Just a supervisor. I'm 10-15. >> On July 30th, 2024, deputies from the Escambia County Sheriff's Office responded to a trespassing call at a private commercial property in Pensacola. The property owner had posted no trespass signs. The man they found had no ID. He told officers he had been warned before, over a year ago, from this exact location. The deputy issued a second warning, handed the man his bag, let him walk. The warning was documented on camera and acknowledged out loud by the subject. Under Florida law, that moment, the acknowledgment, is the trigger. It converts a civil matter into a criminal predicate. Return to the property and the trespass is complete. No argument, no defense. 20 minutes later, deputies were back at the same location. The same man was still there. The deputy approached again, this time with different instructions. The deputy gave nine verbal commands to get on his knees, nine, each one documented on camera in real time. The subject refused every single one. At that point, under Graham versus Connor, officers are authorized to use force proportional to the threat level and the degree of non-compliance. Nine commands with no response crosses that threshold in any jurisdiction. The taser was deployed. The subject went to the ground. He was handcuffed on the property he had been warned to leave 20 minutes earlier. >> Oh yeah, I got to go one more time to reverse this complex I created. Who even called on me? >> All right, have a seat in my car, okay? >> Yeah, whatever, bud. I don't really want >> Not you right now. Come on. >> I really want you. Why do you have to You didn't have that taser. I had your ass. >> Stop. >> [ __ ] YOU. >> STOP. STOP IT. >> [ __ ] I DARE YOU TO TAKE THE CUFFS OFF. >> 347, we're still fighting another guy. If I can have another another 10-18, please. >> You set me up and you know this ain't right. You're the one who told me to walk down the street. >> You just dented my car, man. >> I don't give a [ __ ] I'm good. >> Will you get in the car and sit in the car? >> Why'd you do this? >> Will you sit in the car? >> No. Thank you, I'm good. Why'd you do this? I know you're daring me right now. You're daring me right now. That's all you're doing. I want you to know that. >> walked through. You're under the awning here. You're trespassing, okay? >> I didn't do anything wrong. I [ __ ] hate you. This is why nobody likes you, dude. >> 347 is up for me. >> You know I ain't got a [ __ ] problem with cops. You did this [ __ ] for no reason, [ __ ] >> On the ground. We're still cuffing you. Do you want to get in the car? >> I wish you didn't have that taser. I'd have been right on you. I ain't scared of electricity. You know I want to break something, please. I'm not scared and I'm not going to sue you. Please. You know what you did was wrong. You really do. I know you're daring me. That's all you're doing. You're just daring me. But I ain't that stupid. But trust me, I want it. I want it. Felt good. I like pain, if you can't tell. And I'm not scared of you. And if I knew where you live, I'd find you. And I hope I go to prison. So, [ __ ] you. My my wife my wife was murdered and you can't do a [ __ ] thing about it. Everything's okay. What you shaking for? Come on. So, when can we actually finish this? No gun belt, no tasers, no bulletproof vests. Just hand-to-hand the way it should be. Please. And the funny thing is God told me this morning, you're going to have to go one more time. You on any drugs? No, sir. 100% sober. You take anything today? No, sir. I just I've been wanting to hurt somebody or get hurt. And I feel like you set me up. You told me to walk down the walk down the street. Murdered my wife. And you can't do anything about it. Just cuz I'm a junkie. What you got? >> All right, guys. Hang on. >> Here's 497. >> That's the car. >> He's handcuffed, yeah. >> All right. >> Hey, it's Sergeant Miles County Sheriff's Office. Why did Why did you resist my deputy? >> I can't help it. I feel aggressive. I feel aggression and I just start getting angry and I start to enjoy it. I feel like he set me up. I mean, I he I didn't do anything wrong. >> Okay, well, you understand you're trespassing here. >> I was walking through a thoroughfare street. I'm not I don't know. I don't want to argue. I don't want to cause more problems for myself than >> All right. I was more trying to figure out what led to you getting hit with the Taser. >> Uh well, I was down on my knees and I started I seen Once I was down on my knees, I instantly became very aggressive and he did his job very well. >> That's fair enough. I That That That goes a long way with me being >> The best part is like you almost feel like you can get your muscular control back, right as it as they start tightening up on the trigger, you almost feel like you have your muscular control back and then tighten it back up. >> Okay. >> Feels pretty good. >> Well, I mean, I respect I respect you, you know, being being straightforward about it. >> I just I can't help it. I've been getting angry. >> Well, let's let's let's try not to let this happen again, you know what I mean? >> Yeah, I mean, basically I've just been getting angrier and angrier and angrier and angrier and angrier and angrier build up inside and I just I didn't feel like I was doing anything wrong to be harassed. He asked me to leave the street. I left the street. He pulled up on me, jumped out with a Taser and I couldn't control once he had me once I couldn't control it. I just I can't help it. I got this ringing in my ear and it just don't stop. >> I understand. >> Ever since my wife died. You know, my wife was murdered at West Florida Hospital by one of the nurses and there's no way I can prove it and there's nothing the police can do for me. >> I understand. >> And I've just been getting angrier and angrier and angrier ever since. And now I just lost my Spanish tables, my Spanish notebooks, my Bibles, everything. But God told me this morning, "You're going to have to go back to jail one more time to reverse this complex." And I'm sorry. >> All right, well, yeah. Best of luck to you, sir. >> What happened after the handcuffs went on is where this case becomes something else. The subject did not go quiet. He made statements on a body camera he knew was recording. He told the deputy he wished there had been no taser. He told the deputy he would have been right on him. He told the deputy that if he knew where he lived, he would find him. Every one of those statements is admissible. Every word spoken to a law enforcement officer in custody, absent an invocation of Miranda rights, is fair game for prosecution. He invoked nothing. He also told officers he had been wanting to hurt someone or get hurt, that he had been growing angrier since his wife's death, that he had expected that morning to end up back in jail. There is a legal concept called voluntary disclosure. When a subject provides incriminating information without being questioned, that information does not require a Miranda warning to be used in court. He provided it anyway. When Sergeant Miller arrived and asked why the subject had resisted, the subject said the deputy had done his job very well. He said it with the deputy standing nearby. That statement, on camera, was the closing argument the prosecution did not have to write. The subject was charged with three counts: trespassing after a warning, resisting an officer with violence, and criminal mischief. In Florida, resisting with violence is classified as a third-degree felony, up to 5 years incarceration per count. Add the misdemeanor trespass charge, add criminal mischief, total statutory exposure, 7 years incarceration and $7,000 in fines. The most damaging witness in this case spoke voluntarily, at length, on a body camera. The deputy gets an A. He issued the warning by the book. He gave nine commands before escalating. His restraint during the post-arrest verbal assault was documented and consistent throughout. Under Graham versus Connor, use of force is evaluated against what a reasonable officer would do given the totality of circumstances, not in hindsight. Non-compliance across nine commands on a trespass property clears that standard without debate. Sergeant Miller gets an A. He de-escalated a volatile situation through patience alone. He extracted voluntary admissions without a single leading question. He acknowledged the subject's grief without compromising the arrest record. That is crisis management done correctly. The subject gets a D. He was warned. He acknowledged it. He came back. At every stage, he eliminated defenses available to him, not through ignorance, but through stated intent. He told officers he expected this outcome before it happened. Florida law defines resisting an officer with violence as a felony, regardless of whether the officer is injured. The threat is sufficient. The continued physical struggle after taser deployment and the threats made in custody together constitute multiple independent charging events. The lesson here is this. A trespass warning is not a suggestion. The moment you acknowledge one out loud, you have created the legal foundation for a criminal arrest. The second encounter is not a new event. It is the completion of the first one. The right to remain silent was available throughout. The subject chose not to use it before the arrest, during the arrest, and after the arrest. That decision will appear in every document filed in this case. If you want more body cam footage, the moment suspects don't expect to end up on camera, hit subscribe. We post every week. Drop a comment. What do you think the sentence should be? We'll see you in the next one. >> All right. It was He did a great job. >> Yeah.
