In White Hall, Ohio, detectives executed an intelligence-led sting, intercepting a cash courier collecting proceeds from an active elder fraud scheme. The victim had already lost $20,000 in a prior handoff. Four constitutional questions govern this operation: probable cause, search authority, bystander detention, and Miranda compliance. Three were handled correctly. One was not. On probable cause, officers directly witnessed the exchange in real time, corroborated by pre-operational intelligence. Under Illinois versus Gates, 1983, the totality of circumstances test is satisfied. The arrest is constitutionally sound. On search authority, United States versus Robinson, 1973, authorizes a full search of the arrestee and items within immediate control incident to a lawful arrest. The cash is clean evidence. On the Uber driver, Terry versus Ohio, 1968, authorized the investigatory stop. His corroborated account eliminated suspicion. Release was legally required. Officers acted correctly. Where is your Uber information in here? Like your information, in case we want to get your records or whatever. What time did What time did they ask for the Uber? Can you tell what time? When I be >> When When he requested the Uber? This maybe 20 maybe 15 Is Is it on there? Yeah. Can you show me? Where where it's at? What what do you Like what time you picked him up or whatever? The map for my map or for the guy? On on here, yeah. For you that you you for your map for him. Like what time did he request the Uber? Oh. Can I end the finish it? Yeah, I'm going to go. Yeah, finish it. Come on, officer. So, um these guys were involved in some kind of scam. So, they were trying to scam this lady over here. So, that's why everything happened. All right, um a detective might call you to talk to you about it, but I think I got most of the information from you. So, um as of right now you as soon as they move you can get out of here, okay? All right. >> Okay, thank you. Thank you. All right, so the phone is dead now. So, then I'm going to move it when he gets back on. So, obviously I'm Detective Kubinski with the Whitehall Police Department. I deal in fraud. I think he is. Um I am familiar with this scam, okay? And someone else at another agency uh informed me what was going on, okay? This This is uh Make sure it's all the way up here. This is uh you know, something that's overseas, okay? So, but obviously I'm going to get your money back. How much money did you spend on the gold bars? I didn't buy any gold bars. What did you buy? I went to the bank. So, your money, how much money? It was $29,000. $29,000? And what they did was they told you that uh your bank account had been compromised and you needed to put it somewhere? Or what was >> No, I I was talking to someone from He's from the the apartment. Is that trick or treating? Mhm, okay. Okay. And snow. Yep. And I've already Where do you live by chance? I live in >> Okay. So, right across the street from that apartment. Yep, okay. Okay. And um What did he tell you? What did he tell you? Well, I've already done a drop off. And what's Same people pick up? No, this was a different person. So, you've already How much did you drop off the first time? $20,000. $20,000, okay, that stuff's gone. Cuz that It's all coming to my bank account. Yeah, I'm not I'll be able to get your 29 back, but I'm not going to be able to get your $20,000 back. Because you moved the cash, right? So, I can't trace cash. That's what I was told to do. I know. I know. Yeah. Uh well, at least it's not it wasn't gold bars. Um okay. Well, sit tight. When he gets back on, you can tell him everything. You gave him money. I just want to go home, stuff like that. I'll be right back to talk to you, okay? Okay. On Miranda, this is the operations critical vulnerability. No advisement is audible before officers engage the suspect post arrest. Miranda versus Arizona, 1966 custodial interrogation requires prior advisement. The suspect was handcuffed in a patrol vehicle. He was in custody. Any unwarned statement is presumptively inadmissible. On charges, Ohio Revised Code section 2913.02, theft by deception with the elder victim enhancement under subsection B3, elevating the felony by 1 degree. Federal wire fraud under 18 USC section 1343 applies because the scheme used interstate communications from overseas. Money laundering under 18 USC section 1956 follows. He is a named courier, not a bystander. Whitehall PD and Detective Kabinski receive an A- minus. Intelligence led execution and clean evidence preservation reflect best practice. Deductions, no audible Miranda advisement, and an extended post-arrest lecture that created unnecessary suppression exposure. The suspect receives an F interstate travel to collect fraud proceeds from an elderly victim. The network had already extracted $20,000 before intervention. No mitigating factors apply. The Uber driver receives an A cooperative, consistent, verifiably innocent. His detention was lawful. His release was required. Did you get a picture of this? Uh yeah, big one. Put it Do you feel like you're sending a video? Just go with this. You get the lights. Cool. 29. >> Did you get a camera? Dusty got it. Are we thinking this Uber got driver that knows nothing? I think so. You think he knows? No. How much cash is it? 29,000. It's your auto. Yeah. Hey, did you get it? Sorry. Who are you? >> [music] >> This is my phone. Do you think I can have it now? Huh? This is my phone. Do you think I can have it now? No, we're taking that. That's our phone. You'll probably never get it back. >> [music] >> Never? No. We're going to write a search warrant and dump it. I'm not even from >> [music] >> Who are you? I'm not even from here. Huh? I'm not even from here. Who are you? >> [music] >> What's your social? >> [music] >> Here's how this is going to work. You're going to sit in jail until you tell somebody who you are. So, if you got to sit there for the next 20 years, you're going to be John Doe, that's who you will be. >> [music] >> Hold on. Let me finish my spiel. All right. So, it's going to be uh a situation here. You understand? Huh? You know what I mean. You come out of these cuffs. All right, they're not tight on you. All right. Yeah, you come out those cuffs, we're going to have some problems. Yes, yes, yes, yes, you're grown. You're over 18. This is what happens when you do stupid stuff and you make a dope decisions. Do you understand? Well, not necessarily. Just keep your mouth shut. Just go in and do what you got to do and you're going to be all right. Huh? Well, hey. What do you do? All right, we're going to stand right here. We're going to go to the left here. Just stand by. Okay, come on. All right, brother. Come on. Well, now the sad thing about that is, you know, again uh this is where you got to make a decisions, you know? What do you want to do? You're only 115 lb, right? Everybody in jail is 230 and 300 lb and you know, we're going to walk all the way around the back here. You know? So, when you make a decision that can cost you your livelihood, make a decision that can cause you to get in jail, you know who can you be mad with? Nobody but myself. You damn skippy. You understand? So, let this be a learning lesson and let it be, you know, a learning experience and you would never do it again. Now, again you live in Georgia. You up in Ohio someplace. Anything happen to you, your mother would not know nothing about it. Am I right? Some people don't have ID on them because they feel, well, if I got ID on me, they know who I am. You get killed up here because of something stupid now you'd be missing. You understand? Now, how you think that make your mother feel that she can't find you? You haven't called, you haven't returned the call, don't nobody know nothing. Am I right? Now, you're missing. You understand? But yet, you went and did someplace we don't know nothing about it until somebody smell you, right? Which it does happen. You understand? Now, you decompose and whatnot, and bam, you know? He ain't got no ID on him. We do a John Doe. Do you got dental insurance? Do you have dental records? So, they will pull, you know, your dental and trace you that way. If you have fingerprints, they might trace you that way, you know? And then, that's when they do, you know, your mother might put a uh hey, I've missed a son is missing, and it trickles up here. You're like, oh, shoot, this is like the guy that he she might be looking for. Now, she got to come up to Ohio. Am I right? To identify what's left of you. That's if they find you. Now, it might be 10 years before they find you. What happens then? Now, you just Well, damn. Well, what did he do? Well, he hang out with the wrong kids. He's a good kid. This that and another. He wanted to be a rapper and this that and another, so on and so forth. He just get mixed up with the wrong people, blah blah blah blah blah. You know, it's not worth it. He only 20 years old. You understand? You're not even old enough to carry a gun yet. You understand? And you're making adult decisions that get them in trouble, you know? And they can go to jail for life if they don't get killed. You understand? And here you 20. I wish I would have left I'm completely left Cleveland and went to Georgia without nobody knowing, you know, where I'm at. And doing something silly and dishonest where you get arrested. You understand? So, I can only preach to you, you know? But, it's going to be up to you if you absorb and realize what's going on. As of now, you're scared, you know? Cuz you don't know what's going to happen once they close those cells on you. You just You just see I say you're just another You understand? So, I know a few people down there. Hopefully they will, you know, take good care of you. Watch your head. All right, I have to put the seat belt on you just in case if I roll this thing, you can't say that you weren't seat belted. Have you ate? I can't even get up in this thing. Lessons. Miranda is not procedural courtesy. It is a constitutional requirement with direct evidentiary consequences. Advise before any post-arrest communication. Post-arrest silence protects the case. The lecture does not. Build prosecutions on physical evidence, not unwarranted statements. For the public, no legitimate agency, not the FTC, FBI, or Social Security, will ever instruct you to withdraw cash and hand it to a stranger. That instruction is the signature of a fraud. Hang up. Call your bank. Report to reportfraud.ftc.gov. Let us know if there is an interaction or legal topic you would like us to discuss in the comments below. Thank you for watching.
