Sir, I'm I'm telling you. You're giving me an order to take a test. Well, just if you don't mind opening the door so I can at least see what's going on down there. Look, I'll do I'll do your test. I'll do your test. What am I being detained for? What am I being detained for? Don't touch me. Don't touch it. Get off me. These were multiple times when corrupt cops get destroyed by higher authorities. Starting with the case of a law student who owns corrupt cop and exposes his crooked past. On July 29th, 2023, Sergeant Eric Mlan of the Senica Falls Police Department, stopped Christopher Welch, a former law student, for a defective headlight in a Burger King parking lot in Senica Falls, New York. Sergeant Milan was soon joined by officers Bryce Rumsfeld and Colin Zetto. The interaction quickly escalated as Welch calmly but firmly refused to comply with sobriety tests and resisted a frisk despite the officer's repeated requests. Welch insisted he had not consumed any alcohol, explained his refusal to take tests, and maintained a respectful yet assertive demeanor throughout the encounter. During the stop, Sergeant Milan pointed to Welch's watery, glassy eyes and a fruity smell in the vehicle as signs of intoxication. How you doing, sir? Hi, how are you? Sergeant McQueen with the Sonic Falls, please. Put you over cuz you have a light out in your vehicle. You know, I was actually wondering that cuz it was a little like, you know, it wasn't lit up 100%. Gotcha. Yeah. Yeah. Okay. Do you have a license on you? I do. Yes, sir. Where you coming from tonight? I'm actually just coming from my house to here to get some dinner. Okay. Everything valid on your license? Uh oh, yeah, absolutely. Okay. How many alcoholic beverages you had tonight? No. Nothing? No, sir. Okay. Yeah, I was going to get that. Oh, I thought you were handing that to me. Oh, no. Okay. All right. You have registration for the vehicle? Uh, you know what? I I mean, it's it's legit. I just don't have it in here. Okay. Is the car registered to you? Um, I think it's my girlfriend Jennifer. Just want to just It's one or the other. Okay. Just want to turn the car on real fast to see just to verify the headlight is still off. You just stay in the car. I just let you know. Yeah. No, not No, you're good. Just a passenger side one. Uh, you just stay in the car for now. Take a look at your license. I don't know. Probably my Pops or something. Okay. Yeah. You got to take a look at your eyes real quick. You don't mind? Nope. I was looking for a pair of drivers to see. Oh, yeah. I don't I don't take those tests. No. No. Why not? I just No, I don't take tests, sir. Okay. Okay. Well, I'm asking you. I'm want to make make sure you're okay to drive your vehicle. Yeah. No, I understand. I don't I don't take tests, though. Okay. Why not? I just don't. It's no disrespect to you. No, I am performing an investigation right now. Okay. To make sure you're okay to drive your vehicle. Yeah. I won't I don't take tests, sir. Why not? I just don't. I mean, I I take, you know, I am a law student for one, and two, I just don't take test. All right. Sit tight for me, please. Okay. I'm smelling some sort of alcoholic beverage. Smells like it's a fruity drink. Okay. From inside of his vehicle. so I could check his eyes in his vehicle to see if he's willing for any sort of test. He goes, "No, I order to do tests." Um, he's not doing any tests. I want to see if he get the same odor when you go up there. Okay. Um, see what you think. I'm going to go get my flashlight. Sure. However, Welch countered these claims by citing his asthma, allergies, and the possibility that the smell came from a non-alcoholic beverage. Although New York law requires chemical tests after a lawful arrest for DWI, it does not mandate field sobriety tests, which Welch declined. Courts have ruled that refusal to submit to such tests can be used as evidence, but cannot be grounds for arrest by itself. Despite this, Sergeant Milan attempted to coersse Welch into complying and even ordered him not to drive. A move that exceeded legal authority since Welch was not arrested or charged with impairment. You want to answer any questions? Why? Why is that? Because he's trying to give me tests and he's accusing me of drinking. I just as I asked you a question, sir, to perform test. I understand, sir. I'm doing investigation right now. I don't I don't drink for number one. Okay. And you're asking me if I've been drinking, sir. I don't drink. Okay. I don't know that. I never met you before. Well, I'm just an investigation. Make sure you're safe. That's all it is. I understand, sir. But I don't answer question. It's no disrespect, but you know what I'm saying at all. I understand. Yeah. And you know, no offense, but I feel like you're kind of coming on a little strong. I'm just doing my job, sir. I'm just because a vehicle smells fruity. No, fruity alcoholic beverage like I stated to you, sir. Well, the you also have watering glassy eyes. Another sign of intoxication. I have sinuses. I have allergies. I also have asthma as well. Okay. Does that Does that cause your eyes to get watery glasses? Yes, sir. Absolutely. Cuz I also have asthma. Absolutely. Sinuses, doctor. Yes, sir. Okay. But do you have no issue? Wait, if you're not drinking, man, there's no issues taking a test. I don't take tests, sir. They're just I just don't do it. I'm sorry. Okay. Do you have a supervisor? I am a supervisor on Do you have a supervisor? I am a supervisor working right now. Okay. Do you have one available? No, I don't. I'm I'm the supervisor right now, sir, on the shift. Okay. I'm asking you to exit to make sure you're okay to drive right now. I'll exit, sir. I'm not I'm not, you know, I'm not going to just Okay. And I appreciate that. You want me to exit? I I want you to exit to make sure you're okay to drive. I'm giving you a law for exit your vehicle. Make sure you're okay to drive. All right. That's all I'm doing. Use my wallet. That's Don't you don't need your wallet or anything. Again, I'm not taking any test. So I don't know what what your you okay to put this in my is this okay nothing on you mind if I get back down for my safety I do mine yes sir I don't I don't Well that's going to be an officer safety check I'm not I don't comply it's just going to be put back down for our safety that's all it is if you have to do it I'm not going to hold anything go ahead if you have to do it this is embarrassing it's not embarrassing I run a local business I'm not there's nothing against you if you get out of the car I just want to make sure that's your wallet that your put your wallet in I don't answer questions I'm just I'm just double prophecy. I'm getting clues of intoxication. I answered your question, sir. I understand that drink. If you're getting any clue of intoxication, you need to go back to school. I've been a cop for 8 years. I know what signs of. I'm being honest with you. Okay. Well, I don't I don't know that. I never met you before. People have told me a lot of things in the past. All right. So, what I want to do is check your eyes. Make sure it's okay to drive. Absolutely not doing that, sir. Would you be able to walk for me? No. Absolutely. Absolutely not. Okay. believe that you think I No, if you had nothing to drink tonight, this would show that you had nothing to drink. Sir, I'm not doing that. Why is that? Because I do not I' I've been through law school and everything else. I do not comply. You do not comply with a lawful order. Sir, I've answered your question. All right. What I'm giving you is a lawful I'm giving you an order, sir. I'm I'm telling you. You're giving me an order to take a test. I'm advising you to take soriety test. Make sure you're okay. I will not take a test. No disrespect. I have We're not trying to disrespect you either. You are because you you keep asking me multiple multiple times. Sir, sir, we have a job to do. Okay, that's all it is. It's no disrespect towards you. I've answered your questions. I will not take any tests. I will not. And it's no disrespect. I have a lot of friends at law enforcement. You know what I'm saying? I would not disrespect in that way. I do not take tests. I do not. In fact, I've dealt with you before um previously. Recall recall when I was on Ripmer Lane. um before I you came to my house um and asked me a bunch of questions. Okay. Also, you know, again, oh, was that about was that the Uber thing? Yes, sir. Okay. I do. And I was more than a respectful and I appreciate I'm a little nervous because here I am at Burger King getting dinner for my family, you know, and I get nervous when I speak to cops because I just get it. But you pulled me over for a headlight. That's correct. Okay. Now you're Now you're pushing it. You're I'm not pushing you. I'm just doing an investigation. You're claiming fruity alcohol. You're saying something that smells fruity. So fruity alcohol million things. I deliver groceries for Walmart. So maybe I also said you had water and glossy eyes. That's a sign of intoxication. Many people have that. Okay. Well, I don't know. I never Just because somebody has glossy eyes doesn't mean anything. Yes. It's a It's a sign from our training and experience. It's a sign of intoxication. Okay. Well, okay. So, what are you going to do with this, sir? tight. Sergeant Melan also ordered Officer Rumsfeld to frisk Welch without reasonable suspicion of being armed. A search legally questionable given the circumstances. When Welch resisted, the officers continued pressing for compliance, which raised serious concerns about the legality of their actions. Ultimately, Welch received only a citation for the defective headlight, but was compelled to call someone to drive him home. This order was later criticized as an unconstitutional seizure under the Fourth Amendment. Following the incident, Welch filed a lawsuit against Sergeant Mlon, the other officers involved, and the Senica Falls Police Department. He also obtained Sergeant Emlan's personnel records from his previous department, revealing a troubling history. These records showed Milan's repeated disregard for citizens rights, including a 2020 incident where he used a taser excessively on a nonviolent individual and a pattern of unjustified obstruction charges against those refusing sobriety tests. Despite warnings from superiors at his former department, Milan continued his defiant behavior and eventually resigned. But wait for this next case where a female cop messed up big time. On the night of September 5th, 2023, contractor Bradley Connley was resting inside his vehicle after hours in the parking lot of the Monument Valley Shopping Center in Grand Junction, Colorado. The shopping center had been vacant since 2015 and was undergoing construction for a combined Dollar Tree and Family Dollar store. Mr. Connley, who was authorized to be on the property after hours due to his work, was approached by Officer Tuya of the Grand Junction Police Department after she noticed his vehicle in the otherwise empty lot. Officer Tuya asked Mr. Connley for identification and questioned his presence, requesting proof that he was authorized to be there. Mr. Connley explained that he was the contractor working on the store, but declined to provide his ID, questioning the legality of the stop and whether he had committed a crime. Officer Tuya insisted that without proof of permission to be on the property, Mr. Connley was trespassing under Colorado's thirdderee criminal trespass statute section 1844. This statute makes it a crime to unlawfully enter or remain on someone else's premises. Hello. How's it going? How's it going? I'm building this store right here. Okay. Yeah. You got stuff in there then? Oh yeah. Okay. Um I just left it up. Okay. Do you have your driver's license with you? What do I need that for? So, um I want to verify that you are supposed to be here. Um what kind of store are you guys working on? Okay. If you want, I can just open the door for you. Okay. Um who's a good contact? Um I'm him. What do you mean I'm him? I'm the I'm the guy. So, how do you have any paperwork or anything? I know you might have a key. You said you could lock it up or open it up and stuff like that. Do you have locked it up? I just got I just got But do you have like a contact number that I could verify like who you're leasing the property from or anything like that? So I I'm a little confused. Um normally people don't have any problems identifying themselves. Well, cuz I want to I know I know you're doing construction from here. You told me that you're that is that what it usually is. Nobody has any any problems. So the other thing is is you know it's after hours. It's kind of weird to have people even construction workers to be on site at this time of day. How can I verify that you are supposed to be here besides you having a key to that place? I guess just come here during the day. Well, I don't work daytimes. You don't want to give me a phone number and you don't want to identify yourself to me. Well, it's not that I don't want to identify you. It's just that have I committed a crime? I I don't know how. So, yes. Unless Unless I can verify you are supposed to be here, then you are trespassing. Is that how that works? So, you're on private property. Yes. I don't know how trespassing works. So, if you're on private property, you're trespassing. That's the trespassing law. Yep. Really? If you if you just want to hang tight, I have another officer coming. So, we'll just hang out and we'll wait and we'll just go through that. You don't have any weapons or anything? There's no not one weapon in here, though. I mean you no ill will or no harm. And I don't mean you any disrespect whatsoever, but um you're not going to get my ID. I promise you that. I'm not committing a crime. I'm supposed to be here. So it'd probably be best if you just left left me alone. Okay. Yeah. Okay. I'm sorry you feel that way. No, that's just the way it is. That's the law. So what do you mean it would be best? You got your body camera? Absolutely. Okay, awesome. You'll be on YouTube and it's not a big deal, but it is a big deal because if I haven't committed the crime a crime, which I haven't, it's going to be best for you, your department, everything as far as looks if you just did the right thing. Did your job. Well, do you mind uh while I'm here just keeping your hands where I can see them? Yeah, of course. Thank you, sir. That's why I asked you if you want me to step out. Yeah. And like I said, we'll wait for my partner to get here and we'll go through all that. What was your name? I'm Officer Tafoya. Your badge number? 17-8. That was very good. Yeah. All right, Officer Dress. So, we're going to go around to the other side. This gentleman agreed. He's going to step out of his vehicle. Um, he's refusing to identify himself. He said he's not going to identify himself. What I said was that it best for us. He wanted to just make sure she was here alone. So, make sure that I do have an open container there. So, and he says he's not trespassing. So, we'll go around and Okay. Okay. So, do your favor. Set the car off. Thank you. Oklahoma. You want to detain him? Yeah. That was Paul Mary 496. I'm going to put my shoes down. Well, just uh if you don't mind opening the door so I can at least see what's going on down there. Does that make sense? Sure. Yeah, I see the ranch and stuff. So, yeah. All my all my tools are right inside that building, too. Okay. Oh, got a little partner there. Hey, she goes everywhere I go. Oh, young lady. And like I explained to her, I have no ill will, no weapons in the car. So, okay. Is there a reason you don't want to identify yourself? I'm a constitutional right advocate. first and foremost. Second, I just build stores and I'm building I've been down here 7 weeks building that one, making sure there's been some suspicious weird activity and there's been other officers around here. She's not going to come out, is she? Uh, she might. I don't know. All right. So, sir, I am going to detain you. Okay. I do need to identify yourself. You're refusing to identify yourself. Have I committed a crime? I know I've asked. What's the crime? You're trespassing and you do have an open container in your private property, right? Yep. So, I do need you to go ahead and turn around and turn in the background. 35. And I don't obviously consent to any Do you have a wallet or anything on you? I do not. Okay. There's nothing. While the law defines premises to include parking lots, it also clarifies that a person is only trespassing if they do not have a license, invitation, or privilege to be there. Normally, a parking lot open to the public during business hours grants an implied invitation to customers, but after hours that invitation typically ends. Therefore, the officer argued that unless Mr. Connley could prove he had consent, he could be charged with trespassing. Despite Mr. Connley's calm and respectful demeanor, he refused to identify himself, asserting his constitutional rights and questioning the officer's authority. Backup officer Drestler arrived and Officer Tuya detained Mr. Connley in handcuffs, citing probable cause not only for trespassing, but also for an open marijuana container and violating a city ordinance prohibiting camping in public areas. However, the marijuana charge was questionable since the statute applies only to public highways, and the camping ordinance only applies to public or government-owned property, not private lots like this one. Further complicating the situation, it was discovered that the part of the parking lot where Mr. Connley was parked belonged to a nearby church, which expressed a desire to pursue trespassing charges. Mr. Connley believed he was parked on the shopping cent's lot. A reasonable confusion given the lack of clear boundaries between the properties. I know you said you've been previously contacted by law enforcement. Have you been contacted by law enforcement here at this address before? Well, yes. They stopped by all the time. Not contacted. They just came through and seen how I was doing when I was working. Well, that's completely different, right? Yeah. Okay. Was that daytime or night time? And daytime. Both. But I'm not answering any more questions and I'm not talking to you. Okay. And I have a campsite in Fra of So, how could we mediate this and mitigate this for next year? I'm not talking. You can do it and say whatever you want. I'm not answering your questions. Check. So, I would say probably and I'm trying to be respectful to you, but Well, it's kind of rude if you're interrupting because it's kind of rude that I'm in handcuffs right now. You expect me to be happy? I'm not. The best thing that I told you before the best thing you could do is just go about your way. I'm not breaking a law. Well, I'm sorry. I'm trying to help you, but you're not helping me by handcuffing me. Are you kidding me? Say something. No, I don't want to hear your bull. Okay. If you want to contact the owner of the property, go ahead. I can't tell you anything else. And yes, I know him personally. I'm building this 18,000 square foot. So, how do I get a hold of the owner? I got his number. Okay. Do you can I get that from you? Hell no. Okay. Get it another way or just uh take my word for it. or if nobody's made a complaint that I'm trespassing, go along your way. But I know one thing. You have about what 20 minutes. And either way, it doesn't matter to me because I've looked at it before. So, whose car is this? I Sir, I don't answer questions. Well, it's not yours. I'm not the registered owner. I don't answer questions, sir. Okay. So, it's it's I haven't committed a crime. Yeah, you have. What What crime? You're in a parking lot of a closed business. Nothing's open. And you are trespassing. Not trespassing. That's not how it works, sir. It's not. With all due respect, go ahead. That's not how it works. Trespassing, you got to be asked to leave if you are. And if given the opportunity to actually leave, and you should know this. So, a reasonable person that says, "Can I have your name?" I'll give you a Well, let me speak for a second. Articulate it. Just put it on camera. I just so a reasonable person who's in this situation who says I know the owner would say hey if we call this guy and he tells you that he knows constitutional right advocate you don't have the right to just come up and and put me in handcuffs and demand that I I sir without doing this um you're absolutely right it's not and a reasonable person in a situation like this says yeah my name is officer Drussell 2017 if if you could get a supervisor out here that'd be awesome so yeah we'll work on that Okay, thank you. Now, other than that, I don't answer questions, and I'm not committing a crime. So, you're doing this all without me committing a crime, and I and I know the law very well, and I don't break it. Okay? And this ain't breaking the law. And you can't just come up and either detain or arrest. Now, if you tell me you're going to arrest me or else me give you my name, I will at any point during this, if you say, "Hey, my name is Brad, by the way, because you told me your name and bad number. I appreciate it." Hey Brad, we're going to arrest you if you don't give you your me your name. I'll I'll give you my name gladly. Other than that, I have nothing more to say and you're not getting my name or fingerprint reader or any of that. There's nothing illegal in there, but it'd be really nice to let me put on a sweatshirt right there. It's kind of chilly out here. Or just let me go. So, you know, I know you don't want to listen to us and you're not going to, but I'll listen to you. This all could have been like it could all been okay if she walked up and and said, "What are you doing?" And I said, "Hey, here's what I'm doing. I'm building a store." You know, let me speak without interrupting. I don't I mean, with all due respect, once again, I don't want to hear it, man. I've heard it a million times. Well, I don't want to hear it either. I don't want to hear cops playing. Well, what are you going to do? I've already told you. I'll give you my name if you say you're going to arrest me if I don't. Otherwise, um, kick rocks. And I'm not trying to be disrespectful, but you're violating my rights right now. I've said it several times. I'm saying it again. I've haven't broken a law. And you can't tell me a law except I'm trespassing, which I'm absolutely 100% not. Like I said, there's no reason for this. I have no ill will, no harm or nothing. You could take these off and I could put a sweatshirt on. This encounter highlights a serious issue. The officers placed the burden of proof on Mr. Connley to demonstrate his right to be on the property rather than having reasonable suspicion or investigating properly before detaining him. The prolonged detention in handcuffs, despite no evidence suggesting danger or flight risk, likely violated Mr. Connley's constitutional rights. He maintained composure throughout, complied with lawful commands, challenged the officer's actions, and later shared the incident on his YouTube channel, fought the charges in court, and pursued a civil rights lawsuit. But in this next case, cop assaults an attorney, then the entire department gets crushed by the feds. On April 16th, 2019, in Louisville, Kentucky, officer Mark Batson of the Louisville Metro Police Department pulled over 64year-old attorney Douglas Miller for allegedly driving 76 mph in a 55 mph zone. Though the initial interaction wasn't recorded due to Batson failing to activate his body camera, the majority of the encounter was captured. During the stop, officer Batson discovered an empty beer bottle under Miller's seat, which Miller denied was there. Batson proceeded with field sobriety tests and requested a breathalyzer. When Miller hesitated, Batson abruptly ordered him to turn around to be arrested. Miller agreed to take the test, but Batson grabbed him by the shirt, threw him against the patrol car, and took him to the ground. Do me a favor. Go ahead and step on out. Yeah, if you want to. You lied to me. You lied to me. You have anything on you I need to know about? Drugs, guns, knives, the beer bottle under your feet. No, I don't have it. Step on back here. We're going to do some field sobriety checks right back here. Stand right there for me. I didn't know if you meant I passed. Okay. Walk over to the front of my car. Just stand right there for me. You ever taken one of these before? No. Like I said, I've got one in my car. Like this one? No. out in the old out sensor. Yeah, this is the new and improved one. So, just going to be take a deep breath in. You're going to hold it for just a second. Will you do me, did I pass those test? Cuz if you're an attorney, you know, it's not a pass fail test. You have shown some clues of impairment. How long have you been on the 10 years? Are you going to do this or not? You want me to do? It's your choice. No. Are you willing to do this or not? What are you going to do if I say no? You're going to arrest me? I have no idea. I mean, I've already seen the Bible under your seat that you told me wasn't in there or that you were hiding when you were driving, which is tampering with physical evidence, which isn't a felony. Go ahead and turn around for me. Put your hands back. No, look, I'll do I'll do your test. I'll do your test. I'll I'll be your Get on the ground. Roll over right now. 11:35. Start me a car. One fighting. Roll over on your stomach now. Now. You're under arrest. I got you. Get on the ground. Put your hand behind your back right now. I'm not struggling. Put your hand behind your back. Put your hand behind your back. Okay. Put your hand behind your back. You're holding my hand. Roll on your stomach right now. Okay. See? Yes. At this point, you are under arrest. And I told you that before. Now you got resisting. Oh my god. Stay right there. All right. I'm not doing anything. Oh, 11:35. Start being serious. Tell me this is a dream. Tell me this is a dream. Oh, you bloody my should stay there. I'm not going anywhere. Quit leaning up. You got blood. You bloody my nose. Oh god. Oh god. Please save me. Save me. I'm not going anywhere. You don't know you're not on me. Yes, I do. You haven't been compliant the whole time. Please. You're hurting me. Stay there. Please. You're really hurting me. Oh god. Please. Please. Stop. Stop. Quit moving. Stop resisting. I'm not resisting. You're killing me. He's already cuffed. He needs to go in a car. Okay. I I'm I'm already cuffed. Oh, please stop. Okay. Oh, please stop. Just relax. God almighty. Do not move until I tell you to. Okay. I'm not I'm not Oh my god. You don't have a back seat, do you? Stand up. Nope. Just sit tight, man. I'm not doing Where are you? Quit moving. Don't need to be checked out. Right back. Quit moving. No, I just need anything. He just needs to go in a car. What's that? He needs to go in somebody's car. All right, roll over to my side. There you go. While radioing for backup, Batson grabbed and squeezed Miller's throat, falsely claiming he was being combative. A tow truck driver helped Batson handcuff Miller, though body cam footage showed Miller never resisted. Once on the ground, officer Troy Best arrived and dropped a knee onto Miller's neck while both officers restrained him, pressing on his neck for nearly a minute despite Miller being handcuffed and repeatedly shouting, "You're killing me." Officer Batson later claimed Miller was resisting, omitting all mention of choke holds in his report and describing his force as closed hand strikes and pressure point techniques. His supervisor, Sergeant Matthew Keller, supported this version in a use of force report, downplaying the force used, and claiming Batson acted within policy. Ultimately, Miller was charged with speeding, DUI, resisting arrest, and thirdderee criminal mischief. At the jail, Miller's breath and blood tests showed a BAC well below the legal limit, 0.0 0 64 and 0.067 respectively. The second car. Ow. Oh god, you're killing me. God almighty. Go and have a seat for me. Highway. Just make sure you keep your camera on with him. So, we're good. Perfect. Just wait on EMS and we'll get him down to the book. Thank you. He's an attorney. He's an attorney. Yeah. My camera's on. Yeah. Can you ride a tow slip? Yeah. So I can get that car and get out of here. Uh, Sergeant Keller should be on his way. Okay. Cuz we're going to have to do paperwork on him. Oh, yeah. So, you have the right to remain silent. Anything you say can attention to court of law. You have the right to consult within attorney prior to and during any questioning. If you choose to answer any questions or make any statements, you can stop at any time. Do you understand your rights? Okay. Thank you. I uh I just meanded him so we're good. Whatever he says now. Beautiful. Thank you. You okay? Yeah, we got to do an air on him. Good. He's bleeding. Well, he's being charged resisting, too. So, good. He's been burning, so Oh, great. So, what the hell happened to you? I don't I don't know. I'm an attorney. I'm not going anywhere. What? Well, you should have you should have got handcuffed the right way then. Huh? You should have got with the program and got a handcuff the right way then if you're not going anywhere. You already resisted. You already resisted. So, you weren't here. No, but I trust my officer. You want to loosen this up? Especially when when you're intoxicated and he's not. Have you ever been arrested? No. Have you ever been in handcuffs? No. Okay. Well, that's how they feel. Okay. It's not killing you. Take this video. We're going to watch it. See, I'm telling you. Well, you're intoxicated. Want to bet? Huh? You want to bet? So, you're not intoxicated. You haven't had anything to drink. That's what you're saying? I didn't say I wouldn't have had something to drink. Okay. Well, I didn't say you were drunk. I said you're intoxicated. smell. I can tell you are. I smell it. We'll see. We'll see. So, you haven't had anything to drink? I didn't say that. What did you say? You said you weren't under the influence. One drink is under the influence. Really? Really? What is it written that? Well, you're a lawyer. You tell me. I know what the law is. Okay. Feel a little better now? Yes. All right. Good. Now, would you like to go to the hospital or not? I don't I don't think I need to go to the hospital. You don't think you need to go to the hospital? No. Okay. All right. Hang tight. Hang tight. All right. Turn and face the police car, please. Thank you. His injuries were more severe than initially recognized. He suffered a ruptured artery in his leg, could not walk for 6 weeks, and had visible facial bruising. Miller later filed a civil lawsuit, which is still ongoing. In 2023, the Department of Justice cited Miller's case in a scathing report detailing systemic excessive force and accountability failures within LMPD, including unauthorized use of neck restraints. The DOJ concluded Miller's arrest was a clear case of unjustified and excessive force, one that exemplified the department's widespread misconduct, lack of oversight, and constitutional violations. Next up, cops ruined his life over nothing. He missed his daughter's graduation over a false arrest on May 31st, 2024. Rusty Moore was pulled over by an officer with the Little Falls Police Department in Morrison County, Minnesota, after a caller reported that a vehicle with Moore's license plate was all over the road. Trooper Megan Bozer, a drug recognition evaluator with the Minnesota State Patrol, arrived shortly after and began an investigation. Moore, who had just finished a shift in Alexandria and was on his way to his daughter's high school graduation, was cooperative and calm. He explained that he had taken his prescribed 30 mgram dose of Adderall at 6:00 a.m., as he does daily. Despite this, Trooper Bozer expressed concern about his glassy eyes and decided to conduct field sobriety tests, although she did not inform Moore that these tests were optional under Minnesota law. During the tests, Trooper Bozer noted an elevated pulse rate of 116 beats per minute, which she later cited as evidence of stimulant impairment. However, experts agree that stress and adrenaline, especially during police encounters, can produce similar physiological responses. Moore completed the Romberg balance test and other assessments without issue. They did. You have your proof of insurance? Yep. Would you like to see it, too? Yes, please. Yeah. So, is it okay to open it up? Absolutely. You don't have any knives, weapons, guns, or anything in there? No, it Yes, that's just fine. Where you coming from? Uh, Alexandria. Just got off work on my way to my daughter's graduation. Alexandria? Yeah. High school graduation. Yep. And you own the car? Yep, I sure do. What were you doing in Alec? I I worked there for Markley drive for what? Markley Asphalt. I drive a semi- dump truck. Gotcha. There's God working. What were you doing while driving? Were you on your phone or something? I got handsree. Well, you were called in for being all over the road. Yeah, that don't make no sense to me at all. Okay. There's no reason that you would have been all over the road or wasn't ever all over the road. Somebody must be Josh and it must be a prank or something. I don't know. I don't know about that. Yeah, I haven't been all over the road and had no issues. So, okay. Are you taking any prescription medications? Uh, I take Adderall. What when's the last time we took Adderall? Uh, 6:00 this morning. How many milligrams is that? Uh, 30. 30. Okay. Once a day, once a morning. Six. How about anything else? No. Any illegal controlled substance uses that we use? How about alcohol? No. Okay. So, I'm a drug recognition evaluator and there's a couple concerning things. Okay. Um, I'm going to run you through a few tests. Your eyes are glossy, watery. Hopefully not. I still got to change into some clean clothing. You don't want to wear that? No. Okay. Hands up. Do you wear any knives or anything? No. Okay. Nice quick pat cuz sometimes that's totally fine. People forget that they have pocket knives, especially if they do construction. I'm going to have you come back towards my 15 hours a day. So, okay. So, what time did you start this morning? At 6:00. You started at 6:00. I'm going to have you stand in front of my grill here. Face your car. Any recent brain injuries? No. Concussions? No. Tumors? No. that you know of any lower body injuries that prevent you from walking or No, I won't have you doing any cartwheels, so you'll be okay. All right. Blind in either eye? No. Do you wear contacts? No. Okay. Just a couple questions I ask. Have you done field sobriety before? Yeah. Okay. So, I may do stuff very similar, but I also might do it a little different from in the past. I'll explain everything. Okay. So, you won't be guessing. If you have questions, just ask. Okay. First thing I do is I just take a pulse. Yep. And just relax there. It's a roamberg test. So, feet completely together. Okay. Toes touching, arms by your side. You're going to tilt your head back and you're gonna close your eyes. Okay. While you do that, you're gonna estimate the passage of 30 seconds. When you believe 30 seconds has passed, you're going to tilt your head out down just like you are now and open your eyes and say stop. Okay. So, I tell you when to start and you're going to tell me when to stop. Okay. Eyes open. Closed. Eyes closed. Okay. Eyes closed. Okay. Yep. You can begin. Finished. How'd you get there? What do you mean? How'd you get to 30? Did you count? Did you just guess? Did you you I just asked. Yeah. Counted in your head. I counted in my head. Was I close? You're close. Okay. Nonetheless, Trooper Bozer arrested him for driving while impaired by prescription medication, telling him he would not be able to attend his daughter's graduation. Moore pleaded for leniency, explaining his urgency and insisting he was sober. But Trooper Bozer moved forward with the arrest. Under Minnesota law, it's illegal to drive with any measurable amount of a schedule 2 controlled substance such as Adderall, regardless of actual impairment. A valid prescription can serve as a defense, but Moore's partially used pill bottle led Bozer to suspect misuse. A blood test later revealed 0.034 034 mg per liter of amphetamine in Moore's system, which was consistent with his prescribed dose and well within the therapeutic range. Uh, last time I had encounters with the cops, they were at the wrong room. They tased me six uh six cops tased me 12 times. And you don't fight with cops, do you? Nope. No, just that once. I didn't fight with them that time either. Well, if you got tased 12 times, I wasn't very cooperative. No, I was faced down and got tased 12 times and put in a coma. So, how long ago was that? Uh, a few years ago. Okay. So, so I get nervous around cops a little bit, you know. And I can get that. But have I was the wrong person. Wrong room, wrong everything. But I've never given you a reason to be nervous, right? Well, you're right. Now you're telling me I'm over stimulated and I just pass the sobriety test and you're making just now you're getting agitated, which makes me a little nervous. [Music] Am I getting arrested for DWI? Are we going in or what? Are you going to be cooperative? Yes, I am. Yes, you are under arrest. Sure. So, I'm missing my daughter's graduation. Okay, we'll try to make this fast. Okay, what do we do? Go take a drug test. Yes, sir. Oh, thank God I didn't make it by seven. Oh, I can pass. Okay, but the thing is Yes. Do you have somebody that can come get you? Cuz if I'm arresting you for a DWI Oh, I'll pass your drug test. No, sir. So, what's going to happen, and I'll explain it to you, is we have to go in for a BCA drug test, which I don't get the results for today. So, I'll be in jail overnight. Can you just listen for one second? Are you going to be cooperative the entire time? Yes. Can I grab my wallet? Can you give me my wallet? I'll grab I'll grab all your wallet and stuff. Um I can't call my daughter. I'm not going to make it to graduation. Oh my god. Try to relax here. Okay. Why do you think I'm over stimulated? I don't understand. So I'm a drug recognition evaluator. And you're showing signs, numerous signs of like what? Like I've took my prescription. I've You wanted that with you, right? Yes, please. Okay. Come on back with me. I I'd like to call my mom or somebody and I Well, I'll grab your phone. I will. Okay, come on back. Am I going to be in jail overnight? We'll see. Typically, yes, you would be, but we're gonna drugs. I'm going to pass every drug test you got. I have zero drugs in me. Okay, go ahead. No, no, no, no, no. Okay, have a seat. Moore was charged with two counts of DWI. He lost his job and commercial driver's license, and he filed a legal appeal that remains pending. Trooper Bozer's decision reflects poor discretionary judgment. Moore was fully compliant, posed no threat, and was clearly not impaired. Yet, she prioritized suspicion over facts, disregarding both the human impact of her decision and the blood evidence that ultimately supported Moore's innocence. Next up, cops illegally arrest NFL legend and get sued for $20 million. On February 24th, 2024, Deputy Caneric of the Okichchobee County Sheriff's Office conducted a traffic stop on a participant in a charitable rally, citing them for allegedly traveling 63 mph in a 35 mph zone. The stop occurred in Okachobee, Florida, as the driver and several high-end luxury vehicles participating in the charity event pulled into a gas station. Among the participants was pro- football hall of famer and Super Bowl champion Warren Sap. During the citation process, Deputy Caneric exaggerated the driver's speed, claiming it was almost double the limit. Mr. Sap calmly pointed out that 63 mph while over the limit was not double 35. The deputy responded with hostility and backup arrived in the form of deputy salante. When SAP questioned the deputy's exaggerated language, Deputy Salante demanded his name. Sap declined to identify himself, prompting the deputy to place him in handcuffs, stating he was being detained for obstruction under Florida statute 843.02. However, courts have long ruled that obstruction without violence requires physical interference, not just verbal disagreement. The 11th Circuit Court reaffirmed this in Colon versus Smith 2024 and the US Supreme Court's decision in City of Houston versus Hill 1987 protects even challenging or provocative speech directed at police. the amount of with the amount of traffic. I'm trying to educate you, man. And and with the amount of traffic that's coming through is not double 35. 63 is what I got on my radar. Go ahead and take it to court cuz it's almost double, but you're But you're almost double. Okay. But you're going over the speed limit. I got that. But you doubling the speed limit. You didn't double the speed limit. Okay. Well, I got exaggerated by Well, I got it. Why you got to grab me like that? What am I being detained for? I'll explain that in a second, sir. You know, you this is affecting the arrest. So, we going to see. You still ain't ask about the detainment, sir. You're being detained and I'll answer that in just hold. No, no, no. Wait. You need some tape, don't you? There you go. That's what we're going to do. You're being detained. What am I being detained for? Hold on. Hold on. You can explain to me. What am I being detained for? What am I being detained for? What am I being detained for? Okay. I was No, no. I'm asking what am I being detained for? I can I can resist the unlawful arrest, but I'm not Supreme Court. I have handcuffs on me and you haven't told me why am I being detained. I can stay right here. I'm not being detained. I'm being detained. I'm just standing here. Why would I need the back of your car? Because I'm surrounded by about 20 situation. It's a safe situation. Ain't nobody doing anything. Nobody doing anything. I'm right here, dog. All right. You haven't asked me why am I SAP did not physically interfere or approach the officer aggressively. He merely engaged in a verbal exchange while standing at a distance. Florida law only permits arrest for refusal to identify during a lawful detention. something SAP was not under at the time. Once the citation was handed out, the traffic stop had effectively concluded under the Supreme Court's Rodriguez versus United States 2015 ruling. Sap's arrest, therefore, was both constitutionally and procedurally unsound. Sap was transported to jail, where he respectfully continued requesting to speak with a supervisor. He was held for three hours and released on a $750 bond. Please get in the car. Can I get a Can I get a supervisor? Can I get a supervisor? I need a supervisor cuz he he told me I didn't I'm being detained because I didn't tell him my name. Yes. That's obstruction. That's obstruction. Obstruction is that obstruction. Stand up. I need stand up. Supervisor, please. You're underrest. I'm in the car. I'm already Stand up. Stand up. I'm already in the car, sir. Can I get a stand up? I need to search your pocket, please. Hi brother. What's going on man? I asked him why would you give me his name? It's obstruction. I don't have any as you can. All right. I mean you have this camera. Oh good. There's nothing against the law. That seat's annoying. Sorry. I did nothing but nobody. It's all right. Whose car is it? You know who he is? That's Warren. That's Warren. Okay. Well, player player turn. Hey, what is going on? All right, make sure my air before he came with the guy in the white hat, I believe, right there. Um, but I was issuing this guy a citation and he wanted to argue cuz I said obstruction. Okay. So, um, all right. I'll get That's what we got. Obstruction. Give the people that's going to jail. All right. I'm going to take him. All right. I'll follow you. All right. So I got his camera or whoever he wants to speak to one a supervisor. Do you want to speak to him or not? Have to be. Yeah, you're super s But he he wants to speak to you. Unless you want me to just take him. No, you're just walk away. It's okay. Take him. I'll follow you. He wants to speak to him in the jail. He can take He can talk to someone in jail. All right. I was instructed to take you. Hold on. I'm instructed to take you. Hold on. Y'all not going to let me speak to the I am instructed to take you. Let me speak to the supervisor. 696. I've just tried. He's not. I was told. And you said what? I was told to take you. I was told to take you. You said what? You already spoke to that guy. Okay. What is my charge? What is my charge, please? 696. That's a 1105 male 51 to the jail. Getting mileage. Oh my goodness. I love this. I always wondered how did y'all do this. All right. And I just watched it go down. You want to bring it out here? Yes, sir. Yes, sir. This being recorded. Oh, I was just like, my name is Sergeant. I'm the road patrol supervisor. You want to speak to the supervisor? I was wondering you was outside the gas station when they drove away, right? Yes. How come we didn't have a conversation here? because you were already in the back of a patrol car and we needed to get you out of there as quick as possible. And that's what we came up with. That's what happened. Okay. Whenever there is a situation like that, we try to clear this clear the area as quick as possible because because there's a large group of people there and it's it could turn dangerous. It was peaceful. We were peacefully assembled at that point. Well, your officer had been there for 15 minutes writing the ticket. Well, the officer was screaming for backup, too. So, we went I I got it. So, now when I my situation, you asked to speak to a supervisor, so I'm here. What would you like to know? What was I What am I here for? You're being You're being arrested for obstruction. That's a physical act, right? No, it's it's impeding investigation. It could be physical. It could be refusing to leave. It could be inter continued to interject yourself into an investigation that's being done on a separate situation. Wasn't an investigation. It was a ticket being written, right? It was a traffic investigation. So after you hand the person the ticket, the traffic stop is effectively over. Well, the deputy was still talking. No, I was asking after you hand the ticket to the man, the effective is effectively over. The stop is over. The resisting without violence charge was later dropped by the state attorney. In January 2025, SAP filed a notice of intent to sue Oki Chobi County, seeking $20 million in damages for violations of his constitutional rights. As of now, no formal lawsuit has been filed. SAP earns an A+ for remaining calm, informed, and assertive, while the deputies receive an F for ignorance of constitutional law, overreach, and unlawful arrest based on verbal disscent. But hold on your seats because this next case is more shocking than the other. On March 6th, 2024, Mike Simons, his son Damian, and their friend Jonathan were staying overnight at Mike's auto shop to restore a 1940 Chevy panel van. Around 900 p.m., Damian and Jonathan stepped outside to retrieve belongings from Mike's car parked nearby. At that moment, Deputy Tyrie Holdridge of the Douglas County Sheriff's Office spotted them near the vehicle and decided to investigate, believing something suspicious might be unfolding. As Deputy Tyrie approached, he questioned the young men about the car, demanding IDs and telling them to sit down. Damian asked what they had done wrong and refused to comply, especially after informing the deputy that the car belonged to his father and they had the keys. Rather than deescalating, Deputy Tyrie forcibly grabbed Damen's wrist. When Damian instinctively pulled away, the deputy slammed him into the car, then violently threw him to the ground. Damian screamed in confusion as other officers arrived and began handcuffing him. Good. What are you guys doing? Is it your vehicle? You guys have your IDs on you? Okay. Not at all. Uh, tell us what we did wrong. Yeah, you're in a business area and it's all closed and I don't know this is your dad's vehicle. Actually, he wants to have a seat. Have a seat right here. The door open. Actually, have a seat. It's all right. I don't listen to him. Have a seat. Tink. Can I get a second? You have a seat right here. Don't touch me. Don't touch it. Get off me. Top on me. Get him off. I said get on the ground. All right. There's a cop on me. Get him off. You're joking me. Jonathan, record this. I said get on the ground. I don't know what you're doing. What did I do wrong? On the ground right now. What did I do wrong? What did I do wrong? Is your camera on? Yeah, it's on. Get the off of me. Ow. You get off. Leo, roll on your stomach. No, I'm not listening to you. Get the off of me. Start recording. And the call and Nicole, start recording, please. And Nicole, start recording. Get another game. Yeah. ID number. Give me my ID number. Where's your sheriff? Stay right there. Get the off of me. Mother real gang member, huh? Real big man, huh? The off of me. I don't know that. Okay. Well, I'll wait till my partners get here till we get the off of me. You have no reason. You have no problem. I do. I do. Over. What? Say your legal probable cause. Your legal probable cause. They have keys to the car. I'm recording. Yeah. It's like you never read the Constitution, man. I hope you lose your job. Move. What's up, tyrant? Yeah, put the put the Why don't you go ahead teach your face? Got it. Don't worry. Is that your ID? I legally required. Give me your ID. Give me your ID. [Applause] Put pressure on me. It'd be nice to get the badge number or something. Yeah, badge number. I'm going to put this mother. Roll over. I'm not listening. Why would I listen to you? Oh, yeah. You're a pig, too. Tough guy. You're a piece of cake. I hope you know that. I didn't. I asked him his name. He didn't want to give it to me. You don't have to, man. This is America. I don't know that join an investigation. Oh, you're the one. You're sw What the heck? I hope you lose your job. You have to get some backup here for somebody who's got the keys. You're going to find out whose car it is. Okay. Well, then that's all I wanted to do. Lose I wanted to get the me. Stop my thumb. Despite offering no physical resistance and not attempting to flee, Damian was charged with obstruction and resisting. Mike Simons, witnessing the scene, grew agitated and criticized the officers. Though visibly upset, Mike made no physical threats, only voiced sharp words against what he saw as misconduct. Regardless, Deputy Tyrie ordered him detained, too, citing escalating behavior and the fact Mike was legally armed. He was handcuffed, accused of obstruction, and arrested simply for expressing outrage while standing near his own car. Despite the tense encounter, both Damian and Mike demonstrated exceptional restraint. Damian was charged and taken to jail, while Mike was later released without being booked. Eventually, the resisting charge against Damian was dropped on June 21st, 2024. During a bench trial, Damian was found not guilty of obstruction. The court noted Deputy Tyrie lacked reasonable suspicion to detain him, making his refusal to identify himself and sit down constitutionally protected. Mike and Damian have since filed a complaint and plan to pursue a civil lawsuit, citing excessive force, wrongful detention, and violation of First and Fourth Amendment rights.
