These were multiple times when corrupt cops realized they have been fired. I'm finna go in there. Well, I just had a phone conversation. Well, that's cool. Put it down. PUT IT DOWN. GET IT I TOLD Y'ALL I HAVE 9 YEARS IN THE MILITARY. OKAY, WE TOLD YOU SO GOOD OKAY, GIVE ME A SECOND TO PLEASE. I TOLD YOU IT'S 9 years Get the [ __ ] out. Somebody punched ME IN MY FACE. HEY, BRO. AND YOU TRIED TO RUN me over. Sir, I swear I didn't And then you look at me, you waved at me, and then you kept going anyway. Starting with rookie cop who swiftly fired after this stop on June 4th, 2021. Mr. Hellcat parked at a QuickTrip gas station in Locust Grove, Georgia and made a phone call. After 20 to 30 minutes, officers Pitts, James, and Mosley approached him questioning his activities. Officer Pitts requested his ID implying a need to verify his residence. What's What's going on, man? What's Are you hanging out? Are you eating somebody? Are you waiting on somebody? Are you lost? I live out here. So, the reason I'm asking We've been here how long? Probably 20 minutes? 30 minutes. 30 minutes? Yeah. I was just You haven't gotten gas. You haven't gone in and gotten any food. No. You parked at a gas pump. And I know I know the tank's not on this side. So, it's on the other side, right? No, I'm on the other side of the gas. So, what's What are you doing? I'm just I'm just chilling. I don't want to go home yet. I can't I can't sit in the parking lot? Cuz I I live out here. Where you Do you have somebody? Who's your ID? Or is it in the car? I It's on me, bro. What's What's the problem? Who's here? Georgia lacks a stop and identify statute, but its loitering law allows officers to request identification if they suspect loitering. This law defines loitering as being in a place, time, or manner unusual for law-abiding individuals causing reasonable alarm. The officers cited concerns about drug trafficking based on Mr. Hellcat's behavior and past drug sales in the area, as well as an interaction with a known drug offender. So, right now what it boils down to is you're loitering. What is loitering? Yes. Yes. Because like if you were like getting gas, waiting on somebody, like if you were doing anything other than just kind of like hanging out, it wouldn't be an issue. Well, I'm I'm chilling on the phone. We know. This area is known for narcotic activity. It's known for criminal activity. So, that's the reason Another reason why we're speaking to you. We want to make sure that's not a foot. Right here, people will park up over there, they'll wait right here, they'll wait for somebody, they'll they'll do like that. And what? And under a tree have no idea. So Yes. I I I live out here. I I I believe you do. You know? Do you have your ID with you? Is it Is the license current? Is the address on your license current? No. Okay. What's your current The state's definition of loitering is doing something not like the normal. Hanging out at the gas pump, not like the normal. Do you know what I'm saying? So, we we have to just go and Now, if you were to like take off and run as soon as you see us over here Well, why would I Why would I do that? Well, so that's it That would add to it, but you didn't. So, it's It makes it a whole lot better. Do you get what I'm saying? They referenced Georgia's loitering law, though Officer Pitts's explanation omitted the requirement of reasonable alarm. Anti-loitering laws have a controversial history, often deemed unconstitutional when broadly applied. The officers claimed they were dispelling the alarm, a reference to the loitering statute, but Mr. Hellcat was not legally obligated to do so. The statute allows individuals to explain their conduct, not to satisfy officers' suspicions. The officers eventually left without arresting Mr. Hellcat. Well, but I I literally come here all the time. I live I live here. That's what I'm trying to tell you. Yeah, that's fine, but you can't just If you're If you don't have If you're not doing any business, you're not getting gas, you're not going to get food. finna go in there. I just had a phone conversation. Well, that's cool, but now that we've had this communication, it's what they call dispelling the alarm. Now that we're able to to figure out, okay, this guy doesn't have any issues or anything like that, then we can be about our merry way. But, we never met you a day in our life. I've never I've never met you. I've never gotten She's never met you. He's never met you. So We're just doing our job. It's what we're what we're getting paid to do. I'm chilling out. Finish your business with your phone. Finish your phone call. Go inside, do your business if you got to. And then head on home, all right? Yeah, but I was coming to Second thing, you're Look, Like I've never Go look up loitering in in Georgia code section. my my my father's a retired sheriff. Okay. Well I know, but I've never Like I said, this this area is known for for drug transactions. We're going to make sure none of that's occurring here tonight, so I was in the public eye. I haven't spoken to them. And I I know you saw the weird girl run up to my car and I'm like Yeah, they just came from a party. With a bunch of with a bunch of a whole ton of drugs. And we're sitting right there with our blue lights on. This I I do a lot of stuff with the music [ __ ] so I'm My car is like really well known. I'm racing at Silver Dollar. I do track events. I don't do no And like he said earlier, the reason we got out with you and asked you and didn't just like immediately throw you in handcuffs was called dispelling the alarm. That's all that happened. We sat there for a while. We We observed you. We were watching, okay, this guy's not getting gas, he's not going in there. We were watching everybody come and go. So, it drew our already drew our attention. Then we saw somebody that we dealt with earlier with a whole bunch of drugs around here coming up to you and like, okay. So said, "Hey, I see your car everywhere cuz I live out here." They said, "We see your car, SRT on the side." Hey, what's Which makes sense. And that's the reason why we came over here to introduce ourselves, dispel alarm, make sure there's nothing nefarious going on. Now, we're going to be about our way cuz that Now, if if we thought something nefarious was going on, then we'd be going a whole different direction, you understand? But, we have to dispel alarm, make sure nothing nefarious is going on. Do you understand that? Three days later, Officer Pitts was terminated. The Locust Grove Police Chief declined to comment. The officers received a C- minus for their handling of the situation. While they operated under the loitering law, they failed to accurately explain it, maintained an accusatory demeanor, and based their contact on questionable grounds. The interaction highlighted the ambiguity of loitering laws and their potential for arbitrary enforcement. Mr. Hellcat received an A- minus for remaining calm and compliant despite facing accusations. He challenged the officers' conduct and likely played a role in Officer Pitts's termination. The officers appeared to exhibit confirmation bias interpreting Mr. Hellcat's actions as suspicious rather than innocent. The encounter demonstrated the challenges of balancing law enforcement with protecting civil liberties. However, this next case unfolds cop who gets fired after apologizing to Army Sergeant. On May 10th, 2020, Officers Kenoma and Marlar of the Suisun City Police Department responded to a call regarding a potential ingestion of nail polish remover at Sergeant Sirah Hawkins's home. Upon arrival, the officers' initial interaction was confrontational with Marlar making disrespectful assumptions about Hawkins's wife. Hawkins asserted his rights, and the officers argued they were conducting a welfare check. The officers' presence on Hawkins's porch fell under the knock and talk doctrine allowing them to approach and ask questions. Hello. Hey. I don't know who that is. You know who that is? No. Who's your your girlfriend or your baby mama? Lady right here. First of all, that's my wife, Marla. Okay. Okay. And who? Fineman. Who are y'all looking for? One of two, can you go with the mother's name? Wait, what's the problem? So, we're here on a welfare check. We have to do that. Why? Because we received a call from Northbay for the incident that occurred earlier. What incident? Traffic. Copy. Look Look right there. Who's being investigated if y'all investigating? Right here. 9 years US Army. Now, what's the problem? Okay. What's your first name? I don't have to identify myself to you, do I? Am I under investigation? You want to tell me what's going on? One of two, can you run the address? Can you come out here? No, she can't come out there. Y'all need to tell me what's going on. This is my house. Don't Don't Copy. They're advising that this is not the right address. A welfare check for what? All right, man. What's going on, man? Y'all violating my rights right now. Actually, we're not, dude. Yes, you are because you're not telling me No, who that is. I just said it to you. Listen Listen to me, dude. We're not violating your rights. You are. How? Because you Which Which right? Which Which civil right are we violating? Why are you raising your We're not violating anything, okay? Why is he raising his are We are here on a welfare check. However, Marlar's conduct, including profane language, violated department policies. Hawkins's use of profanity was protected by the First Amendment. The officers' actions in looking through the window were examined under the exigent circumstances doctrine as they were responding to a potential medical emergency. Officer Kenoma eventually explained that they were at the wrong address clarifying the welfare check was for a different location. All right, I don't know what that means. Stop talking. Let me talk. I don't have to stop talking. Okay. Why do you I don't like to I don't like him. He's raising his voice at me right now. or nail polish, okay? Okay, so we're here to check on Okay, I'm going to talk to you. First of all, you came to my house and say, "Is that my girlfriend or my baby mama?" That's my wife. That's disrespectful starting off. All right, sir. So That was disrespectful starting off and then he's raising his voice at me. Okay, I understand. So now I can raise my voice, right? What's his problem? Okay. Okay. Now, I need your badge numbers. I'm sorry. I'll give you my badge number. But so the reason we're here is to make sure to eat a dick. So you told me to eat, right? That I messed up. I apologize. you're on film, you messed up. So so you you haven't violated any of my rights. The first thing you said to me coming here was, "Is that my baby mama or my girlfriend?" Then he started raising his voice at me. Pause. I need your name and your badge number. Officer Conoma, 107. Thank you. I need your name and your badge number. Officer Marler, 102. And And seeing that my window, I told you not to go to my window. Close the blinds. Do you have a 14-year-old son? Close the blinds. Hold on, sir. Sir. Close the blinds. Sir, do you have a 14-year-old son? Close the blinds. Close the blinds. I'm not going in the house. Close the blinds. Are your children okay? OKAY. LOOK, OKAY, GUY. HE'S ASKING IF MY CHILDREN ARE OKAY. WHAT IS THAT? WHAT ARE YOU TALKING ABOUT? WE'RE GOING TO LEAVE NOW. GIVE ME one sec. What? Cuz I got TO EAT THAT'S WHY YOU'RE LEAVING NOW? WE'RE GOING TO LEAVE NOW. MY FAMILY WAS HERE ALL DAY. WE HAD A GOOD DAY. You're here telling ME TO EAT A IT IS. I don't know who the 14-year-old is. I don't care. I TOLD Y'ALL 9 YEARS IN THE MILITARY. OKAY, WE TOLD YOU SO THANK YOU FOR TELLING ME TO EAT A PLEASE STOP. I TOLD YOU 9 years I apologize as well. I DON'T GET YOU'RE PROBABLY A PIECE IF YOU SERVING AND YOU TELLING PEOPLE TO EAT YOU PROBABLY was a piece All right. YOU CAN GET OUT OF HERE. THAT'S WHAT YOU CAN DO, MARLER. YOU Face to Okay. Let me explain cuz we may have been Can I Can I explain to you? This situation highlighted the complexities of community caretaking and the limitations of warrantless entries into homes. Although the community caretaking exception has limitations, the exigent circumstances justified their initial actions. Marler's unprofessional behavior led to his release from the department. Did you go to North Bay today? What is that? Get in the house. WHAT ARE Y'ALL TALKING ABOUT? NOBODY KNOWS WHAT Y'ALL ARE TALKING ABOUT. NOT LETTING me explain. YOU NEVER EXPLAIN. YOU STARTED ASKING QUESTIONS. YOU SAID, "IS THAT MY GIRLFRIEND OR MY BABY MAMA?" OKAY. I APOLOGIZE for that, okay? I'm here to clarify. So it may have been a miscommunication between North Bay and our dispatch. So we got a call that we needed Okay, a 3-year-old was brought into the hospital because she ingested nail polish remover, okay? We don't know anything about any of that. that is absolutely fine. So this just got a little out of hand. But you don't come to somebody's house and say, "Is that your baby mama or your girlfriend?" Right. And I I completely understand that. It was I'm trying my best to be professional. And And it You You're doing fine, but that guy, I don't know what side of the bed he woke up on. PUT YOURSELF IN MY SHOES. TWO COPS KNOCK ON YOUR DOOR, BOOM BOOM BOOM. I'M IN THERE HAVING A GOOD TIME WITH MY wife Okay. of 5 years They are already who I have now scared. Okay. You probably scared them. They don't know Officer FRIENDLY. YEAH, YOU KNOCKING ON MY WINDOW. YOU The Suisun City Police Department issued an apology acknowledging Marler's inappropriate language. Marler received an F for his conduct, which escalated the situation and delayed resolution. Conoma received a B for maintaining professionalism, though her initial approach was flawed. Hawkins also received a B for his understandable outrage, which was protected by the First Amendment. So Y'all want me to like quote what statute you guys are violating? I'm not one of those people, but I'm pretty sure I can go on Google and see if this We have every right to be here to check on somebody. And you have the right to Google us and make sure. So you have the right to be here and check on somebody, right? Yes. Then I have to come out my door? You did not. We needed to contact Exactly. Exactly. Okay. I'm leaving now, sir. Okay. Have a good night, sir. The incident underscores the importance of officers setting a professional tone during interactions. Marler's disrespectful behavior derailed the encounter, hindering the swift identification of the correct address and potentially delaying critical assistance. Conoma's attempt to de-escalate was commendable, but earlier clarity would have prevented the escalation. Hawkins' reaction, while understandable, contributed to the delay. But wait for this next case where cop gets fired, arrested, and sued. After this stop on August 20th, 2020, Corporal Robert Barino of the Somerville Police Department initiated a traffic stop on Timmy Miles after he left his residence. Somerville PD officers delivered the package and surveilled the property. When Miles drove away, Barino, believing Miles had the package, pulled him over. While officers can generally order individuals out of vehicles, Miles could argue the initial stop lacked reasonable suspicion as the package remained on his porch. After removing Miles, officers found the package was still at his residence, yet they continued to detain and handcuff him. Miles confronted Barino about the excessive force used against him. Uh-uh. You just came I know what you picked up. I know what you picked up over there, okay? What I picked up? Yeah. Yeah. Come on. Get out. Come on. What What What No, I ain't getting out the car till y'all tell me what's going on. to tell you what's going on. Come on out. No, bro. What What What's going on? I Let me record this. What What What y'all got y'all hands Yeah, we're recording right now. So come on out. on? Get out of the car. Yeah. Come on out. Come on out. Oh, no, no, no, no. Don't grab me. Don't grab me. Don't grab me. Uh well, we're telling you, giving you a lawful order. If you don't get out, you're about to get ripped out of the car. Well, go ahead. So don't I got a back problem. Don't rip me out the I'm not trying to do that. So come on out. Come on out. We'll explain it to you. We're going to tell you Dude, come on. STEP OUT OF THE CAR. Let me go. No, I'm not letting you go. Bro, let me go, bro. This is your last chance, demand cuz Get the [ __ ] out. Hands behind your back. Why you punching me in my face? I don't know what's going on. Yeah, pull him Pull him up. You got your camera on. Look at my face. We got your camera, bro. SOMEBODY PUNCHED ME IN MY FACE. HEY, BRO. I'M TELLING YOU WHAT'S GOING ON. ALL RIGHT. WHAT'S GOING ON? DESPITE MILES' explicit denial of consent, officers searched his vehicle. Although a K9 unit did not alert to drugs, the officers proceeded, later admitting Miles' marijuana use as justification. However, this did not provide probable cause for a full vehicle search. What What are y'all doing? What the [ __ ] IS GOING ON? YEAH, SO WE DO I SO DO. MY FACE IS HURT. SOMEBODY DON'T TOUCH ME. I'M A I'M A GOOD CITIZEN. Don't touch me. Marler's going in the 300, but we getting him out. He's still there. Yeah, we have to make sure or we don't we don't have anything. They lost sight of the box. And this car left. We stopped it. He didn't want to get out. We had to extract him. It's not there. Yeah. Yep. Uh we got sni- uh then lookers. There you go. Somebody punched me in my face. It hurts for real, though. Somebody hit me hard, too. Somebody going to jail for real behind this. Anybody get it? You want to search it? What? This car. Yeah, yeah, yeah. Continue with the search. I mean, we'll get a dog. Get a dog cuz right now he's going to say I mean He didn't pick up the package. So let's get a dog and make sure there's probable cause to search the car. I mean, I already popped the trunk for safety. Come on, man. I want everybody car. Everybody car. Hey, you brave. You brave. You can't with all You real brave to be punching on choking people. You wrong. You had no business choking and pulling on me like that. I would have complied only if you'd have let me know what the was going on. I come out my yard, everybody swarming me and punching me and throwing me on the ground. That's ruthless. That's thuggish. And y'all called us mother Please. And I'm paying my taxes. What? We didn't know All right. Please put him down. You know that's wrong. Come on, man. Come on. No No No You refused to get out of the car. Refused to get OUT OF THE CAR. I I WENT LIKE OH OH, THIS MAN GRABBED ME FIRST. I SAID, "WHY YOU GRABBING ME?" I got a right for my rights now. Come on now. You behind me. I did the RIGHT THING. I STOPPED. AND THEN YOU ORDERED ME TO GET OUT OF THE CAR FOR WHAT? You refused to get out of the 907 You had no business choking me, bro. For choking me, you going to jail. You ain't had to put your hand on my neck. Ain't that serious. For whatever you looking for, bro. I do not allow a search on my car. I do not allow a search on my Nope. Nope. Nope. Nope. I do not I do not allow a search on my car. Yeah, they called him. We thought there was a package in there. Is he Is he the driver or you was? We did. It was supposed to be a controlled delivery. Got you. Got you. Yeah, if If we can get that trunk closed for him. Yeah. No no thing. No? All right. I appreciate it. Thank you. Dispatch Did they notify you about sending the EMS? This uh to the traffic stop. Negative, sir. Can we get one or black male approximately 30 35 uh complaining of head trauma. Nobody notified them so they're coming now. They're coming. I confirmed it. They're coming now. I'm doing a front search of you. Anything else we find here? Secure his phone. Mhm. So I could uh do a search warrant. Did he admit to using marijuana? Oh, he did? Hey, you know what? Just do the um incident to arrest. Well, uh hand it over rather than tow it. There was this stuff back behind here with this stuff but he's got a quarter cut and it's smell like weed in here. Yes, sir. Yeah, he has a couple baggies in the front as well. Yeah, I'll get photos of them. After EMS arrived, Miles was taken to the hospital and arrested. He was initially charged with possession with intent to distribute marijuana and disobeying a lawful order but these charges were later dismissed. Barino was terminated from the Somerville Police Department for his actions and subsequently charged with third-degree assault and battery. If you thought that was worse, this is because you didn't know about this case where a cop got fired immediately after this stop on December 13th, 2022, Officer James Hinkle of the Waterbury Police Department was directing traffic at an intersection with malfunctioning traffic lights when a driver failed to stop at his signal. The incident, captured by dashcam and body camera footage, revealed significant discrepancies between Officer Hinkle's actions and established traffic control procedures. His hand signals were unclear, lacking proper eye contact and the standard open palm gesture. Instead, he used a low claw-like hand position contributing to the driver's confusion. Officer Hinkle's subsequent interaction with the driver was marked by aggression and unprofessionalism. He accused her of attempting to run him over, a claim contradicted by the dashcam footage which showed him lunging towards her vehicle. He threatened her with arrest and berated her. Despite her explaining she was confused, he issued citations for failure to obey an officer's commands and reckless driving. PULL OVER! PULL IN THE PARKING LOT! WE'RE IN THIS PARKING LOT RIGHT NOW. I'M SO SORRY. PULL OVER! GOSH, please don't yell at me, SIR. PULL OVER NOW! I'M so sorry. There's no one else with me. NO, PULL OVER! I'M NOT REPEATING MYSELF. GET OUT OF THE ROADWAY AND PULL OVER! Turn the car off. License and registration now. Did you not see this bright yellow vest standing in the middle of the street? No, I did. I thought you were leaving. I'm sorry. NO! THIS MEANS STOP! THIS MEANS STOP! I DIDN'T SEE THAT until I was already past you. And then YOU STILL DROVE BY ME! I'M SO SORRY, SIR. I didn't see you. License and registration now! Give me a second, okay? No! License and registration now! Okay. Okay. You almost RAN OVER AN OFFICER STANDING IN THE MIDDLE OF THE STREET! I'm so sorry. I didn't realize what was going on. That was very confusing. IT'S A BRIGHT YELLOW JACKET STANDING IN THE MIDDLE OF THE STREET. WHAT DON'T YOU UNDERSTAND? were other cars going that way. No, they weren't! You were the only vehicle coming from that way! YOU ALMOST RAN ME OVER IN THE MIDDLE OF THE STREET! THE legality of the reckless driving charge was questionable. Connecticut law defines reckless driving as operating a vehicle with conscious disregard for safety. Given the driver's confusion and the unclear signals, it was unlikely she possessed the necessary mental state for a reckless driving conviction. Officer Hinkle's conduct prompted an internal affairs investigation leading to his termination on January 9th, 2023. Chief Fernando Spagnolo condemned his behavior as unacceptable and unrepresentative of the department. The chief also contacted the driver who was cooperative and acknowledged the department's respectful treatment. Out of the car and stand next to the fender. Leave your purse in the car. Where do you work? I work for a clothing company in California. What are you doing here today? I'm going to Target. You're going to Target? Yeah, to do a pickup. What is such an important factor that me standing in the middle of the street Sir, I didn't see you. stopping you and you try to run me over. Sir, I swear I didn't And then you looked at me, you waved at me and then you kept going anyway! I swear I was not trying to run you over. I thought you were the cars were going I'm telling you to stop IN THE MIDDLE OF THE STREET and you wave at me and keep going! I I saw your hand before and I was too late to stop and I No, it wasn't! YOU WERE DOING 10 MILES AN HOUR AND YOU STILL DROVE BY ME! I'm so You didn't even attempt to stop your car! Sir, You're lucky you're not in handcuffs right this second! I'm very sorry, sir. I really am. EXPLAIN TO MY KIDS WHY WHY THEY DON'T HAVE A DAD A WEEK BEFORE CHRISTMAS BECAUSE you're trying TO RUN SOMEBODY OVER. YOU SEE THE BRIGHT LIGHTS FLASHING IN THE MIDDLE OF THE STREET? THAT MEANS you's cautioned there's a cop out there. I got kids at home and you almost RAN ME OVER A WEEK BEFORE CHRISTMAS. SIR, when I see flashing yellow LIGHTS IT'S NOT FLASHING! IT'S RED and blue! THAT'S A COP CAR STANDING IN THE MIDDLE OF THE STREET FLASHING LIGHTS! NO, IT'S NOT AN ACCIDENT. You're just being irresponsible. three and then waved at me and still tried to drive by me. Run her, please, and make sure she's valid. A week before Christmas, almost get ran over. Yeah. I got two kids at home waiting for me to come home tonight. Sir, I'm very sorry. I thought you were Sorry doesn't break it! You looked right at me and still decided TO DRIVE BY ME! NO, YOU WEREN'T! I WAS IN THE MIDDLE OF THE INTERSECTION! EMOTIONALLY. Would you mind filling this out for me? My hands are a little shaky right now. Failing to obey a signal of a law officer. Reckless driving. Officer Hinkle received an F for his unclear signals, aggressive behavior, and lack of professionalism. His victim mentality and over-dramatic accusations were deemed inappropriate for a police officer. The driver received an A for maintaining composure and attempting to take responsibility despite the miscommunication likely being due to unclear signals and the chaotic traffic situation. She remained calm and respectful throughout the encounter, refusing to escalate the situation. See, this is why I was trying to direct traffic because it's I was out here for 25, 30 minutes doing traffic. 30 minutes doing traffic and almost got ran over once. Everybody else, no problem. No problem. Any time you see flashing red and blue lights in the middle of the street, it means there's cops present. No, stop talking. Stop talking. And it means you need to pay attention because there's going to be police officers out and about, okay? This bright yellow vest, it's very, very bright. It's neon yellow because it stands out, okay? I'm standing in the middle of the street telling you to stop. That means stop. I'm not waving hi, Merry Christmas. This means stop. Listen, when you see me do this and try to get your attention and stop you again, it doesn't mean wave back to me and keep driving by me. Stop! Stop! Then what were you doing in your vehicle? I was paying attention to the cars in front of me. There were no cars in front of you. There were zero cars in front of you. You were the only vehicle traveling on that road for 500 ft. There were no vehicles in front of you. No, there wasn't. She almost runs me over a week You need to call me something. Officer Hinkle's actions demonstrated a lack of necessary temperament while the driver's response showcased commendable restraint. The Waterbury Police Department's swift action in terminating the officer demonstrated a commitment to upholding professional standards. But hold on your seats because this next case unfolds cops who get fired, arrested, and sued after unlawful arrest. On June 26th, 2020 in Loveland, Colorado, 73-year-old Karen Garner, who suffered from dementia and sensory aphasia, attempted to leave a Walmart with $13.88 worth of unpaid items. Store employees stopped her, refusing her attempt to pay with a credit card, and then called the Loveland Police Department. Officer Austin Hop responded, tracking Garner down as she walked home. Despite her confusion and inability to communicate effectively, Hop escalated the situation, grabbing and throwing her to the ground. Garner repeatedly stated she was going home. Officer Daria Jalali arrived and together they forced Garner to the ground again, ultimately placing her in a patrol vehicle. Loveland Police Department policy mandated officers attempt to establish a calm communicative interaction with individuals showing signs of mental illness. All right, let's stop, ma'am. I don't think you want to play it this way. Ma'am. Police, stop. Do you want to stop? Lights on, siren. Stop. You just left Walmart. Do you need to be arrested right now? No, no, no. Okay. Let's stop. I'm not doing anything. Right now you're resisting, which is not going to fly with me. And before that you tried to steal from Walmart. And they caught you and took the stuff back. Stand up. Oh, boy. I'm not doing anything. Why are you fighting with me? And why are you trying to slip the cuffs off? I'm going home. Stop. I'm going home. No, you're not. Are you finished? Are you finished? We don't play this game. You understand me? And if you try to kick me, oh, this is going to be bad. I'm going home. Stop. I'm going All right. home. I'm going home. I'm going home. Wait. I'm going home. I'm going home. There we go. All right. Sit down. I'm going home. Sit down. Sit down. home. Get in the car. In you go. Do not hook onto him. I'll come on the other side and grab her. What's that? Where is your sergeant? Huh? Who's my sergeant? Yeah. Okay, well, first, I can tell you that. Sergeant Metzler, he's at the police department. You can go talk to him if you have an issue. Yeah, give me your card so I can put a report. Okay. I see you sitting there how you throw the little kid. Little kid? Well, I don't know if you know little kid. And this is what happened. was just walking and I see you how you grab him. stole from Walmart and refused to stop, refused to listen to lawful orders, and to fight me. This is what happens when you fight the police. I have to use force to safely detain her. That's what this is. This isn't just some random act of aggression. Oh, well, we I don't know if you realize that. Yeah, well, the way that I see her from over there, you know, it was like that's not But you see, you don't know the whole situation. That's the thing. Yeah, you know, but it's like But knowing the situation, do you feel differently now? Well, yeah, but you know, like seeing it from there, that that guy just walking I get that. I get that. So when I went to go grab her and talk to her, she started running, leaving, pulling away from me, trying to fight me. Well, that's the thing, I didn't see her running, you know. Exactly. So before you go to a snap judgment, you got to get all the facts. But right here she wasn't running. I get that. I see her walking right there you pull over. to deal with this. You hang tight, okay? Get your feet in the car. All right. Yeah, let me see your feet. Get in the car. We'll get it. I want my credit card. Karen. I got your credit card, okay? It'll go with you. What's your date of birth, Karen? I want my credit card. I have it. You will have it with you. I will not lose it, I promise. What's your date of birth, Karen? What's your date of birth? What's your date of birth? Okay. Negative, sorry. I got nothing else. This is just from a credit card she has. Golly, she's probably like 4'10", 5' maybe like 100 lbs. How did you say you're tiny and you got Oh, you're good. I got her handled. If it was a big dude, it'd have been different. But she's like 20 lbs. It's 200. For what? Well, at least resisting right now. Is that 200? Yeah, okay. Hey. Let's get her down to the station. Okay, we don't need to wait for fellow. Uh no, we can see what what he I mean, we know we know she what she said. She stole some stuff and they caught her before she left and got it back and then she ran out. So we have the you contacted her for that. And then she resisted, obstructed. so We're good either way. So we're good either Either way she's going. All right. Unless they decide not to prosecute, I don't care. Cool. Okay, we'll head down there. At the police station, Garner was left handcuffed and without medical care for hours despite sustaining significant injuries, including a fractured and dislocated shoulder. Hopp's report falsely described the incident, yet higher-level officers approved his use of force. Garner filed a federal lawsuit leading to public outrage after the release of body camera footage. Hey, you got the door open. Come on, Karen. I'm going to run. You're going to run? Oh, good thing we got the handcuffs. I was going to pay for it. But you didn't. Hopp, Jalali, and Sergeant Philip Metzler were placed on administrative leave and later resigned. Criminal charges were filed against Hopp and Jalali. Hopp pleaded not guilty and his trial was scheduled for April 2022. The city of Loveland settled with Garner for $3 million, but this next case unfolds a corrupt cops who get fired, sued, and arrested. On May 30th, 2021, Officers Hanning and Summers of the Idaho Springs Police Department responded to a 911 call from Timothy Braden and Brittany Odom alleging their 75-year-old neighbor Michael Clark had assaulted Odom. Upon arrival, the officers spoke with Odom who appeared intoxicated and had no visible injuries. Her history included fraud, domestic violence, and DUI. Despite the lack of corroborating evidence, the officers proceeded to Clark's apartment. Under the knock and talk doctrine, the officers were within their rights to approach Clark's door. This is Brittany. That was the neighbor right there that we were on the call with. Wait, wait. This is Brittany. She's the one that got hit. I'm I live here. This is my friend, Brittany. And then this is my neighbor that hit her. I wasn't even here. I was outside. I literally just saw him. on the door like or through the wall. Bam, bam, bam. And I'm sleeping. Shut the up. And so I like came out and was like, "What what's going on?" He busted all my [ __ ] My nose, my mouth. All I I want All I wanted to do was like, "Hey, what was what was disturbing you?" And he was like, "Shut the up." Boom. Was he white, black? He's white. Does he have hair? Yeah, he's bald. Gray hair? Yeah, gray hair. He's a older guy. He's about this tall. That and that guy lives right there in that room. And that's where the wall would have been. He was saying before bang, bang, bang. That's what woke me up. We just moved in here yesterday, but I saw him, I guess, last night or the Okay. However, they lacked probable cause for an arrest. Odom's unreliable testimony and the absence of physical evidence made an arrest unreasonable. When Clark answered the door holding a sawfish snout sword, Hanning immediately escalated the situation. Clark complied with orders to put down the sword, but refused to step outside or lie down. Hanning then deployed his Taser without warning, causing Clark to fall, hit his head, and lose consciousness. I'm going to put my dog in the bathroom, okay? Okay. What do you want? What the What the MOTHER PUT IT DOWN. PUT IT DOWN. PUT IT DOWN. GET ON THE GROUND. DOWN. I'M TRYING TO BACK UP. BACK UP. GET OUT OF HERE RIGHT NOW. Get out here. I hit the Get on the ground. No. They hit that wall so hard. I thought they were going to come through the wall. Stop. Clark was legally entitled to carry the sword in his apartment. Hanning's Taser use violated department policy which restricts Taser use on elderly individuals and requires a verbal warning. Clark was not violent or resisting arrest and the Taser deployment constituted excessive force under Colorado law. After Clark lost consciousness, the officers did not immediately call for medical assistance. Instead, they moved his body into the hallway. Henning retrieved the sword and placed it near Clark, seemingly to fabricate a scenario where Clark was attacking them. This action could be considered tampering with physical evidence as they intentionally altered the scene to justify their use of force. Clark was hospitalized and later suffered a stroke, leaving him requiring 24-hour care. Officer Henning was charged with assault and terminated from the department. He pleaded guilty and received probation, electronic monitoring, and community service. Heart's unconscious. Sir. Sir. Sir. Sir. Sir, talk to us. Talk to me. Talk to me. Sir, talk to me. That is a good bat that he's holding. That looks like a freaking Where did you find that? Did you have to hunt for it? It was laying right there on the ground when I walked in. Clark, I did not Get that down. Not arguing with you. I did not get that down. All right. We're going to sit up. I did not get that down. I'm going to go down with you. I It was on Now, you want them out of cuffs up here? Okay. Did you go in my apartment and look for weapons? Mr. Clark, you're going to sit up. Did you Did you look in my apartment and look for weapons? We don't need They don't need to look at the apartment. It was here in the hallway. How did it get in the hallway? What is going on? I have done nothing wrong. What did I do? What's that? What did I do? You punched that girl. Huh? Punched that girl and then answered the No, I with a freaking machete, man. All right. Oh, no, that is absolutely false. All right. Okay. We're going to stand here. I had did not come after nobody. Okay. You're dealing with me now. We're going to go down to the ambulance second. I was just paying for that. All right. We're going to stand up on the count of three. Ready? One, two, three, stand up. I attacked nobody. I did nothing. Does this look familiar? I Just come on. Just Just sit. Just sit. I did not come at anybody. Sit down. Swing your legs up. Swing your legs up. Sir, swing your legs up. Be nice, please. Officer Summers resigned, but was not charged. Clark filed a federal lawsuit, which was settled for $7 million. The officers were criticized for their excessive force, delayed medical treatment, and tampering with evidence. Henning's taser use was deemed unnecessary and retaliatory, while the officer's staging of the crime scene was considered a deliberate attempt to cover up their misconduct. Clark, the victim of false accusations and police corruption, received a substantial settlement, though it cannot fully compensate for his irreversible health damage. But hold on your seats because this next case is more shocking than the others. On August 19th, 2022, Albuquerque Police Department officers Skin, Flores, and Ryken responded to a report of shoplifters at a Target store. They approached Matthew McManus, a 53-year-old man with disabilities who was struggling with a self-checkout purchase. The officers decided to criminally trespass McManus for taking too long, potentially violating the Americans with Disabilities Act, ADA. Title three of the ADA prohibits discrimination against individuals with disabilities in places of public accommodation. One Target could have accommodated McManus by offering assistance or allowing him extra time. Title two of the ADA applies to public entities, including police departments. While courts agree title two covers some law enforcement activities, its application to on-the-street encounters is debated. The officers informed McManus he was being charged with concealing identity and resisting officers. Under New Mexico law, criminal trespass requires the property owner to withdraw consent, which Target employees did not do. Additionally, the defendant must have actual knowledge of the withdrawal. McManus could argue his disability prevented him from understanding. McManus repeatedly stated he believed the officers were security guards. Resisting an officer requires knowledge that the individual is a police officer. McManus could also argue he resisted due to excessive force. Concealing identity requires intent to obstruct the law and only applies when an officer has reasonable suspicion to detain the individual, which was questionable in this case. I my things I I didn't know you were you were police officers. Yes, we told you that already. I didn't see your badge. Okay. Well, we told you, right? We identified ourselves Security guards said they were police officers. We identified ourselves as Albuquerque police. Let's go ahead and get him stood up and searched. The reason to talk to you was they didn't want you in there no more, okay? So, we have the reason. We asked you your name, you didn't give us your name. That's What was the reason? They didn't want you there, and they have that right as the business not to want you there anymore. We're going to help you stand up. We're going to put you in that patrol unit there, okay? Sound good? No, it don't sound good. Well, that's what's going to happen. 911, help me, please. No one's on the phone, man. I didn't see their badge. I didn't know they were police officers. Well, everything's on camera, just so you know. You can You came very uh resisting in the store and out here. No, I didn't I didn't do anything. I'm done explaining to you. That's why you're under arrest. You're under arrest, okay? That's not changing now. Well, who what? Concealing identity, resisting officers, okay? I didn't know you were police officers. How could I I told you. That's your own fault you didn't listen, okay? I can't help you with that if you don't want to listen. I I didn't believe you were police officers. Stand up. You didn't believe us, it doesn't matter. The security guards Just go over here. Don't resist anymore. Stop. Just walk, man. No. Just walk. No. I didn't do nothing. I was just about to pay my my my my money in the My money I don't know what the system was. Putting my money in the I didn't do nothing. We told you what's going on. Stop. I I didn't know I'm done with you. Stop. Separate your feet. We told you who we were. I don't know. I don't know. The security guards told me they were police Well, then sorry that the security guards told you that, but they We What's your name? Tell me your name. You're going to Tell me anything, man? Not till I get a lawyer. Well, that sucks to suck, man. No, no, I I have the right to remain silent. Not when it comes to your name. No, I don't know. That's You do, but that's why I know you're going to jail for concealing identity. So, Matthew, here's what you're under arrest for, okay? Concealing identity and resisting and evading you freaking officers, okay? Don't catch a felony charge by hitting me or anything. Step in. Just take it easy. All I did is doing it while paying for my things. No, I was just I was just explaining to you. And you had to cut off one of my fanny packs, you know, how hard it is to get my money out. And I was trying to get my money out and I got it all out and then then you came and I thought you were security guard. McMannis was taken to the hospital and issued a summons. Charges were later dismissed due to his incompetence to stand trial. Officer Skin was fired and faced criminal charges including false imprisonment, battery, perjury, and making a false report. He pleaded not guilty. The officers were criticized for their lack of empathy and poor discretion. They failed to accommodate McMannis's disability and escalated the situation. McMannis, deemed incompetent to stand trial, was commended for peacefully asserting his rights. The incident highlighted the mistreatment of individuals with disabilities and the need for better police interactions. The Albuquerque Police Department's decision to remove Officer Skin and the New Mexico Attorney General's pursuit of criminal charges were applauded. However, the lack of action against officers Flores and Ryken was questioned. The officers' actions demonstrated a lack of common sense and an inflated sense of ego. On October 17th, 2021, officers Roger Williams, Zachary Espinosa, and Tyrone Brooks Craig of the Athens-Clarke County Police Department responded to an anonymous call about a possible domestic disturbance at the Athens, Georgia home of Lyanna Beam and David Priest. The interaction was recorded on the officers' body cameras. Hi. Hi, how you doing? I'm Officer Craig with Athens-Clarke County Police Department. We got a call about a domestic disturbance here. No, um the dogs are back there, but we're fine. Okay, but uh can you tell me what happened? We were just mad at each other. Okay. Just screaming. We just had a fight. Okay. STOP OR you're going to get tased. So, I know why I'm getting Can I Can I please Can you please tell me why I'm being arrested? Right now, it's What? You're detained right now. For what? For what? Obstruction what? This is my property. It's a police officer. This is my property, man. Come on. I'm working at Saint Mary's. I know my The Fourth Amendment protects individuals from unreasonable searches and seizures requiring law enforcement to have a warrant or fall within a recognized exception. In this case, Mr. Priest refused to open the door leading officers to forcibly enter, chase him down, and detain him for obstruction. Georgia law states that obstruction occurs when someone knowingly and willfully hinders an officer performing lawful duties. However, the US Supreme Court has ruled that warrantless home entry is justified only under exigent circumstances such as an imminent threat, evidence destruction, or a suspect fleeing. Here, Mr. Priest's injury did not appear severe, Ms. Beam was no longer inside, and there was no evidence destruction or escape attempt. Since officers lacked a warrant or exigent circumstances, their forced entry likely violated the Fourth Amendment. This also means Mr. Priest's refusal to open the door was not obstruction as officers had no legal authority to demand entry. Get up. This is my house. What are you doing? This is my house. I didn't ask you to come in here. Don't put me in that [ __ ] car. You're going to jail now for obstruction. From what? You came to my house and you put me in You came to my property and why are you doing this? Why are you doing this? Please, help me. You just came into my house. I had no problem. You just arrested me for nothing. Why are you Why are you doing this? You're going to jail for obstruction. We already explained it to you. I literally was at my house. You knocked on my door. Why are you I honestly don't You got anything on you anything I know about? No, I have nothing on me. Why are you doing this to me? No, why are you doing this? Stop. Try and see or you can catch another charge. That's your choice. I have no Can stop. Do not pull away from me. Get up. Get up. Get up. Get up. No. Get up. You used the wrong breath. Get up. Then you can stay right here. I don't do I don't do drugs. I don't do anything. We didn't say anything about drugs. You have any on you? Get up. Stop touching me. Get up. Stop touching me. Stop. Get up. No, I haven't done anything. You're treating me bad. I haven't done anything to you. I really just live here. I don't know why you're doing this. I really don't. I I don't. I think you're a good person. Why are you doing this? stand here, the more charges you're going to get. Every time I tell you to get up and you don't, that's obstruction. But why am I getting any charges? I haven't done anything. No, why are you doing this? I haven't done I haven't done Get up and get in the car. Okay. Stop. Do not touch me. Get up. Get up. As soon as you get up, I'll let you go. Don't touch me. Get up. Let's get up. Get up. That's two. Get up. That's three charges. Get up. That's four. Let's go. In the car or I'm going to slam you on the ground again. In the car. In the car. Get in the car. Go. Get in the car. Get in the car. I don't care. Get in the car. Get in the car. Get in the car. Get in the car. This is my last warning. I'm telling you or I'm going to slam you on the ground. Get in the car. I'm trying to be nice. Get in the car. Get in the car. Get up. Up. Get up. She was pulling away from me. Get up. Officer Williams' actions raise serious concerns about excessive force and department policy violations. While police are allowed to use reasonable force to accomplish lawful objectives, the Athens-Clarke County Police Department's policy requires officers to consider various factors, including suspect size, level of resistance, and potential threats before applying force. Here, Ms. Beam was handcuffed, significantly smaller than Officer Williams, and had not attempted to attack him. Despite this, the officer repeatedly slammed her to the ground, causing her to hit her head and become unresponsive. We don't know what happened. We know We don't know. No. Yep, they were fighting. She's She had blood on her hands. Refusing to let us talk to him who's covered in blood. She starts pulling away from me, and then that's That's what happened. I've been trying to get her in the car for 20 minutes now. She starts pulling away from me. So, she has to get on the ground. Get up. You got to stand up. Let's go. Get her up. Get her up. We have EMS on the way. Girl, you got to sit down. You got to get her to sit up. Yeah. Come on. You got to get in the car. Just come on. Come on in. You want to slide her up? Okay. Yeah. Just turn her feet in. They want her to We got to close the door cuz she'll come out. Go ahead. I got it. What happened? Try to avoid this. We finally got her. Is this your friend? So, she's very intoxicated and she's going to jail. So, she hasn't been searched yet. I couldn't get that I like literally just got her in the car before. That That makes sense for the broken glass noise, but I'll finish filling you in over here. So, I'm going. I'm muted. I'm pretty sure she was, too, and I got cut. I don't know what that's going to be. So, is it his blood or her? I 1019 cuz she was I'm pretty sure No. Just to make sure she's okay, and I got a little cut right there, so. I don't I don't We didn't get that far. Hey, how are you? I'm Sergeant Emmett of the Clarke County Police Department. What's your name? Okay. What What's your last name, Leanna? Beam? How do you spell that? B E A M? Okay. So, I don't know why I'm being held. Okay. So, here Here's the Here's the situation right now. I'm going to explain it to you, okay? So, you are currently under arrest for obstruction, okay? You're interfering with an investigation in reference to a domestic incident that we got a phone call about. And then you repeated it You then you repeatedly refused to cooperate with the officer because you're being in You're being detained. You're lawfully detained. And when when you refused to comply with the officer at that point in time, and you're resisting, and you're pulling, and you're trying to run off, Well, unfortunately, that's not an option at this point in time. Okay? Do you have anything on you at all that would get you in trouble? You have any guns, drugs, knives, bombs, anything like that? Okay? Do you have any pockets on what you're wearing at all? Okay? So, is it Is this like a dress kind of thing or something like that? Okay? So, because you are detained and cuffed, we have to check you to make sure that you don't have any weapons or anything like that on you, okay? So, would you step out of the vehicle for me so I can use the back of my hand and check you? But, you're going to have to go back in the back of the vehicle, okay? Because you're under arrest. For obstruction. Ob- obstruction of a police officer. Well, ma'am, when you refuse to comply, Yes, ma'am, because we received a phone call. In reference to a domestic incident where we heard broken glass, and we need to investigate the domestic incident, and you interfered with that investigation. It doesn't matter if it's your house or not. We have a requirement. Go ahead. Sergeant Caleb tells Ms. Beam she's under arrest, claiming officers must investigate domestic disturbances. Georgia law requires police to file a family violence report, but does not mandate warrantless home entry. The Georgia Commission on Family Violence advises officers not to enter a residence unless there's probable cause, an ongoing confrontation, or an immediate safety threat. Since Ms. Beam asked them not to enter, and no emergency existed, a court would likely find the entry and her arrest unlawful. Yeah, this is not helping the situation at all right now, okay? That's fine. I wasn't here when that happened. I'm sorry. Well, when you're pulling away and resisting, that's doing something, okay? Well, you're still under arrest. Turn around and face the door for me, okay? You don't have anything on you, right? Okay. Let's do a double check to make sure, okay? Have a seat for me. Slide on in. Get your feet in the car, please. Watch your head, okay? Watch your knees. So, it doesn't look like there's any way for her to have anything on her or anything like that cuz it looks like it's pretty much just a dress. I didn't feel anything bulging or anything like that. Are we just obstruction times two? Is that what we have right now? There's 41 in the in the house after we had to go in there and get him. She's not telling us anything of what happened. He's got Friend cuz said that she got no She got told that he punched a window and busted it, which was If he did do that, which would explain the broken glass in the car. Um Have y'all seen Did y'all see a window busted or anything? Okay. So, um Is his hand busted? Look like he punched through it? I would do that and then just I would That's what I would do. So, we're pretty sure he He punched the window and broke the window. So, we have criminal trespass and obstruction on him cuz said he was fighting against them, too. Yeah. Yeah. And so, we got both of them for obstruction. them to check him. That's why I was asking if he was disorderly or not. Yeah. So, let's figure out just if every- everybody's more calm now, it seems like. Let's figure out charges, and once we figure out charges, we'll just get them out to the jail. Sounds good. Yeah, I just wanted to make sure that they're okay medically. Well, she got taken down, and not sure if she lost consciousness or not was kind of the original concern. But, he's got a busted hand, and he's cut all up. She's conscious and alert, so I'm assuming at this point. So, she just wants to go home. She's intoxicated. We had a call for domestic, and then she didn't want to get out of the way, didn't want to allow them to do their investigation, and then he's cut up and bloody, and then he didn't want to let us do anything, wanted to fight against us, so She's what? She's answering all my questions properly. She says she doesn't want medical attention. What do you I mean, I I just wanted to make sure she was fine because Yeah, she says that she doesn't she doesn't think that Thank you, guys. I'm going to go home. I'm under arrest, and Yeah, you're still you're still under arrest. Following the incident, Ms. Beam was charged with obstruction, but prosecutors dropped the case on August 23rd, 2022, citing public interest and justice. Mr. Priest faced obstruction and criminal trespass charges, which were also dismissed on May 17th, 2022, for the same reasons. An internal investigation led to Officer Williams' termination on May 4th, 2022, which he appealed, but a personnel review board upheld the decision. On August 14th, 2023, Williams filed a federal race discrimination lawsuit against Athens-Clarke County, which is still pending. Notably, Williams was previously involved in a 2019 excessive force case, where he shot Salvador Salazar three times, resulting in a $250,000 settlement. That's all for this video.
