on June 23rd 2024 Miss mines went into the backyard of a house she was thinking of renting in Springfield Missouri and wanted to see how big it was a neighbor told her to leave and Miss mines complied and left but after the neighbor reported the incident to police officers from the Springfield Police Department responded the interaction was recorded on the officer's body cameras think the the dud I called even knew what was going on I just randomly asked him okay can we go in your house and do you want to press chares I guess yes and yes hello hello sir yeah that'll be my mother okay it's that house right there yeah so is she still here talk yes she is she's in the bathroom right now oh okay okay so I was one who found out that was unlocked okay did you see the female back there too I saw her walking back there and I yelled at my mom that somebody's going in the backyard and I ran out and stopped her yeah okay when was the last time you guys know that's actually the female right there okay right over there it won't be back hey police stop oh me yes you can I help you yeah yeah yeah so uh somebody seen you uh the backyard see I seen the people move out and they had a box of stuff way when they moved out that was in the yard for you know to train it for free so I seen they moved out and I said well I'm going to check out the backyard see how big it is cuz it's empty she cussed me up once I'm down the that lady who this this lady yes she did she said yeah she say you can't come go back there don't you ever s anybody back there in that yard I said ma'am I wasn't going in y just trying to look at the back yard see if it was big enough you live I live at Battlefield Towers you live at Battlefield Towers yeah you walk there after get groceries yes that's the only way I have to get around okay I was not doing nothing WR you in the backyard just no I didn't even go to I didn't even get there she wouldn't let me go backy why are you yelling at me am I am I yelling at you no okay let's let's let's chill out okay I'm trying to figure out what's going on having anxiety I'm sorry no you're fine you're fine can't deal with that sorry sorry I had to raise my voice just you were raising your voice okay because of my anxiety cuz it's stupid all I wanted to do was look at the backyard because so how far did you get into the yard I didn't even get to where her dog was cuz dog started working when it come back so I came dog is it's right right between the houses with so you went between the houses no I was walking toward the backyard I didn't get to the back you didn't get to the backyard no why were you looking in the backyard again just to see how big it was see how big you looking at buying the house well I thought maybe he was going to rent it or something and I was trying to see the yard to see if it was big enough okay okay I'm just trying to get get your story here okay that's my story I gotta get both sides I understand that well thank you for doing that um but I didn't do anything wrong so you saw he was moving out so you were going to check out the backyard see how big it was cuz you were thinking about rent in the house if it was up for rent exactly she came out and started yelling see y that me in the through the the kitchen window okay I just turn around to the left and went ahead and walk got my grocery I don't want to live there anyway cuz I can't live next to that cuz I'd be doing this all the time yeah we don't want that her anxiety would go crazy wouldn't it at PTSD she don't know that okay I'm sorry that you have that okay um what is your name why why yeah well because I'm talking to you and I'd like to know your name for you know what's going on I don't want her to know my damn I don't want her to know I'm not giving I'm not giving her your name this is for me I don't understand why you always have to give your name I just didn't do nothing no I did what's wrong giving a name you got something to hide or not hardly not hardly well then what is your name it's V the m spell it yourself I'm tired I've just walked in the S and I'm walking back in the and she wants to complain about cuz I wanted to check out the yard SP I can possibly maybe rent this house or whatever you just go grocery shopping or yes I did walked all the way to Food for Less you walk pretty far didn't you yes I did and I'm hot I'm tired I'm hungry I'm thirsty and I just want to go home and I didn't think well I need to know your name okay you need be M that's all I'm telling you that's my name you need to spell it out for me no I don't I have to identify you v m m it's German m e i n TS and that's all I tell rest out yourself I live at Battlefield towers and that's all I'm telling you because I have not to identify you CU I have reasonable suspicion that you were trespassing on that property okay I was not trespassing on that property okay as of this moment you are detained so you have to identify yourself Veta the officer claims Miss Mes must identify herself because she is being detained for suspected trespassing Missouri does not have a general stop and identify law outside of Kansas City but individuals may still be required to provide identification if their detention is lawful trespass passing laws in Missouri distinguish between first and second degree trespassing first degree requires knowingly entering fenced or posted property which Miss mines did not do however second deegree trespassing includes entering someone's property without permission even without Criminal Intent since Miss mines walked onto the yard without authorization the officer could argue they had Reasonable Suspicion to detain her and request identification nice well you ain't very nice either so there you go I was starting out nice so you started yelling at me no you yelled at me first she yelled at me first you want to get the truth about her KS my PPS did and then you want to stop me yeah well I'm glad I'm so glad you did I'm glad you didn't have nothing else better to do with your time I don't want to put you in handcuffs okay whatever do whatever it is you got to do what's your date of birth I was born in October 27 1959 I'm 5 too I weigh 90 lbs I have PTSD I had anxiety disorder depression disorder I did not do anything work wrong I'll be 65 years old go put your hands behind your back for me stop stop resisting stop I'm not doing anything okay I didn't want to have to do this yes you did or you what do you mean you're the one who freaking out that's all you guys do you don't do nothing else to old people let go of your phone let go of the phone I'm done being nice with you here why don't you just uh here check my purse take whatever you want What's your deal ma'am I have PTSD she does set it off okay you guys are not listening but that don't matter you were on a property that you're not allowed to be on okay I seen that it was still empty I said well I'm just going to walk back look at the backyard see if it's big enough for my dog so you just admitted you're trespassing on property i w didn't you no permission to be there and you're walking on the property to look in the backyard yard I didn't get to go get to the backyard I got to where the end of that okay what's your date of birth again October 27th 1959 would you like me to bow down to you too why would I want that hey why you being weird oh hey aren't we all I'm not yes you are so where were you headed to with all your stuff cuz you obviously just got sir I walked from Battlefield Towers to uh food for L I walked all the way down Woodland Street I didn't make no stop I live who do you know that lives over here then I live at Battlefield Towers okay so why I walk down wood to go Towers why are you trying to look in a backyard that's what I'm trying to figure out because I have another dog and I was trying to see how big the yard was cuz I knew the house was empty that's why and I didn't even get to where that big tree is right there by the house cuz the her dog started barking and after that I backed off and started walking off after she cuts me out V mints October 2 Min m whatever yeah I told I told him that but he don't remember so here's the thing M this house is still own okay and there's people that are watch that house okay I've already contacted the owner and he wants to pursue charges against anybody that's on his property okay so you are not to be on this property and if I catch you here I'm going to take you to jail for trespassing okay you yes sir I do and I won't ever do that again to take those off you and you can continue walking out to where you live okay thank you it is unclear if Miss mines filed a formal complaint regarding the officer's actions but his son who shared this video on his YouTube channel has also included legal costs among the reasons for the fundraising Campaign which means that legal action can be taken on this issue on November 21st 2023 Michelle Allan Gregory Vice chair of the New York Coalition for open government was asked to leave a New Haven city council meeting in oswago New York after supervisor Dan Barney asked her about the minutes of the special session after she refused to leave 911 was called and the interaction was recorded on Deputy Gregory's body camera what what was the first6 $ 6,396 is what we budgeted we're 96 y $639 we're going to increase it to 8,396 and since decisions were made during the public hearing there will be excuse I will second that Mary excuse no herb she's out she's gone that's the second time she's out take her out three warnings I get a second warning no you don't get out go I'm not leaving you got to go sorry you have to go I understand what you're saying sir I will need to be physically removed um and I I understand what you're saying you have to go I don't want to physically remove you you have to go I will leave supervisor asked you to leave you have to leave hello supervisor bnie sir hi Hi how are you um we had a situation where we had a person disrupted our meeting I issued a warning okay and upon the second uh incident asked her to leave she refused to leave um no physical altercation or anything like that occurred our um security officer here walked over asked her to please leave she refused several times so we want her out now she's got some friends here that are refusing leave too okay uh we're done with our meeting okay and uh it's time for people to go okay okay where's the where where this is her here not sure what name she's going by tonight she likes Jane public Michelle Allen okay you leing ma'am yeah I was told I had to wait because I was being the police were being called all right so you have friends with you too who's who's your friend you guys okay all right well let's just have you guys he told me I had to leave a public meeting and then and he said he called the cop so I was waiting for the police to come so I would not be physically removed sh I got you so cuz I'm allowed to speak at a public meeting abely are you public resources so um will if I want to he her arrested can I do that no you cannot oh yeah um actually uh it's uh obstructing governmental Administration this has been going on for an extended period of time like two and a half years um so okay okay that's that's where we're at all right I've talked to Don Hilton about this do you uh have your idea on you I do and I don't have to provide it it's a Fourth Amendment right no you are being investigated so yes you do have time am I being committed okay if we're talking governmental obstruction because I spoke out at a public meeting I'm not here to argue about the reasons of why you're being charged with that so we're going to investigate it okay and so for that we're going to need your identific being you don't have to commit a crime to be investigated right in order to provide my ID you you have to be investigated yes you have to you have inves inv you have to be investigated doesn't have to be a crime I'm not providing my ID you have to no I don't you will provide your ID or what or you going to be placed in custody uh for what for OG you have a second charge for that okay I would suggest you not do this and you call a supervisor I would love to call my super supervisor I would why don't you go ahead and get preor on the phone I already have a couple attorneys on the phone as well that's fine and because I spoke out at a public meeting you're trying to arrest me for failing to provide your identification see what no what I'm what I'm being charged no you're not being charged with anything yet you have investigating if I don't provide my ID I understand what you just said to me that you said that you had to be given a charge to provide your identification I'm telling you that's wrong okay I all you need is I it's not about disagree that's the facts I know my rights you obviously don't GRE would like to speak you no she wants a supervisor so actually re here would love to speak hold on one second no I'm requesting a supervisor be present preacher are you able to come down here yeah what what am I being charged with you are not being charged with anything you Deputy Caitlyn Gregory informed Michelle Allen Gregory that she was required to provide identification due to an investigation for obstruction warning that refusal could lead to an additional charge under New York law obstruction involves intentionally hindering a public servant's duties through physical Force intimidation or unlawful acts while calmly speaking out of turn during a public meeting likely wouldn't meet this standard refusal to leave after a lawful order could potentially be viewed as obstruction however it's unlikely her actions constituted disorder orderly conduct which requires intent to cause public inconvenience or alarm additionally New York law does not allow officers to require physical identification during a detention based solely on Reasonable Suspicion courts have ruled that refusal to identify oneself without more does not amount to obstruction did did you not just say can I can I see what he's trying to charge me for um so what's going is a long drawn out Interruption that's gone on over about two and a half years okay for requ public documents which is for an open meeting LW every meeting but um if if you speak out during a public meeting you get a warning and if you speak out again we can ask you to be re to remove yourself and that's what we did tonight we're very polite there's no physical nothing she you know herb didn't grab on her or nothing like that he did he did put his arm on me he most certainly did M I put my hand on he did put his hand on me I I talked to Dan about this a while back one night when she pushed her way into my office and I hav't recorded yelled out I recorded it it's all recorded yeah yelled out that U she was a member of the press when Randy pelis I am a member of the press conversation with me I am a member of the press so um it's not irrelevant that's open government and freedom of inform me because right now now now you're committing a violation with me can I see what he's trying to char I'm asking you for your identification I don't have to provide it unless I'm being investigated say it with me investigated it's not just investigation yes it is it's investigation yes it is okay 100% it is we'll debate that in court time that's fine but you're still going to have to provide your documentation because you're going to be arrested for it okay so that's or what am I being I'm not going to keep saying that this over see the the statute that he's trying to quote to me the document that he's handing me he's quoting to me can I please see that that's going to be separate for what I'm from what I'm charging with can I please see what he is do you see him going in there trying to get it but I'm telling you now you're going to have two different charges for it you can charge me with whatever you think you should okay a set so these are local policies these are local rules of decorum which are not a statute these are not a legal statute I don't think he said that this was a statute these are just other documents he had in his hand he was explaining what is the legal statute for this this is a local policy you're looking for the statute of obstructing governmental Administration whatever he yes whatever he's accusing me of I would like to see that statute The Authority Falls within the town board we have the authority to make local laws we made one earlier not local law questioning that we're asking you to do I'm not questioning it to be honest policy so listen you said you know your rights so I mean this is a policy that has nothing to do with what I'm going to be arresting you for asking for the statute of what you're saying it's obstruction of justice correct do you got your phone can I ask can you I'm going to have you look at up cuz I don't have it on me what statute am I being arrested for obstru governmental Administration can I see that statute yes do you want to pull up your phone I would rather not I think that you supposed to provide that no I don't have a law in my back Michelle Allen Gregory claimed Deputy Gregory was required to show her the obstruction statute but officers are not constitutionally obligated to provide such details as long as there is objective probable cause for any offense a court would likely find no requirement for the deputy to explain or present the statute do you have a phone I do but I don't use it for work use okay because then it gets subpoena and I don't want that okay but it's it's free that everyone has on the internet okay otherwise you know you'll have to wait until we process the arrest okay such a waste of money it's kind of a waste of time all you have to do is it is give us a your ID I don't have to give you that because I am not reasonably I have not reasonably committed a crime there is no reasonable suspicion that I have committed a crime we ask for people's identification just simply if they need to be checked on simply if we are just encountering them don't wish to wave my Fourth Amendment right for that okay there's know read this I'm just saying I don't think so are they involved with that as well um nothing more than just refusing to leave after a meeting was over normally we send people out the door I guess she's still here I don't know you witnessing yeah no they here with me I'm staying until she's safe so I guess they're trespassing no and you want to charge everybody here with that's trespassing that's going to be trespassing if you don't leave yeah for sure so I guess if these two don't leave it will be trespassing our meeting's over it was it was over at 7:20 mhm and I'm being detained for what and you're expecting them to leave me no it's not going to happen and you're going to arrest them both for trespassing for staying with me yeah they will okay well you can write me a citation and then I'll show up wherever I need to show up okay will but we'll step outside and we're all leaving together you're going to be coming back with us no I'm not how do you figure so you have identification then I do okay can we have that please no everyone's going to do the same thing then I'm not going to be invest what AM mind being investigat trespassing this is a public building doesn't matter he has the authority to leave me to arrest a three of us now so you need to call some other attorneys this is been bad it's okay all right well as long as everybody's aware I'll let you guys know when I get bucked okay we'll Su them all right bye all right arrest me then no you want to speak to a supervisor so we're going to have a come wait wait you stay here do you have like any documentation for like the past couple of meetings or like anything that notes about instances or trespass orders or anything like that do you have a trespass order you can issue a what a trespass order a trespass order yeah or anything forense I know it's not addressed in this um rules of decorum that'd be a good question for your supervisor M we do lack the doors when we leave so we got three refusing to identify themselves so we'll probably need a statement from you um okay about everything so there's two sheriffs here and the ringy more officers here to potentially Pace me under plac me under arrest for speaking out during the meeting obstruction of something in violation of their Town policies because they came out of the executive session and I told them that they shouldn't do it that that there needed to be minutes um publicly available because they came out of the executive session and said um notic decisions were made but then voted on stuff that happened in executive session and I said hey you need to have minutes available and then um someone called the cops on me to have me remoted so if I get bucked up if you a call bail me out okay I'm going to do this because this is wrong all right I love you yeah yeah um uh two other people for TR we waiting for preor to get here because she wants to speak with the supervisor these three are refusing to identify themselves and refusing to leave which three okay she's being detained she you're refusing you're refusing to leave because you I'm leaving her by herself I want her to be safe same same thing okay you're refusing to leave she could have left no I was told I was detained she was told she but these two were not detained so they could have they're staying with me because I should not be okay so then they'll be charged with trespass as well well then they can be charged with trespassing I know they're doing it for you she got too far out so okay and they won't identify themselves okay if I'm being threatened with arrest I will identify myself but other than that I just threaten you with arrest like six times for what again o for no that's violation of policy no that's not what I'm placing you under arrest for you're refusing to identify yourself and that's what you're going to be charged with please make sure she's safe where she okay now you guys are leaving please make sure she's safe she's gonna be safe trust me yes PR just called out in my unit she will be fine I promise you so if I identify myself I will not be arrested or irregardless I'm still going to be arrested well you're still going to be arrested for the trespass he wants you arrested for trespass and I are going to step outside okay for speaking out because you violated an executive session it's ridiculous you guys want to just stand out there with them in case we do decide I don't they're leaving now and they Cooperative if that's the way they're going to and play it then I don't mind but we I better not have any more problems with them hey how's it going good how are you so these two here and then the third one out there we're supposed to all be leaving no yes no stay I'm going from the original point of when she was asked to leave so these are the three people yes and the other ones outside I guess she's now deciding to actually finally leave but let me just clarify something quick if we want that's fine but nobody ever told anybody they had to stay she was told to leave repeatedly by herb Hawker our security guard okay and she refused to leave nobody ever told anybody they had to stay we wait the Mee the meeting come end m a few minutes later and then we told them all a few times have to go time to go okay her friends decided that they wanted to stay with her they refused here and this lady here no no not the one on the far end not the one on the far end she did not want to leave after the meeting was ended because the sheriff's had been called I right I was told to leave while the meeting was still present I said I wanted to wait till the end of the meeting that it was a public meeting I was allowed to attend he asked me to leave and then he called the police during the meeting then he asked everybody to leave then I was told I was being detained and I said for what so then I was told I had to wait now I'm being told I'm going to be charged with obstruction and trespass when I was told that I had to wait because I was being detained it doesn't even make any sense okay this is the only young lady had a problem the reason she was being detained was because she wouldn't produce identification okay but during the meeting was she creating a disturbance yes she did twice she was she was warned the first time the second time I asked her to leave and I told her Mr Barney stated he asked Michelle Allen Gregory to leave the board meeting after she spoke out of turn twice New York's open meetings law grants the public the right to attend such meetings but it is silent on when individuals can be removed courts have held that public meetings are limited public forums where speech may be restricted only if it is content neutral serves a significant government interest and allows alternative expression this a while back two different occasions she pushed her way into my office I understand so that that's what happened tonight You' like to Pur charges against her correct yeah we yeah if if we can okay yep so we'll put her in custody someone grab a statement from you what am I in charge with exactly trespassing Criminal Trespass okay I was not trespassing I was told I had to stay I was told I had to pass you're going to be charged whether not your guilty or not it's be up to the judge please stand up for me so I'm being charged with trespassing I'm not going to ask you again please stand up I'm trying to no can you take my person yes you don't want to say who you are is that correct I said I would do that why are you taking pictures of me being arrested right now don't worry that's ridiculous so right now else you need I would rather you not hit my purse honestly what would I need do you want your cell phone and your ID I don't know what you just put in my pocket phone and your keys um I guess I would need my wallet wallet where is that in here it's the blue thing this is ridiculous you guys are gra this did you want to can you pat her down too make sure she's you were not supposed to Pat me down well you're not supposed to sir and we're not doing it here we other stop can we go outside please no no this isn't a dict par choice right now what we're doing everything else will work on later right just wa minute are you still wanting the other two as well but they but they weren't asked to leave and refuse right were they cre disturbance or no did you ask those to leave did you want we asked everybody to leave okay after the meeting stay with those two for now make sure those two this one in the black coat and then this one with the purse there don't leave yet so if you have a meeting right right someone is not acting like an adult appropriate way to act in a public meeting you have all the right to ask them to leave they don't call us we respond out you don't have to keep dealing with this through the whole thing so we'll ask him again and then if they don't want to leave we'll arrest them she pushed her way into my office when Randy pelis from the uh padium times wanted to do an interview with me so I said come on you know we'll go in is that something that made you feel uncomfortable that she did that oh yeah everything that she does she she forced her way in one night when Mary and I were in there talking with the Jud supervisor she's my Deputy so what I want to have you do is we have a nice young lady Deputy she's going to take a statement from you okay make sure you mention the past that happened the past bad experience okay then obviously tonight you're having a meeting what you did to create disturbance you complely asked her to leave she didn't asked her again and she's trying to create chaos yeah okay we're going to try she signed in probably every single time she's been here under a false name she doesn't have to give her real name she has to give her real name tonight or she not get processed and she can sent she can come up with who she really is and we can prove that who she is at this point that's why I wanted her to have her ID the other we asked them to leave you asked them to leave yeah leave but they would not leave because they didn't feel like she was going to be safe and then they wouldn't identify themselves as well well when her first brought them out of the meeting room the none of them they all said no we're and you told them was time to leave over with you it's time to leave very yeah they'll get Char okay I'm going hook him up all right who are my other ladies that one there on the phone okay this one here and this one here this one here yeah so right now because they asked you to leave and you refuse to you're going to be arrested also for trespass we asked everyone I asked I asked her to leave okay I asked her to leave and she would not leave and then she wouldn't identify herself you didn't ask me who I was you didn't ask me you asked Michelle I asked both of you I did not hear you you didn't look at me I did not hear you okay do you have identif we want to do is conduct your meetings in an orderly manner I don't I don't have a problem with that Linda Williams unless you go that's fine whatever you want to do I don't really care she's the only one that actually just started to actually cooperate so yeah I mean so we'll take other then and then you want to stay and take the statement or um it doesn't matter uh yeah if you want you want to do it that way that's fine that's fine I said there's some past instances that should be documented with it and I think he's going to request to refrain from order protection so the young does come back okay okay all right that sounds good we'll do that then thank you guys no problem sorry are you guys taking the two and then we're staying back with the statement yeah I be good for let get the experience sorry darling which is weird I'll take her from the back of my car yeah is okay there's plenty of room in that one play Rin that one well they're both asleep and I can't feel them can you not grab by the handcuffs and grab me by the arm please thank you Michelle Michelle Allen Gregory spent a night in jail after Mr Barney requested an order of protection which was denied at her arraignment she was charged with trespass obstruction and later disorderly conduct while her friend received a trespassing citation in August 2024 all charges were dismissed due to speedy trial violations Gregory and her friend Bale are pursuing civil legal action
