Get his head. Just get his head. Let's go. I got him. Got it. Yelled at him. Yelled >> at the father. Yeah, she ran out here. Where was the father at the time? Sitting in the pool. >> This ain't real, bro. >> This ain't happening, bro. [laughter] >> This ain't real, bro. This ain't real. >> On July 26th, 2025, officers received a frantic emergency call reporting that a three-year-old boy had been found floating in a swimming pool. They rushed to the scene trying to understand how a so young could have ended up in the water without anyone noticing. But when they arrived, what they discovered revealed one of the most disturbing cases of negligence they had ever encountered. >> He was asleep. Sorry, they're here. I'm so sorry. >> Back up. Back up. Back up. Back up. Back up. Back up. Back up. >> Back up. >> Two or three. Starting CPR. >> I was doing that. >> Just back up. And Etsie's coming. You got to do faster than that. Here comes Etsy. Eie's here. Just pick him up, >> Dad. >> Dad, go with him. >> Get his head. Just get his head. >> Let's go. >> I got him. Got it. >> Yep. >> A hotel housekeeper working on the third floor happened to glance down at the pool below. To her horror, she spotted the young motionless in the deep end. Without hesitation, she rushed downstairs, desperate to pull him from the water. But when she reached the pool, she made an even more shocking discovery. Sitting on the pool steps was the 40-year-old father, Sharef Omar Smith, fast asleep, completely unaware that his own son was fighting for his life just a few feet away. >> We're going to get you to where you need to go with your We just need to get all the information. >> They're going to ask what's your name, baby's name. We can get that information. Then we'll get you down there with her. [laughter] >> No, this ain't real, bro. This This ain't happening, bro. >> [laughter] >> It's a real bro. It's a real >> This is not actually happening. >> Can I get a name if they >> This is This ain't really easy. >> What? What's What's your name, man? They just need a name and birthday for the medics. >> They're still working. They're still working on it. >> Uh Kai Smith. Kai. >> Yeah. >> How do you spell that? >> K I D N. >> Oh, Kaden. >> Yeah. Well, >> what's the birthday? >> Hold on. Uh >> call him. >> I need to call his mom. >> Is she Is she here, too? >> Not right here right now. >> It's a Kaden Smith. K I D E N. >> No way, bro. >> What? was Kaden's birthday. >> I don't know. >> You don't know Kaden. You don't know the birthday. >> She said that the one over there. >> Yeah. >> Blocked. >> And you can see like a little bit of a staircase right there, >> right? >> Where he was in the pool. >> Yep. >> Was down here. She came running around the corner right here. Came through the gate, yelled at him. >> Yelled at the father. >> Yeah. She ran up here, grabbed, pulled the out. >> Where was the father at the time? >> Sleeping in the pool. >> Sleeping Sleeping in the pool. That's what she said. >> From the steps, you can see him get up in the pool. >> What about the other worker or her? Is she the worker that came out here? She the only person that came out here want to come out here. She radioed for the manager to call 911. She's like, "What? Call 911." She called, she called us, came in here, grabbed it, pulled it out. Said she didn't know how to do CPR. >> What made her even come out here? She was up there cleaning bedrooms and she looked at the window and saw that floating in the bowl. >> Oh my god. And the maintenance guy ran over and attempted to see all the rest. >> The maintenance worker did. We got his information. >> For someone who was expressing disbelief and distress, the housekeeper had desperately shouted at Smith to help save his but all he did was wake up, looked at what was happening, and then without a trace of urgency or concern simply stood by and watched, offering no help at all. Even more disturbing, instead of rushing to his child's aid, Smith lashed out at the housekeeper, cursing at her for waking him from his sleep. >> They're on their way to homes right now, man. So, they're just still working on them. >> Where are you? >> Where are you, guys? Where are you? Oh my god. >> I told you. Oh my Oh my god. >> Hey, hey, hey, calm down. Slow down. Uh where they're taking them. >> They're taking them to homes. >> Is he breathing? >> They're still working on I don't know right now. I'm with you. So, >> we don't we don't know. [screaming] >> But we just we just got to figure out what was the time lapse like how long like what happened? Did he slip in? Where are you? >> I'm still at the hotel. >> WHERE ARE THEY GOING? MY GUY, >> they're going to Homes. >> Share. What the is home? >> Homes is the hospital. >> Share. He wasn't listen. Oh my god. I am coming. Oh god, where's my Where is my Where is my Jesus Christ? All right. Hey. Hey. Hey. >> Go. Hey. Go to home. >> Smith's wife told investigators that he was not intoxicated when she left the hotel earlier that day. However, she also revealed that he was a heavy drinker, raising the possibility that he had consumed a significant amount of alcohol after she left and was heavily intoxicated by the time the incident unfolded. Meanwhile, to piece together exactly what had happened, the officer spoke with the hotel housekeeper who had discovered the young in the pool. She gave a detailed account of the moments that followed, including the father's disturbing reaction to the unfolding incident. >> CPR, >> is that your stepdaughter or something? No. Now he's the one who witnessed him. >> But I seen him on the third floor and he'sing sleeping. >> Dad was sleeping. >> He was asleep. >> Do you have video of the pool area? >> I do, but it's not. >> Can I come around and look? >> You can come around, but I don't know if you're going to be able to. >> You're not going to be able to see what she told out. Too many bushes. But she said he was asleep over here and the little boy was floating over here. >> Oh, wow. >> Yeah. and she was the one who went out there and screamed at him and pulled the out of the water. >> He didn't even notice until I was pulling him out of the water. >> Okay. Um I know you're really upset and I understand that. But you know, they're working on her right now. Okay. They're taking her to the best, you know, trauma center. So hopefully she can recover. Okay. >> She's not she's not she's not passed away yet. >> So So, >> you called 91, you called 911. >> I called 911. >> So, between her calling 911 and you just saw the floating in the pool, how how long of time frame would that be? >> I don't know. She I saw her come sprinting down the out of this exit door right here. And when she about right here is when she got walking, she said, "Call 911." I repeatedly, I said, "What did you say?" She said, "Call 911." And I immediately picked up picked up the phone, called 911. Then she started asking me a million questions and I was like, "Listen, I don't know. All I know is they said call 911. I know there's a little boy and a dad or a little girl and dad outside." I didn't know it's a little he told me it was a little boy. Yeah, he told me it was a >> So, >> I thought it was a girl, but it's a boy. >> I don't know. All I know is they were the only two out there. So, I assumed when she said call 911, that means something. >> He was asleep. And like I don't mean like oh, might have been a couple minutes like nodding nodding. He was nodding on some sort of something. >> You grabbed the out of the deep end and pulled them pulled them out. >> Yes. >> Well, thank you for doing that. You're an awesome person for that. Okay. >> She's a mother. >> I just I'm trying to see if I can get anything. He just sat there. He wasn't trying to >> Dad was sleeping on the stairs in this in the in the >> and he the was in the deep end like like 5 foot 6 foot like right there where he was laying and I made I ran back there >> where he was laying when paramedics pulled up is where exactly where I >> I grabbed him by his arms and his leg is 5 foot. I broke a mic with me. [sighs] that was sleeping in the steps of the show. >> Yeah, cuz you can you can barely see them cuz there plants in the way, but you can see >> I thought I thought it was fake. I was like the swimming or something and the just wasn't moving, so I started running. >> I was in >> Can I have your first name? >> Caitlyn. This is when he woke up. If I go back >> and I zoom in. I don't want to speed it up cuz then you'll miss it. >> Where's he at? >> He is. >> Sorry. They're in motion. So, they only go by motion. You You can't see his body, but he's right here. You'll see when she runs over in like about 30 seconds. Here she comes. Right. You'll see his body move like, "Oh, my son." Here she comes running around to come see a girl. >> I kept screaming by the time by the time I see him. >> There he is just now moving. Oh my >> god. Yeah. >> And then you can't My bushes are too thick, so you can't see. >> If your was right there, it wouldn't went all the way to the deep end, >> you know. >> Meanwhile, the officers arranged for Smith and the 14-year-old sibling to visit the hospital where the boy had been transported to join the mother. It was at the hospital that a drug recognition expert requested a voluntary drug evaluation, which Smith declined, making it as clear as day that he was in fact highly intoxicated. >> My dad, >> I have more problems. I have bigger problems. I have bigger problems than your ego. >> You know, whatever. Come out here, dude. Stop. Stop. Stop. Stop. Whatever you go Jesus, >> sir, if this is like if I'm not under arrest or if I'm not anything like that, I really don't want to dwell on this. >> You don't want to talk to us about what happened? >> I mean, if there's I mean, what are you guys here for? I mean, hold on, sir. Hold on. If I may. >> Uh, the the police are here for us. You guys didn't save his life. you guys didn't, you know, like there's no reason for it. >> So, this is what I'm going to do. >> If you don't want to talk, just say you don't want to talk. >> Okay. >> All right. >> I do appreciate you, though. >> No problem. You You have that right. >> Um, you know, most most of these things that happen is an accident. You know, most parents in the world do not want to, >> right? You know, so I understand your concern and I'm going to respect that. Okay. Um, you will have another detective probably that's going to reach out to you at some point, but we have to know what happened. >> Yeah. >> Okay. >> Can't go into the jail. Nothing. Smith's refusal to undergo a evaluation or answer the officer's question regarding the incident gave officers enough probable cause to take him into custody without bond. During the investigation, they also discovered that he had an active arrest warrant in Georgia for driving under the influence. Tragically, the little boy was taken off life support the following day and succumbed to his injuries. In the wake of his death, prosecutors upgraded the case, adding a charge of aggravated slaughter of a young person to the existing charge of act causing great bodily harm. As of now, Smith remains in custody and [music] the case is still pending before the court.
