in a world where the badge is supposed to symbolize honor and Justice some police officers betray their Oaths and turn their Authority into a weapon for personal gain and corruption in this video we explore some of the cases involving corrupt cops on March 9th 2024 Sergeant Joe beers of the oilton police department responded to a call about individuals soliciting solar panels within City Limits after finding one solicitor she provided a vehicle description for the others Sergeant beers later located the vehicle in the driveway of 76-year-old disabled Vietnam veteran Willard Walbridge just outside oilton City Limits when Sergeant beers approached the solicitors Mr Walbridge asked him to leave the interaction was recorded on Sergeant Beer's body camera Ste back nothing you need to step back son I'll take your damn head off okay you need to step back I ain't stepping back you're on my you're on my place get the hell out of here now all right you need to step back you understand that you need to stay back get the hell out of here now you're on my place okay you goingup want to go this way do you want to go this way I was making contact with uh somebody that wasting and I have a another suspect here that's starting to get our rate I'm probably gon have to go hands on all right keep your hands out your pockets you're on my place I ain't getting my hands out of nothing let me let me explain something to you okay I'm dealing with something totally different okay whether it's in the county or not in the county it started in the city okay that's where we are I'm going to be straight to my permission to your you damn sure this is my you one more time to step back okay this is my place step back I'm not stepping back you get the hell in your truck and get out of here now Mr wallbridge repeatedly asked Sergeant beers to leave his property but Sergeant beers refused claiming he didn't need permission the fourth amendment protects against unreasonable searches and seizures in a home and its immediate surroundings but driveways being open to the public often don't have the same Protections in this case sergeant Beer's presence in the driveway likely wouldn't be seen as a Fourth Amendment violation however after Mr wallbridge asked him to leave it could be argued in court that his refusal violated Mr Walbridge is privacy rights depending on whether the court views the request as revoking any implied permission for the officer to be there do you guys know him do you guys want to come try to talk to him before he goes in what was that well I'm dealing with another issue so you fix it with an issue all right turn around place your hands back turn around and place your hands you put your hands in my turn around I'm taking your [ __ ] head off now you understand that son 97 can a drum right unit turn around Play Change behind your back no turn around and place your behind your back get the hell off my place turn around stay in that car get the hell off my place turn around and place your hands behind your back that is a lawful order you put your hands on I'm taking your head off you understand that son turn around your hands behind your back turn around turn around place your hands behind your back how not do 97 count I got one fighting turn around place your hands behind your back [Music] yeah well your husband does not want to listen all right listen I'm going to turn you around we're going to Cuff you up you got a lot of cuffs me go [Music] ahead turn around guys kind to have one of you guys assist me just make sure this other guy that's back here doesn't come back behind me did you get my Nitro you need your Nitro hey he needs Nitro they're coming when Mr wallbridge refused to move Sergeant beers ordered him to put his hands behind his back when Mr Walbridge didn't comply Sergeant beers took him to the ground triggering a cardiac event Oklahoma law states that obstructing a public officer is a misdemeanor but since Mr Walbridge is home was outside the city limits Sergeant beers was acting outside his jurisdiction making the arrest likely unconstitutional additionally the force used by Sergeant beers may be deemed excessive under the Fourth Amendment considering ing that Mr wallbridge did not physically resist or pose a threat the level of force used could be seen as excessive and unconstitutional you need your Nitro 91 go ahead and start me medical hey stay with me okay I'm going to roll you back this way I'm going to roll you back this this way hey go get that tell him to grab his [Music] Nitro bring it bring it bring it I know you know how it goes I don't [ __ ] know 91 you got P start me [Music] medical here here here it's totally [ __ ] unold God hold that hold that hold that [Music] here why do they put this [ __ ] car how many one or two do you know just just drop under it goes under under close there's one Ward no one better get [ __ ] Amo here all right it's right I [ __ ] hurry you going end up to [ __ ] death when your this was [ __ ] stupid figured it out yet it is stupid you didn't have to do this I don't care what he was doing he's 80 [ __ ] years old back okay you going to do me now back up I hope he back up where's is that is that the wife how many does he normally take one or two one I guess I don't know whatever he needs he doesn't does it go under his tongue can he take more than one Willard can you take one more Nitro can you take one or two he's unresponsive now he heart attack guys back up for me 907 County my subject might be having a heart attack you need tell the ambulance stepping up I'm going to put this it's your pill your Nitro your Nitro okay put it in your mouth your Nitro hey he saw yeah well he he's looking for you guys yes sir I just can't have you over here threatening me until tell give me theel give me the peel he's got to go in his I know Willard I'm Willard in your mouth okay here one you do you got it one you do that's your wasn't trying to get it to this [Music] point I'm G need you guys to stay here for me statement from me okay so somebody called in saying there solicitors going around uhuh so they gave this vehicle okay so I made contact with these guys okay it happened in the city and your husband is this your husband yes came up basically told me to get the [ __ ] off his property this is County property started threatening me property talking to okay is it well there's an answer to that happened prior to that so take it in this concept if these guys murdered somebody in the city and then they came over here and we're talking to you would we not come here and apprehend them I don't know what you do Sergeant beers claimed authority to continue his investigation on County property because the solicitors initially broke the law in the city however Oklahoma law limits police authority to their jurisdiction with exceptions for Hot Pursuit assistance requests and serving warrants since none of these exceptions applied Sergeant beers was likely acting outside his authority and a court would likely find his actions Beyond his jurisdiction [Applause] all No7 count going to be on West count far out as my amulance he so conscious 907 County how far outside the ambulance we're like 20 20 20 miles between each you can leave your car I'm going to pull my car back so they can get in here you know just leave yours there it's uh it's right on that [Music] post think just just a little hotheaded I shouldn't have had to get to this point just hang tight for [Music] did you get your phone ma'am okay okay yes they're on 99 [Music] still hang on one second this beers dis Bears West uh if you do what's your address five 5344 we turn that right down 5344 Westwood [Music] thank you what is beers Sergeant beers beers yes ma'am my badge is 907 huh okay yeah let me deal with this I'm out with deon's grandfather um I have everything on body cam so it's all there but there were some solicitors um somebody called the office I was in the PD and uh I came out they said it was a Rish looking car with Michigan plates came down Westwood his he is yes but I was dealing with them so City resident called on them they're they have another female who go ahead sir you still need Dr negative okay so sitting a PD um doing paperwork call comes through I missed the call I call right back they say you know hey this is so and so I can't even remember the name I have to look on that call ID um there's some solicitors down on 6th um isn't there an ordinance for it so I didn't really know for sure I looked it up found that there was an ordinance made contact with a female um right there at 6 and um right there where all those junked out houses are wherever that was that can you hear me now so make contact make contact with a female off six street right there where those junked out houses are that one burned down um so the female's there I got her information she told me what the other two males were driving so I came back this way found this car it's here I saw the two gentlemen there so I want to make contact with them make contact with them we're fixing to leave we're I going have them go back with me over to where she was so I could explain you know the city ordinance St three of them at one time and um the I I even know his name he came he kep getting up in my face getting up in my face so you ain't got a [ __ ] right to be here this is County property and I said I understand it's County proper is yes yes so um I explained to him that you know we have an issue that happened inside the city that I was dealing with and that I have to deal with that and then I I'll talk to him give me one second ma'am um and so who's the chief chief s I'm on the phone with him right now I'll have I I'll I'll make contact with you um so he kept coming out kept coming out kept getting up in my face putting his hands up cles up yes so I don't know he just got upset that I was here talking to them and he said you have no right to come and talk to them because um they're uh I got Dr right pull up because um um they're in the county now and I said well I had an issue that took place in the city and you know I have to handle that and then we'll go from there and so we went from that to um start putting his hands on back at that point I said you know look you need to back up away from me or this is going to go a different way and he said uh I don't know exact where something about you know like you know if if you put your hands on me or you know I'll do something to you I mean there was some type of threat physical threat so I kind of Sid stepped and I went to grab his arm he yank back away from me so I Sid Steed the other way grab his arm and put him on the ground yeah I didn't know I mean I didn't know who it was I mean I treated him just like I would have done any other person it's all on body cam so so then he said he uh he hollered and said he needed a Nitro and so I hollered at his wife said um said um hey he needs his Nitro they brought it out we gave him two Nitros I call for an ambulance called for I called for drum right before I ever had to go physically I was trying to get drum right here so we could take it a different way no I don't know you still need me I told him 1022 you hey hold on one second I was trying to get somebody here before it got to this point so okay yeah they sent me all the way to like fourth on the east side of town and I'm like I don't know where he is I I told him uh between Maine and third off of Westwood yeah they said between Maine and third Westwood never came out so okay all right man if you don't need me I'll head back y you're good I appreciate it um let me talk to the ambulance I'll back uh basically physical to the ground he said he need his Nitro and so I hollered for his wife to get his Nitro they gave him uh two pills try to get he's on his side so they were tucking him and then we've been here at this whole point so Mr wallbridge did not suffer serious complications from the cardiac event but reported bleeding and bruising he filed complaints but hadn't considered legal action and was not charged with any crimes on March 23rd 2024 the oilton police department shared partial body cam footage and defended Sergeant Beer's actions on Facebook despite the Department's support Sergeant beers resigned on April 9th 2024 the incident is under investigation by Creek County district attorney Max cook but no charges have been filed and no updates have been released on May 15th 2023 chalk artist Joshua Le Hinson was drawing on a public sidewalk in leyon Valley Texas when field training officer Jorge Bretton and training officer Alan Gonzalez of the leyon Valley Police Department responded to an anonymous call alleging that Mr Hinson was defacing public property the encounter was captured on officer Gonzalez's body camera what's up bu how's it going good on man what what's all this that we're doing here somebody call us because youi so you don't have a permit unfor freedom of expression to create in public property I've been it's public yes yeah I've been arrested one in court three times now so I mean if y'all need to arrest me for it we arrest me and then I'm not trying to go that far man you just have an idea on you what am I doing wrong man we got I'm creating and it's about to rain and wash it all the way yeah that's that's my concern that is not could you stop it please could you stop it just stop okay this is impermanent man go right here please this way you have your idea on man hey hey the police are out here messing with me I'm just trying to do my sidewalk shot hold on hold on it's okay we tried to talk to you you don't listen we try to be civilized we want to give you a break now you pushing us to do this yes no you are you're bullying oh we're bullying so breaking the law it's all so simple man all you have to do is just give me your name and then I told I told you I told you I wasn't trying to go this far all right well you're going this far and you chose to yeah I need my stuff go ahead and get it huh we'll go ahead and get it right now for you what's your name man you don't have an idea on you you have something my pocket can I go ahead and grab it I mean I don't have any other choice do i y have already me for sidewalk in this wallet right here so you're just trying to get some tip money off of that or what yeah got you trying to create Beauty in a public place problem is you don't have a permit for that you don't need a permit no okay you going to explain that to the Y okay you have any weapons on you man no any knives anything's going to poke or shake me my back my artwork over there all right then just give me a fav to go ahead and I'm going to go ahead and sit you in the back of my patrol car right and then we're going to figure out what we're going to go ahead and do all right this time you're just detained you're not going to leave take he pH these are the elements of the crime these two this I don't know mind our evid let's Okay okay we're going to book him yeah for yeah definitely officer Bretton informed officer Gonzalez that they would arrest Mr Hinson for graffiti under relevant section of the Texas Penal Code however the state graffiti statute prohibits the use of permanent materials like paint or markers not chalk it's highly likely that a court would find Mr hinson's chalk drawings did not violate this statute Additionally the leyon valley ordinance prohibits possession of graffiti implements like paint containers or etching tools but it does not include chalk making it improbable that Mr Hinson violated the local graffiti ordinance however Texas Penal Code addresses criminal mischief which prohibits making markings on property without the owner's consent regardless of the implement used while there is no specific case law in Texas regarding chalk other courts have upheld similar statutes against chalking considering it defacement even if temporary therefore it's possible a court could interpret the Texas criminal mischief statute to apply to Mr hinson's chalk art you check in you yeah just paper taking everything out after deciding to arrest Mr Hinson the officers took him to the police station for booking the arrest along with the conversation between officer Breton and his supervisor Sergeant Chad mandry was recorded on body camera footage graffiti how much the whole uh Crossing in the corner the by the bus stop on the how do you call it marker or what no it's chalk okay is that a reible fence but yes because it's chalk marker perent marker all that Stu I'm going to read the statue again I want to give you a break order for Cosby has to be indelible meaning not erasable CH is I don't know the water is not washing off so it's going to take a little time but chalk be careful chalk is not considered a per marking okay so they I told him hey what is this doing I'm going to give him a break hey just stop no no I I'm doing hard this my right I can do this sidewalk on the sidewalk okay that's probably not going to be arrest offense yeah we're going to check right now if that is the case just let him go yeah double check but come be careful cuz if we bring something back to like that then if we unlock detained them then that opens up for lawsuit okay Sergeant mandry warned officer Breton that arresting Mr Hinson for using chalk which isn't a permanent marking could lead to an unlawful arrest lawsuit under us Law Officers can be sued for violating civil rights but they are protected by qualified immunity unless they violate clearly established rights the fifth circuit court has stated that if a reasonable officer could believe the arrest was lawful even if mistaken qualified immunity applies even if the Texas criminal mischief statute didn't apply to chalking a court might still Grant the officers immunity due to the statute's broad language the specific charge graffiti versus criminal mischief doesn't affect the legality of the arrest as courts focus on whether probable cause existed for any offense as officer Breton discussed this with Sergeant mandry officer Gonzalez took Mr Hinson into the station all right man so this is our Police Department we're just going to hold you and process all your stuff going to go ahead and get everything out on your pocket [Applause] top Mr Hinson was detained for about 30 minutes before being released without charges he later filed a complaint against officers Breton and Gonzalez and called for breton's dismissal officer Breton was not fired but was removed from training duties and given a reprimand while Gonzalez faced no discipline as he was still in training the city of leyon Valley apologized to Mr Hinson and held a chalk the walk event to support public chalk art the dispute was settled without a lawsuit with the city agreeing to pay Mr Hinson $16,500 on October 17th 2021 officer Roger Williams Zachary Espinosa and Tyrone Brooks Craig of the Athens Clark County Police responded to an anonymous call about a potential domestic disturbance at the Athens Georgia home of lyana beam and David priest the encounter was captured on body cameras hi hey how you doing I'm officer Craig with ad County Police Department we got a call for what OBU face I'm struck said what you off on my property police offic this is my property man come on I work at St Mary's I know my godamn dude look are you kidding me when Mr priest refused to open the door for officers Espinosa and Brooks Craig they kicked it in chased him down and handcuffed him for obstruction the Fourth Amendment usually requires a warrant for home entry with exceptions for emergencies in Mr priest's case his injury wasn't serious enough to be an emergency Miss beam was not in danger and there was no evidence being destroyed or an escape attempt the officer's entry likely violated the Fourth Amendment and Mr priest's refusal to open the door may not count as obstruction since the officers didn't have the legal right to enter I know you just saw this is my house what are you doing this is my house I didn't ask you to come here don't put me in that car you're going to jail now for obstruction from what you came to my house and you put me in CB why are you that's your choice I have no re that you should TR for anything stop do not pull away from me get up get up get up get up no get up you still wrong for this get up then you can stay right here miss beam struggled against officer Williams's attempts to place her in the police vehicle leading him to slam her to the ground the fourth amendment protects against excessive force during an arrest requiring it to be proportionate the Supreme Court's Graham V Connor case outlines three factors the crimes severity immediate threat and active resistance while officers can't use disproportionate Force the 11th circuit allows significant force on resisting suspects in the Lewis V City of West Palm Beach case officers were granted immunity after a suspect died from being hog tied despite only resisting arrest since Miss beam struggled a court might find officer Williams's Force reasonable or Grant him qualified immunity if she sued I didn't do anything I I don't do drugs I don't do anything we didn't say anything about drugs do you have any on you why are you treating me like this get up stop stop touching me stop touching me stop touching me stop stop touching me no what I law abiding Sy not pay for y goddamn taxes bro come on this is get Ming around this officer Williams tripped Miss beam again causing her to hit her head and become unresponsive according to the relevant Athens Clark County Police Department directive officers should use only reasonable Force taking into account factors such as the seriousness of the offense imminent threat and resistance although Miss beam struggled she was handcuffed smaller than officer Williams and did not pose a threat while some force was justified slamming her repeatedly to the ground was likely excessive and in violation of Department policy Polie man stop being like this what happened sir I will turn I will turn we don't know they'll cover him we try to talk to him she starts fighting with us why were you it's unknown can we get them 108 no that's my girlfriend I don't have anything check my pockets right now but that's my girlfriend dude why do you throw her down get up why do you throw her down she this please man stop being like this search me I will turn I will turn get in the car no get in the car y'all just threw my girlfriend on the ground get in the car y'all just threw my girlfriend on the ground it's unknown so what happened can you tell me what happened we don't know what happened we know who called we don't know you don't know who called the police nope they called you to this house yep they were fighting she's she had blood on her hands refusing to let us talk to him who's covered in blood she starts pulling away from me and then that's that's what happens I've been trying to get her in the car for 20 minutes now she starts pulling away from me so she has get on the [Music] ground hey man we need to put her in the car she down she needs to get in the car get up I you you got to stand up let's go her up get her up we have EMS on the way girl you got to sit down pull do you know do you know who called no are you familiar with these two no I all I know is that I think it's a rental property I mean I know I've seen them in and out of the house like I know that I've seen them there but I don't know if they're the owners or the hey you have uh I'm trying to I don't see anybody else here who could have call I don't know they said they did they call no so they said they saw them well they didn't see them they heard them fighting and then they saw them go in this this uh house right here we go over there she comes out she's covered in blood she refuses to let us go talk to him right so she gets charged with she gets put in handcuffs right I try to get her away from the door she starts fighting with me she goes she she gets arrested for obstruction right then and there right hear you say that every time you don't get up it's another so when we're over here and I'm trying to get in the car she starts pulling away from me again so I have to get on the ground and then she refused to get up we finally get up right here and I guess she was talking to someone over here I don't know if it was you it was me stand and she starts pulling away from me again so I have to take her down to the ground again so cuz the only reason for her to pull away from me is to get away right so I'm just wondering who could have made that call is there car in that house right there I have no idea there a caller and it could have been somebody on that side the caller right there the caller didn't tell us who they were just are you familiar with them at all going ask if there's anything happening in community because help uh well I'm pretty sure they both intoxicated yeah but right now we have obstruction for her um blood on both of them I don't know how I got on them but here for we're making sure everything okay then we can leave yes ma'am then y'all can leave it's just my is this your friend my best friend so she's very intoxicated and she's going to jail know so she hasn't in searched so I couldn't get that I like literally just got her in the car before he I think he punched a like a window or something and that's all that I know so that that makes sense for the broken glass noise but I'll finish filling you in over here I'm going uned um so I'm going to get her out we'll see if we can't get at least get her search just to make sure she have anything on her that she has you okay yeah saw you wiping off well when we grabbed he covered in blood when we grabbed him and there's I'm pretty sure she was too and I got C everywhere we've been wiping and trying to clean stuff there blood all in the like the fouryear area so is it his blood or her blood I think it's his blood um when we showed up you could see him talking in the kitchen she come out and met and met us he he kind of gave me a rundown of that stuff so I just I mean she had blood on her the windows busted she wouldn't let us in she's acting the way she and she defended him the whole time and wouldn't do she wouldn't cooperate at all I mean that's that's what he's so I'm I just told him I'm going to try to talk to her try to calm her down a little bit see if we can get her searched um you know em you call 108 cuz she was I'm pretty sure we'll see how I mean they usually get pretty fast just to make sure it was okay and I got a little cut right there so what's her name I don't I don't we didn't get that far hey how are you I'm Sergeant init of the Clark County Police Department what's your name um Lanna lyanna yes I like to go to okay what um what's your last name L beam how do you spell that b e a m Okay so I don't know why I'm being so here here's the here's the situation right now I'm going to explain it to you okay okay so you are currently under arrest for obstruction okay you interfering with an investigation in reference to a domestic incident that we got a phone call about and then you repeated and it you then you repeatedly refuse to cooperate with the officer because you're being and you are being detained you're lawfully detained and when when you refuse to comply with officer at that point in time and you're resisting and you're pulling and you're trying to run off you to get to go home well unfortunately that's not an option at this point in time believe okay wrong do you have anything on you at all that would get you in trouble you have any guns drugs knives bombs anything like that no okay do you have any pockets on what you're wearing at all no okay so is it is this like a dress kind of thing or something like that yeah yes okay so because you are detaining anythings we have to check you to make sure that you don't have any weapons or anything like that on you okay so would you step out of the vehicle for me so I can use the back of my hand and check you but you're going to have to go back in the back of the vehicle okay why because you are under arrest for what for obstruction against what obstruction of a police officer that's not fair Well ma'am when you refuse to comply and when they you guys give to my house yes ma'am because we received a phone call in reference to a domestic incident where we heard broken glass and we need to investigate the domestic incident and you interfered with that investigation my house it doesn't matter if it's your house or not we have a requirement Sergeant Caleb arrived and explained to miss beam that officers are required by law to investigate domestic disturbances the relevant section of Georgia Code mandates a domestic violence report for any domestic incident but does not authorize a warrantless entry into the home according to protocols there must be an invitation probable cause an ongoing conflict or a safety concern for officers to enter the home while broken glass suggests probable cause for a misdemeanor the fourth amendment requires a search warrant or exigent circumstances therefore a court would likely find the officer's entry and Miss beam's arrest unjustified go ahead I I don't like the way who I treated I'm just a person that's coming to hang out no it's not okay the way you're is not okay do you not feel bad I'm not doing anything I haven't done anything do you not feel kind of bad this is not helping the situation at all right now okay oh my God whatever whatever whatever you need to do I don't like the police officers that me down that's fine I wasn't here when that happened I'm trying well when you're pulling the away and resisting that's doing something okay I live here well you're still underr turn around and face the door for me okay you don't have anything on you right no I don't have anything on me I'm just going to double check and make sure okay are you hurt anywhere that you can tell right now no I must hurt I is by you searching me I live here okay have a seat for me again okay why would I this is not fair this is so unfair have a seat for me slide on in get your feet in the car police Melissa watch your head okay watch your niece so doesn't look like there's any way for her to have anything on her or anything like that cuz it looks like it's pretty much just a dress I didn't feel anything buling anything like that yeah I just never got the chance with her no no you're good I'm I I I I get where you're coming from you're good so um for right now do let's uh see we get I didn't get a date of birth from her but um we may have got from a friend or something like that um we'll just so are we just obstruction times to is that what we have right now I mean well there's 41 in the in the house after we had to go in there and get him she's not telling us anything of what happened he's got friend said that she got she got told that he punched the window and busted it which was if he did do that which would explain the bling glass in the call um have y'all seen did y'all see a window busted or anything okay so um does his hand busted look like he punches through it so he can go for I would do that and then justes and then hook them up both through obstruction I would that's what I would do that's I mean who's the friend that said that I need a witness statement uh that's the one in the orange was saying that to another person so well he's so we're pretty sure he B he punched the window and broke the window so we have Criminal Trespass and obstruction on him cuz they said he was fighting against them too and so we got both of them for I just wanted them to check him that's why I was asking if he was disorderly or not yeah so um let's just focus on getting God dang your car's covered in blood or espinos is whatever but um so let figure out just if every everybody's more calm now it seems like let's figure out charges and once we figure out charges we'll just get them out to the jail sounds good all just want to make sure that they're okay medically well she got taken down and not sure if she lost Consciousness or not was kind of the original concern but he's got a busted hand and he's cut all up she's conscious and alert times four at this point so she just wants to go home she's intoxicated so y'all have made it busy on me my first day good we did not expect any well no well and I know but I'm just talking about like with the other things I've had to deal with today too cuz I've already had to call C twice today so so yeah we got here and gu the door hey she's like y everything's fine I can see him through the window he's standing there with his shirt off hey can we talk to him no I need to talk to everybody yeah no you're not talking just got call for domestic we got to call for a domestic and then she didn't want to get out of the way didn't want to allow him to do their investigation and then he's cut up and bloody and then he didn't want to let us do anything thing wanted to fight against us so I just showed up to figure out what was going on cuz I got I got asked and I was like here we go she's telling me she's time she's Time 4 she's answering all my questions priv she saying she doesn't want medical attention what do you I mean I just wanted to make sure she was fine yeah she says that she doesn't she doesn't think I'm going to go arrest yeah you're still you're still under arrest after the encounter charges against Miss Beam for obstruction were dropped on August 23rd 2022 and charges against Mr priest for obstruction and Criminal Trespass were dropped on May 17th 2022 both in the interest of Justice an internal investigation led to officer Williams being fired on May 4th 2022 his termination was upheld on August 14th 2023 and he subsequently filed a federal race discrimination lawsuit which is still pending Williams was also involved in a 2019 excessive force incident resulting in a $250,000 settlement on October 23rd 2020 Sergeant Jeremy bird of the Port Orange Police Department in Florida received a report about someone in all black filming over a wall at the police department he sent officers to investigate and they found James numer a local citizen who had visited the department to file a complaint the officers mistakenly believed Mr numer was trying to climb the wall and the interaction was recorded on body camera they supposedly climbing our wall with a mask on over here Andre called it in yeah over here somewhere on this wall on Clyde he said Andre called it in see anything in Black okay I think that's the guy he was saying was trying to climb a wall there cuz Andre saw it so 12 to 15 go ahead hey I guess he's walking Southbound on Clyde next to the PD now dressed all in black ATT where supposedly he's walking down this way he's walking nor so hello hello hey were you trying to come over our wall here h no I look stupid no we get you for one second cuz we had a call of a guy dressed in black that was climbing up on our one of our walls there hell no you guys got cameras uh-huh do you have an ID card with you let me call I'll call flaming hey sge can you call Fleming who messaged where did Fleming Mees who' he message what's that was that you yeah well we're out with a guy tressed in Black that's running right along here so he said he had a citizen call oh so he didn't see it no he didn't Jesus Christ all right yeah I think I'm going to have to get a all right well great I thought he saw yeah all right he's refusing to give his name or I don't like cops I don't talk to Cops I don't deal with cops I was minding my business looking at my phone walking he I was freely he stated to me that he was inside the lobby trying to make officer complaint figured out was closed so he left the office I'm sorry the lobby and came onto the road I'm sorry the sidewalking came this way so he was trying to make a complaint but okay well I can help you with that no you can't yeah I can no you can't I'll be here Monday through Friday during business hour to talk to a supervisor I am the supervisor I don't care well that's if you want to make an officer complaint I'm the guy to talk to you ain't going to do you protect I don't care line Brothers say what I said you protect your Blue Line brothers you you ain't going to do based on what based on police that's what's based on You Don't Know Me based on every I don't need to know you you're a blue line that's all you are to me okay you don't give a damn about nobody but your other Blue Line people so trying you ain't trying to help me do you're right now you're harassing me on the side of the road am I being detained or am I free to leave you're free to go thank you oh y keep an eye on him I look up he's wearing AO shirt see if anything happens oh we have oh this guy yeah cuz we don't even have an ID we don't have any he wouldn't give ID no but he's wearing an shirt so we can probably figure out who he is do you know if he's parked in the front Park lot or anything like that I don't know you want to go Preston go to the see if he's got a tag on a car in the parking [Applause] lot now you're detained for jayw walking running across Clyde Morris like that how else am I going to cross that's what crosswalks are for there isn't a crosswalk within 150 ft I know you cross angle when there's no cross hor within 150 ft you're detained you're illegally detaining me and now you have to identify yourself no I don't I want a supervisor I am the super I want your supervisor I didn't do anything wrong I committed no crimes I am not giving Sergeant bird told Mr numer he was being detained for jaywalking and asked for ID which Mr numer refused Florida law allows pedestrians to cross outside crosswalks if they yield to Vehicles except at intersections with traffic signals Google Maps confirms Mr numer did not cross between such intersections so Sergeant bird would need to believe he failed to yield in his report Sergeant bird claimed he saw Mr numer Crossing and slowed to avoid hitting him but body camera footage doesn't capture the crossing and shows several u-turns before stopping Mr numer under Florida's stop and search Law Officers May temporarily detain a person to determine his or her identity if they reasonably suspect that the person has committed is committing or is about to commit a crime if officers have reasonable suspicion that Mr numer failed to yield the right of way they can legally ask him to identify himself JW walking is a traffic infraction [Applause] jaywalking is a traffic infraction I didn't jwalk for which you are lawfully detained I didn't jwalk you're unlawfully detaining me I do not jwalk I actually saw you myself yes I understand that you are allowed to cross the street if there is not an intersection within 150 ft you're allowed to cross the stre at a 90° angle there was no traffic coming you were the closest traffic and you were far enough away from me to make it safely you guys just want to ID me illegally so go ahead if that's really what you want to do take my wallet Terry V Ohio says you're not allowed to dig into my pockets without a reason so if you really want to file a have a lawsuit filed against you go ahead I will sue you all right so I got if you don't identify yourself go ahead take my wallet right there take W out of my pocket I'm telling you go ahead take my wallet out of my pocket that's illegal you're breaking my rights right now you're violating my rights that's a violation you're not allowed to go in my pockets and take my wallet without reasonable you just told us to no no I you're threatening me with arrest that's done under duress you are threatening me with arrest that's correct I am Sergeant bird claimed that Mr numer gave his identification willingly while Mr numer argued he only did so under the threat of arrest the Supreme Court has ruled that officers can ask for ID without suspecting a crime as long as they don't imply that compliance is mandatory if a citizen voluntarily consents there's no Fourth Amendment violation however consent must not be coerced either explicitly or implicitly as any form of coercion would invalidate the consent and make it a pretext for an unjustified police intrusion no you're not treating me with respect CU you had no right to pull me over you got no reason to be messing with me you just heard somebody called and probably didn't call and said that somebody looked over your wall over there and now y'all feel violated and you want to come punish somebody so that's why we're here right now going through this no yeah and and you would have never said a damn word ref we'll sign him for jaywalking and he can move on and I'll see I want all your name and badge number that's fine you have no legal right to detain me right now you think I don't do this all the time I know exactly what I'm doing okay you cannot write me a ticket for jaywalking if I'm over 150 ft away from a crosswalk you know that you're only doing this to force my ID that's the only reason you're doing this cuz you're a punk you want to know my name so you're going to get it one way or the other no matter how you have to do it cuz you're a tyrant I didn't make you run across thead you're a tyrant you know what the laws are you know I didn't break no laws I didn't make you run across the you didn't you know I didn't break no laws Mr numer argues that the officer stopped him just to force him to identify himself the Supreme Court has ruled ruled that an officer's motivations don't matter what matters is whether the seizure was objectively reasonable based on the circumstances if a court finds the officers had reasonable suspicion that Mr numer committed a pedestrian violation the detention and identification would likely be considered constitutional even if their real motive was to learn his name however if no Reasonable Suspicion existed the court would likely find the detention and identification violated the Fourth Amendment psych ain't nothing wrong with me I ain't no psych I'm perfectly totally sa D citation I'll see all of you in court for it too because I ain't do nothing wrong that's fine I am legally allowed to cross the street if I'm more than 15 ft from an intersection I cross at a 90° angle that is the law you have no right the only reason that you are doing this is so you can force me to give you my name so exactly what am I being detained for I already told you you want to tell me again JW walking yeah jaywalking I was well over 150 ft from the closest intersection whatnot you have to yield right away to vehicles on the road right away there were no cars on the road you were the closest car and you were 300 yard away from me so don't even try that okay you know damn well this ain't going to fly you just wanted to force me to tell you my name I refused the ID myself down the street and now you want to force me to tell you my name guess what it don't matter I'm going to be out here tomorrow I'm going to be out here the day after I'm going be out here the day after I'm going to be out here every day okay I don't got a problem that I'm going to show you tyrants what's up I didn't do a damn thing wrong and you know it that's not fa you know full well I didn't do nothing wrong I was well over 150 ft from the intersection I crossed it a 90° angle and there was no traffic coming you're a liar says you but that's not true well yeah who's going to believe me over blue line Thug gang member like you you don't give a damn about the C since you're nothing but a money generator all you do is generate funds for the city and state you're a revenue generator that's all you'll ever be and okay you go with him yeah all right here here you go sir all right 6450 I don't need anything from you I explain something to you you got 30 days to either pay or from you I'm it I from you all you you you you after the encounter Mr numer challenged The Pedestrian citation in court and reported that a judge found him guilty however the court records are not publicly available online to confirm this outcome it is unclear whether Mr numer appealed his conviction filed a complaint or pursued legal action against Sergeant bird and the Port Orange officers
