You don't live here, so stop playing games. >> Do you know this woman? >> No. >> Ma'am, you should do your job. >> August 28th, 2025, Port Saint Lucie, Florida. A 911 call about a woman on someone else's property, barefoot, running a hose, refusing to leave. What starts as a trespassing complaint turns into something bigger the moment she opens her mouth. Florida law doesn't require someone to be violent to be arrested for resisting police, just uncooperative in the wrong way. >> Hello. >> Hello, this is Officer Hernandez with the Port Saint Lucie Police Department. >> Hey, how you doing, Officer Hernandez? You know what you're doing? Doing good. You're calling about the situation that I just called about? >> I am. >> Yeah, yeah, there's a my neighbor is a Jamaican, so I never seen a I never seen a white person over there. There's a this this a lady that's on the front driveway, look like she damaged the side of the side of yard hose, and she has the hose pulled out to the driveway. She's sitting on the driveway, barefoot. It look like she's wearing like damn damn booty shorts and a white beater, and she's spraying like the the hose is like spraying she's spraying water on the middle of the street. And she's down on her phone or something like that. I'm I'm not sure she's still there. My wife is she's heading back to the house right now. >> Okay, and what was it that >> It it it seems to me as far as it seems to me like the yard hose like you know where you where you roll your hose up for the yard hose? >> Like the sprinklers? >> Yeah, yeah, the sprinklers, but it's not a sprinkler, just the hose that you pull out if you want to like wash your car >> I got you. Yeah. >> So, she damaged that, and then she she's barefoot, she took her socks and threw it on our driveway. I I don't know what the I don't I don't know if these people know her because like I said, I never seen any white people over there at their house before. They're they're all Jamaican all Jamaican. >> I got you. Have you ever seen her in the area? Hello. >> Go ahead. Go ahead. What was it? I'm I'm in Texas right now. This connection is kind of >> I got you. I said have you ever seen her around in the area? >> Huh? >> Have you ever seen her >> Yeah, I never I never I never seen this I never seen her. I never seen her around there. That's That's why That's why I'm calling. I have a picture of her. Do you want Do you want a picture if you want to give me a if you need that if you see her walking around cuz she's walking around. So, I'm assuming she lives somewhere in the area or she got lost. I don't know I don't know which one of the two cuz there's no way you're going to take off your shoes and socks. And be barefoot in the neighborhood that's not yours or you're not within a 10-minute walking radius. >> So, you didn't observe her but your wife did, correct? >> Yeah, yeah, yeah, yeah. She's in She's in the house right next to her. >> All right. And do you have any of the um neighbors' information? >> No, I don't. I I don't have anybody's information. But, I don't want But, I don't want that lady to know that I that my wife called in cuz you know, if she was in you know, walking around I don't want her to like, you know, come back with retaliation. So, if she's doing that I don't know I don't know what else to do. I don't know what else she's capable of. >> I got you. No worries. Okay, let me um I'm on my way there now. I'll make contact with the female if she's still there and I'll try to get in contact with the neighbors and try to see what's going on, okay? >> Yeah, cuz their car's in the driveway. That's That's what I'm confused about. >> Okay, so they're possibly home? >> They may be home, yeah. >> Okay. Yeah, like I said, I'll try to make contact with them and I'll give you a call if I have any questions, okay? >> All right, cool, cool. Thank you. What was the name again you said? Cath- uh Catherine? >> Hernandez. >> Oh, Hernandez. All right, Officer Hernandez. >> I do All right, yes. >> Great. How are you doing today? >> Good. What's going on today? Um You live here? >> Yeah. >> Yeah? Okay. Do you have an idea on you? >> No. >> No? >> No. >> All right. Why is the hose running? >> I'm trying to clean the car. >> You're trying to clean the car? All right, we're going to turn it off, okay? >> I got to go for it. >> What's your name? >> Shelby. >> Shelby. What you doing outside? >> I'm just chilling. >> Just chilling? >> Yep. >> And you said you live here? >> Yep. >> Okay. This your car? >> Yep. >> And you said you live here? >> Yep. >> Okay, there's no one at the house? Okay. Let's get a phone number for you. You got any middle name? >> Yes, Marie. >> Do you have any type of proof that you live here at all? You got mail that gets here or anything like that? >> No, I don't need it. I get everything electronically. >> Okay, can I see it? Showing that you live at 2032? >> No. >> Okay. >> You hear the dogs inside cuz they don't want I'm not I'm literally just sitting in my car. >> Okay, it's cuz we have some neighbors calling in saying that you were here and you're not supposed to be here and you don't live here. They've never seen you around this residence, that's why. >> Oh, okay. >> So, do you have any type of proof that you reside here? >> I find it It's none of the neighbors' >> Okay. >> Where'd you live before this? >> [cough and clears throat] >> Huh? >> Why do you want to know? >> I don't know. You don't think this is a little strange, miss? Sitting in the driveway with the hose running. It's a little little strange. We're just trying to figure out if you need any help or What kind of dogs are in there? Just curious, making conversation, that's all. All right. >> Okay, so do you have any type of identification showing proof that you live here? This car doesn't come back to you. You're not Your neighbors don't have never seen you around in the area, or at least at this residence. >> Okay. I wouldn't go any further back there. >> So, what are you doing here? >> I literally >> You live here? Can you show me some type of proof that you live here? >> No. >> Okay. Do you know if anyone's inside? >> Mhm. >> Who? >> It's me. >> Okay. How long have you been living here for then? >> It's not my house. Just calm down. >> For nearly 6 minutes, officers ask one question, "Does she live here?" She never answers directly. Under Florida's resisting an officer law, refusing to cooperate during a lawful investigation can be a crime on its own. That charge covers physical resistance, and it also covers obstruction, refusing lawful orders, lying to police, or refusing to identify yourself. It's a first-degree misdemeanor, up to a year in jail, no punch required. Every "Don't worry about it" on this body cam is building toward that charge. The officers aren't just being nosey, they're building probable cause. >> How long have you been living here for then? So, you you're telling me you live here. >> Yes. I'll see you later. >> Where are you going? >> Home. >> No answer. >> Is she going to [ __ ] break in this house now? >> All right, the party is over, Shelby. We got to go. >> Okay. >> All right. Where do you really live? >> Huh? >> Where do you really live? >> Why do you want to know? >> Cuz you're about to get called for for trespassing right now. This is not really funny. >> I mean, I don't know. Just trying to help. >> All right, sorry. You're good. >> Oh, my record. I really don't give a [ __ ] Just let me enjoy the music. >> You can enjoy the music all you want. It's a free country, not in somebody else's property. This is not your house, right? So, the party's over. All right, let's go find your shoes and let's go back home. >> Can I please listen to >> No. Let's go. I'm over it by now. Let's go. >> No, I'm good. >> I'm freaking bit up by ants and I'm not in a good mood now. So, let's go. The game's over. Come on. >> I'm just trying >> Shelby, where do you reside? >> Don't make her doubt. >> That's what we figured out so far. Which one of those? >> So, what are you doing >> I'm over there. >> Okay, what are you doing here? >> I am just >> live here, so stop playing games. >> Okay. >> So, what are you doing here? >> I'm just vibing with the dogs. >> Do you know anyone that lives here? >> Shelby, are you on any medication or or drugs right now? Take me again. >> mouth. >> Take me again. >> Shut your lips >> Take me again. >> with your eyes. >> Take me again. >> I'm not giving I don't want your gun. Like it's an Airbnb maybe? >> I'll um I'll see if we have your address and your phone number. >> West Branch? >> You got anything on you? >> No. >> Quit it. Stop moving. >> Stay in the car, Shelby. >> Okay. >> Can you just go over there with my cell phone? >> Nope. >> Okay. >> Yep. >> By the 11-minute mark, this stops being a conversation. Kicking at officers during a detention isn't the misdemeanor version of resisting anymore. In Florida, resisting with violence is a separate charge, and it's a felony. Whether that charge gets added is up to prosecutors, but the exposure on camera is already clear. What happens next isn't about a garden hose anymore. In the end, she was never actually charged with trespassing. The charges filed were resisting an officer without violence and criminal mischief for hose damage valued under $200. Resisting without violence is a first-degree misdemeanor, up to 1 year in jail. Criminal mischief under $200 is a second-degree misdemeanor, up to 60 days. Stacked together, the maximum exposure is 1 year and 60 days plus $1,500 in fines. All of it traces back to a garden hose and a refusal to say a name. The officers get a B+. They called the reporting neighbor first, gave repeated chances to identify herself, and only escalated once she didn't. Shelby gets an F. No ID, no cooperation, and physical resistance once patience ran out. Every option to end this quietly was on the table. She used none of them. The lesson here is simple. Refusing to answer a lawful question doesn't protect you. In Florida, that refusal can become the charge itself. That's the case. Every defendant is presumed innocent until proven guilty in a court of law. Subscribe for more body cam legal breakdowns and tell us in the comments, fair charges or overkill?
