stable life marrying in the early 2000s raising three children running a successful equipment rental business and living in an upscale area of Washington Township Kimberly was a devoted mother and respected community member while Matthew an avid Hunter was known for his exceptional Marksmanship at trial one friend testified that they once observed him at a gun range hitting Bullseye after you pull in and you say you just get out of the car and he just comes out of the garage like a police officer like SWAT like SWAT team right at me and as he's running to me I say uh I see him you know something and as soon as I finished wife bam he shot one right [ __ ] whiz by my head then my wife yells Danny like I could see where her thinking he's going to kill her husband and he looked over and that's all I needed man I got behind that car I grabbed my fire I came over the hood and I just started shooting and he scurried towards the front of the house I didn't go after him M said Kim get in the car let's go that [ __ ] up I should have jumped in the driver's seat was who was in the driver's seat her she was in the driver's seat yes she drove she drove you both there yes and she jumped in the driver's seat I jumped in the passenger seat the same way we arrived you know okay so she drove you guys there yes and you guys get out okay cuz before when you were kind of doing this scenario else I had people come yeah I had people coming from the lawn and I remember a girl and I noticed it was a girl and I let her go I didn't I didn't know so you did you point you pointed a your gun at a at a girl she was running at me okay and and she was got to 10 ft from me I I was like this where is this guy and then I went like and then she ran behind the man that's the only person I remember seeing some other people on the lawn too running towards me but she's the only one that got close to me before we got in the car oh my god did anybody say anything to you when this girl was running up on you I don't know you don't remember oh he was shooting at us um I'm just asking cuz I got before you said nobody else was out there now you're saying there's a girl and a bunch of people on the lawn yeah that was so remember that yeah okay so you do remember these people outside yeah okay at any point in time did you fire at them no you didn't fire in their Direction no y okay did you point the gun at her maybe yeah initially probably okay cuz I someone was coming at me okay but when I saw it when I turned towards her she ran the other way and I turned back towards him and here was the garage here's the front door here's the side of the house this this is the direction I shot in till eventually he went around the side of the house and detective he was if this is the garage like you got two cars here this is the door to get in he was in the middle of the garage here okay that's where he pulled his firearm and then he came out of the garage Commando style and we were parked about here and he came from here like out here and there was a car here I think bu a car okay there was another car here block you know there was a car here would it be easier for you to draw it out no no do you want to write a statement or anything no no what I told you was should I have my attorney write a statement can have your attorney do whatever you you guys want to do you know so that's between you guys am I going to need an attorney I can't give you legal advice I can advise you of what's going to happen from here on out am I going be charged with a crime you're being detained right now okay so technically you're under arrest right now okay we have uh we have a few days before we have to like formally charge you if we are so we we're going to basically uh we're going to be presenting this case to the prosecutor's office they're going to make a determination if there's any charges once we have all our evidence but right now you're not going anywhere so you're going to be sitting you're going to be sitting in uh in the this County Jail here for at least a day or two right so we are we do have enough evidence to hold you for right now till this all gets sorted out when will you know if there are cameras on the house we already know there are oh beautiful beautiful so the only problem is is they don't show him in the garage they will they will show me backing up and getting around the car we'll see what it shows that should prove my point right if you see that backing up with no firearm in my hand getting behind the car well you'll see you'll hear I don't know if if they got sound but detective 110% he pulled his firearm first came at me I went like this and then he fired a shot at me just the way I said 110% I'm not lying okay all right um we are uh we also have oh my God we also have a search warrant for your body too so we're going to take pictures of you and all that stuff okay right swabs and things if you in case you have blood on you or whatever so all right um if you want to know as far as your wife goes um she's going to be transported to the me medical examiner's office they're going to be conducting an autopsy honor so that's going to be happening in the next day or so how does my family get informed uh we're going to be taking care of that do you have her parents phone number we are going to be tracking all that down do you know her parents phone number yes okay so you could go get them all right oh my God oh my God guys good yeah all right these guys are going to take you back okay go go and stand up ah let turn around for us so like I said they're going to come down they're going to conduct a that search warrant on you uh in a little bit okay and then uh we'll go from there okay make it right Matthew Malone was booked into the mome county jail and charged with one count of first-degree felony murder four counts of felony firearm possession one count of assault with intent to murder one count of carrying a weapon with unlawful intent and one count of assault with a dangerous weapon if convicted of the highest charge he faced a mandatory life sentence without the possibility of parole in the months following the incident investigators discovered that just hours before the shooting Kimberly had confided in a friend about Matthew's Behavior the previous day allegedly there had been an altercation during which Kimberly was struck on the head with a glass picture frame at the time of her autopsy the medical examiner found fresh abrasions on her body and cuts on her scalp help which was later admitted as evidence at trial investigators also learned that Kimberly had made several thousands of dollars in payments to Daniel's debit and credit accounts from the family business in early 2022 during the trial assistant mome County prosecutor Steve Fox argued the evidence will show when he went there with a gun with two loaded magazines with a screaming wife to confront her lover inside his own home he would have known it would bring a risk of great bodily harm or death he intentionally created that risk that's enough he's responsible for Kim's death the defense maintained that Daniel fired the first shot igniting the deadly shootout in May 20124 Matthew was found guilty of the Lesser charges of voluntary manslaughter assault with intent to murder and three counts of felony firearm possession 2 months later a mome County circuit court judge sentenced to serve 86 months to 15 years for the manslaughter 12 to 40 years for the assault to be served simultaneously and 2 years for each firearm count to run consecutively with those sentences Matthew will likely spend a significant amount of his remaining years behind bars his life forever changed by that fateful confrontation
