Once that request is made and a trespass warning issued, continued presence is criminal trespass, not negotiating position. Resisting without violence under Florida Statute Section 843.02 does not require physical contact. Verbal non-compliance, deliberate delay, and failure to obey a lawful command are sufficient. Every which way, followed by refusal to move reinforce this charge. The taser was drawn, not deployed. Under Graham versus Connor, 1989, that decision is judged from the officer's perspective at the moment, not in hindsight. Given repeated non-compliance and physical encroachment in a confined space, the display falls within accepted use of force continuum. The officer's immediate acknowledgement of the mandatory R2 our report reflects proper procedural awareness. The disorderly intoxication charge under Florida Statute Section 856.011 is the weakest. The statute requires documented endangerment or public disturbance while intoxicated. The employee's testimony that the subject might have been intoxicated but seemed like that type of person is speculative. Courts require objective indicators, slurred speech, impaired coordination, odor of alcohol. Without them, this charge is vulnerable. The employee discarded the subject's boarding pass during an active dispute. The refund was already issued. The transaction was complete. Disposing of a personal document served no legitimate purpose and escalated a situation that was legally resolved. It does not negate the subject's obligation to leave, but it directly contributed to his refusal. Poor judgment from personnel in a security-sensitive environment. >> I got to miss the last grace. You guys are broke. No. You own your house? Are you buying your >> You're talking to the wrong guy. I don't really care what you say, what you want. You're not impressing me, okay? I've been doing this too long. You're not impressing me. Don't really care. Perfect. >> Also. >> Can you shut your mouth, please? >> Are you buying a house? That's That's outside the plan. Are you paying for your Are you paying >> Show wants one copy of photo driver's license. Got 10-15. >> Amazing. >> That breath thing. Yeah, you know that one. Fake Latino right here. >> Well, this one >> Tiene que ser boricua, like Coca-Cola. Right here. Put your key on the ignition. There's no way waiting at the curb side. The curb side is for customers only. You have a seat, big guy. It's a smaller guy for you. Either way, if you get in by yourself, it's a lot easier on you. Cancel order. Coca. 23. Cancel order. On a week basis. On a week basis. You know it, I know it. We're going to buckle you in for your safety. We want to make sure you're okay. I'm already here. We'll going to you're okay. >> Let's go, man. All right. >> Sir. >> Alex, how did it all start? Just want to listen to you. >> Yeah, so he was giving Hold on, let me close the door here. He was giving Spirit a hard time when I come up. He's already on the phone arguing. Spirit says, "We We gave him a refund. We just want him out of here." So, I was like, "All right, let's let's go, buddy." my boarding pass. I said, "But they gave you a refund." He's like, "I want my boarding pass." So, I said, "Okay." I gave him his boarding pass. I gave him the boarding pass. I'm like, "Here you go, sir." He's like, "I don't want that I'm like, "Okay, do you want it or do you not want it?" He's like, "I want it." I said, "So, here you go." That's why I just want to take his boarding pass. So, he said something like money money You need to stop. Get out of here or you're going to get arrested. Oh, wait. He started mouthing off again. He doesn't want to leave. something. I said, "Stand back. Don't come close to me." But if he does it again, so I pull out my taser. I said, "You're going to get the [ __ ] out of here right now." >> I didn't pull a taser. >> I pulled a taser. I said, No, no, no. I definitely have to do an R2R. I said, "You can you're you're you're right now you're being trespassed. You got to leave the airport." I'm not going nowhere. >> So, do you hereby voluntarily make the following statement without coercion or benefit or favor by any person whatsoever? >> Yes. >> Okay. So, tell me what happened. >> So, he came up to get a refund. And then he was just very loud and just high energy already and he wouldn't really let me get a word in. And just how they all are is being dicks. And just like wouldn't let me talk. So, I of got frustrated and I told him do you want to rebook or you want a refund? I never really went anywhere and he just got angry, started like talking crap to this person in Spanish that was on the phone. And I got new that. So, all it I was sick of it, so I just refunded him and told him to please get out of my life. And then he just wasn't he was being loud, wasn't um wanting to move away. >> Even after you told him to get out, he was saying he wouldn't move. >> He said, "I'm going to stand right here. I'm going to stand right here until you want to help me." >> Yeah. I think I remember I think I was walking up towards when I cuz I heard him say that. So, I remember that. And then that's when we came. >> Yeah. >> Um Do you Was he um Do you think he was maybe intoxicated or anything like that? Maybe um >> Um honestly, he might have, but he probably just seemed like that's the type of person he gets in like I know you can say I'm crazy. I've gone here before. Like that. So, I don't know. >> Okay. And then you guys called Who called? Do you know? >> Um I don't think I I didn't call. I was dealing with Someone called. >> Okay. But you did refund him, correct? >> I didn't want to deal with him anymore, so I I'm just going to refund him. I don't care. >> There was no other business after the refund, right? >> I threw his thing in the trash can cuz he kept throwing it at me. So, I threw it in the trash can and that's when he was like, "I want my ticket." And then they were like, >> The paper? What was it? Was it a receipt or whatever? >> No, it was like his boarding pass from the other flight. >> Did he throw it at you or he just threw it like >> I gave it to him and then he just kind of like tossed it and then it flew at me. >> Okay. Did it hit you? Okay. Yeah, that's all I need. Um yeah, obviously he was arrested, so >> Sick. >> That's all. You'll be able to leave a report. >> I'm so sorry. >> No, no. Don't be sorry. Listen, we can't You're in a public place. You're This is the airport. You You got to act accordingly. So, you're good. All right. I won't keep you any more. Enjoy that overtime money. >> Okay. >> Officer Alex, BD escalation consistent, post arrest procedure sound reporting obligations acknowledged, deduction taser display occurred off frame, justification relies on verbal account alone, a documentation gap with real consequences in any subsequent review. Spirit Airlines employee C plus, appropriate to call for assistance, discarding the subject's property and providing speculative intoxication testimony weaken the case she initiated. Subject C, no physical resistance that mattered, but the trespass and resisting charges are fully supported. A resolved refund dispute became three criminal charges by choice. Three takeaways. One, in a commercial airport a trespass order is final, no further negotiation exists. Two, charging disorderly intoxication without documented objective indicators invites dismissal and civil exposure under section 1983. Three, service personnel in high conflict settings must be trained to avoid provocations. Discarding a customer's document during an active confrontation is exactly the kind of detail that complicates an otherwise clean removal.
