Help. Help. On July 27th, 2024, officers from the Marian County Sheriff's Office received a call reporting that an altercation between a group of men was taking place on the side of the road. After receiving the call, they promptly responded, but upon arrival, only one man remained at the scene, throwing what appeared to be trash out of his car. Even so, the officer decided to approach him to understand what had happened that day, unaware of the danger he was about to encounter. 68, I'm going 97. Looks like I just got one subject on scene. You keep it clear. No. >> What's going on, man? Hey. >> Hey. Let's get out of the road. Talk me over here. >> Yeah. Close the door. Talk me over here. Close the door. Talk me over here. THE man seen here was later identified as 38-year-old Joseé Hernandez, one of the individuals involved in the altercation. Instead of cooperating, Joseé made it clear from the very first second that if it were up to him, this would be anything but a simple encounter. But even though he tried to act tough and overpower the officer, he couldn't. And he was realizing that in the harshest way possible. >> Get on your stomach. GET ON YOUR STOMACH RIGHT NOW. HANDS BEHIND YOUR BACK RIGHT NOW. Can't believe you're doing for your kid. They have those units. 1018. Hey, with you made it on your stomach. Put that hand behind your back right now. [clears throat] >> Oh, >> Joe had ignored any chance of resolving the situation in the smoothest way possible and was now taken to the ground, severely injured after trying to fight the officer. But the situation ran deeper than the initial call had suggested. When the officer first encountered Joe in the car, he also noticed a child in the front seat, one Joe would later do everything possible to distance himself from. >> Put your hands back here. >> Okay, >> I got to puke. I got to puke. Friendly friendly wall look good. >> Give me give me some hand sanity >> here. Look first. Give me a little bit more water on the hands. Just saying. >> Friendly. >> Just saying that it's not there. >> Friendly. >> Listen. If we can't identify this kid, you don't have someone who can get him. DCS going to come confiscate your kid. >> That's fine. I have no kids in my car. >> Okay. >> Well, that's another problem. I don't even >> The child found inside the car was later identified as Jouge's son and was discovered in a deplorable condition. The boy was covered in and sat with no clothes at all in the front seat. Although Joue tried to downplay the situation by telling the officers he didn't have a child, he couldn't escape the harsh reality that was beginning to settle in. >> So what happened when I pulled up? So when I pulled up, this guy throwing trash all out his car. Yeah, >> he throw trash out his car. So, I mean, I turn my lights on. I'm like, "Hey, buddy." >> Okay. >> He opens his door. I say, "Come talk to me over here so we don't get hit." He opens his door. He rolls his back window down. He says, "Are you pussy?" He's dropped or something. >> Yeah. >> He goes, "Are you pussy?" >> Yeah. >> And I was like, "Bro, I just don't want to get hit by a car." >> He basically about squared up on me. He kind of he opens up his car door. He steps out. >> I say, "Hey, step back here. I don't want to get hit." >> He gets back in his front seat, sits down. He's kind of giving me that look. Okay. >> All right, man. So, this is what we're going to do. You're going to bring this knee in and I'm going to I'm going to sit you up. >> All right. You're going to breathe a lot better when you sit up, man. >> We've given you more than enough seconds. >> I want to get you off this ground. >> All right. I want to get you off this ground. Okay. In front of my kids, not even going to let a four-year-old box. >> As the investigation continued, the officer spoke with one of the witnesses who claimed that she had pulled over after seeing Huee throw what appeared to be trash out of the window. That trash, however, turned out to be several $100 bills that together totaled $15,000, now scattered all over the highway. But up until that point, the officers still hadn't uncovered the full extent of the case as they had yet to fully deal with. The >> girl, watch him. Watch him. Come here, big girl. >> Come here, Lola. Fire on. Fire. Fire. Fire. HEY. RELAX. RELAX. RELAX. RELAX. RELAX. RELAX. RELAX. RELAX. RELAX. RELAX. OKAY. OKAY. >> All right. Relax. Relax. Come on, man. >> Hey, go ahead and bend one of your feet. >> Which one? >> Whichever one you want. >> I don't care about one. Just pick you up, man. Okay. >> Get on your feet. While the paramedics were working to place Jazui in the ambulance and transport him to the hospital, the officers turned their attention to the child, placing him in their patrol car and trying to find someone who could take care of him. And as the investigation continued to move forward, important details began to emerge. >> Currently, >> okay, I'll I'll see what I can find. >> Yeah, that's not it. Where does it start? Okay, look. I don't know. Barbosa, do you say they did have a tag or they did not? >> They did. They did. >> We'll see after we sort all this mess out, we can make contact. >> Okay. >> Okay. What's that? >> I was driving by earlier. >> Okay. >> And I saw the a fight going on. >> Okay. >> And but I didn't have a phone. I was going to go to Denellan police and I saw you guys coming by. >> Okay. >> And I had seen that Lincoln parked earlier. >> Okay. around 5:00. >> Uh, just parked there. >> Yeah. >> Okay. >> So, I thought it it would have broken down. >> Okay. >> So, I didn't think anything of it. >> Did you actually see the fight? >> I saw Yeah, I saw it was a >> Chevy truck or a GMC. >> Well, what what color? >> White. >> It was white. >> Yeah. >> Uh, it was a taller truck lift kit. >> Okay. >> And the guy was like a semi blonde. >> Okay. And he had um I'd say he was maybe 6 foot >> and then it was a shorter guy. >> Two guys. >> Okay. >> Hitting whoever was the driver of the Lincoln. >> They were hitting him. >> Oh yeah. I mean >> was he hitting them back? >> He was on the ground. He was trying to defend himself. >> Okay. >> From what I could tell. >> Okay. >> He was trying to defend himself. And the this dog was just in the back seat slightly looking. And I believe there was a woman. >> I think it was a woman. I couldn't tell sitting in the passenger seat, but she was just >> sitting there. She wasn't doing anything. >> According to the witness, Jawway wasn't alone in the car at first, but was with a woman. However, no sign of that woman or of any of the men had fought with was found at the scene. Even though this might have seemed to complicate the officer's investigation, they soon began to uncover evidence that shed light on the case. While one officer was collecting the money thrown onto the road, other officers searched's belongings and there they found an amount of illegal contraband that together with all the money recovered told a story of its own. Yeah, >> I've got probably seven grand in my hand, if not more. >> Yeah. >> Um I am going to still do a sweep down to where I started on the other side cuz I only checked that side of the road. I haven't got all this side yet. Here, I'll hold on. So, so it's all in one spot. Check under the cars, too. There's another one that was just laying underneath. >> You found some signal one? >> Yeah. Uh it's in this bag. It's a lot. >> If it's small, it's traffic. >> It's It's not a small amount. >> OMC. >> Yep. OMC. >> Yeah, dude. That's why I'm like OMC. >> You're doing this in front of your kids, man. Come on. >> No, that's So, um >> Oh, there's a charge calling the dogs. Do we want to make uh drug units aware of all that or do are we going to just work that as >> I haven't seen how much it is. >> The money is a lot. So the the actual >> I'm going to bring it over here so we're down the road. >> Um >> so if it's it's uh >> oh there it's definitely traffic >> but I don't know what it is. >> Okay. Is it rocky? >> Is it powder? powder. More like sand. Could be. Could be. >> Could be. Could be. Kind of looks like cocaine the way it's >> Yeah. >> powdered up. >> Powdery. >> Yeah. It's It feels sandy. I'm not going to manipulate it too much. It's dropping. >> Yeah. It's dropping. >> Yeah. I just need to know how to fuel it. >> All the little baggies. >> So, we haven't even searched the car yet. No. >> No. Um, did you get your pocket bag? [laughter] >> Yes, I got it. It's uh It's right here. Okay. >> Got to get out before all this. Yeah. >> I saw the money. Oh, you just throw money away. >> Uh, literally just throwing money away cuz it was all up and down the >> leg right over here by the car. >> I I I would even be shocked if there's some underneath. We'll have to wait till we move all the cars and everything. >> Yeah. >> Um, all righty. Hey, we appreciate it. >> Of course. >> Anytime. >> What the officers found was later confirmed to be 8.4 g of fel along with contraband packaged and ready for distribution. And as [clears throat] the investigation continued to unfold, they also discovered a breath case and written instructions involving chemical agents. A finding that only deepened their concerns about Josuer's involvement with narcotics. But whatever's plan had been that day, his encounter with the police ultimately dismantled it. And in the end he was charged with battery on a law enforcement officer, resisting arrest without bodily harm, trafficking in 4 gs or more, and possession of illegal contraband.
