Okay. Why? Because um they someone called and rever um some incident that happened >> when? >> So right now >> right now? >> Yeah. >> What kind of incident? >> So right now just give me one second. >> Okay. >> Did you um Is your friend in there? >> Yeah, I think so. >> What did she have on? >> Um >> like a jean jacket or something? >> Yeah. >> Okay. On July 16th, 2024, Lincoln Police Department officers responded to a TD Bank in Lincoln, Florida, after employee slag fought a woman attempting to cash a fraudulent check. Two suspects were detained. Both would be arrested. This footage is a case study in Miranda compliance, the limits of warrantless phone searches, the legal standard for guilty knowledge in fraud cases, and the boundaries of what a patrol officer can legally promise a suspect. >> Hello, ma'am. >> Hello. >> Hi. We need a talkie for a minute. Okay, I'll just hang on to this. Okay, >> can we go over [clears throat] here real quick? >> Yeah. >> Go ahead and sit in this chair. Tell me really quick. What's your name? >> Elana. >> I'm sorry. >> Elana. >> Alana. I'm Corpal Johnson at the L Police Department. Hi. Reason we're here is just because we're uh conducting an investigation. Uh you were described in our call as possibly being a suspect. So, um it's some type of fraud call. We're still trying to figure out what's going on, but for until we figure out what exactly that is, we need you to stay here. Uh, did you come here in that uh white Nissan? >> Yeah. >> Okay, I got you. >> No worries. Um, as soon as uh we get a little bit more info, which is what Officer Kelly is doing, then we can get into the the nitty-gritty stuff cuz I don't really have a whole lot of info. I was just down the street. [laughter] No problem. >> All righty. And while we're waiting, just so that way we can get this out of the way. Um, at this point, you're not free to leave. Okay. And we're going to be asking you questions that are uh incriminating in nature or could be incriminating in nature. So, I'm going to read your Miranda warning, which everyone always associates with cop TV and movies and stuff of like, oh, I'm under arrest. All the Miranda rightites do is I have to explain to you what your rights are when you are not free to leave and you're going to be asked questions that might be incriminating. Okay. So, I'm just going to read that real quick. I always like to preface that cuz people usually freak out when once you start doing it cuz they see too much TV. >> Yeah. >> All right. All right. You have the right to remain silent. >> With these rights in mind, are you willing to talk to us? >> Yeah. >> All right. Perfect. Like I said, I don't have any questions right this second, but um except for [clears throat] some I guess preliminary stuff, but um what are you uh what are you doing today? >> Um I was just trying to cash a bond that I received. >> A bond that you received? Okay. Where'd you get the bond from? >> Um I actually got it from my cousin. >> You got it from your cousin? Who's your cousin? >> Um, Yah, >> I'm sorry. >> Yah. >> Mariah Hyra. >> Yah. >> I'm sorry. Okay. Um, and do you know where she got the bond from? >> Um, no I don't. Okay. >> Um, I know that it was from my grandmother who passed away and she just gave it to me and told me that I couldn't do it. >> Okay. It was from It's your grandmother that passed away? >> Yeah, it was our grandmother. My my grandmother who passed away. Yes. >> Okay. Who is Marina to you? >> My cousin. It's your cousin. So, obviously she your grandparent. >> Yeah. >> Okay. Gotcha. Um and how how much is the bond for >> that? I don't know. I said, "How thous,000?" >> 1,000 on the bond. Yeah. >> Okay, I gotcha. Um and she didn't have any other bonds or anything like that? >> No, no, no. >> Okay, I got you. >> It was just one. >> Okay. All right. No worries. Um and then when when did you receive this bond? Um, I received it like like a day, probably two days ago, maybe. >> Two days ago. Okay, I gotcha. And, um, with with your cousin, um, is there a reason why she didn't cash it or did she >> I don't know. She received one, too, so I don't know. >> Oh, okay. I gotcha. I gota um, and then were you prior When did your grandmother pass? >> My grandmother passed away like a year ago. >> A year ago. Okay. And was your cousin hanging on to these bonds the whole time or or how? >> From what I was under the impression she was. >> Okay, I gotcha. Um, and were you aware of these bonds prior to your grandma dying or anything like that? >> I wasn't. I wasn't aware until recently. >> Okay. Did you um did you hear anything about, you know, maybe your cousin may a little while ago talking about having bonds or that, you know, you're all getting bonds and stuff like that for >> Well, I know that there was money set aside for us. I know that. Okay. >> I just didn't know like what it was. I didn't know about like the bonds, but like that's all I knew was that they were coming. >> Okay. Gotcha. Did she give it to you by mail or did she give it in person? >> In person. >> In person. >> Okay. I >> Okay. Do you know um what her phone number is off the top of your head? >> No. >> Would you be able to look it up? >> Um >> if you have your phone on you? >> I have my phone. Do you have your or not your address, your driver's license on you or your ID card or what? She has my ID. >> Oh, she has it? No worries. I'll get it from her. I mean, no worries. No worries. Um, I'm sure she's got it somewhere. We'll figure that part out. No worries. Um, how often do you see your cousin? >> Um, well, I live in Claremont. So, >> Oh, you live in Claremont? >> Yeah. >> Okay. I got >> I don't see her that often cuz I have a son, so >> Oh, yeah. No, that makes sense. >> And I'm in school on What are you in school for? >> A surgical tech. >> Oh, really? Yeah, I'm in I'm in med school, so >> Oh, very nice. Okay, good stuff. Um, how long you been in school for? >> I've been in school for a year. >> Oh, how do you like it? >> I love it. >> I'm a nerd at heart. So, >> hey, there you go. I feel that. Me, too. Um, [snorts] okay. So, um, if you live in Claremont, she lives in Davenport. What brings you to Dand? >> So, I was actually visiting cuz my grandma had passed away. So, like I just came to see family. >> Okay, I gotcha. Um, and then who what's the family that you have that live around here? >> Alicia. >> Alicia. Do you know what Alicia's last name is? >> Alicia. >> I have her phone number. >> Okay. >> I call her Ley for short. >> You call her what? >> Lely. >> Lely. >> Yeah. I can give you the number. >> 92. And you were born in 96. >> Same thing. Arch. >> Same. checks. >> Yeah, they look like they're printing them off a printer thing. But what's getting them caught up is this. You got a check dated for 92 and you were born in 96. >> And they already tried to hit multiple banks account. >> The previous checks were on 92 also, right? >> They weren't 92. >> That's similar. >> Yeah. It's like years before their birthday. How you get a check years before your birthday. And that's her. >> Yeah, that's all her information, everything. >> What's she saying about it? >> Johnson's question. >> Okay. >> Apparently, they just got a call from Daytona. That's how they knew about it >> cuz she hit Daytona, Orman Beach, and a couple of other stores. And they all denied her and she came here. Um, so what's probably going to end up happening, I'm not going to lie to you, it's this is going to take probably a little bit cuz um, you know, we still got to go through the investigation um, from that point. Hey Burns, can you stand by with her for a minute? I'm going to have Officer Burns stand by with you for a second. I want to kind of figure out what we got going on. >> The date discrepancy is the first hard evidence on the knowledge question. The check is dated 1992. Alana was born in 1996. A legitimate inheritance bond cannot predate the beneficiary's birth by 4 years. Courts treat this as evidence of either actual knowledge she knew it was fake or willful blindness, which is legally equivalent to knowledge under the conscious avoidance doctrine. A defendant cannot escape liability by deliberately avoiding facts that would make the crime apparent. >> So, she's been Yep. She she agreed to talk. So, she says that she got this from her cousin two days ago. Um, it from her perspective, it's a bond that was her grandmother's that her cousin told her that uh >> one of them was hers. She had another one, I guess. Um, she knows it's for $1,000. >> Oh, yeah. Um and then she this is this is where stuff starts kind of making less sense. She this one right here lives in Claremont. Her cousin lives in CMI. The reason she's in Dan is she's leaving family from Daytona because she said that um her grandmother passed a year ago and because her grandmother passed, she had to go spend time with family in Daytona a year ago and then happened to come through the land and that's when she went to go cash this in. But she >> she said her cousin was >> the person's name on the check. >> I don't know. >> No, it wasn't the same. >> It's not her. H. >> All right. >> The Yahara. >> That's who she's saying is grandma. >> Yeah. No, that's who she's saying is her cousin who gave it to her. >> Oh, okay. >> Whatever. >> Why she Did we ask why she's trying to catch her cousin's bond? >> Because she said um her her cousin told her that she got a bond and then >> I'm going to run her own David to see if her date of birth. She'll check. I don't got a I only have a month and a year and she doesn't know about a middle name. >> Oh, this on the chat. I'll get it. >> And so it's it's um from what her cousin told her, she her herself was given a bond that you know from grandma dying and so was the cousin. So the cousin just gave her the her bond from grandma. >> How much was that bond for? >> I haven't looked at it. I've only talked to her. >> So um this like now before you leave, right? Okay. >> But uh yeah, she's um she's she's I I told her, you know, just kind of the baseline of what we're trying to do. Like you know, we got called for potential fraud, so I told her a lot of information. So I'm just kind of trying to get a baseline of, you know, what her actions and stuff are today and everything. >> So um but you know, it's a lot of eye contact, a lot of very like she's doing her best not to move around. I think it's like it's almost like she's too hard to look inconspicuous. >> Yeah. >> So, um >> I'd be curious what the home girl outside says. >> Yeah, me too. Um because I I want to know who she is. Um cuz we didn't get to that part yet about who she came here with. She did confirm that she was riding that white Nissan there. So, >> um >> yeah, but that's where we got at so far and that's why I wanted to come over here just kind of get a better idea on what we're working. So >> yeah, we got to I mean we have to prove that >> she had knowledge. >> Yeah, she knew that it was bogus. What are they saying as far as how they knew it was bogus? >> I like I said, I've only been talking to her. So >> hello. >> Hi. >> I'm Corpal Johnson. >> How you doing? >> I'm doing all right. Um so like I was explaining to um I'm sorry. Who? The >> Lana. >> Uhhuh. >> Lana. >> Lana. Yes. She's I forget what she said. You uh are you guys friends? Family? >> Yeah, friends. >> Friends. Okay. Um, I'm explaining to her I explained to her why we're here. I don't know if officer Gil explained it to you. >> Yeah. So, we're just trying to make sure that, you know, we're working a fraud. So, we're trying to make sure either >> prove that a fraud did occur or it did not occur or at least, you know, find the problem. >> What though? >> Uh, what she was trying to cash. >> So, um, >> is it a check? >> Huh? >> A check. >> It >> I don't think it was a check. >> What do you think it was? She said it was from her great grandma or something. >> From her great grandma? >> Yeah. Okay. I got >> her mom gave them all. >> Okay. Did you say where she got it from? Like specifically? >> No. The original plans were for me to go get a outfit cuz today is my 30th birthday. >> Happy birthday. >> Thank you. And um we were just dibbling and dabbling and I told her like it's getting late. My mom literally I could show you. My mom is like, "Um, are we going to make it out to eat?" I'm like, "I'm about to drop Lana off. Maybe 5." I told her, "I don't want to go anywhere. It's raining. My hair is done." She was like, "He picked me up. It's up to you. Thought we just do something like like today is literally my birthday. I I >> Oh, no. I got you. But what we're going to do is try to get through this as quickly as we can just so that way we can get you to have your birthday dinner." So, real quick, um, where did you uh and uh Lana meet up at? >> What do you mean? >> Like when you guys first got together today, where was that at? >> Um, I was downtown Orlando. We were going to go to this taco spot for Taco Tuesday, but then they said that they um they didn't open until 3:00. It was called like um Talking Taco. >> Okay. >> So then I was like, "Let me hit up this girl. She's pretty far. Do you want to ride with me?" She said, "Yeah." And then her car is breaks or something. So she was like, "Um, I'll ride with you." So I'm like, "Okay, let's go." So then we stopped at um another bank. Then we came here. We went to Waw Wa. I was going to go into Ross. >> Before you continue, what was the other bank you stopped at? >> I don't know. >> You don't know the name or anything like that? >> It was It was this bank. >> Another TD bank. Do you know um uh what city was in? Listen, [laughter] no. Seriously, because even my mom can tell you like I don't know anything past Avalon and East Colonial that way. >> Okay. >> Like everything I need is GPS and I have >> Q link wireless. >> Okay. No, I got you. >> That my phone is like full crap. >> When she went to that TD bank, do you know what she was going in that one for? >> No, I don't know. >> No, she didn't tell you. I'm literally tired. I sat back. I put my feet up and >> I got you. How long was she in that TD bank for, do you think? Approximately. >> I don't know. >> No, >> honestly, I don't like No worries. >> I wasn't paying paying attention until my mom told me >> that she gets up at 4:30 to pick her up so we can go get something to eat cuz my daughter wanted to take me to >> Yeah. Yeah. Yeah. Yeah. >> So, that is her name or is not? >> It's on the check. So, it says that one or her. >> Okay. See, I was looking at I was looking at that name. Okay, >> that name that date of birth don't match. She's 1987. >> Okay, >> that girl date of birth. >> No, it's not. >> Same address and everything. >> It's not either of their dates of birth, >> huh? Not either date of birth. >> What was the amount? >> $1,000, I believe. in here. >> Oh, >> $1,000. All right. >> They said it look like they're printing them off >> paper like a paper or whatever. >> Do you know if that other one is spilling? They're probably going to let me get it to compare it. >> The other one from the 18. >> It would be worth asking. I don't know. >> From the other day. >> Yeah. From the 18. >> Let's see if they look the same. >> See, it look like they're printing them off. >> What's your name again, miss? Your first name? >> Elana. >> What is it? >> Elana. >> Elana. Okay. Um, Elana, just to give you a little bit of background what we're going what we're doing. Uh, this is not the first case that we've worked this our shift in particular with these pretty much exact same checks. Um we've made several arrests on them. Uh our detectives have several cases with them. Um it's an ongoing investigation and people just keep coming to the same TD bank with these same checks and they just keep getting arrested. >> Okay. >> I've never been in trouble. >> I understand. Um there's a first time for everything. Okay. So, it's time for you to be very honest about where the check came from and who gave it to you, where'd you get it, stuff like that, because you're looking at some pretty serious charges right now. >> The first constitutional issue arises at the moment of contact. Miranda versus Arizona requires a warning whenever a suspect is in custody, and incriminating questioning will follow. Corporal Johnson tells Alana she is not free to leave and that incriminating questions are coming. Satisfying both prongs of the Burkimer versus McCarti custody standard. He reads the full warning, explains its purpose clearly, and obtains an explicit verbal waiver before any substantive questioning begins. The fifth amendment threshold is properly cleared. The central legal question is not whether the check was fraudulent. It was the question is scienterer, the legal term for guilty knowledge. Florida statute 831.2 two makes uttering a forged instrument a thirdderee felony only if the presenter knows it to be forged. A person genuinely deceived into presenting a fraudulent instrument is a victim, not a criminal. This distinction between innocent courier and knowing accomplice is what every investigative decision in this encounter is designed to resolve. >> Probably >> if I'm honest, am I still? >> Probably. But I will tell you this, >> like I have to pick up my stuff at 6:30. Like what am I >> Where's he in daycare at? >> He's at Kitty in Winter Garden. >> Okay. Well, hear me out. I'll be willing to let you make some phone calls or do whatever you got to do, but you got to help us out cuz I got kids. I understand that, right? You got to get your kids. So, we need to know where the checks came from, if we can help you out at all. All right. >> So, where' the check come from? >> There you go. >> No problem. >> I didn't I didn't make it. >> You did not. >> I didn't. >> Okay. Just to be clear, you know that it's not real, right? No, I did not know it was real. >> You didn't know that it was real? >> I promise you. >> Okay. So, who gave it to you? >> Her? That's right. >> Yeah. >> What' she tell you to do with it? >> She told you to cash it? >> Okay. Is she one of the names on there? >> No, I don't think so. I know her real name, but >> you know her real name? >> Yeah. >> Is that her car? >> I think so. >> It's registered to her. Okay. How do you We'll start from that. How do you know her? >> I met I've known her for like a year. >> Oh, okay. >> We met through We met through a mutual nail tech. >> Okay. Is that what you do? You do nails or >> No, no, no. I'm in school. Like I'm I'm in med school. >> Okay. So, what was So, you've known her for about a year. You said you're a mutual nail tech. >> And how did you guys end up linking up today? Like what was the purpose? >> It's her birthday today. So >> today's her birthday. >> It is her birthday. So she was like, "Hey, do you want to hang out?" She was like, "Um," she was like, "I have a thing where you can make money." And I was like, "Is that like?" And she was like, "Yeah, like it's perfectly fine." And I just thought like, you know, >> that was legit. >> Yeah. Like I didn't think it was anything. You know, I have a son. I don't I'm not a bad person. I don't get in trouble. Like I didn't do anything wrong. Like >> Okay. >> I've never >> Okay. >> What did she tell you? So she said, "Okay, we have this thing." >> I don't know much of how like she got it, but I just gave it to >> Okay. >> It was her like I don't know. >> Okay. So she said we have this thing where we can go make some money and she >> But she told me it was legit. >> She told you it was legit. Okay. She told me it was legit and I was going to get in trouble. That's what she told me. >> Okay. How did she get your name on there though? >> I don't know. Like I don't know who she went through. I don't know if she did it herself or if she went through somebody to get it. I don't know. >> But I can't tell you cuz it was already done before she came to pick me up. >> Did you know any of that was going to take take place or >> No. Like I cuz it's literally her birthday. So like I thought we were just going to hang out. >> Let me ask you this. When we ask her, is she gonna say the same thing? >> When we go and put her in handcuffs and we say, "Hey, >> it's literally not mine." >> I know. But it has your name on it. >> I know. I'm not It's not >> right. So, listen to my question. >> When we ask her, when we take her and put her in handcuffs right now, >> what is she going to tell us happened? Is she going to tell us you knew it was fake or she going to tell us? >> She I don't think she's going to tell you she knew it was fake. >> She's going to have some reason why her your name is on it. She used the number of my >> cuz right now she's saying she has no idea where it came from and that this was all your idea. I'll be honest with you. That's what she's saying. >> It's not my idea. I've never done anything like this. I don't I don't >> understand. I'm a mom. >> I got you. >> Mom doesn't mean you can't go to jail. >> I'm a single mom. >> Okay. So, is that why is this the money for you being a single mom or is this the money for cuz it's her birthday and y'all want to go party? >> No. Like I mean like yeah, I'm going through a rough time but like I didn't know you would fake. Honestly, I did not know. >> So, her name ain't on it. Yours is >> I know that, but she was the one that had somebody do it. >> Do you have any evidence of that? >> Like a picture or something? >> Text messages, >> anything? Cuz right >> I found like where she asked for my info. >> Yeah. Yeah. Show us >> cuz right now her name ain't on it and yours is. You know what I'm saying? >> Yeah. The date of birth don't have to match. But >> is this the old one? >> No, this is a real one that somebody cash. >> Like that's an actual real one. That's the fake one. >> You can see the different. And it look like that's a male barcode. >> Like she she sent me this. Like >> when did she send you that? >> That was yesterday. She sent me that. What is that? What is that asking for? >> That's social security number, name, date of birth. >> Is that So, she was telling you what that that was your stuff or >> No, like this is an example of like ones that she did. >> I got you. Do you have any of the messages that go along with that? I have cuz I'm just like I'm telling you want to take off >> like I have pictures of one she did like >> like look look like this is what she unless they request us >> she sent it to me this is like her like she sent it to me >> okay >> I didn't do it >> well So, you knew that that bond, >> but I didn't know it was fake. She told me that it was like a legit thing. I didn't know. She'd never said it's fake. I would have never known. >> So, you didn't know. >> So, let you understand that money just doesn't grow on trees, right? >> No, I understand that. I would. >> So, you thought that $1,000 was just going to miraculously appear in your name and that it was legit? >> She didn't explain it to me. >> You didn't listen to what you're telling me. You know what I'm saying? Take a step back. Take your need for this $1,000 out of it, right? Because times are tough. Times are tough for all of us, right? And you have this need for $1,000, right? Take that out of it. And use a little bit of common sense. And just think about the whole situation for a second. This person that you've known for a year tells you, "I'm going to create a check with your name on it that was not intended for you, and you're going to go into a bank and cash it, and that's completely legit." All right. >> I mean, it sounds crazy, but it wasn't me. >> Sounds crazy or is crazy. >> No, it's crazy. >> It wasn't me, though. Like, I >> It looks like it's both of you. >> I didn't make it. >> You uttered it. You came in here and tried to cash it, which means you're guilty, too. >> I get that. >> That's a crime. That's a felony. >> I can understand. >> Okay. That's what we're looking at here. That's a felony. >> I'm trying to be honest with you. >> I appreciate that. >> The one that that initiated it. >> You didn't make it. Yes. Okay. >> I was under the impression that it was a legit thing. Like, Okay. So, how So, you tried this at several other banks today? >> Well, she brought me to like like two or three. >> Two or three? >> Yeah. >> And it didn't work those times. >> No, they gave me um like a split. Um they said that they were able to verify it but like it was like the like that was the thing that was throwing me off. Like they were able to verify it but it was like they couldn't um cash it. Like they were telling me to send it to the treasury. >> Do you have those slips they gave you? >> It should be in the card. >> Okay. >> And you didn't think >> I'm in literally I'm in med school. Like I'm just trying to take care of my spend at work. Like I work full time. I'm a single mom. >> I got you. Is that what the $1,000 was for? Was like helping you with bills or >> I mean, yeah. Like my baby father lost his job, so I just thought like I didn't think it was like a fake thing. Like I didn't think it was like a >> Okay. Well, we're as of right now, you're still not afraid to leave. I'm going to go ask her the same questions and see what she comes up with. Okay. So, last chance before I go out there and talk to her, what's she going to tell me? >> I'm telling you the truth. >> Okay. >> I don't know what she's going to say to you. She's probably going to sit there and say that she didn't do it >> or she didn't know about it. >> Gotcha. >> I just showed you everything I have. >> Let me see. So, those messages came from her. What's her name one more time? >> Her real name is Dorian. >> Dorian? >> Yeah. But they call her baby. >> Baby. Okay. And um were those texts or Facebook or how did they get text messages? >> Text messages. Okay. >> Do you have the number? >> Um it's a iCloud. I can give you the iCloud. >> What is it? Email or something? >> Yeah, it's okay. Email her iPhone. I have a number. She was calling me off earlier. >> Okay. Yeah, you can give me that. >> When Alana voluntarily shows her phone, a fourth amendment issue enters the frame. Under Riley versus California, the Supreme Court held in 2014 that officers cannot search a cell phone's digital contents without a warrant, even incident to a lawful arrest. The court was explicit. A phone is not a cigarette pack. It contains the privacies of life. Consent to show one image is not consent to browse the entire device. If officers scrolled beyond what she offered, that evidence is suppressible. The same concern applies with equal force to Dorian's Telegram messages. The body camera capturing what appeared on screen documents that a search occurred. It does not authorize one. The prisoner's dilemma technique deployed against Dorian is constitutionally permissible. Informing a suspect that her co-conspirator has already implicated her, whether true or not, is affirmed in Illinois versus Perkins. Officers may misrepresent the state of the evidence to elicit truthful admissions. Frasier versus CUP further established that deceptive interrogation tactics do not automatically render a confession involuntary. The test is whether the suspect's will was overbornne by the officer's conduct. Here, Dorian is calculating, not confused. Her disclosures are strategic. The technique is used within its legal limits. What officers may not do is promise leniency they are not authorized to deliver. Florida statute 94806 removes officer level discretion entirely when a felony is committed while on active probation. The arrest is a statutory mandate. The sergeant's consistent refusal to imply otherwise protects the voluntariness of Dorian's admissions under Colorado versus Connelly, which holds that a confession is involuntary only where police coercion overcomes the suspect's rational decision-making. Had he implied cooperation could prevent the arrest, her entire postconrontation statement could have been suppressed. The referral to the state attorney for any leniency discussion is the only legally accurate answer. Officers cannot offer plea agreements, charge reductions, or sentencing concessions. An officer who makes such a promise, even informally, even in good faith, risk suppression of the entire resulting statement. Beyond suppression, unauthorized promises can expose the department under Brady versus Maryland if the prosecution later fails to honor an agreement the officer had no authority to make. The sergeant draws this line correctly and holds it under sustained pressure. >> Righty. All right. So, um, my sergeant and I want to ask you some, uh, some follow-up questions. Before we do that, though, you're not in trouble right this second. I mean, at all for as far as I'm aware, but we need you to step out of the car just so we can talk to you cuz moving vehicles and active vehicles. >> Okay. >> Yeah. Thank you. over here in the uh cover thing. >> Yeah, we we don't want to mess up your hair cuz I know you just got it done. >> Do you guys need to go in or >> Nope. We're just getting out of the rain so we can talk to her real quick. Appreciate it. We will eventually, but they can let us in. >> Okay. >> Thank you. You have a card. You got your card. >> How do you read it? >> Oh, her. Okay. Um, see, she read your rights. Um, you understand your rights. You're willing to talk to us and everything like that. You're not under arrest. We got to ask you questions. Okay. >> Um, I only talked to her. I didn't talk to you, but supposedly there's some inconsistencies about where you guys met, how long you guys been together, hanging out today. She's saying that you guys um met like a year ago. Is that about right? We just have we haven't talked to you. Here's the deal. >> I'm talking to you. Whoever >> uh you are detained right now. You are not free to leave. And there are some implicating things where you could very well be going to jail. Okay? But we'd like to ask you some clarifying questions. >> There are some implicating things that we have now seen, some text messages and images that we have now seen that we'd like to talk to you about if you'd be willing to speak to us. Okay. >> Am I going to jail? >> Potentially. >> He said I'm potentially going to jail. >> So that's the question is we would like to talk to you about these pictures and videos that we have seen or text messages. Sorry. Pictures and text messages that we have seen and that's that's just it. Would you want to talk to us about it or not? >> Am I going to jail? >> I have already answered that question like three times. What's going to happen for me not to go and yell on my birthday? >> Well, we have to prove that you're not involved in a crime. That's what we're trying to talk to you about. >> I'm not involved in a crime. >> Well, I've seen some things in the last 5 minutes that would make me believe that you may be. So, I'd like to talk to you about those things. >> What text messages? >> Okay. So, obviously you understand that we are here. We got called here because there was a report of a possible crime committed. >> Okay. What is the crime? >> The crime is a fraud. Okay. and uttering a forge document, trying to cash a check, fraudulent check. >> A check. >> Yes, paycheck. Okay. Or other monetary item. Okay. So, we come here, they give us some information that there's been a series of events today where people have tried to cash this fraudulent check and it's been unsuccessful and that she's inside as the one that's been trying to utter this force document that's been trying to cash this fake check. >> So, she's the focal point of the investigation. At that point, you're just the rat. Okay? Up until the point where she tells us that you gave her the check and she shows us text messages and images from an email from a phone number. Uh where these checks were being provided to her where there's some personal information being exchanged to put on these checks so that they could be cash something along the lines of it's legit blah blah blah. So >> from me or from her boyfriend? She is saying that they came from you. >> Her boyfriend. >> Okay. Why would she tell us it was you? >> It's because she's >> wants her boyfriend. Okay. So, what about the messages that I saw between her and Gmail? >> Do I have a Gmail? I have a a Gmail. We do a search warrant to Google. It's not going to say that it's >> not my email. She's been on the phone literally all day with her boyfriend. >> I got you. >> So, if you look at her call logs, she's been on the phone all day with her boyfriend. >> I got you. >> I'm just telling you. I'm just wanted to ask you because that's what she's telling us. She's telling us that she didn't know they were fake. That she cashed them because you told her to. >> So, what about her grandma giving them? if I weren't cover. >> I'm trying to figure that out myself because apparently that's all a lie. >> No, I just think she's trying to cover up on her boyfriend. >> Okay. I mean, she she is providing incriminating information about herself, right? And implicating you by saying that you gave her >> No. She So, you did not give her these checks. You don't know anything about these checks? her her I know her boyfriend does that type of stuff, but she told me that that was from her grandma that she was going to come with me for my birthday. >> I got you. >> That's the checks and stuff. >> Okay. >> She she confirmed that she has that you said yummy is her email. Do you have emails or text messages from that email providing you images of the checks or anything? >> But did that come from that email? >> Yeah. I need proof that that came from that email. Like a >> It's right here. >> No, not that one. The Yummylicious cuz she's denying the little baby. >> I don't >> This is like She sent me these. I don't know if this will help. Like she sent me these. >> No, let me see. Okay, let me see the other messages. Any of them have any pictures of the checks or anything? >> Um, and this one I don't know. No, but it has no just [snorts] only this one. This one is there other one that she uses >> a little baby. >> Yeah. >> Does she say any >> like I have I have when I sent her my location this morning. [snorts] I thought >> you might through these. >> So this was today. Okay. Today. Happy birthday. >> Yeah. [snorts] There's not much like on this Yummylicious one. Like she uses that one more. >> Is her name in Is her name in the little baby chat? >> No. >> Is her name in the little baby chat? Dorian. >> Who's Lana? >> Was me on the >> Okay. Lana. Okay. So, that was >> like the picture that she sent me when she I guess when she did it or [snorts] >> [snorts] >> Where is she from? >> She's from Miami. >> Miami. >> But she looks like [snorts] the last people came from. Amy, where do you stand? >> A little bit clear. [snorts] >> She said it was all your boyfriend that your boyfriend gave you the checks or whatever. >> No, it wasn't. He has nothing to do with this. Like at all. >> Did you have any contact with him today? [snorts] >> Earlier like I called him to check on him to make sure he ate and then I just called him just now to see if he could check on my son or me. >> Okay. >> I need to figure out who has to pick up my son. [snorts] What's up? Any like pictures of her? Do you all send like selfies or anything? Um, I mean, she sent me this like an invitation for her birthday this weekend. [snorts] [music] >> She not claiming it. >> Is she not claiming baby to bless? >> Mhm. She's not blaming anything. >> Yummy. Is the profile picture her? >> Uh, no. >> Oh, hi. 54 golf on a silver utility. >> Oh snap. Can you go back to it? >> Yeah. Oh, she must have deleted her phone. >> Well, it's on my body, but I don't know. >> Yep. She on her phone right now. >> If she deletes it, it goes off of your phone, too. >> [snorts] >> That's the fair back. She probably delete everything. Can't get rid of eye messages. I know that for a fact. Take that phone. >> Dorian's apparent attempt to clear her phone while officers are present raises a separate issue. Potential obstruction and spolation of evidence. Under Florida law, intentionally destroying evidence once an investigation is underway, even before formal charges, can constitute criminal obstruction. The sergeant's observation that the act was captured on body camera, is legally meaningful. The deletion attempt, if proven, is now part of the evidentiary record and directly relevant to prosecutorial charging decisions. >> All right. This is ours. Yeah, that's ours. You're going to jail. >> You're deleting things. You're going >> I'm not deleting anything. >> You're going to jail. I just saw everything I need to sell. >> But I didn't delete anything. I was sitting here googling the boy's name. >> I understand. We'll look at that and we're going to try to uh figure that out. But I saw everything I need to see on >> But he's calling me on Telegram. >> I saw a lot of messages from you >> on >> He's Did you not see when he was calling you on in on Telegram? >> Information he's saying. >> Can you make a phone call for me? No, we're not doing that cuz you won't tell us the truth. So, I don't I have no sympathy for liars. >> Did you give somebody to pick up your kid? >> Okay. >> And then it miraculously disappeared and you have your phone in your hand. >> I was googling. I just asked him if I could Google. I I'm honest to you. He He can do that. >> We're all the boy Gucci. We're all in a group chat. >> Okay. Well, however, they disappeared. We saw what we needed to see. It's been captured on our body cameras of you sending these messages, getting her personal information to put on these chicks that you knew were fraudulent. She knew they were fraudulent. You're both going to jail. That's it. That's plain and simple. >> Okay. What is the charge? >> Uh, honoring a forge document. >> And is there a bond for that? >> 2500. 2500. So 250 to get shot. What's your criminal history like? Let me ask you that. >> I'm on probation. >> Oh, nope. No bond. We're going to You're done then. All right. You be in until tomorrow. >> Can I Can I speak to you or can I can I help? Can you help me? >> That chance lies. So, >> I think is there anything that because I cannot go to jail, my daughter is going to be so disappointed. >> I'm disappointed. >> Societyy's disappointed. You committed a felony and you lied about me and I gave you every opportunity to tell me the truth and you still lied. >> I gave you a chance to Is there any way that you could find the boyfriend's information? >> We'll work on that. That's part of That's part of the investigation. His guilt doesn't mean you're innocent. >> I told you what was going to happen, didn't I? >> Can I talk to you? >> Talk. >> But am I still going to jail? >> Yeah. >> I gave you an opportunity and you didn't take >> Okay. Because listen, the boyfriend I'm sorry. I don't keep meaning to >> the boyfriend, he knows all of my information as well. Okay. >> So, it's kind of like >> if I snitch on him, that's going to fall back down on me. >> So, >> I'm not asking you to snitch on him. No, I'm not. >> I'm asking you to tell me the truth about what >> only her bag is in there, officer. >> I'm not asking you to snitch on anybody. I'm asking you to give the information that you >> I'm asking you to give the information that you can leave it because that's all my No, I'm sorry. >> No, officer. No, listen. >> Can you talk now? >> Yes. Yes. Yes. >> I want to know what you know. >> Okay. If I tell you where it came from and you guys can have proof of that, you want to see what you do. >> Depends. >> Maybe it's good information. >> Okay. I need to know what your involvement is. >> I'm just a driver. >> Okay. Did you know? >> No, you're not. >> No. Yes. No. Officer, listen to me. I'm not the head of the operation. I'm not even that smart. >> Say you were the head of the operation. >> No, kid. >> And I'm not challenging your intelligence, but I'm asking your involvement dancing around the question. >> Okay. Respectfully, I am not like this is not my operation. >> I was told to do something. I did it. >> Okay. Understood. >> Was there information that came from >> the boyfriend? Yes, there was. >> Okay. >> Is there somebody else involved? Yes, there is. >> Did you make the check? >> No, I didn't. I swear to God, I I put that I put that on my tape. I did not I did not make that. >> But you got the information from her to have the check made. >> No, listen. It was a group check. >> Okay. So, I wasn't the only one with the information. Okay, honest to God. I'm I'm telling you the truth because now like my life is depending on it because >> my my daughter that's my only concern right now. >> I just helped. I knew more than I told you. But I'm You got to understand I'm scared. Yes, I'm scared. >> Understand. And all due respect, I'm not trying to beat around the bush. I'm not trying to be funny or anything. But it wasn't I'm not the brain of the operation. It was everybody that put it together. So >> I understand. >> Okay. I'm not innocent. >> Okay. So you knew more than you said you did. >> Okay. Because >> I appreciate your honesty. >> Okay. Because the boy, the Gucci boy, he has all of my information. I'm sorry. I don't need I know you're little. I don't need >> I don't mind. He's like, >> but he knows all of my information. And then coming from somebody like me that I don't have money where I can you can't front money or snitch on somebody or how they say put bounties on people. He can't, >> you know. So it's like just now I got scared and I'm like, "Okay, it's my birthday. I can make a couple of dollars." But we were all in a group chat. But it initiated from him. Like when she was on the phone with him, she's telling him, "Oh, babe, should we go to another one?" >> Gotcha. That that is where that I'm >> But you guys were all in it. >> I >> You were intending on making money, >> right? And I just got asked to drive because >> he supposedly has a >> on his foot on a monitor ankle monitor because his house just got raided and she said that they took um ID printers, Louis Vuitton sneakers and all of this stuff. >> Understood. Okay, >> officer Salman. >> Yeah. I cannot go to jail. But look, I can help you. I just cannot go to jail. Please. I know. I I know. I know. I wasn't asked. >> The problem is you're on probation. >> Okay. That changes. >> Listen, listen, listen, listen, listen. I have 143 days left. >> A probation? >> Yes. >> Mess that up. >> No. Please, please. If I if I if I can please give you information. I'm sorry. Am I pulling you? >> You're fine. >> If I can please give you information. Is there anything? And it's not it's not going to be no sugarcoated nothing. I can give you valuable information that is bigger than me standing right here in cuffs in that one little flimsy thing. I'm telling you, please, please, like, I don't know if I have to go to the detective's office or whatever, but I cannot go back to jail. My daughter is going to be so disappointed. She made me a cake and everything last night. Like I'm supposed to be going out to eat with my family right now. >> I understand that. >> And look, >> what was your first name one more time? >> Dorian. >> Dorian, you are on probation. There's nothing I can do about that. >> Okay. If you were not on probation, maybe we could talk. You are on probation. I have no choice. Regardless, you could tell me. You could tell me >> who killed John F. Kennedy. >> And I can't release you. You're on probation. >> Listen. Can I >> You're on probation. >> I'm sorry. You are on probation. You can't just be police contact and I can help you like maybe a million dollar operation. >> Well, while I would appreciate that, my policies about people on probation are what they are. Okay. >> I would appreciate any information you can give us. >> So, even if I post bond, they're not going to let me go. >> Not with not being on probation. No. >> Okay. That being said, just answer me this. You don't have to go into anything else. The rest we'll do. we'll work with later. You knew that this check based on this group, this bond what? >> Okay. This bond, >> but he said, okay, >> was no good. >> No, look, he said that he got them from somebody and he was just putting her name on it. So, they were supposed to be real. That is what I was told. >> Okay. >> Um, excuse me, sir. >> What are you doing? Huh? It's getting towed. >> Yeah. Who's going to drive it? You were hurt. >> They're coming right now. Please don't tow my car because that's the only way my daughter could get back and forth to work. >> Okay. >> Do you mind just right here? >> No, I'm asking you a question. Can you please make a salmon? Can I ask you a question, please? >> What's up? Can you do me a favor? >> What you need? >> Is there I Are you the um corporal? >> Sergeant. >> Sergeant. >> Okay. Sergeant, is there anything so I can post bond for you to do for me? >> No, you're on probation. I already told you that. You are on probation. No matter how many times you ask, you're on probation. There's not. I'm sorry. You could give me the juiciest piece of information right now. You're on probation. I don't have the discretion to release you. You are committing a felony while on probation. I do not have the discretion to release you. I just don't. If you weren't on probation, maybe we could talk. >> So, can you not tow my car because my mom needs >> It is part of this investigation, though. >> There may be evidence in there of this these frauds that we're now working that is part of a larger scheme of frauds that we've been working for several months now. >> So, listen. If I give you guys information on where they originated from, can I not go to jail and you guys could do your drug I mean your fraud bus? >> You are going to jail. >> Plain and simple. No matter how many times you ask, you're going to jail. >> No. Okay. >> While any information would be appreciated. I understand the position you're in and I cannot make you any promises that you will not be charged or not going to jail. I can promise you this right now you're going to jail because you're on probation. Okay. Is there Okay. So, you said there's a criminal investigation going on for this. >> There is a It's a part of a larger investigation. There is a whole bunch of fraudulent checks that have come to this bank here recently, >> and they all look a lot like the ones that she had. >> Okay. Hey, Mr. Johnson. Officer Johnson. He said that there is a investigation going on with this. Correct. Correct. >> Okay. So, There's an investigation going on if I can tell you. Well, he said I'm already going to jail >> and that's understandable. >> If I can help you guys, is there any leniency for me >> for that? That'll be up to the state attorney. >> Yeah, that's if the the state attorney can most definitely uh uh cut something with you if you if you provide more information to the the the higher rank, you know. So, uh, I'm not saying you'll get off scot-free, but it might be a lot more lenient than what you would get if you just stood your ground and stand and and try to stand on your own. You follow what I mean? >> Okay. So, as far as So, she's not going to jail. >> She is. >> She is. You both are. Yep. >> Okay. Did he ever make her boyfriend? >> I can't make her. She gave us the information about you. You gave us the information about her. She admitted to her wrongdoing. You admitted to your wrongdoing. You guys are both going to jail. That does not mean that her boyfriend will not at a later date based on the information we have and this investigation is going to continue. As of today, the only people we have problem cause the charges, you and her. >> We are going to continue the investigation. >> A detective will be continuing the investigation. We're patrol. We're not investigations. A detective will be continuing the investigation and working with other detectives from other jurisdictions who are already working these frauds. But as of right now, the only two people being charged are you and her for right now. For right this very moment. >> Okay. You can sit for about me. >> Yeah, >> she's got to search you. >> Search you a little bit. >> Corporal Johnson receives a B+. The Miranda procedure was timely, complete, and intelligently explained. Suspect separation was immediate, and properly executed. The patient non-confrontational interview style reflects best practices in non-coercive interrogation. The deduction. The phone review lacked documented consent boundaries or a warrant request. In a case where digital evidence is central to establishing the knowledge element, that procedural gap is the foundation of a defense suppression motion, and it was avoidable. The sergeant receives a B. His probation analysis was legally accurate and consistently applied under pressure. His management of the leniency issue was procedurally sound, preserving the admissibility of Dorian's admissions. The deduction, I have no sympathy for liars, stated on body camera to a suspect. creates impeachment material for defense council and undermines the documented neutrality that professional conduct requires. Officers do not need to agree with a suspect's choices. They need to keep that disagreement off the record. Alana receives a B minus. She waved Miranda cooperated throughout and produced phone evidence that advanced the case. The deduction her opening account, a grandmother's inheritance bond passed through a cousin, was a fabrication abandoned the moment it became unsustainable. That fabrication directly undermines the credibility of her later claim of complete innocence. Attempting to cash the same instrument at multiple banks without questioning it further narrows the space between ignorance and willful blindness. Dorian receives a C. She had operational knowledge of the scheme, recruited Alana, coordinated the sequence of bank visits, and communicated with the organizer throughout the day. She disclosed information only after officers had already seen the telegram evidence on her own phone. Cooperation at that point is damage control, not mitigation. Her attempt to delete messages while in investigative detention is the defining act. The conduct of someone who understands precisely what the evidence shows. Three lessons from this encounter. First, digital evidence demands a warrant or documented bounded consent. Voluntarily shown is not voluntarily searched. Officers who exceed the scope of consent transform their strongest evidence into a defense attorney's most effective argument. Second, Miranda is the foundation, not a formality. If the warning or waiver is defective, the evidentiary structure above it collapses. Third, officers cannot promise what only prosecutors can grant. Any statement implying otherwise poisons the voluntariness of the resulting confession, and may suppress the very admission that would close the case. Alana was sentenced to 18 months of probation, 50 hours of community service, and an anti- theft course. Dorian received 35 days in jail reflecting her probation violation, her operational role, and her conduct during the investigation. The Broader Network, a boyfriend operating through encrypted group chats with ID printers seized in a prior raid, remained under active multi-jurisdictional investigation at the time this footage was obtained.
