Don't let her touch me. >> Turn her off. >> Don't let her touch me. Don't >> She's going to pat you down. >> No, she's not. Don't Don't touch me. >> Where's my Do you have anything on you that could touch me? No, I do not. >> Please look forward, ma'am. Thank you. >> No, I don't. I know you wanted to touch me. Yep. >> Stop, Christina. >> No, you need to stop. Like, I did not do anything. But you're being racist. Like, just stop and leave me alone. >> Have a seat. >> Just give me my phone. Where's >> Go ahead and have a seat. >> No. Where's my phone, >> Christina? Have a seat in the car. >> Give me my phone so I can talk to my son. >> Have a seat. No, you need to like you need to stop harassing me. You This is sexual harassment. Don't touch my leg. >> Have a seat in the car. >> You're sexually harassing me. You're sexually harassing me. Don't touch me. >> No, you're actually arrested. >> On the night of February 6th, 2024 on Forest Hill Boulevard in West Palm Beach, Florida, a routine traffic stop became anything but routine. A woman was clocked driving well over 100 mph, swerving across lanes. What followed would raise serious questions about impairment, deescalation, and the line between a bad night and a criminal record. >> Hi, how you doing? >> I am so sorry. Like, I'm just trying to go back to my hotel and I know I was speeding. I'm so sorry. >> You got your driver license, registration proof, and insurance? >> Um, goodness. Where's my purse? Where you coming from? >> Huh? >> I was at an Airbnb where my son is at. He plays football. So, I'm here. >> So, we're here for his seven on seven football team. >> Okay. >> And I came from where they're staying and I'm going back to my place. >> Okay. You have your driver license, registration, insurance? >> I do, but I think it's in the back. >> In the back where? Put the windows down for me. The window gets down. >> The back windows. Put all the windows down. >> Shoot. >> Where in the back is it? >> I mean, oh my god. I hope I didn't get out the house. Can I get out and look or >> You don't know where it is? >> I thought it was here, but it is not. Oh, here it is. I'm sorry. Here it is. It fell on the floor. Oh my god. Please. like um I just want to get back to my Airbnb. >> Well, how much have you had to drink tonight? >> I did have a glass of wine. I'm not going to lie. >> A glass of wine? >> I did? Yes. >> How long ago was that? >> An hour ago. >> Please don't like >> I'm sorry. >> Please don't like >> Well, I mean, you're going well over 100 mph. You didn't even realize you passed me and you're swerving all over the road. So, I mean, it's kind of a problem right now. >> No, I know. It was more that I was looking at the GPS trying to figure out where I was going. >> Can I call my son? Like I'm not really sure. >> Yeah. You're not sure where you're coming from? >> So, no. I don't know the address I was coming from, >> but it was one of like the kid's grandmother's house. >> All right. You rented the car, Christina? >> Yes. >> Can you let those other windows down for me? >> Sure. Oh, you did? >> I'm good. Like, I don't like What's going on? What do you mean? What's going on? >> I don't know. Like you're over here and I'm just so confused. Please like put the windows down. It's just >> It's so I could see better. >> I'm his backup. >> Okay. Every traffic stop they for officer safety they request for two officers to be on traffic. >> I mean that's fine. It was just I'm a little confused. That's all. >> Okay. >> All right. Christina, can you step out for me? >> Is the car in park? >> Yes, it is. All right, we're going to go right up here. >> Oh my gosh. Okay. >> Right to the front of your car. Just step up there for me. Turn to face me. >> Where? >> Right here. Step right there. Right. Turn to face me. All right. All I want you to do is follow the tip of your pants. Arms down. Feet together. >> Just follow the tip of the pins with your eyes only. Okay. You got to keep your head still for me. >> My head was still. >> No, you're you're turning your head. Just follow hand only. Arm down to your side. >> Okay. >> All right. Look at me. [laughter] Keep your head straight. >> Okay. Okay, >> I look okay. >> All right, just keep your head straight and follow the pin with your eyes only. >> There you go. >> Right here. >> I'm sorry. Like I like really see it. Like >> Say it again. >> I said I can see it. Like I just can't like really follow it. But I'm >> Okay. Do you have any issues with your eyes? >> I have contacts in. >> You have contacts in? >> Yes. >> But your eyes are fine. You don't have any other issues? >> No, I don't. But like sometimes it's like hard to follow like but I can follow it. >> Okay. >> Keep your head straight for me. It's >> not my head. It's like I'm welding from my feet. All right, here's what I want you to do. Take your left foot. Put your left foot in the middle of that white line. In the middle of it. There you go. You're going to put your right foot in front of your left foot. Heel to toe. >> I can't do this normally, but okay. >> Arms down to your side. All right. What you going to do? You're going to stand straight up and look straight ahead for me. >> I can't I literally can't do this normally. >> You can't walk in a straight line. >> No, I can't. >> Don't start till I tell you. I'm going to explain and demonstrate everything for you. >> Okay. >> Okay. [clears throat] So, go ahead and put your left foot back behind your behind your right. There you go. Arms down to your side. All right. Look at me. I'm going to explain demonstrate the task for you. So, you're going to start out from that position. Okay? You're going to take nine heel to toe steps down that line. Don't start till I tell you, >> okay? >> Okay. You're going to count your steps out loud. You're going to keep your arms down to your side. You're going to take your steps all the way down the line to nine. And then you're going to turn around and take nine heel to toe steps back down the line. >> Okay? >> All right. Same thing. I'm I'm going to show you. Don't do anything till I till I tell you. Okay. >> That's fine. >> So, from that position, Like, yeah. >> Huh? >> Go ahead. >> What were you asking? >> No. I'm like, I can't do that naturally, but I'll do it. Go ahead. >> Okay. So, you don't you don't walk in a straight line every day. You don't No. >> No. I'm clumsy. >> You're clumsy? >> Yep. >> All right. Go ahead and keep your arms down to your side. >> All right. When you start, you're going to start from that position. You're going to count out loud. One, two, three, four. You're going to go all the way to nine. I'm going to four to show you how to do it. Okay. >> Yeah. On your ninth step, you're going to take a series of small steps just like this. >> And you're going to take nine heel to toe steps back up the line. So, it's going to look like this from that position. >> One, two, three, four, all the way to nine. Again, I'm going to four just to show you how the task is done. >> All right. Keep your arms down to your sides. You understand the task? >> I got it. >> All right. Go ahead. You can begin the task if you understand it or you don't have any questions. >> No, I got it. One, two, three. 4 5 6 7 8 9 Turn around. Right. 1 2 3 4 5 6 7 8 9. Okay. All right. Come up here a little bit. Stay on the line. All right. The next task we're going to do, what I want you to do is put your arms down to your side. Keep your arms down to your side. When I tell you to, you're going to take either leg of your choosing. Let me stand on this side for you. Either leg of your choosing. You're going to raise it 6 in off the ground. Okay? You're going to look down at your toe. I feel like you should let me take my phone now and record cuz like this is just like so over the top. But okay, >> you're going to look down at your toe and you're going to count out loud. 1 1,000 2 1 3 1,000. You're going to go all the way to 31,000 until I tell you to stop. If for any reason you put your foot down, you just pick it up and continue where you where you were at on your count. Okay? So, it's going to I'm going to demonstrate it for you. It's going to look like this. You're going to raise your foot. You're gonna look at your toe. You're going to count 1 1 2 100 3 100. For any reason, if you put the foot down, just pick it up and continue. 4 1 5 1,000 6 100 all the way to 31,000 or until I tell you to stop. Okay. >> Yeah. >> You understand [clears throat] what you're going to do? >> Yeah. >> All right. Go ahead. Put your arms down to your side and you can go ahead and start if you understand the task. 1 100 1,00 2 100 3 100 4 100 5 100 6 100 7 100 8 100 9 100 25 100 26 100 27 100 28 1 >> Keep your arms to your side. >> Oh, I I whatever. 28 1,000 29 1,000 31,000 41,000 31,000 I'm sorry 31 >> You go and put your foot down. Stay right there. What's the highest grade you completed? >> I have a bachelor degree. >> Okay, perfect. You know your alphabet from A to Z. >> Like you're so and so. >> I have to ask you to It's part of the instructions. I have to ask you. Yes, I do. >> Everything that we're doing here is part of the standardized instruction that we ask everybody when we're doing DUI investigation. Okay, >> that's fine. It's fine. I got it. >> It's nothing personal against you. That's just the way it's written. >> That's it's fine. But yes, I do. >> Okay. What you're going to do is you're going to put your arms down to your side. You're going to maintain that position. I'm going to explain and demonstrate the task for you. If you don't understand the task, let me know and I'll explain it to you again. >> Y >> Okay. So, what you're going to do is from that position, you're going to tilt your head back. You're going to close your eyes, and you're just going to recite the alphabet from A to Z without singing and without rushing. Okay? So, it's just going to be like this. A B C D all the way to Z. Okay. >> All right. >> You understand the task? >> I got it. >> All right. Go ahead. Tilt your head back. Close your eyes. A B T U V W X Y Z >> Okay. >> And I'm sorry I'm freezing. >> All right. >> Step up here. Have a seat for me. >> Have a seat. Where? >> Right on the front of that car. >> When officers approached the vehicle, the driver, Christina, immediately admitted she had been speeding. She also volunteered that she had consumed alcohol one glass of wine approximately 1 hour prior. That single admission triggered a standardized field sobriety test protocol governed under the National Highway Traffic Safety Administration guidelines commonly known as NHTSA. These tests are not optional once probable cause exists. Under Florida statute section 316193, operating a motor vehicle while under the influence of alcohol to the extent that normal faculties are impaired constitutes DUI. The officer had observed speeding and swerving creating articulable reasonable suspicion to investigate. The first test administered was the horizontal gaze nestagmas or HGN. Under NHTSA guidelines, this test measures involuntary eye movement as the eye tracks a stimulus. Officers are trained to look for six specific clues, three per eye. The walk and turn test followed. This is a divided attention test requiring the subject to walk nine heel totoe steps down a line, turn, and return. The officer correctly demonstrated the task and issued standardized instructions before Christina performed it. Christina completed the walk and turn. She expressed concern about her balance beforehand, self-identifying as clumsy. While this does not constitute a legal defense, it is a mitigating factor that a competent defense attorney would raise in challenging the weight of the field's sobriety results. The one leg stand test requires the subject to raise 1 ft 6 in off the ground and count allowed to 31,000. Christina completed the count, though she lost track of the sequence briefly near the end, and raised her arms during the count, both of which are scored clues under NHTSA standards. The alphabet test is not a standardized NHTSA field sobriety test. It is sometimes administered as an additional cognitive assessment. Its results carry less evidentiary weight in court than the three standardized tests, and defense council regularly challenges its admissibility. Critically, Christina skipped the letters C through S entirely during the alphabet recitation, jumping from B directly to T. This is not a minor error. This is the kind of demonstrable cognitive disruption that supports a finding of impairment. After completing all tests, the lead officer made a decision that deserves specific recognition. Despite observing multiple clues of impairment, she determined the evidence was insufficient to support a DUI arrest. Instead, she offered Christina an alternative. Call someone to drive her home. This decision reflects exactly the kind of proportionate discretionary judgment that good policing looks like. Florida law does not require an arrest every time impairment indicators are present. Officer discretion exercised responsibly serves both public safety and the individual. All right. So, here's the deal. Is there someone that can come pick you up? >> You have someone that can pick you up? >> My son can. >> Your son can pick you up? Yeah. >> He hasn't been drinking tonight? No. My gosh. No. >> Okay. All right. Here's the deal. >> Yeah. >> Okay. Even though you argue with me all the way down here. >> I didn't argue with you. >> You told me you were being >> But I didn't >> investigated for DUI because you're white. >> I I said that, but I didn't argue with you. >> I mean, that's kind of >> But I didn't argue with you, but I did say that. >> Mhm. So, even though all that happened, okay, I don't think you're impaired to the point that I should arrest you, but you are impaired enough that I'm not going to let you drive away from here. So, if you want to call your son and have him come pick your car up, pick you up, I will allow that to happen. What I will say is once you get to your hotel, okay, and he leaves you there, don't take your car out again. >> I I mean, I have no reason. I'm only here for my son. He plays football. Like there's no other reason for me to be here. >> Okay. >> Yeah. There. >> All right. Where's your phone? >> In my car. >> All right. >> Or in my rental car. >> All right. And go ahead and grab your phone. Call your son. >> Hello. >> Hey. Um, where about are you? >> I'm pretty close by. >> Okay. So, listen. I got pulled over. Um, and they're not gonna let me drive. So, if you can like come where I'm at. >> I know. It's so crazy. Like, it's so ridiculous. >> Um, yeah. I mean, are you going to be able to send me your left? >> Um, I was trying to send it to you earlier and I I couldn't figure out how to send it to you. >> You're on Forest Hill Boulevard and 441, just south of the intersection. Forest Hill Boulevard >> and 441 >> and 441 >> just south of the intersection. >> Just south of the intersection. If that means anything to you, I don't know. >> Is there like Can I like pull in like at least like somewhere? No. Okay. >> Can you uh >> Huh? >> You're damn >> I'm sorry. What did you say? >> I said you're damning. Yeah. I don't know. Like, it's it's so ridiculous. Um. >> All right. All right. Okay. Can you cut that down, though? Tell me where to >> So, let me hold I'll text you the address. Hold on one second. >> He doesn't have anyone that he could uh bring with him to take the car for you. >> No, he does not. >> Okay, that's fine. >> So, that's why I called my son. So, I'll stay in the street like a loser, but my son's going to come with his friend and take the car if that's all right. cuz >> like I was telling her, I mean, you've got indicators of impairment, but not enough for me to arrest you and take you to gun club. Okay. So, I'm going to I'm going to let you slide tonight. You're going to go home. >> You're not letting me slide. Like, >> you are you're not getting arrested. You're not getting a ticket >> because there's like you just said, there's not enough for you to do that. >> There's enough for me to tell you not to drive your vehicle, >> right? And I'm not going to drive it. That's why I called my son. That's why I said we're letting you slide. We're not taking you home. That's not letting me slide. >> I'm not arresting you >> because you don't have enough. That's what you're saying. Like it doesn't make sense, >> ma'am. Why are you still arguing with me? I'm just telling you. >> I'm not arguing with you. I'm not arguing with you. >> You just said, "I'm letting her know that there's not enough for me to let you >> to take you to jail. >> There's enough to detain you and do the roadsides for >> anyway." You just said there was not enough. That's all I'm saying. >> Yeah. Which is why that's why you're not a handcuff, >> right? Okay, that's all I'm saying. So, you're not letting me slide. It's just that you don't have enough. That's all. And I'm not trying to argue with you. I'm just That's what you said to me. >> Okay. >> I mean, >> just understand. >> I don't know if it's a black and white factor here cuz you guys play that part. >> Can you not do that in front of me? But you guys play that. Absolutely not. >> I don't even know who you over. It could have been anybody. So, how do you play that? Now that you did, now that you did, I know >> that's so disrespectful on so many levels. You don't know my background. For you to say that to him and for you to say that to me, you don't know my background. You don't know his background. >> I wasn't talking to you. >> I don't care. You're talking to my partner. Let's get that first fact. Second of all, when he says you slide, we should have wrote you a bunch of Let me get my phone. Sit down in the car. Get my phone. No. Don't disrespect me. Because you think you can do that to me? >> Nope. Absolutely not. Absolutely not. Absolutely not. >> All right. Just have a seat in your car until your rides get here. >> No, but you're going to keep talking, right? >> The whole thing is recording. >> All right. Just have a seat on the >> But don't disrespect me. I did not disrespect you. >> She was not disrespect. >> I did not disrespect you. Don't disrespect me. >> Ma'am, >> do not. Christina, have a seat on the passenger side. Out of the road. Come on. This or come on this side. >> Come out of the road. Your car is far over the way for me. >> Yeah, it's keeping people from running us over. So, come on over here. >> Disrespect you for a second. >> Come over here. Out of the roadway, Christina. Christina, come over here. That's why we're standing over here. So, we don't get run over. >> Disrespect me. I did not disrespect you. >> No, I did not. >> We're not going to argue. >> No. No. I'm going to record all of it. >> You can record, but we're not going to argue on this. I did not disrespect you for a second. I did not. >> Okay. >> And she wants to jump in. No matter. No. I'm going to record. >> Everything here is recorded. The whole interaction's been recorded. >> That's fine. Yep. That's fine. George Floyd. Yep. >> Mhm. >> I did not disrespect you. Don't Don't you dare disrespect me. >> Yes, you did. >> No, I did not. >> I'm not. >> No, I did. Oh, now you want to be quiet, right? Yep. Uh-huh. I'm going to tell you what. You don't know who I am and what you're about to find out. >> Okay. If you don't think so, then that's your opinion. But >> I did not show your video. I did not. I did not disrespect you. >> That's your opinion. >> It's not my opinion. It's facts. I did not disrespect you. >> The like I said, the entire thing is recorded. >> That's right. So, look at it. Look at it. Cuz this is not the end. You're going to hear it. The way you just got in my face. Are you on your way? I'm I'm going to tell you what this little mother as like I said nothing to them and this this little wants to talk to me. >> Who? >> The cop. >> Oh >> yeah. No. And as soon as I recorded, she shut her mouth. >> Yeah. She has no idea who the we are. But anyway, just get your ass here because this will be taken care of after you pick me up. But I I'm so sick of racism and this she was like literally in my face and she's like, "You don't know me." And I'm like, >> "Oh, she has no idea." Yep. And they're telling me they're recording it. >> Are you going to send me a list? >> I Why don't you get back in my face like you were before? What happened with that? >> Stop. >> No. Why was she in my face like that? >> Can you stop? >> No. But why WERE YOU IN MY FACE LIKE THAT? >> Give your son the address where you're at. >> Oh, he's going to come. So he can come here and get you. >> BUT DON'T GET IN MY FACE LIKE THAT. >> SHE'S NOT IN YOUR >> SHE WAS THOUGH. >> CAN YOU STOP? >> SHE WAS THOUGH. >> You know me. >> I was cool. I DIDN'T SAY A THING. DON'T GET IN MY FACE CUZ YOU DON'T KNOW ME. I'M I RECORD it cuz I don't give a Make sure you had a cuz listen I don't with nobody. I have a good heart. I DON'T KNOW, BUDDY. BUT DON'T GET IN MY FACE LIKE THAT. YOU >> You were in my face. >> No, she wasn't. >> OH, SHE WAS. >> SHE WAS DEFENDING ME. >> SHE WAS LIKE, "YOU DON'T KNOW WHAT I'VE BEEN THROUGH LIKE THIS TO ME. Don't tell me she wasn't. >> Have a seat and stop." >> No, don't tell Don't tell me that. You're going to defend her cuz she's she was your Maybe you're her. I don't know. >> Cuz you know she was in my face. >> All just tell him to drive here. All you have to do is come get the car. That's it. No, I'm so stupid. These stupid mother looking at me. I'm so stupid. Like so sick of it. >> You know, cuz I'm white and they're black and Spanish or whatever this is. I'm so sick of this in America. >> What happened next had nothing to do with law enforcement and everything to do with Christina's own choices. While on the phone with her son, Christina made a series of statements directed at the officers. statements that crossed well-defined legal lines. Under Florida statute section 836 05, corruption by threat against a public servant is a felony of the second degree. The statute covers statements made with intent to cause a public servant to do or refrain from doing an act by communicating a threat to that public servant. Christina's statements on the phone, including references to what officers would find out and what would be done after she was picked up, were made within earshot of the officers and on a recorded body cam. These statements provided the legal basis for the corruption by threat charge. When officers initiated a patown search for officer safety before placing Christina in the vehicle, she physically resisted and refused to comply. Under Florida statute section 8432, resisting an officer without violence is a first-degree misdemeanor. The patown itself was legally justified. Under Terry v. Ohio 392US1 1968. Officers may conduct a limited pat down for weapons when they have reasonable, articulable suspicion that a person is armed and dangerous. The escalating situation created that threshold. Christina's repeated physical resistance, her refusal to comply with lawful commands, and her grabbing of the seat belt to resist placement in the patrol vehicle collectively elevated the situation from a voluntary courtesy release to a custodial arrest. The officers displayed notable restraint throughout the physical encounter. Despite Christina's resistance, no taser was deployed. No strikes were used. The level of force applied remained within the soft empty-hand range consistent with Graham v. Connor 490 US 386 1989. >> I got to be treated like a immigrant >> on you little. >> All right. And that's a put. >> No, listen. Let me distract myself. Please stop. >> Just stop. Please. All right. No. Stop. >> Turn around. >> Turn around, >> Christina. Turn around. >> Just stop. >> Turn around. >> Okay. Where's my phone? All right. Turn around like she asked me to. >> Can I just let me talk to my son? >> Yep. Of course. >> You pat her down. Put her on. >> No. Pat me down. Don't let her talk to me. >> I don't know. Don't let her touch me. Don't touch. >> She's going to pat you down. >> No, she's not. Don't Don't touch me. >> Where's my dog? >> Do you have anything on you that could me >> Please look forward, ma'am. Thank you. >> No, I don't. I know you wanted to touch me. Yep. >> Stop. >> No, you need to stop. Like, I did not do anything but you being racist. It's like just stop and leave me alone. >> Have a seat. >> Just give me my phone. Where's >> Go ahead and have a seat. >> No. Where's my phone? >> Christina, have a seat in the car. >> Give me my phone so I can talk to my son. >> No. You need to like You need to stop harassing me. You This is sexual harassment. Don't touch my leg. >> Christina, have a seat in the car. >> You're sexually harassing me. You're sexually harassing me. Don't touch me. >> No, you're actually arrested. >> Have a seat or you're going to be tased. >> No. Sit in the car. >> You're sexually harassing me. Have a seat. You don't want to get hurt. >> Christina, >> you're sexually harassing Christina. Stop. You're making it worse. Have a seat. >> No, you didn't have to do that. >> Have a seat. >> Let me talk to my son. >> When you sit down, you'll talk to your son. >> Let me talk to my son. >> Have a seat, Christina. >> Let me talk to my son. >> Oh, because you can harass me. Like, no, you can harass me, though. That's okay. >> Sit down. >> No, but you can harass me. I have a broken leg. Don't you dare. >> So, sit down. >> I broke her leg. >> Don't you dare. She's going in the car. >> Listen, stop sexually. >> Stop kicking me. >> I didn't kick you. I did not kick you. >> I did. >> Sit back. >> No. >> Let me stop. You said You said I could talk to my son. Let me talk to my son. >> Talk to your son. When you stoping your No, you told me. >> This way. Let him seat so you could be safe in the car. >> You told me I could talk to my son. He said, "As soon as you sit down and you're secure." >> Wait, no, he didn't say that. Let go of the seat belt. >> Let me talk to my son. >> Let go of the seat belt. >> Let me talk to my son. >> Let me talk to my son. >> Let go of the seat belt. >> Let me talk to my son. >> Put your phone in the car. >> All I'm asking you, what? >> I told you I would, but you don't want to put your phone in the car. >> You need to You need to loosen these. No, you need to loosen this. >> Nope. You're This is hurting. >> This is hurting. THIS IS HURTING MY ARMS. Loosen this now. It's hurting my arms. Ma'am and loosen it. It's hurting my arms. >> You want to argue? >> No. Just loosen. Loosen it. It's hurting my arms. >> No. You're Listen. >> Stop kicking at him. AND YOU WERE NO, >> I'M NOT KICKING HIM. >> THEN PUT YOUR FEET INSIDE. THAT'S kicking him. Put your foot in the car. >> Listen. Loosen. Loosen this. >> No. Loosen this. It's hurting. >> Put your feet. >> Listen. I'm not kicking you. No. Loosen. >> Put your feet in the car. >> Loosen this now. Cuz it's hurting my arms. >> That's not how that works. No, loosen it. Put your feet seat belt and we'll adjust your handcuffs. >> Oh, because you're not We will adjust your handcuffs. You need to put your feet. Loosen it. It's hurting my arms. So why would people answer your question? >> She asked me if I had a vaccine. >> So you're not answering no question business. And that's your personal business. You're done. >> Fair enough. Okay. >> Christina receives a D minus. The initial traffic stop was legally valid. She admitted to drinking. She performed poorly on cognitive field sobriety assessments. She made threatening statements against officers on a recorded line. and she physically resisted a lawful patown. The lead officer receives a B+. Her decision not to arrest for DUI, despite having sufficient indicators to support charges, demonstrates sound judgment. Her deescalation attempts were consistent and patient. The backup officer's approach to Christina's personal space did contribute to the escalation, which keeps this grade from reaching an A. This incident carries five lessons every driver should understand before they ever see flashing lights in their rearview mirror. Because the decisions you make in those first 30 seconds set the trajectory for everything that follows. Lesson one, voluntary admissions carry full legal weight. When Christina said she had been drinking, that statement became evidence. You are never required to answer questions about alcohol consumption during a traffic stop. The fifth amendment to the US Constitution protects your right to remain silent. Lesson two, officer discretion is real and your behavior influences it. The lead officer chose not to arrest Christina for DUI when the evidence was borderline. That discretion evaporated the moment Christina began making threats. How you conduct yourself directly affects the outcome. Lesson three. Threats made with an earshot of officers, even on a private phone call, are not private. Florida statute section 83 65 makes threatening a public servant a felony, regardless of whether the threat was directed at them in person or communicated indirectly. Lesson four, resisting a patown search is a separate criminal offense from whatever initiated the stop. Under Florida Statute Section 8432, resistance without violence is still a chargeable misdemeanor. Compliance during the stop does not prevent you from challenging the stop's legality later in court. Lesson five, body cam footage is neutral. It records everything, the officer's conduct, and yours. In this case, the footage that Christina believed would protect her ultimately documented her own escalating behavior. The camera does not choose sides. It simply records. If this breakdown gave you a clearer picture of how a traffic stop can go from a warning to an arrest in under 20 minutes, share it with someone who needs to hear it.
