On July 25th, 2025, officers responded to a vehicle crash involving two women who both admitted to driving while intoxicated. What this footage presents is not a simple DUI stop. It is a dual operator arrest, an implied consent question, and a mental health crisis, all in one encounter. >> Hi. >> Hi, B. >> Hi. >> Can you talk to me? >> No. >> Yeah. >> I don't know what's going on. Okay. Um was anything wrong with the car? >> No. >> Okay. What caused you to hit the sign? >> We hit it. >> Um I was telling her to turn and she just >> Okay. Were you stopped at the stop sign? >> Yeah. >> Okay. And then you guys were trying to turn that way. >> Uh this way. And then she turned straight and then that's when I took over. >> No, that I understand. Who the [ __ ] these people? >> I understand. I'm just trying to understand what happened. >> Who the [ __ ] these people are? >> Like I said, just ignore them. Okay. >> The cops are Sometimes the cops are cool, but sometimes it could be [ __ ] >> I know. >> I'm not saying you're >> No, you're okay. I'm just trying to understand what happened. That's all. Okay. Okay. Um, so you were stopped at the stop sign and you wanted her to go right and then she just went straight. >> Okay. Do you know about how fast you guys were going? It's my Monday, so Yes. >> What's your name? >> What's your name? >> I'm not sure. >> My name's Trista. >> Trisha. >> Yes, ma'am. >> You're so welcome. >> That's a pretty name. >> Thank you. What's your first name? >> My name's Joanna. >> Oh, very nice. That's pretty. >> I would be so disappointed, >> bro. stay here. >> But you know, you only live once. >> The best thing is nobody got hurt. >> Exactly. >> High five to that girl. >> Give me just a second. Okay. >> What's your name again? >> Trista. >> Trista. >> And then did they get your guys' driver's license and all that stuff already? >> I think he has my ID. >> He took it. Did he grab your driver's license, Juliana? She has her ID, but she is 20. >> I have a picture of my ID if you want that. If you want that so bad. >> Um, okay. >> I I really want >> Do you have your driver's license number? >> Do you have it memorized? >> Yeah. Can you >> Your phone's right here in the cup holder. >> Let go though. >> Um, is it cool if I grab it? >> Uh, other side. >> Yeah, for driver's license over there. >> I can't grab it. Like, you're okay. What's your name again? >> Trista. >> I need I need >> Okay, give me just a second. Okay, >> you're cool, though. Have fun. >> I'm sorry. >> No, you're okay. >> Like, I don't know. I don't know how teens are supposed to have fun, but I I've been through so much. >> Did they get both of their driver's license? >> Mine? >> Just yours? Oh, not hers. Okay. >> Talking to She was talking to her partner. You have to put in your password so I can find your ID. >> No, she's supposed to talk to me. >> She is talking to you, but she's talking to her partner as well. >> That hurts. >> I know you, but it's okay. Can you put in your password or No, >> I don't remember. >> That hurts to a deeper cuz I don't know these two. >> That's okay. >> Like I said, just ignore them. Okay, you're just talking to me. >> But it's like they know what I've been through then. >> When was the last time that you guys had anything to eat? Um, I ate like 24 hours. I haven't played [ __ ] >> Would you Would you eat? >> She hasn't ate anything today. >> Oh, you do have it. Oh, perfect. No, you're okay. >> But um >> Oh, that's your ID card. Okay. >> Can I go pee? >> I really need >> When was the last time you had anything to eat? >> I haven't. >> She hasn't ate anything. Okay. >> Okay. >> I'll eat this glass if you want to. >> And then are you pee? I just see a man in the corner and then I see a man over there. >> It's okay. >> What was that? >> I I'm >> sure I have her ID card. >> You want me to give you my ID card, Julie? You don't even have your ID. >> Uh, you said you didn't have it. Do you have your ID card, >> Julie? Hey, do you have your ID? >> Like an ID card? It looks like this. Do you have one? Like this one? >> An ID? Like an ID card? Do you have an ID card? No, she doesn't. >> Okay. Okay. Thank you. >> I mean, I'll go pee if you want to. >> Just try to hold it a little longer. Okay. Give me just a second. Okay. >> I I can. >> Thank you. I appreciate it. All right. You're all set. >> Can I give you a hug? >> Not right now. Oh, be careful. >> Would you guys be willing to do a pass, like blow on a pass to see what your blood alcohol content is? >> Okay. Are you able to walk? >> Yeah. >> Okay. You can go ahead and have a seat right there again, my dear, so you don't fall in the driver's seat. >> I promise I won't um What if that work? I promise I won't. Um >> you can have a seat right there. Okay. >> I know what I'm doing, but I'm just worried about her. No, I promise, guys. Worry about >> Can you just have a Can you have a seat right there in the driver's seat for me, my dear? >> You go, Grace. Just so you don't fall over. >> Sit in the passenger. You sit in the driver. >> Can I have you sit right there, please? >> I'm going sit in the passenger. >> She'll meet you on the other side. Okay, >> Juliana, can I have you sit right here for me? >> Are we getting arrested? >> No. Come on. >> Yep. >> We're not going to do this. Okay. >> Don't put her back in the car. >> I love you. >> Oh, okay. >> Don't put her back in the car. >> We're going to I'm going to have her walk back to the back of my patrol car. Okay. Uh I can Well, you can help her. We can both do it. We'll walk her back over there. I get arrested and I'll build myself out. >> What the [ __ ] >> No, I myself I'll build myself out. But if I build myself out, can I get your number? >> Oh, be careful. We're going to walk to the back of the car. Okay. >> What's her name? >> I don't know. >> We're going to go on this side. Okay. Yep. Please. Just so we're not in the way of the road. Perfect. And you can lean up against the car. Okay. So you don't fall over. >> Come on. Right here. Right here. Get up. Okay. >> It's Do you want to sit on the ground? >> No, I can sit. >> I'll just have you sit down. Okay. >> No, I can stand. >> You don't want to sit on the ground for me right here on the asphalt. All right. And then this is the PAS device that I talked to you guys about. It's just to test your blood alcohol content. Okay. It's not the chemical breath test. So, if you are um arrested for driving under the influence, you'll have to do a chemical test as well. Okay. Are you hearing the tree? >> They are. Yes. >> I was just >> Mhm. Sorry. >> No, you're okay. Where do you live at? I know you're visiting her, but where do you live at? >> I live in Elkrove. >> Elkrove. >> Very nice. >> Yeah. >> No, you're okay. Do >> you guys work? What do you guys do for work? >> I just started a job. >> Very nice. >> I Oh, that's cool. >> Yeah. You know how life gets though. >> I do. All right. I'm gonna have you take a big breath in and you're going to blow out. You're going to put your um lips around this straw like you're blowing up a balloon. Okay. So, go ahead and give me a big breath. Thank you. No calm. Where are your parents? Why' they leave you alone? >> Um I just got out of the break room. >> Okay. >> I came out here one or two days ago >> by yourself? They just left me today and she came over and they started drinking. >> That's why I came to see her. >> Okay. >> Which is fair. I understand. That's crazy that your parents left you alone out here. >> I mean, I'm 21. I'm >> Oh, okay. And I'm But you're okay. I don't care. But she's beautiful. >> All right. Same as just take a big big breath in and then blow out. Keep blowing. Keep blowing. You're going to have to blow super hard. Okay. >> So, blow in or suck in and then blow out. Keep going. >> It's going to have to be like you're blowing up a balloon. Okay. So, take a deep breath in and then you're going to exhale everything you have. Okay. >> Okay. >> You're going to have to seal your lips around it and blow out. Okay. >> You're sucking in, my dear. You got to blow out. >> Oh, I'm so sorry. No, you're okay. There you go. Keep going. Harder, harder, harder. Thank you. Are you okay? >> I'm fine. Like I'm just going to test. >> You're going through. >> So you were driving at one point. >> She tried to reverse off the fence, but she was driving when I hit it. Yeah. Neither subject was Miranda before the initial questioning and they did not need to be. Miranda versus Arizona established that warnings are required only when a person is in custody and subject to interrogation. At the scene of a crash, neither woman was yet under arrest. Their statements were voluntary, made outside of custodial interrogation, and fully admissible in court. The dual driver scenario is the central legal challenge here. Trista claims she drove the entire time. Juliana admits she drove and crashed into the fence, at which point Trista took over to attempt to back the car out. For a DUI arrest, officers need probable cause that each individual operated the vehicle while impaired. Both women satisfy that standard independently through their own words before any test was administered. The officer correctly distinguishes the PAS device from the evidentiary chemical test, and this distinction is legally critical. The preliminary alcohol screening result is investigative only. It cannot substitute for the statutory chemical test required after a lawful DUI arrest. Under the implied consent doctrine codified in all 50 states, a driver's license is issued on the condition that the holder submits to chemical testing upon a lawful arrest. The Supreme Court in Birfield versus North Dakota confirmed that a warrantless breath test incident to a lawful arrest does not violate the Fourth Amendment. Blood draws are different. They require a warrant absent exigent circumstances. The officer's offer of both options here is constitutionally sound. Officers reference a result of.20 a blood alcohol content of20 which is 2 and 1/2 times the legal threshold of 08 applicable in all 50 states. At this level impairment is not a question of interpretation. It is a matter of record. >> Okay. >> She's definitely going to go >> she say admitted to driving it too. But we still have no definitive proof that neither one of them are driving it. But they both admit to driving the vehicle. >> Correct. >> So you're going to have to do what we talked about, right? Based on their statement. She crashed >> and that she tried to drive out. >> She's got the straight deuce. >> You have second. >> I've asked them. I haven't got a second. Thank you. >> Why don't you have an one? Can you only give me one? I'll >> All right. I'm gonna have you go ahead and just turn around for me and face the patrol car. Thank you. >> All right. So, I am going to be placing you under arrest for driving under the influence. Okay. >> I I don't care. But if I get stabbed, that's all you guys. If you [ __ ] let a [ __ ] stab me. >> Oh, hold on a second. Okay. >> I'm I'm not playing though. If you let a [ __ ] stab me, that's all you got. >> No, I'm not [ __ ] playing. If you let another [ __ ] stab me. >> No, she can't. She can. What the [ __ ] >> Stop moving for just a second. Okay, >> I'm not looking. >> I know. I know. >> So, we'll put her in that car. >> Okay. All right. I'm going to put you in that car over there. Okay. Please stop. >> Okay. All right, Juliana. We're going to go into this car. Okay. All right, we're going to go this one. Okay. >> Um, say if a [ __ ] person, >> I'm going to blame it on you guys. >> Can you sit up for me, please, Juliana? Please. Here, I'll help you up. Okay. >> Okay. >> Thank you. 1 2 3. We're going to sit up. Okay. Ready? 1 2 3. >> Just give me a moment, please. >> Okay. I got to get you seat belted, though. Okay. Somebody touches me. >> I have myself. >> Okay. Thank you. >> We're going to put her under. >> Okay. >> That way at least I have a conversation. >> Okay. Fair enough. >> All right. All right. So, I'm going to place you under arrest as well. Go ahead and place your hands behind the small of your back. Michael's touching. Thank you. She did get from her car, but to a different fine. It's okay. You're fine. Um I think the driver pass. >> I do have a wallet right here. >> Um I think there's also a phone on the floorboard. >> This is her phone. And then you guys have my ID. >> It's on the driver side. >> ID about the chemical test real quick. Okay. Are you willing to do a breath test out here for official results or do like a blood test? >> Um, I don't feel good with needles, so we can do. Okay, >> get her breath test. >> Okay, >> this is the other one that's because we're going to try to keep them together because she's helping her stay calm. >> Yep. >> I don't have a card for that. >> That's fine. We're have a seat in that car. We'll deal with that right now. That way, if you guys need to take my beverage card and stuff is okay. >> We just want to make sure you got no marijuana. She might have like a pre-roll >> on her uh >> like stuffed anywhere. >> No, no, no, no. But like in her bag, she might have a pre-roll. >> I'm not worried about it in the car. I'm worried about on you guys. >> No, no, no, no. >> All right. We're going to set this up for you real quick. We're going to put you on the other side. That way we can talk with her. >> Yeah. >> Um should we set this up first and keep her out or put her in the back seat right now? >> Okay. I'll have you walk around this side. Thank you. >> You have her ID? >> I do. Yes. >> All right. And then you're just going to sit right next to her for right now. Okay. And I'll come and get you in just a minute. Okay. >> Okay. >> Okay. Here's your Here's your phone. >> Here's your phone, Juliana. >> Phone's right here. Okay. >> Yes. [ __ ] me. >> I'm going to Do you want to [ __ ] care? >> We got to take you to get medically cared. Okay. >> I'm just going to put it on the next go to hospital. >> They're going to take you right now. Okay. So, go ahead. Can you put your feet in the car, please, for me? Come on. >> Okay. Hey, I Hey, we're going to take you to the hospital, okay? I'm going to ride with them. Okay. >> I really want you to get out of this [ __ ] >> Yep. Sounds sounds good. >> You got it. Are you sure? >> Hey, Juliana. Juliana. [ __ ] you. >> Let me the [ __ ] out. >> LISTEN TO ME. >> NO, >> JULIE. JULIANA, your boyfriend. You need to listen to me. >> I don't care. >> Okay, I'll just Hey, Juliana. Hey, Juliana. Can I get you on this side for me, please? >> Oh, >> yeah. She was able to slip her hand out of it. >> Hold on a second. Hey, Juliana. It's just me. >> No. >> Hey, Juliana. I'm sorry. >> Hey, Juliana, it's just me. Okay, give me a second. Hey, let me fix this. Okay, >> that's why. >> Come on, Julie. >> You need to compromise. >> I'm sorry. >> Hey. Hey. >> It's just me. Okay. Give me just a second. Okay. >> Yeah. >> Can you just give me a second, please? >> Okay. Come on. I got to get you out. Okay. >> No, that's that's fine. Hey, can you step out for me, please? >> Yes. I I promise. >> And then just so you're in the hospital, I'm going to put this other one back on you. Okay. >> I'm sorry. >> No, you're okay. >> When Juliana states she wishes she were dead and asked to be shot in the head, these are not figures of speech. They are indicators of acute suicidal tiation, and they trigger a separate legal obligation that does not pause because an arrest is in progress. Most agency policies and an increasing body of case law recognize that a subject expressing imminent self harm must receive a medical evaluation before processing. The decision to transport Juliana to the hospital is not only appropriate. Depending on jurisdiction, it may be legally required. Officers who ignore this exposure their agency to civil liability under section 1983 for deliberate indifference to a serious medical need. When Juliana slips one wrist from her handcuffs, officers respond without escalation. And that is the correct call. Under Graham versus Connor, force must be objectively reasonable given the totality of circumstances at the moment it is applied. An impaired distressed subject who is not actively attacking does not justify additional physical force. The measured verbal reseing here is precisely what that standard demands. >> You understand how it feels to just be used for your body? >> No. You don't understand. I wish I was I wish I was dead. >> I wish I had nobody. My mother is dead. That's the only cared about me. I >> like if you want to shoot me in the head. >> I'm so over there. I don't know your name. >> It's Trista. I still don't know it. >> That's okay. >> I'm sorry. >> No, you're okay. Like, I'm I'm >> That's okay. I understand. Yeah. You're going through a lot of stuff. That's a lot to go through. >> I'm sorry. >> Don't fall backwards. >> I I don't mean to put you through this. >> No, you're okay. I understand. You're going through a lot of stuff. Okay. Just try to calm down for me. Okay. >> My mom is going through so much right now. >> Yeah. >> And I'm the only one that pays bills. I have I have I have to go through so much. I have to sell my like they don't obviously they don't know it but I sell my body like >> to pay for your mom's bills. >> Yeah. Like that's a lot. >> That's a lot to carry. >> Like I don't want them I don't want them to be homeless. Like you know what I mean? >> Like nobody understands me. Nobody knows what I've been through. Yeah. And I'm not trying to put that on nobody else >> because I know how it feels to be a burden. And I I don't want to be a burden. >> I'm sure I'm sure. >> I'm so tired of being burdened. Like you you you don't even >> This could be a turning page though. This could be a new beginning, a fresh start. Maybe if I was dead. >> No, >> I have 10 grand. I guess I started my I started my first day. >> Oh, that's good. Did you like it? >> I did. I met I met a friend. >> That's cool. >> And I'm I'm not used to making friends cuz I'm so >> Yeah, that's okay. >> Who is that? >> That's my partner. That's the guy who's at the crash. He's >> Can I talk to only you, though? >> Yeah, we're talking. >> I feel safe with >> We're talking. Okay. >> I'm I'm so sorry. I don't >> That's okay. >> I don't mean no harm. >> You're okay. I understand. You're going through a lot. >> I really am so sorry. >> Should I I should just go to sleep? >> You can You can take a nap if you want to. >> You can lay your head down. >> Should I use the bathroom? Not yet. Okay. >> Yeah. Okay. Can I put these in front of me though because they really do hurt. >> Yeah. I can't though cuz my policy says that I have to have them behind your back. Okay. >> That's fine. >> Okay. Thank you. >> I'm sorry. >> No, you're okay. >> Sad. >> Yeah. >> Yeah. I get it. But you were telling me that's a lot. That's a lot for anybody. >> I'm sorry. >> You're okay. I just I just never had a person that like I don't to talk to like you know. >> Yeah. >> Like I' I've had to b up so much. >> Mhm. >> Like I've been raped. I've been like I can't I can't talk to somebody about that. >> There are people that can help you with that though that you can talk to. Not >> but I I don't know cuz I feel like if I use that against me. >> No. Not if you went and like sought help like somebody who could actually like like a doctor or something. They could help you with that. Absolutely. They're not going to. Good. Make that clear. >> Okay. >> All right. It's clear. They're not going to touch you. Okay. Good. >> All right. I'm going to get you in this car. Okay. Ready? >> Yeah. >> All right. Go ahead and sit. >> Can you put her first? >> Oh, she's going to go and meet you on the other side. Okay. >> Can you put her first? >> I'm going to put you first so I can put my seatelt across you. Okay. >> Can you put her first? >> Is that the only way you're going to go in the car? >> Yes. >> Okay. If she goes in first if she if you want to sit on the passenger side, I can buck alert myself. Okay. >> See, it's just >> That's okay. I told you she's going to go with you. Look, she's right there. >> She's my priority. >> No, that's okay. Look it. She's in the car. Okay. >> Okay. >> All right. Yep. You're good. I promise I'll cooperate. >> Okay. >> Thank you, promise. >> Thank you, Promise. Thank you. Okay. >> I'm not trying to >> No, I understand. >> She's my priority. >> Yeah, absolutely. Go ahead and take a seat. Okay. Watch your head. >> The inquiry about marijuana on the subject's persons is lawful as a search incident to arrest. No warrant required. Contraband discovered on the body of an arrestee is admissible. Items in a separate bag, however, would require independent justification. The female arresting officer receives an A minus. Her legal procedure is precise throughout. She correctly frames the past device advisment and builds probable cause through the subject's own statements rather than overreaching. Her response to Juliana's mental health crisis is the strongest element of this footage. She engages it directly, offers accurate information about confidential support resources, and makes the hospital transport call without hesitation. The A minus reflects only a minor coordination gap during the vehicle loading sequence. Not a significant issue, but cleaner officer communication would have resolved the moment faster. Trista receives a B. She cooperates, does not resist arrest, and her voluntary admission to driving, combined with a back more than twice the legal limit, constitutes the evidentiary core of her prosecution. Juliana receives a B minus. The partial handcuff escape and volatile behavior create legitimate officer safety concerns. However, her cooperation once trust was established was genuine, and context, including severe personal trauma disclosed on camera, is a factor that cannot be ignored in any honest assessment. Three takeaways from this encounter. First, a voluntary admission at the scene before any arrest is one of the most durable pieces of DUI evidence an officer can obtain. It requires no device, no warrant, and no Miranda warning. Second, the payass device and the evidentiary chemical test are legally distinct instruments. Consent to one does not satisfy the obligation under the other. Third, suicidal ideiation expressed in custody is a legal trigger, not just a human one. Officers who respond to it, as seen here, fulfill the duty of care the law requires. Officers who do not expose their agencies to consequences that far outlast the arrest itself. Let us know if there is an interaction or legal topic you would like us to discuss in the comments below. Thank you for watching.
