It's my understanding. It's his ex-wife. >> Bunch of arguing. She spit in his face sometimes and I think when she in his face he snapped. >> Okay. >> Hit her. >> Did he get um >> he's not? >> So the case is not resolved >> or there's like for some reason it's not on his background or something. >> But has it not been resolved? >> I don't think so. It's my understanding. So, it's still potentially open >> false allegations from the first two instances. I just know it's on his record, right? >> I've actually pulled his back on tech when I first met him. It's not on there. So, >> yeah. Um, yeah. I just keep that in mind if you already have knowledge of prior history, >> right? >> Safety planning. >> Yes, sir. you know, um, you know, if you see it escalating to that level to make sure you protect you and your kids by not physically, but like removing yourself from the situation, let things cool off, you know, things like that. There's safer ways to resolve than both of y'all getting arguing. I will say in front of my kids, he's never he's very protective of my kids. You don't argue in front of the kids when they weren't here in the family when the roommate was living here. You know, I was holding her at the time, but that was 90% of our problems. So, >> okay. >> And then once this gone, things have been better, but I said it just still in order. >> Okay. Um, yeah, we're going to get out of here. Um, you have my number. Um, you have my email. Um, if I don't respond, usually I'm out doing things like this, so I don't I can't answer my call all the time. But if you leave me an email, um, usually I respond. Okay. >> Um, I know you've talked to my supervisor, too. So, if you want to reach out to him, if you can't get >> Oh, okay. But yeah, um if you want to reach out to him, you're more than welcome to. Um but like I said, I just want to make sure you've got the resources you need. Um our our goal is not to make things any worse. Um I don't think that um I I mean, I don't have anything off of this, but I don't know if another agency will be in contact with you, but just keep that in mind. Um, >> and um, that was all I had. I think I just want to make sure that you got a pamphlet. >> I guess I need to be expecting you back for >> Well, they may reach out and call you. >> They called one incident I had. They called. >> Okay. >> It is very small and minor. You know, they're silly. They were obviously abused. You know, I was a single mom. I said something one day when I was upset. So, >> yeah. And >> reporting myself. >> Yeah. Yeah. And it's not to say that anything's wrong. Not saying that the kids are not taken care of. >> No, it's the safety. >> Yeah. Understood. >> The safety. And >> I literally put it there like 1:00 this morning. >> Yeah. And they have resources to provide you in case you do need locks, things like that. You know, our thing is to provide you as much education and resources than, you know, taking your kids away for something like that. That's not something that they would do. >> But we have to document it. >> I understand. That way if there's another incident, >> you already warned me. >> Well, not saying that we warned you, but just making sure that you know it's it's aware. >> Okay. >> Yeah. >> Um Yeah. And and I'm going to you know contact them and and make a report. But um the phone number that you provided him, >> that's a good number. Okay. Um, yeah, that's that's all I had. >> Okay. >> Um, >> I appreciate your transparency and coming out this time. Just helps to see what's going on. >> Well, the last time, you know, you were mobile. >> Yeah. >> And and everything and um I already had talked to you over the phone, so I think I obtained enough to document and make sure everything was addressed in that case. Um, I know the first case I didn't charge either one of y'all >> and you know I was an aggressor even in that case. >> Yes. And I I I've seen that and also with the driving while intoxicated. >> I was cussing them back out. >> That was you know concerning cuz if you were to have your kids or if you would have hurt somebody. I understand you were leaving this situation but you put yourself in another situation you could have potentially got yourself seriously injured or somebody else in there. >> Yeah. about the lake. >> No. Oh, yeah. Yeah. He claimed it was about that, but it wasn't about that. >> I saw that report. I was like, it had nothing to do with the lake. But I removed myself in front of complex. I told officers that way, hey, I've been drinking. I got an Uber. >> Um, but yeah, the second time there's some alcohol. >> But, um, you know, I'm not trying to push any issues in that case. Um, we believe that, you know, there's something going on and sometimes if it's better to have somebody else as the middle person, like the courts or something to help provide that separation >> um resources, project safe is great to help you work through that and him. And like I said, they're there even if you don't want to be with them or you want to be with them, >> right? >> They work with you on what to do to move forward, >> right? So, you know, even in court cases, stuff like that. >> Okay. >> Yeah. And, you know, they can be an advocate for you throughout this whole incident. >> All right. Well, I hope you have a better day. Okay. Hey, my mouse All right. That door right there.
