corrupt cops are known for misusing and abusing their power but young people who know their rights and are not afraid to use them can put these police officers in their place here are a few examples of what happens in such moments also if you have a bad experience with the cops don't forget to write in the comments on September 29th 2019 Park City police officers in Park City Utah responded to a verbal dispute involving Quarry Mountain resident Michael Frank and a neighbor stemming from his 15-year-old son jack riding a motorized bike around the neighborhood after speaking with the neighbor and other Witnesses one of whom claimed she might have seen a gun in Mr franck's waistband the officers proceeded to locate Mr Fran's residence and attempted to make contact can I help you hello are you uh Michael hi uh can I help you something yeah uh we're here about a officer Rodriguez uh first name Jim Jim how are you Jim and your name please sorry badge number what's that badge number please let's go ahead and talk about the incident that you had out here a few minutes ago don't know what you're talking about okay step down here for me as Mr franek tried to retreat into his home officers forced entry and restrained him following the 1976 United States V Santana ruling officers are allowed to pursue a suspect into their home without a warrant if in Hot Pursuit with a witness reporting that Mr franek had a gun and his sudden Retreat posing a Potential Threat the officer's warrantless entry could be deemed lawful Utah law also prohibits fleeing from an officer's command to stop so Mr franck's attempted Escape Justified the officer's entry to detain him during the altercation his son began recording the encounter don't take his phone don't take his phone I'm good I'm good I've chilled the whole time I haven't anything relax I haven't resisted offic talk to you I am behind my back this is unbelievable no I know this is unb walk in the house without a search warant this is unbelievable it's all on film get my camera it's on my phone too it's on my phone he the whole thing is on film the whole thing is on Fone ja follow me and record follow me give us space I'm not give us space okay what's your what's your space Jack Jack record the give us does this look like enough space I didn't resist I know I didn't do it you know see he acknowledged that I didn't resist Jack yeah I have video I didn't resist we asked you to stop right I didn't I didn't do anything against your instructions you came this guy came into my house without a warrant without any probable cause let me just talk for a second I said I don't know anything and he tackled me in my house he told you to stop right he did not say anything of the sort off the whole thing it's all video it is it's all on video it is dude he that guy is out of control I'm finally complaining against I want him nowhere near me that guy is crazy what's your name yeah I do not need to give you that yeah you do for what reason because you're involved in this I'm involved with this yes but this guy threaten me and call the cops on you and what's your what's your badge number what's your name what's your badge number badge number that's his name 3K 12 Okay now what's your name I'm not making any statements you're not making any statements nope okay I have the right to identify you you understand that right then you can search up my face and you can search up my well you're going to sit tight for minut you're going anywhere I can go in my house if I want am I detained you're detained for what reason for what that guy threatening me why isn't that guy going to jail that guy threatened to beat me in his so why aren't you guys arresting him that's not the information why you yeah he can just lie so you were the one driving up and down the street on the motorcycle uh I was on my gas bicycle okay that's gas power vehicle you have to have a driver's license um no you don't not when it's 50 cc and you have a permit for it Utah law protects the right to record law enforcement in plain view without it being considered interference or obstruction officers however cannot demand Jack's identifications solely because he was filming since Jack was involved in the previous altercation and there was a complaint about his bike use on the road officers could reasonably suspect him of involvement which would justify detaining him briefly for identification they threaten to like be did he threaten or anything yes what did he what he goes he goes that bike is illegal I said no it's not it's a 50 cc bicycle and I have a permit for it and he said get out of the way he was on his little road bike he said get out of the way I'm going to beat your ass so I don't if you guys want to believe him and we have two witnesses he has zero okay calm down calm down calm down no I'm pissed off cuz you guys just came in our house but we tried to come here to ask a question and figure out what was going on because what we got told is a gun was involved in this incident so we're going to take this little no gun no gun was involved not at all I don't know why I we don't know that when we we don't know that that's that's what I'm saying yes I totally understand that but you can't just tackle him but when he's told to stop he has to stop that's a lawful command by an officer we can get physical okay but you can't just come in the house without we have to control this situation do you have a search War we don't need a sear yes you do to want to go to school and learn the law I already know the law you don't we're not going to okay please don't talk to me so I'm get out of my way okay this is my case it's your case I'll talk to you as much as I want okay well I'm not going to respond to you you don't have to respond to me but I can talk to you have a good day and can you tell me why he tackled him into the house why he tackled no one got tackled he was told to stop I saw him with his arm behind his back and twisted all around come outside that's not Tack okay and I heard that some that there was big smacks and stuff like that so yeah I no that's a taser but I'm still talking can you please not interrupt me um so I was I heard all this stuff and then all of a sudden you guys are in the house did he allow you guys to come in the house okay I'm not going to get into that with you okay CU you because you know that you guys came in illegally because he was told to stop when he was outside and he once he flees from us and he's told to stop that is not obeying a lawful command by an officer that's all we're going to get we're done with it after a challenging conversation with officer Proctor Jack was released and the officers left without incident Mr franek however was booked into Summit County Jail on charges including failure to stop disorderly conduct refusal to comply and failure to disclose identity on July 4th 2019 YouTuber and First Amendment auditor Christopher bot conducted a First Amendment audit on a public sidewalk outside the Mendota Lutheran Home in Mota Illinois officer Holland from the menot police department responded after receiving complaints from residents that bot was attempting to film the interior of the building from outside I because going on recording people inside of the H why are you recording them inside and he will not give me answer keep I'm definitely not answering questions to you guys but okay I'll hold them go see if they'll sign a complain for disorderly conduct why you be in that dude like what hey can I not photograph on the sidewalk they were they were concerned that you were photographing residents inside no there wasn't you weren't you just photographing look all these Vines are closed yeah long here I don't know if they are not go look at them all right why wouldn't you stop when she asked you to do I have to yes was I being detained yes what crime was I suspected of committing you really want to go that route what what crime was we're investigating somebody acting in a disorderly manner you're video recording a nursing home and you were upsetting the residence on the sidewalk we didn't know that don't we have to talky on the sidewalk I to answer questions to that no I don't wow do I where'd you get your agree man do [Music] I well if you just cooperated with her you wouldn't be in handcuffs right that's we got to get to the bottom of it is there being a crime committed silence is the consent for you to consistently rate oh wow okay okay not a problem if I do not what did I do anything illegal that's what we're trying to figure out that's a ter you have to come up to me and make consensual contact because you know why because I did not do anything illegal okay okay okay we'll do a Terry stop uh or a contact card with you that you'll be served with but no you forced the Terry stop on me no we have to do an investigative stop you guys have put me in handcuffs I didn't because you're disobeying an officer how is that she telling you to stop and come here you're your did I do anything illegal that's what we're trying to determine okay so so I'm not going to argue with you no Reasonable Suspicion I'm not going to argue with you no Reasonable Suspicion yes there is no that what what what is Define reasonable what crime am I what crime am I suspected of committing at this point Mr bot was officially detained and required to follow officer Holland's commands according to the Supreme Court's Terry V Ohio decision a seizure occurs when an officer uses physical force or authority to restrict a citizen's Liberty once officer Holland ordered him to stop Mr bstat was subject to the officer's commands while the legality of these orders is for the courts to determine citizens are expected to comply at the time and address any disputes later in court isn't that what we're here to investigate do you suspect me of committing a crime yeah it's reported you were committing a crime what crime you're videotaping residence inside the nursing home inside the nursing home and is that illegal from the sidewalk to to video to videotape people inside to videotape yeah they have a right to privacy is illegal to videotape from the sidewalk no you're asking two separate questions is videotaping from the sidewalk tell me what reasonable suspicion is being that you're asking that question is videotaping from the sidewalk illegal you don't get it do you can you I'm not explain anymore CU I am the sergeant can you call Lieutenant nope okay dude I roll up you're in cuffs I'm trying to figure it out this illegal this is not illegal well that's what we're trying to figure out but you won't let us figure it out what I was doing was not illegal because I wasn't doing anything illegal so if you uh so if you jwalk you're not doing anything illegal cuz you say you don't do anything illegal if you Dam Dage a vehicle you don't you don't you don't you don't do anything illegal okay but but how do we know that you aren't doing something illegal because it got reported that you were assuming no we got a report we're not assuming we were reported saying what that you were doing something illegal that I was so you got to report yeah this guy here he doing something IL legal didn't say what though that you're videotaping the residence inside the nursing home no okay no there's nobody in there and am I videotaping on their property or on the sidewalk here's the thing that's what we're trying to determine this is illegal this is ilal right here no you can be detained it's not illegal I can't forcibly be detained when I you're not being forcibly detained you're being detained in handcuffs I'm being held here against my will I am being held here against my will no you're not yes I am am I free to go no you're not free to go you're being detained for what crime am I suspected of committing we already told you videotaping on the sidewalk no no that's your what you're saying that's what you're saying illegal detainment that's what you're saying you're doing no they said you were visit visit videotaping resence Inside Yes they made the call yes okay that's fine I mean if that's all you were doing but if you're videotaping and taking pictures of people inside there that's a different story or if you're going on their property acting in a disorderly manner that's that's uh that's your problem to deal with hello man so what so disorderly conduct okay disorderly conduct how for what I already explain that to what did I do disorderly what put him in the car and then we'll talk about what's going on with what did I do disorder I got your phone the Illinois criminal code defines disorderly conduct as knowingly acting in a way that unreasonably alarms or disturbs others and provokes a breach of the peace the vague wording of this code means nearly any action could be interpreted as a violation making it subjective and potentially flawed similar codes exist across states often just as ambiguous giving officers wide discretion to arrest civilians who haven't broken any specific law simply on the grounds of perceived disturbance so what did he do that was disorderly pop your truck okay so I came up he's recording like Chris hey what's he recording the whole side talk I'm like I'm getting complaints about you being over here reporting and he's like walk away I'm like Chris come here Chris come here Chris come here but what was he doing that they feel is disorderly and I explained to them the situation and they Sam what was he doing that was disorderly he was recording them in the windows the people and he's walking by on this side too I don't know if it was that side but when I came up he was walking all along this way he was reporting the windows he was reporting the doors he was reporting everything I'm like Chris I need to talk to you about this complaint he's walking away Chris I need talk to you about this complaint who who all seen him doing that were there residents in the windows uh I don't know if residents were in the windows but we had a caller about it and I need to get a hold of them to see where exactly they are so he's walking by videotaping the building he vide tape in the building he's like zooming in on the Windows zooming in on the doors I know it's not illegal to do that I explain to them what's going on and they're like oh my gosh okay I I don't know what he's doing okay but time out that's not illegal to do that okay so he's not acting in a disorderly manner if he's on the sidewalk walking by videotaping the outside of the building okay that's the problem we have yeah and they were disturbed by his actions once they found out what was going on but how are they they're Disturbed that he's walking on a sidewalk videotaping they were concerned because they don't know his mental state they don't know what he was doing they and I told him I can't well he wasn't I mean other than not a b you which is a no no which I mean that is what it is but as far as walking by with a video camera I mean I'm not that's that's not something that they bothered by the actions that you doing you could be bothered by a lot of things Sam I think this is something we need to send down to the State's Attorney's office as much as he's irritated you oh no he hasn't bothered me at all I just he wouldn't stop and he wouldn't I understand he wouldn't stop he kept ping away but this you can't do that yeah just so um I I think what we're going to do well I want to know what that caller said too and what they had seen also the thing is Sam he's on a sidewalk he's videotaping the building okay I'll we can send down to the State's Attorney's office for them to review for charges but it's not illegal okay I mean if he's walking up onto the door like all the way up to the door and he's shining the phone and videotaping then yeah that's a problem okay but if he's walking on the public side walk I mean even if it's their sidewalk I mean he's just videotaping the building people videotape schools oh is that alarming and disturbing yeah I mean it's something they're not used to but and yeah he's he's a jerk but I I mean that that beside the point I mean you buckle up yourself or she buckle you up she safety first right come on out all right I tell you I got to get to the bottom of things just right over here okay I got to get to the bottom of things and you uh throwing in these uh turn around I'll talk to you handcuffs off and you're still being detained till I can explain everything to you L well just stop that's what you got to do sometimes well I mean that was I feel like that was illegal no it's not illegal we can detain you okay that's the big difference people read the internet and they watch movies and videos and they think that they can just say whatever they want and do whatever they want well sometimes you have to confront the police and be talk to and say hey this is what I was doing you get a hell of a lot further with sugar than you do with salt honestly if you to just stop and explain what you were doing instead you've got to have this whole just let me talk there would have been this whole production okay officers do not need suspicion of a specific crime to detain someone they only need a reasonable belief that criminal activity may be occurring as established in terv Ohio if officers can point to specific facts suggesting potential crime they may detain an individual for investigation while public photography is protected under the First Amendment certain privacy expectations are recognized as in cats V United States nonetheless photographing what's visible from a public area even through an open window remains constitutionally protected this whole production would have been eliminated and what I would have said is Chris please don't videotape the place because you're freaking them out inside okay so it's illegal to videotape thing you're not getting what I'm saying no I'm just asking for it's not it's not illegal to videotape but be smart about it okay people in there are old people in there mostly it's it's a to be honest it's a it's a women uh a woman dominated uh career in there with cooks and cleaners and nurses and nurses helpers it's yeah I not this one but the other one I've been in with my family and so you see there's not very many men in there very few and the men that are in there are feeble older men or men who are recovering from illness or injury and they can't really do much to defend themselves or help out yes Chris we've had people go in there and assault staff that were like ex-boyfriends and husbands so not like your situation definitely and I know you that's not what you were doing I don't know what the hell you're doing you walking by taking a picture of the place I mean I mean are you going to put it you're out here what are you going to do you going to put it in your scrapbook someday and tell your kids or used to be a nursing home there beautiful architect exactly okay but the thing you're getting confused on is we have a right and we are Justified to stop you and question you and ask you wait what are you doing do I have the right to not answer those questions you do have the right not to but here's the thing how we ever get to the bottom of it and then we take their word yeah his mental state isn't quite right because you know what we don't know what he's got to say for himself if you would have just said hey just taking pictures man I'm not I didn't mean to freak anybody out oh okay well let us go tell him that um he's an innocent kid he was taking some pictures you know what he he understands it's you know far as you know putting me in handcuffs we can do that we can detain you but because we have to get their side of the story but when you come when you when you came to talk to me you need like consensual contact because I didn't do anything nor was I about to no here's the thing you don't when we have give you a lawful order you have to obey it and you were given anything illegal that's in your opinion we don't know that we got the call that you were doing something illegal so we no called saying I did anything illegal why Chris are you are you are you are you you may have gotten a call but they didn't they start they did they just call Chris I've done this with your family and went round and round and you know what I'm not going to do it tonight I'm telling you I'm just asking since you were a little boy we've had this go around in circles and here's the thing no the people called up and said this guy is out there we don't know what he's doing we don't know what his mental state is this this is what's going on we have a right and an obligation to the community to investigate that you have absolutely have to listen to the police and you have to stop when we're investigating something like that you have to stop and say hey come here we need to talk to you if you don't like it I'm sorry but that's just how it is now if we would if you would have just done that this would all been avoided cuz then we could have said you know what Chris you're being cooperative wait right here let me go talk to them and find out what happened happen then after we talk to them and she gets a story well I'm sitting there going okay wait a minute there's a lot of holes in this that don't make sense okay so we have to process everything and it's not something that happens like on the Internet or on TV in a matter of minutes it takes some time sometimes it can be done fairly quickly and other times it takes we're sitting at the PD and new evidence comes to light we talk to the person that call and they're like yeah he was doing this oh dude it's not even remotely close what we've been told okay we've got we've got other Witnesses who are collaborating what actually took place okay it's not as bad as it seems we've had that happen many times bottom line is when an officer tells you you got to stop and talk to him you got to even if I did nothing illegal you don't know that at that point right I do know I did nothing okay then yeah why wouldn't you stop and talk because I did nothing illegal so I okay but we're round in a circle again right it was reported that you were you have to stop and talk to the police if not you get detained because that's what you have to do okay well I mean I Chris you're you're making a mountain out of a of a complete mole hill here no it's okay can can we just all I think I understand I won't I definitely won't film here you you listen listen you can film it's just have some common courtesy and common respect if that was your loved one in there and you were you had your mom or your sister or your girlfriend or whatever in there working right would you be comfortable with some guy they have no idea who he is out there doing this I don't think that they made the call from in there and all these blinds are closed okay after sergeant Stewart intervened officer Holland removed the handcuffs from Mr Peter stead following a calm discussion with the sergeant Mr Ste was released and the officers departed without further incident on May 28th 2022 Corporal Michael prit of the Little Egg Harbor Police Department in Ocean County New Jersey stopped his vehicle and approached a young young man referred to as Mr Walker who was walking on the roadside after Mr Walker gave him the finger the interaction was recorded on Corporal PR's body camera why you get me what's your problem what why you give me the finger I'm walking away huh am I free to go why you give me the finger am I free to go no come here for what reason why you give me the finger what's your problem am I free to go no what you have a problem no you have a problem no you don't have a problem then more I can leave why you you giving me the finger when you're walking huh come here get over here what get over here is that a lawful order yeah for what reason because you're giving me the finger that's legal no it isn't says who says it all pull up the law huh pull up the law what's your name what's the law what's your name what's the law Corporal prit detained Mr Walker claiming his middle finger gesture was illegal however the Supreme suem court has ruled that gestures like this are protected as expressive conduct under the First Amendment as seen in CV California and Texas V Johnson New Jersey's disorderly conduct law only applies if gestures incite immediate violence or involve specific threats based on these precedents a court would likely rule that Mr Walker's gesture was protected speech and not grounds for arrest whatever what you heard come here afraid of you here come here get over here what get over here I'm not doing anything illegal yeah you are you just cursed me off that's not a crime yes it is says who says me say who turn around come on bro that is not a crime yes it is no it's not why are you cursing me it's not a crime what's your name it's not a crime what's your name help help no help help help help Corporal prit held Mr Walker with his hands behind his back and upon Mr Walker's cries for help turned off his body-worn camera only reactivating it when backup arrived New Jersey Law mandates that officers must keep body cameras recording throughout any law enforcement interaction except in specific cases like requests for medical privacy or discussions on investigative strategy Corporal PR's decision to turn off his camera during the incident violated both state law and the Attorney General's policy he said you're being because you're acting what that's not legal it is legal he's allowed to you until he performs this what am I doing though what am I doing that made him detain me what legal right every time I wrode by him twice he shot me the finger so I turned around say is that a crime that's CRI yeah that's not a crime that's not a crime he's looking at you cuz he's like what you want me to do because there it's not a crime I know my rights who are you I don't have to say any of that uh you do it for being detained for what reason what legal reason am I being detained for where are you coming from and where are you what legal reason am I being detained for I need to know that legally patrolman lontine informed Mr Walker he needed to identify himself due to being detained though he gave no legal basis New Jersey has no stop and identify statute and courts have ruled the state's obstruction law does not apply unless a motor vehicle offense is involved in Bryant V Camden County Police Department 2020 the court upheld that refusing to provide ID in an unrelated investigation isn't grounds for obstruction suggesting patrolman ltin was likely incorrect In His demand are you shooting me think why are you is that illegal why are you the bird yes it is when you are cursing in public you are causing a public disturbance you're being a nuisance to the public in what way when he was driving past well I'd like to see you guys prove it in court it's it's called it's called cusing causing a public disturbance by being a nuisance not saying you're being charged with anything at that point he's detain to make sure that there is nothing wrong make sure you're okay what reason does he need to detain he thought maybe you thought you were signaling him down were you signaling to him I was you knew very well that I wasn't signal to you right I wasn't signal you bringing attention to yourself you're you're acting strange I'm making sure you're okay dud that's so funny like you're not here for my safety you're not trying to protect me how you know you're walking on the side of the road and you're you're cursing and you're flipping the bird once at him I gave him the finger once that will not hold up do you know him do you know him it's not your business I the fifth I pleed the fifth then what's the first amendment for okay how first amendment is for your freedom of speech okay what does that have to do with with was I making a action am I calling for an action to be done against you ATT to it's it's it's Behavior that's out of the ordin clearly if you stopped all the way back there I'm assuming you guys were back there and you just Contin back a bit a bit further just continue to walk I was running I was walking once he gives an order for you to stop you're supposed to stop I did stop when he originally said it but I was asking is it a and he took off yeah cuz I kept walking cuz you weren't you weren't pursuing at the first only started pursuing cuz I you pig that's you got a little upset we're here at this point now okay you've brought the attention to yourself you caused the public alarm well I'd like to see you legally hold we doing I'm not charging you with anything so I don't legally need to hold anything in court well I want to know from your perspective up on SC tell me what you were doing bring I play the fth idiot how long have you been in a cop longer than you listen longer than you I'm not a cop I I don't understand what what the point of this is I'm walking that's what I'm doing it's the fourth amendment to be allowed to walk without seizures or anything like that you sure are you sure that's the Fourth Amendment you sure you to have money on it you sure that's for the Fourth Man it gives you the right to walk without seizure what's going to be seizured while you're walking my body my person idiot you were about to he said I was going to be under arrest he said he said you are detained he said you are detained so now what happens so now what happens he just aded Happ he gives you a lawful order to stop and you do not stop awful order and you do not stop legally was not a lawful order you do not stop then that becomes criminal offense and then yes you can be put under but it's not a lawful order then i' take it to court and then he'd get sued and I get per of Damages I'd be rich that would you want May what happen patrolman lontine asserted that the fourth amendment was not applicable as Mr Walker was not under arrest however as established in terv Ohio the fourth amendment protects individuals from unreasonable seizures even on public streets the court determined that whenever a police officer restrains someone's freedom to walk away it constitutes a seizure the Supreme Court also clarified that a seizure occurs either through physical force or when a person submits to an officer's Authority given that Corporal prit physically engaged Mr Walker to prevent him from leaving it is highly likely a court would consider this encounter a fourth amendment seizure what's going to happen it may not be what happens okay okay I get AAL jury am I free to go what may happen is you may get Aur no because at this point you were detained okay because he told you to stop and he didn't stop so therefore you need to identify yourself as a part of the investigation so what is your name okay I'm going to need all of your badge numbers I will give you everything written down on a card what is name I give you if you have an idea that's perfect am I okay I I'll take it to Port this is still this is still a detainment are you a juvenile this is an illegal detainment I ju I'm not going to answer that you have to why because you're being DET I said I'll give you my ID buddy he's such a so who does that make you not a pig dude this is illegal you'll legally have to prove that I was a nuisance in how would you do that how would you do that I just want to hear camera systems okay so when he goes by in the car okay and he sees you doing what you're doing and what going to be there and what part of that caused the disturbance that's what I'm trying to legally understand I don't understand is that a body camera that's what it is perfect perfect Tucker doesn't have them you know that Tuck's been on back order for months because I have a lwuit against them that's and I wish they'd have body cans I would love if they had body can take out it's for all of us it's for all of us it's for everybody that's involved in the situation okay app if you have any problems or anything you want to come down you want to talk to somebody our supervisors are always there as well okay well I'm going to take a lwuit so who would I press criminal charges against what you're going to have to you're going to have to call you're going to have to call and figure that out with a lawyer you would have to file a complaint with the courts got it okay and then you can go from there if you want to see if you can press charges and whatnot if you're violated your rights appreciate it okay stay the don't give us fingers shut the up stay out of the roadway stop causing a public alarm shut up am I to gooping you're free to go stop cursing you're free to after patrolman lontine informed Mr Walker he was free to go Walker directed A profanity at the officers and left without further incident while Mr Walker mentioned plans to pursue legal action no updates are available on whether he has taken any steps to do so
