Arina North Carolina escalated into a harrowing experience for 14-year-old Malcolm Ziggler when police officers arrived at his home accusing him of possessing a stolen motor vehicle Malcolm repeatedly insisted he had purchased the bike legally and offered to retrieve the bill of sale from inside his house however the officers detained him claiming possession of stolen property was still a crime acknowledged Malcolm's age and the complexity of the situation recognizing that his cooperation and lack of prior knowledge might weigh in his favor all the 14 me personally he ain't going nowhere you here with what Dad mhm ain't no sense having him sit in the car t with handcuffs on where you ain't if he was 18 and you might be taking a jail for possession stolen property different but we a you separate your hands there you go all right go and take that hand out for me sir one that one right there you got it let me I usually put on counter in my room Des eventually the officers released Malcolm and removed his handcuffs after his father produced documentation proving the bike was legally purchased but hold on your seats because this next case is more shocking than the others Shan Paul Rees visited the US Air Force Base in Westampton New York intending to take photos of a public area armed with a camera and a deep understanding of his constitutional rights Shawn found himself in a standoff that would test the boundaries of public photography laws and law enforcement Authority as Shawn began taking pictures near the base a police officer approached questioning his actions the officer was polite but informed Shawn that photography was not allowed Shawn standing his ground clarified that he was on public property and not violating any laws Air Force Base Francis eski hey s how you doing I was talking to the other guy I wanted to know if I could get a picture of the helicopter over there no no f is that a is that a law huh is that a law no photographs is that a law La though I'm in I'm in public right yeah but I'm not I don't want to go inside I want to see if I could take I want to see if I could take it from the outside nothing over there I couldn't hear you no no no no um I was just over there uh saw the helicopter oh and I wanted to take a picture of the helicopter and I went up to the guard booth first to ask them if I could take a picture of it they said they said no photos or videos allowed I see this I see the signs but yeah I'm on public property yeah no he trying to go in and not just because it's the a but I understand that but what what I'm saying is I'm on public property right so I was trying to be courteous by asking them cuz I don't want to get I saw the signs no photos fair enough but it's not a law right well if you were to go inside past that gate if I would to go P yeah I would never do that you're on public property right now never do that you are you're so I can grab picture of that the situation escalated when base officials misunderstanding public photography laws called the suffk County Sheriff's Office attention heightened as more deputies arrived each adding to the confusion he reiterated his rights referencing the first and fifth amendments and refused to provide identification as he was not legally obligated to do so as the encounter dragged on Shawn requested a supervisor when the supervisor arrived Shawn detailed the incident emphasizing that he had been illegally detained and that the deputies had violated his constitutional rights despite Shawn's persistence the supervisor remained dismissive reluctant to acknowledge any wrongdoing by his subordinates when Shawn asked for a Complaint Form he was met with resistance and condescension that's all no no problem all right so do like a documentary or something yeah yeah yeah I want to get a picture i' never been over here so I wanted to get a I got a picture of the sign and then I wanted to get a all from public I know you know what I mean I don't want I don't want to break the law man I get it no I get it on what's your name badge number sir hey what's up how you doing sir what's your name and badge number what's your name and badge number sir picture of the ch and he came from what he saying he was coming closer to I didn't take a picture of the shoer yet but I'm going to go and take pictures of something have can make Hey sir what's your name and badge number you're being very unprofessional sir very unprofessional sir stay away from here stay there is that a lawful is that us stay over there is that a lawful order sir yes it's a lawful order until we complete our investigation you are to listen what am what what what crime am I being suspected of committing sir sir preliminary investigation what crime am I being suspected of committing I can't talk over you I will answer your questions I'm asking you a question am I being detained you're still talking over me am I being detained can you stop talking I'm asking you a question sir am I being detained so I guess that's a no you're being detained I'm being detained this is an illegal entainment I'm starting the clock illegal detainment I'm starting the clock what was your name again Deputy H Fester you're not being detained for the record you're just being interviewed right now because there was a 911 can you tell me if he's a supervisor uh well that we're talking to me right now it doesn't matter listen what what you doing just listen just listen to me okay I'm going to explain it to you ready you doing here I'm doing a First Amendment these men right here they swore they swore an oath to the Constitution the First Amendment I'm doing a First Amendment protected activity and you swear that same O So Am IAL obligation to answer no I do not name no I do not Fifth Amendment sir don't you love it listen no it's not you could do whatever you want to do but I mean at the end of the day it's cops like these that shouldn't have guns or badges cops like him illegally detaining me [Applause] this guy has been very uh very cordial and respectful I mean the only thing I can say about him is that in Blue Line right and uh all right excellent all right yes you're going to get a complaint sir add to the list you're going to get a complaint add to the list huh I'm sure I'm sure you I'm sure you've had a lot oh he's got he's he's in route okay hey Hey listen can I ask you a question what's your name and badge number sure my badge number is uh 499 499 and your name and your name my name is uh Deputy mccrave Deputy mccrave yeah thank you 499 Deputy mccrave uh let me ask you a question yeah this officer deputy said I was being detained and then this deputy said I wasn't free to leave so you be free to leave so I was being detained right actually I was out to talk to you to see if you were done with this Stu and just see if you what's your name tell you don't even have a badge on for the captain we come loose 339 is my shield number k r t is my last name you are free to go sir if you want to wait for super that's on you okay what's going on are you supervisor I am yes sir what's your name and badge number Sergeant Tesco s104 how going to help you I just wanted to talk to you because uh I was out here on a public easement yes sir filming um doing a First Amendment protected activity okay and uh this officer came up to me and he was very cordial with me and you know he understood my rights and everything was okay the only thing I didn't like is that he backed up the other guy who was his name was court I don't know he said he spelled his name out to me okay okay that they both said he didn't say anything but the these two guys they said I'm free to leave I mean I'm not free to leave okay and I would like to make make a complaint okay well at that moment right then and there they were responding to a 911 call all right and so they were in the middle of an investigation okay but in order in order to detain somebody so you have to have reasonable articulable suspicion that a crime has been committed is being committed exactly however they were in the middle of an investigation that's what they were trying to figure out they can't detain they can't detain free citizens in thank you so much anything else I can help you with no sir all right have a safe day you too the supervisor eventually provided a phone number for internal affairs but failed to take the matter seriously the encounter ended with Shawn still seeking accountability his frustrations mirrored by many who have faced similar abuses of power but wait for this next case where tribal authorities detain Montana Fish warden in Montana Fish Wildlife Paulson a federal agent was traveling on a public road adjacent to the reservation when he was stopped and accused of trespassing despite his reasoning and attempts to deescalate tribal officers detained him and pounded his vehicle and transferred his belongings asserting their Authority Under a tribal resolution tensions heightened when was revealed that Paulson's Department was investigating an elk killed by tribal citizens leading some to suspect his detainment was retaliatory heard that so what we have here is uh this is uh deed property owned by the tribal Community this is a BLM numbered route this isn't submarginal this isn't reservation this is deed property in the state of Montana right and I'm they've got me pretty well detained here on this open public road okay how's it going guys oh pson ha hawson nice to meet you hawk okay Travis pack nice to meet you don't think we've ever met yet no not yet so the issue here is uh I'm aware of your tribal resolution I guess my question is jurisdictionally okay the authority to stop and detain me what standing does Tribal Law have outside of the reservation right standing you point to the resolution but my question is how do you how is that even valid here where we stand right here maybe that isn't for us to answer well if you're going to enforce it I would hope you could answer well I'm enforcing Tribal Law And if Tribal Law is unconstitutional or are not right or whatever that's that it can't be decided by me the situation grew more complex as tribal leaders and law enforcement debated the legality of their actions Paulson calm demeanor contrasted sharply with the heated confrontation he continuously voiced concerns about civil rights violations warning officers they might face legal repercussions for their actions a tribal council vice president eventually intervened acknowledging ongoing jurisdictional disputes and urging cooperation to resolve the matter after five grueling hours pson was released right but you do you do understand that the actions you're taking may very is is quite likely illegal and you may very well face criminal charges for okay well that's fine as long as you believe that I'm going to pull my vehicle up here are you okay with that yeah okay I'm going to pull my vehicle up here beside his and uh we're going to get his stuff that he wants to take with him into my ride that's the way this is going to shake down right now okay and then we'll inventory he will personally witness it I will witness it myself and then everything will be taken out of from there okay okay my civil rights have been violated all morning long okay I've been detained illegally unlawfully and now you're stealing my enforcement my signed Patrol vehicle and telling me I have to go to a court that has no jurisdiction over top of non-rival members to get it back is that am I clear on this that's what's going on here if I'm wrong someone correct like detained what do you mean by detain I'm not free to leave I haven't been free to leave all morning I've been Boxed In by this gentleman on by your tribal fishing game director Harold Maine by Tribal Police I think Richard Buie was parked down there I and me for a while I mean I'm kind of outnumbered here luckily Bo County Sheriff's Department who has jurisdiction right here is kind enough to come down here to witness what's going on here the incident marred by questions of jurisdiction civil rights and potential retaliation left many praising the gay moren's composure Under Pressure whether Justice will be served remains uncertain but Paulson's stand highlighted the importance of accountability and the need for clearer jurisdictional boundaries the last incident of the video will surprise you because you will clearly see the abuse of power on July 19th 2022 a man we will refer to as Mr family visited an area in Ashland Kentucky and confronted a security guard earlier that day the security guard allegedly yelled at Mr family's wife and children and remove them from the mall hey how you doing doing good you got to kicked out two girls on a bunch of kids yeah yeah no you don't raise your voice to girls are pregnant with a bunch of kids no there's no look there's no look we'll call the sheriff's department call him then we going to do let them not you're harassing woman and children at this establishment they didn't nothing wrong yeah come get Sheriff's down camp and I come over and harassing me after yes ma'am I want all of trespass okay A little p trip you got to run out woman and yell out woman and kids went that way until the police got here I'm going wa right here cuz you don't intimidate me you don't scare me I ain't trying to intimidate or scare you you trying to intimate a scare woman and children though that's what you did you just come in here and just kick out whoever you want out I can if I want to that's that's how it works just kick whoever you want out no matter what I had a reason for kicking the mouth she wants to run her mouth so she'll get kicked out well as you were yelling at her as she was walking out they were leaving weren't they and you were yelling at them they were leaving I told her to leave oh you're just security you don't own this more if I tell them to leave they leave so I'm oh you just get to tell whoever you want to leave I they I run something yeah yeah security that's all more cop that's it a little security job and you're something standing here yelling at yeah I'm s you off yelling my wife and my pregnant wife and my children nobody cares your wife is pregnant nobody cares yeah evidently you did because you thought you could go yell her and get away with it nobody cares that your children got kicked out no one cares yeah I do I do that's what that matters why don't you go wi in your car where the real cops come m cop but they're gone yeah mul cop thinking you can kick over you one out as much right to kick you could kick whoever you want out of this place right if I want to you could walk in and kick anybody the security guard argued that he could remove anyone from the mall for any reason but while private businesses have discretion over Access Federal and State anti-discrimination laws limit their ability to refuse service based on race color religion national origin or disability both the Civil Rights Act of 1964 ensure equal access to public venues such as shopping malls theaters and restaurants therefore the security guard cannot lawfully remove customers for discriminatory reasons kids a playing you could just kick them out it doesn't I mean you're fixing to get kicked out none of y'all will I don't care they heard you yelling my kids I overheard them saying I heard that man yelling and that's the reason why I'm here I told him if they cannot if right raising your voice and yelling in front of children cannot keep I'm I'm done talking you're talking to real cops go away I'm talking to real cops go away more cop how you doing okay first of all drop the attitude because he want your trespass so I need your ID first of all ID that I do anything illegal I need your ID he wants you trespass soon as we have this conversation you're going to leave the mall property and you're not coming back that's fine going to have paperwork of that so you can give me your ID I'll give you my ID if I do something illegal okay we haven't had a chance to talk to him yet okay but I do anything illegal I'm going to call that I was dispatched you're involved in by state law you have to take and give your ID this is not up for discussion unless you want to find yourself in the back of my car give me your ID on the risk of arrest I'll give you my ID okay Deputy Terry Nance demanded Mr family's ID which he provided under threat of arrest Kentucky law does not require individuals to identify themselves unless driving and refusal alone does not justify arrest while refusal can factor into Reasonable Suspicion there was no clear basis for detention in this [Music] case ridiculous come here yeah what's your side of story my wife comes home says this guy yelled at her whatever she goes we went to the movies to complain about the guy yelling okay guy follows us to the movies says us get out of the the movies okay and I said what what do you mean she goes you talk about this guy here yes okay that's the exact guy okay he said to come over here that uh that that you know to get out the movies all this stuff so she comes home to me she tells me this I was want she telling me this I can hear my kids in the background going the mean young man's yelling yeah I finally come back here I approach him I go Hey listen what's going on he going oh oh you uh it's not what you think I'm waiting by that by that bench he's in his car gets out his car comes over to me and start saying I can kick who I want to kick out the moreall then he slow changes it to well with due reason that's the long and short of the whole story okay all right here's what you're going to have to do you and your wife going to come out here during business hours your wife isn't here so I can't trespass her you're going to be trespassed cuz that's what security wants okay talk to whoever the general manager is here or whoever's over talk to them explain the situation that happened tonight and see what if anything can be done to I would resolve the issue the only reason you got the attitude that you did whenever first showed up is because when I stripped out of the car the way that you were yelling carrying on okay I want to know who I'm dealing with when you're in that state of mind and by law if I'm dealing with you and I ask for your ID you have to give me your ID it doesn't mean you're under arrest or you're in trouble okay yeah so I'm not trying to overrule on anything I promise you but unless it's a stop and ass State you're not okay well or unless I'm I'm being convicted of a crime or I committed a crime or or I'm I'm investigating okay so yeah you do have to okay it's just like a traffic stop you do have to okay we're not going to discuss it here we're not going to but you're a trespass from this point on from this property if you come back on this property you will be arrested do you understand that Deputy Nance informed Mr family he was trespassed from the mall and would be arrested if he returned Kentucky law allows Property Owners to prohibit individuals from remaining on their property and private property is not protected by the First Amendment as such Mr family could be prosecuted for trespassing if he violated the order can I word for that you have talked to your general manager we don't carry paperwork we don't have paperwork what it'll be recorded on is the dispatch CAD so as soon as I'm done with you I'm going to tell my dispatcher that you are since I ran your ID that you're trespassed and it'll be on record at the boy County 911 here's your ID back you can leave the property okay what's your name and bat how much n 218 thank you sir I appreciate that and sir just cuz you were here what's your name batch number Al 239 thank you sir have a good day after explaining how Mr family could appeal the trespass order Deputy Nance ordered him to leave and he complied
