September 7th, 2021, Red Roof in Marorrow, Georgia. Now, listen. This case right here, it's strange. It's one of them, you had to be there type situations. ATF agents got a tip, probably from an informant about some dudes running guns from Georgia up to New York. They pull over Markwin Gordon and just like they figured, their hunch was right. But here's the thing, they ain't got no probable cause. See, the feds don't move on a whim. The US District Attorney don't touch a case unless it's tight. Surveillance, paperwork, everything lined up. But these ATF agents, they working off the cuff. Information just fell in their lap. They searched the car anyway. And there it is, a box of guns. Now, I know what you're thinking, Marcel. They bought them legal, right? Background check, store receipt, everything clean. Yeah, technically. But these boys just got their Georgia IDs this morning. Their real IDs. New York. That's the play right there. New York got strict gun laws, so they slide down to Georgia, state with soft gun laws, grab a local ID, buy the guns legal, and ride back up north. That's called a gun run. But here's where it gets wild. ATF agents can't touch them. They can't arrest without a full case. So what do they do? They find a little bit of weed, a few ecstasy pills, and call Maro PD to make the arrest. Not because they care about the drugs, but because they needed probable cause to hold him and seize those guns. Welcome to America, where the lines between legal, illegal, and we'll figure it out later all start to blur. Body cam on. What's going on? >> How's it going, guys? How's it doing tonight? >> Good. Hanging in there. How are you? >> I'm doing pretty good. Just grabbing my gloves. >> Yeah. Hey, man. >> Yeah. Um, are you recording yet? >> Yes. >> Okay. So, let me show you my ID. Just Don Dorman from ATF. Um, gun traffic investigation. Um, these gentlemen gave us consent all the way to get into the car. And while we were retrieving the guns, we got 11 guns back. Um, we we found there was a like a small bag of what I what appears to be MDMAX's. So I ask him, "Hey, who's this?" The driver says, "It's mine." You know, basically ate some on the way down from New York a couple days ago. Um, so he's he's owning owning that narcotic. >> Okay. All right. >> So, um, >> I think I've got an exit test kit, too. I'm pretty sure. >> Okay. >> If y'all want tested charging with it, right? >> Well, I if y'all could because we're not state. >> Yeah, that's what he said. Y'all can only do the guns, not not the drug part. So, which which guy? >> This gentleman here in handcuffs. Yeah. >> And he has been randed. And is he willing to talk? Um, so that's where we're at with that. And then we would be looking to um your if he he's it's a rental car out of Canada. So assuming he's not a um authorized user, you guys would what impound it or >> usually if it had drugs f amount of drugs in it, they impound take it back to our lot. But I mean if it's got lean against and stuff, whatever, we know of course we're not going to keep it right >> because it's a lean rather company. But we we'll definitely tow it. >> Okay. Okay, >> that sounds good, man. >> All right, so where did you say the XC was? Right there was the XC was in the center console. >> All right, actually. Let me see if I got a test kit first. I'm pretty sure I do. [Music] There you go. Of course, one test kit says heroin and ecstasy, but all it says on the damn test kit's heroin. The other one says ecstasy. So, All right. Whoops. [Applause] You said the center console, right? >> Oh, I'm sorry, man. It's right here. It's that little bag right there. >> I don't see nothing. I took it all out, >> man. I had a backyard, so I was like, "Shit, >> where where use that?" [Music] Well, it's all on pill. So, I don't see no crumbs in there. So, what do you say was in here? >> Oh, that's weed. >> There's weed in there. That That's a CBD/Cannabis >> store he owns. >> Nice. Okay. Well, >> as a drug user, he's prohibited from possession for that reason as well. >> Oh, wow. >> No, I'm just Just I'm going to inventory these. Yeah, those are done. I'll get this, >> bro. I'll handle this, man. You don't need have anything else to do. >> No. >> Hey. All right. So, apparently this guy's got three pills that appear to be ecstasy or he says ecstasy. Um I got a fuel test kit, but they're pills. You can't chrome them up and do test them anyway. >> These don't seem >> Yeah, you said >> I got a test kit for ecstasy, but you know, of course, they're pills. You can't damn bust them up, put them in a test kit. So, um, the guy >> Okay. Are you Are you coming over here? >> Yeah, I got I got a whole test kit, but I just didn't know. Okay. All right. just kind of threw me in the sticks here, man. So, I'm not sure really. >> Oh, yeah, man. So, >> what, bro? I was going to take me to jail. >> Oh, dude, you Well, looks like you got to going to jail anyway, bro. I mean, >> told me they wasn't taking me to jail. >> So, are we the one to make an arrest on him or y'all taking him? What's going to happen? >> So, that's what >> This is the first time I've done this with ATF come out here like this. So we we we are not going to be able to arrest him on the federal charges. We have something >> we could, but the United States attorney's office won't take these freaking like a probable cause or else it's just easier just to do it this way. >> So if you have probable cause, we do. I just didn't know what was going to happen. I mean, I got this. That's all I need. I just didn't know. >> You know, usually when ATF comes out, man, they talk to our special offic This thing was on the fly, man. We >> understand it wasn't planned. >> Yeah, no problem. I mean, no problem. Like I said, I just got to They just told me about like literally 5 minutes ago. So, hey, head over here. ATF's out with the guy. Like, okay. Let me uh >> I'm just trying to figure out. >> He's in He's in uh possession of stuff that we would arrest him for. Anyway, >> he told us too. He took one. So maybe assistant. >> That's what he said. Yeah. >> Was an assistant Hey man, step up just real quick. Okay, what I'm going to do is I'm going to change out handcuffs on his hair. Okay. What am I being >> actually for the possession of marijuana and ecstasy man? Give me just a second here. >> Hang on just a second. I'll let you do all the talking here in just a second. Dad >> all you lean back here again. Hey, if you guys still talk to him, man, you can talk to him. But I at least want to get your dang cust off because they're still locked. >> There it goes. Make sure we can lock them back over here. >> Oh, yeah. >> Don't want to take off your cuffs, man. >> Thanks, sir. I appreciate that. You can still talk to him if you want to. I just want to put my cuss on it. >> See if I got a >> Hang on just a second, buddy. Oh, me in a mess, huh? 85 George Heat. Heat. down. someone doesn't matter extend And when y'all have his ID? >> Well, we have a George ID and we have a New York ID. Which one would you like? >> Give me this George. Give me his George. >> No, I I say take his New York ID. You know why? Cuz that's because it's right here and this is what he checked in the hotel with and he's lying. He just he got that George ID this morning. >> Oh. >> So he can buy guns. You understand? He's not a problem here. Cuz they were going right back to New York tomorrow when he checks out here. Do you understand what this is all about? Oh yeah. >> He came down here. I don't know how he got a Georgia driver's license that quick. He got it this morning. >> And went straight to freaking the gun store, bought the guns. He's checking out his hotel tomorrow morning. He's going back to Rochester where this car was rented from. That's what it's all about. Okay. >> Okay. So, >> do you need that, man? >> I don't know what's going There's no trickery, dude. >> So, was it or was it not? >> The trickery with that you have access in your car. >> I didn't charge you with anything. >> And I'll tell you what, you still have a lot. >> I'm scared. I was scared. >> Why you scared? Have I been mean to you? We've been cool the whole time. Nobody I tell you what you know. So let me be true with you. If you want to help yourself because you're being charged at the state level right now, okay? You have one felony charge. >> But I'm telling you, I am I am about to spend days investigating this thoroughly >> and as soon as I can, then I'm going to charge you or you can you can call me. You can come down the where we're going and you can tell me what's up. >> You like there's two ways here. volume. >> Sure. [Music] >> Hey, come on, buddy. AC. >> Come on, man. I'm going to get you some AC. You already check him. >> Not well. You're going to probably want to make sure. >> All right. >> Yes, sir. You want to figure out my mom number? >> Take a what? >> Your mom's number. I don't feel good. >> You don't feel good. Can you say you took that ecstasy? Said in your back pocket real quick. I think it's the jerky. What it is? It's probably the adrenaline. Okay. You're probably feeling this legit. You're probably feeling like, hey, you're on the defensive and all of a sudden now it's been long enough you're out in the heat and your freaking energy's taking a dive, okay? Cuz you're realizing what it's kind of felt here. I don't know what your relationship with your boy Antonio right now. All right. You got a whole heap of [ __ ] probably come down on your head. If you want to get in front of it, give us a call. I'm going to put my car in your pocket. Okay. You get in the jail and come get away from him. >> Can't nobody find out though. I'm just Okay. I can get [ __ ] Bad [ __ ] can happen to me. >> I get it. >> What? >> Easy. You don't get it. >> No. No. No. No. Dude, we do this. >> How much do you get it? >> You want me say this much? You want me to say this much? I mean, dude. >> All right. Put your feet in. >> What part? >> I'm going to turn the air conditioner on back here. >> Talk to him all you want. >> I think I'm too big. >> You ain't too big, bro. That's just the seat belt. >> We ain't going to reach across. Now you got to sit in the seat, man. You ain't that big, bro. I'm 6'2, but I can fit my um my hands. >> Turn your hands like this. >> Hang on. I got to loosen this, man. >> Come on now. You hunk of [ __ ] >> L come out here with you. >> Who? >> Lieutenant. No, he's busy. A meeting or something. I think >> he said he had a meeting with the major. >> Well, I'm fine. >> That should be loose. All right. Now, you said your hands are hurting like that. >> I'll tell you what. Stay back. Some people look back to handcuff to school anyway. >> Do you want me to go to jail with you? Talk to you. >> Yeah. Not in the car, but you want me to meet you there and talk to you. You want to tell me what I'm already know. Help yourself or not. >> So, keep it like that. >> I know you don't want to. That's cool. >> Keep it like that. Ain't going to say it. >> I get that [ __ ] [Music] No, like that right there. >> Just like that. Yeah. Keep your hands together like you're praying. It's so much easier that way. You see what I'm saying? Hang on. I'm going to lock them down before they shut down on you, man. >> All right, that should be good. Now try to sit down. That should be a lot better on your wrist. >> Some people that go back to handcuffing school, man. Federal people don't know how to handcuff, you know. >> Should be loosened up. We turn the air condition on back here. >> Turn the AC on. Give me a second. >> What's up, man? >> I knew he was all that. >> Yeah, you should feel that. I want to say sorry. >> Yeah, man. You want to talk to him? >> Um, I thought you was the charge. >> I'm the SEG. Yeah, but I'm in charge of your little uh your meth your ecstasy in your uh marijuana. >> I never get in no trouble like that. >> I know, bro. >> Can you not put that on me? >> I got to got a felony, bro. I got to Yeah, I got We got policies against that. I'm trying to get all the air flowing on you, bro. >> How much time do you period? >> I don't know, man. That's a felony, bro. Felon is one year minimum. I was using it though. >> I know, but you got it in your bag here, so you're not even allowed to possess it. That's a felony, man. Just give me a second. >> You're feeling okay back there? >> He'll be good. He'll be out probably a couple hours. 2016 OBM route to my 351 adult male. Beginning mileage 25123 parking shade so the car stays cold. 221. [Applause] >> I didn't count it yet. I just stuck it in the bag. >> Uh, ones and tens, it looks like you process this stuff. Let >> you stretch a little bit. Let's >> walk over. Go up that ramp over here. other side of his car. >> Yeah. Go around the back. Go up the >> ramp. All right. Can you revise the last three numbers? >> 307. 307. Should have made you go get me a black. We used to have a big seat there, man. Guess we don't have a big seat. Sit down right there. >> He's giving you room to sit down, man. So you can stretch. [Applause] >> Sir, >> the sir, >> have you been read your rights yet? >> They read them as rights. And you agreed to talk to them? >> Talk to the guys out there, >> the agents, the undercover agents. Did you talk to them? >> Yeah, I guess. >> Okay. >> Okay. Well, at this time, I'm going to read you your rights again, okay? Just so that we're all on the same page. Okay? You understand you have the right to remain silent. Anything you say can and will be used against you in the court of law. You have the right to have an attorney with you while you're being questioned. If you cannot afford an attorney, one will be rep appointed by the courts to represent you. You don't have to answer any questions at all if you don't wish without your attorney. With these rights in mind, do you want to speak with us about what you have here? Just so we can talk to you about what we're dealing with. And you don't have to answer a question that I ask if you don't want to answer. Okay. I mean, yeah, like if if nothing like like it's already understood that I'm I'm a user. So, if y >> already understood what? >> I don't know. I didn't really I don't want to talk. >> You don't want to talk? >> No. >> Okay. >> Cuz I don't know. I feel like I'm getting derailed at this point. >> You're getting railed. >> Derailed. >> No, I'm I'm being blunt with you. >> Copy. >> Okay. I'm not I got no reason to lie to you about nothing. >> Okay, sir. You don't you don't have to be charged. >> I mean, seriously, I ain't got no reason to lie to you. >> Understand? >> Okay. I just want to make sure that you're clear on what we're doing and we're clear on what you got and everything else. That's all this is about. Now, like I said, nothing about no guns, >> right? >> Okay. Just about this here. >> Yeah. Like for somebody like just >> So, it's either yes, you want to talk or no, you don't because I don't want to violate your rights. Okay. You understand that, right? is is um speaking about it in a health situation. >> Um I can't answer that honestly because I don't know what you would tell me. Does that make sense? I mean I can't >> if if I know speaking about it will help the situation, I will talk to you and be honest about it. Your honesty helps when it goes in front of the district attorney's office to whether or not, hey, this guy was full of [ __ ] or this guy lied and lied and lied and lied or this guy was honest and owned up to what he did. That says a lot for your character. Okay? And I'm not making any promises because I can't do that by law. That would be a violation of your rights. So, well, all I'm saying is we're going to talk about the money. Where you got the money, the drugs, where you got the drugs. If you want to talk, you can. If you don't >> selling drugs at all. >> I didn't say I can't ask you nothing until you say you want to talk or not. Does that make sense? >> Because I don't want to violate your rights. >> That makes sense. >> Okay. So, at this time, are you willing to speak? >> I don't I don't like just just to protect myself, I probably shouldn't. >> Okay. >> Me not me not knowing. >> No, man. That's cool. I get the turn. >> And I respect that. >> Appreciate it. >> Okay. I respect that. >> Answer the simple question. How much you weigh? Uh, >> all right. You got it. Did you already search him? Good. >> I searched him searching myself. >> Now, look, I'm going to ask you a serious question because this is one that'll he up. This has nothing to do with this. Anything on you that we don't already have because if you go to the jail, let me explain how this works. And we take you into the jail and you cross the guard line and you have any more drugs on you, then that's another felony. If you already have them and you tell me now, it's just going to add to what you have instead of having a separate charge. Does that make sense? I ask everybody the same question, so does my sergeant. So, if you have drugs in your crotch, hidden in your pants, I need to know about it now because they're going to search you really well at the jail. >> Let me literally >> All right. >> You don't have nothing. Okay. Gordon G O R D. I mean, you wouldn't stick nothing up on your nut side, nothing like that. Up in your ass, right? >> I got you. But I asked, man, I tell you, I'm I'm treat you with respect, dude. >> I literally I literally >> $9 like $3 bill. Three pills. Like I'm about to go to jail like like that's beyond me. I've never been to jail. So it's like wow. Well, the thing is situation. >> I don't know how New York is. Where you from? Well, I'm in just one of them situations. >> We in Georgia >> and no, no matter where you are in the United States, >> no, >> MDMA is illegal. >> Oh, okay. >> It's a schedule one narcotic here in Georgia, which is a felony just to have it. Okay. It's not like a little weed charge. Okay. This is a felony. See, that's where I was getting at earlier about talking to you because right now you got a felony on you, brother. And I ain't lying to you. Okay? And if I really wanted to be a dick, okay? Sure. That's old, right? The money and the gold and the earrings. We'll take that and seize it >> cuz I'm sure that's working pretty good. have marijuana. So, >> see how this works right now. >> Anytime you have narcotics, >> especially I never I never knew that, >> but like you said, you're not going to be through that. But >> and I'm not I'm not >> like I'm pretty sure like no matter like >> and I'm not trying to question you having access to it, but after you like us talking, you know, I don't >> I can't get rid of the felony. I'm going tell you >> I understand what you're saying. I I don't I don't expect you to like do me no favors, you know. >> No, I'm just telling you. I mean, you going to cop that charge, >> okay? >> Okay. Ain't nothing I can do about that. No matter what you told me, >> you're going to go and you're going to postponed on that. >> Where? >> Okay. >> Yeah. >> That's real. >> Copy. >> Okay. Um now, only way that you can help me, which I doubt you can because I just You're from New York, right? You're not local. Like you're not from here. >> From here. >> Yeah. Or hang out here and buy you stuff here. And you know, anybody's got 15 keys, you know. No. >> You follow what I'm saying? That's how you would help yourself. >> Probably. >> Okay. So, you know, anybody murdered nobody down here? None of that good stuff. >> Well, then not will. Can I? >> Well, I I feel you. The chair you in's the chair you in. There you go. Oo, I don't want to know nothing about no murders. >> So, I'm not saying you did. >> No, I'm saying I don't even want to know about murders. >> Well, unfortunately, sir, what you got today is called possession >> you I don't even want to >> possession of schedule one narcotic, which is a felony here in Georgia. Okay. And it's a felony that is 5 to 15 on that. >> You tested it already? I think so. >> I think what's that? >> Tested it already. Oh yeah. Yeah. It's You know it's good. You took some. >> You know it's good. You know it's real. It ain't no fake stuff. >> Okay. >> Sometimes should be cut though. >> Yeah. It doesn't matter if it's cut. >> Yeah. >> No matter the percentage. >> That makes sense. >> Okay. MDMA is >> Yeah. If you had just crumbs in the bottom of that bag, not pills, it still be >> Yeah. >> Now, lucky for you, you didn't have 15 or 20 of them because it' go by weight and it'd be trafficking. trafficking is a higher felony which is 25 to 30. Okay, we're being real. So, let me think about some things for a minute. Like I said, I'm not sure if we're going to seize your money and seize your jewelry yet. >> I say you just sold >> I said I I wasn't going to be a dick. I said I got to think about it. >> All right. I got higher authorities over me. >> Yeah. >> You following me? All right. So, you sit tight, answer my sergeant's questions here. >> No, that is that is whatever sergeant is on duty has that one. So, so we we we don't have our own work phone here. We just hand it to the next shift. So, that one is always in the hands of a sergeant or supervisor here at work. >> Okay. >> All right. And he's he said it doesn't look like a no go on that one, too. We'll just see. >> They're both Yeah, they're both gone. >> They're both gone. One of those down in high fall, so >> Okay. >> All right, buddy. Thanks. >> I mean, to me, they screwed the pooch on that one, you know. >> All right, you're good. Now, if you want to put in your cuss or just leave mine, I don't give a crap. I got more. >> Yeah. Behind his back. Yeah. We just let him pee. Let him relax his arm cuz he's been here for a while. He's been here for a minute. He's been really nice, man. He's been really, you know, nice to us. [Music] Put the fan on. He's going to pull his pants up again. Hey, I got to go do my GBI submission pool now.
