on February 5th 2024 officers Crawford and Al of the weight Park police noticed an open garage at a local upholstery business in Minnesota inside Hunter Clems the owner's brother was fixing his broken down car the incident was captured on officer Crawford's body camera Police Department come to the door officer Crawford knocked on the business door instructing Mr Clems to come to the door as part of a knock and talk encounter which is legally permissible under the Fourth Amendment this Doctrine allows officers to approach a private residence knock speak with the occupant and seek consent to search without suspicion of criminal activity generally anyone can knock to initiate a conversation without infringing on privacy expectations during such an encounter the occupant has the right not to answer requiring officers to leave if unresponsive however if police actions make a reasonable person feel compelled to respond the situation could escalate into a fourth amendment search requiring probable cause in this scenario since officer Crawford announced his presence authoritatively and ordered Mr Clems to the door Mr Clems might argue that his response was not consensual thus implicating Fourth Amendment rights AC Polie wouldn't call myself police if I wasn't them what's up oh sorry I thought you were one of my buddies [ __ ] with me I'm sorry no man I came by I saw a garage open it's 2:00 in the morning oh trying to figure out what's going on I'm working on my car I can't leave until I get it fixed okay you scared me don't worries I was over there drilling so yeah boss who I'm talking to you're not in trouble you don't need to ID me I'm not trouble hey let's not do this so here here's part I'm assuming you were here right uh yeah I guess okay let's say you don't wa no just just you guys are going to give me the whole rund down and then try to give me the ID myself for no reason because I didn't commit a crime I'm inside of more it's more than just a crime man you work here right let's say we find this door open no one in here or it turns out it's burglarized and I have to contact someone but it's not I'm not committing a crime you don't need my ID cool officers asked Mr Clems to identify himself which he refused although Minnesota does not have a stop and identify law refusing to identify during a lawful stop could lead to an obstruction charge under Minnesota statute section 69.50 however the Supreme Court ruled in Brown versus Texas that individuals can't be punished for refusing to identify themselves without Reasonable Suspicion of criminal activity in Mr Clem's case there were no signs a forced entry or criminal activity and he provided a valid reason for being at the business after hours given these factors it's unlikely that officer Crawford had the necessary Reasonable Suspicion to compel identification that's how it is oh is that how it is yeah it is Charles David Rob 802 it's not about rights man it it's about your in in I'm not committing a crime we don't know that well or we call the owner we figure out who you are so what's so what's the crime suspicion huh since when is suspicion a crime or when is we don't know that a crime what we're doing is we're going to make it a bigger thing need get out of here look at my freaking license plate number got absolutely you guys are disgusting get out of here from the doorway officer Crawford saw Mr Clem's vehicle's license plate and called in the number the Fourth Amendment generally allows officers to check license plates visible in public without any suspicion however officers must not violate the fourth amendment to gain a position to view a plate since officer Crawford may have breached the fourth amendment by compelling Mr Clems to open the door running the license plate might also be considered a violation I have my ID well we're going to go down the road we don't really need to go down man God why do I need why do I need my name in your system any more than it has to be it's just you work here let's just make sure that we that you do how are you going to prove that I do huh how you going to prove that I do well I can always call the business owner in the morning fun he's not going to answer cuz he's sleeping okay I can call the business owner in the morning I can give him your name okay and he says oh yeah he works here no problem and we're done H you ain't going to call it in cuz there's nothing going on but then say you don't work here right he's going to call it in that his Shop's been with yep and then I right away in the morning and then I know who was here and I I don't have to help you with your investigation perfect it's on my rights okay well I'm going to check and make sure watch out no I don't I don't I don't give you consent I don't give you consent this isn't this isn't your not move what how you don't have the right to do this I do no you don't you what are you to check for dude who else is here just nobody okay get dude you don't have the right to do this get out of here it's not your personal property I'm going to make sure nothing looks burglarizing in here oh my God you you don't have the right to do this I absolutely do sir nothing is burglarized okay get out of here I did not give you permission to be in here well you don't have to give me permission yes I do you can't just come into a private property despite Mr Clem's objections officer Crawford searched the business premises according to the Fourth Amendment searches of private property without consent are generally unreasonable unless authorized by a valid search warrant this protection extends to business premises which have a constitutional right to operate free from unreasonable official entries although they have a reduced expectation of privacy compared to homes the expectation mainly pertains to administrative inspections not to criminal investigations like officer crawfords which was conducted without Public Access or exigent circumstances without conditions such as imminent danger or evidence destruction and lacking both Reasonable Suspicion and probable cause officer Crawford's search likely violated the Fourth Amendment get out of here copy what was that name again can't just come in here for no reason I didn't commit a crime say it again I didn't commit a crime so you can get out of here now 10 Hunter yeah easy enough have a good night thanks for violating my rights it's not your right it's yes it is it's my rights this is private property you can't just private business at 2:00 in the morning you're private business will not not identify yourself private business I don't have to I didn't commit a crime you're in a private business at 2:00 in the morning exactly the in the morning does not matter the hours of Cl I'm over 18 past the hours of closing this is business it's 2:00 in the morning the garage is open you're inside the business has been closed I'm assuming since about 5 6:00 so what does that tell you the garage that it could possibly be burglarized yeah you could be in here doing something you're not supposed to that you may not have permission to be something hold on I I don't know that but what I can do is now I can confirm that this person this vehicle was inside of this business and if the owner calls in tomorrow and says my this person was in here he didn't have permission to be then I know who I can come and talk to you first you understand Yeah question you're still violating my rights it's I don't have to tell you that well you do no I really don't you do we can make it a bigger deal I could just not answered the door you could have and then I would have went went in underneath there they would have broke into a business that's not breaking in I'm the police I'm in charge to make sure you don't have rights I told you you cannot come in y and you don't have rights to come in here well you're not identifying yourself a business has been CL for hours I don't have to like I said I'm not I'm not going I don't have to help you in your investigation dude so you can go into anybody's house if anybody's house has not a house dude it's a private B it's a private property no it's a private property business does it matter abut private property you can leave now you can leave like I said you can leave did I explain my point no you have any questions about it uh yeah thanks for violating my rights it's not violating your rights well I don't have to let you in so and I don't have to you don't have to let me in permission let you to let me I don't have to tell you my name you refuse to identify yourself I don't have to help you with you refuse to identify yourself in a business that's going close after hours you have any questions about that I'll be contacting the owner make sure you had permission in the morning okay have a good night have fun after leaving the business the officers contacted Mr Clem's brother who confirmed that Mr Clems had permission to be in the garage the next day Mr Clems visited the weight Park Police Department to file a complaint and spoke with officer alel who stated that he and officer Crawford had done nothing wrong but still provided the necessary forms for a complaint when Mr Clems returned with the completed forms he spoke to a sergeant who reiterated that the officer's actions were permissible it is unclear whether Mr Clems plans to pursue any legal action regarding the encounter in June 2023 while driving through Lee County Mississippi Jessica was pulled over by Trooper Michael Harbin of F Troop Mississippi Department of Public Safety for allegedly speeding when Trooper Harbin approached her vehicle he requested her driver's license registration and insurance Jessica unable to locate her insurance card asked if the trooper could retrieve her insurance information using his computer D insurance for this what I I can pull it up the requir you to have it stop me the F you C up you make it to 65 when I got behind you you were do more 65 listen to me listen to me if you keep lying to [Music] me where's your insurance you have my insurance where's it at I mean listen to me the law requires you to provide it not for me CU you're not giving it to me so now you get a ticket for it okay it gives me authorized to do it though yes it does nobody has the authorization to scream at somebody sir look at listen to me shut up and listen to me don't tell me to shut up Sir don't tell me to shut up and don't scream at me I'm not doing anything [Applause] okay feeding seat belt haircut Trooper Harbin reacted in a way he shouldn't have probably reflecting his bad day at home in his work and scared the poor woman aside from the fact that cops are human beings they still need to separate their emotions from their work but this guy falls short of that Trooper Harbin returned to his Cruiser where he wrote Jessica citations for speeding a seat belt violation and failure to provide proof of insurance he returned to her vehicle 5 minutes [Applause] later right listen you going to say stop from uh insurance I what list traffic stop I'm explain it to you at this point Jessica wanted to take the paper and leave but Trooper Harbin pulled it away from her it is important to note that once the citation is written the traffic stop is over and you are free to go so the paper you are given is the last step of the traffic stop I'm not here if you don't be quiet you can go to jail how that you what doing this you're not doing this what am I doing why am I going to [ __ ] jail you're [ __ ] what the [ __ ] is your problem get out right now are you [ __ ] kidding me get out are you [ __ ] kidding I'm about to t you two this dooring condu get out are you kid right now put is running czy what are you doing get the [ __ ] what you shoot me 33 Trooper harbin's body camera was muted during the incident meanwhile unable to get Jessica out of the car he tased her twice there was no credible threat for him to do so Harbin lost his temper let his emotions get the better of him and tased an innocent woman for no reason now come over here have a seat you don't listen unless I raise my voice apparently got your child you're entitled to what I said I'm not your child I don't give a [ __ ] when you don't want to listen to me it's going to happen that way so now you go to jail for disor conduct and resisting arrest and public profanity right there y he cuss me running I don't give a [ __ ] if it's running or not now you want to cuss your malfunction the damn my major malfunction is him why you play back the video cam the body Cam and just be done with it hold on you don't tell me my job now you just asked me what what my malfunction I can't hear anything hear me listen put your head in here and listen he's got creeping playing I can't hear anything I'm a little freaked out I'm on my way because I'm on my way to work and now I've been tased twice and I'm all I'm I literally just don't my way to work okay all right Jessica was taken to jail following the traffic stop after reviewing the incident videos Trooper harbin's supervisor ordered him to undergo remedial training and later testified that he believed the use of a taser on Jessica was justified however the Command Staff reviewed the use of force packet and decided that further action was necessary they required Harbin to compl complete a deescalation class and take 3 days off despite these measures Trooper Harbin was terminated from the Department in October 2023 he appealed the termination and appeared before a tribunal during which Colonel Sanders the deputy director of MHP and chief of the uniform division testified despite his testimony that the traffic stop concluded after Jessica received her citations the tribunal reinstated Harbin compensating him for the time he was off duty the possibility of MHP appealing the reinstatement remains uncertain as of now there is no information on whether Jessica has filed a lawsuit or the outcome of her citations on August 14th 2022 officer Matthew pedit of the Red Oak Police Department was dispatched to a fire scene in the rural area of Red Oak Texas while on route to a nearby residence to check for necessary Evac evacuations officer pedit came across several local ranchers including Chris Moses the owner of the Red Oak Video Vigilante Channel they were attempting to move cattle across the road to safety away from the smoke and Flames the ensuing interaction was recorded on officer Pit's body camera move no move move your vehicles out of the road okay you stop the attitude need to block the road to move cows the fire is not coming this way is it not coming you sure yeah I just came over here our cows were running back here we had to cross them across the road that's why we had the road block when you block off a road that emergency vehicles are using to get somewhere that's my concern is the fire is going to get bigger if I can't get a fir truck or an ambulance or a brush truck through yeah but reason we had it shut down cuz we just got to moving the cows got them through there and I just lock the gate there's they're locked in there okay you don't need nothing from no just need to make sure the road stays open cuz if any if any emergency vehicles come from Lancaster if they need to bring water from Lancaster and y'all blocking the road yeah we didn't know if y'all wanted us to block them or not Noe okay I need y'all to move out of the road fire is out right uh they had a line just burst so they had some hot spots come back cuz they went down to just one ho but they're getting ped uh you're going to have to feel the complaint I just got into a screaming match with Chris Moses over there he decides he's going to block the road because he needs to move cows and I said well okay well how's the emergency vehicle going to get through to put out the fire that's just going to get bigger because you decide you want to block the road for cows he's got his he's got his his vehicle in the middle of the road with his red and green flashing there's traffic backed up I I ain't taking his attitude I'm officer Matthew pit inaccurately reported details to Sergeant lockart about his interaction with Mr Moses and other ranchers he claimed they had blocked the road yet body camera footage shows the vehicles were parked on the side allowing space for others he also incorrectly stated that Mr Moses had flashing red and green lights on his truck when only a small LED light bar was present furthermore he alleged Mr Moses's truck was obstructing traffic in the middle of the road which was not supported by the footage no other vehicles were blocked and the ranchers had positioned their vehicles correctly along the roadsides Mr Moses later acquired the body camera footage and posted it to his YouTube channel Red Oak Video Vigilante clarifying in the video description that no fire unit was impeded and that they had departed before the fire unit arrived I'm busy right now what do you need Chris you're not allowed to block an entire roadway okay I don't know if you know that but you're not allowed to stop stand Park in the middle of the roadway it's against the transportation code okay to move cows from one pure another P to block the roadway that's right that's right to break I'm not having an argument with you take call F I'm done arguing with youge that was bull crap we were blocking the road to move all right and where in the transportation code does it say you can do that what where in the transportation code does it say you can do that you know it's BS the transportation code's BS you you're allowed to ignore it that's what you're saying it's agure okay agult look up the agriculture Cod Sergeant Lockard questioned the ranchers led by Mr Moses about their legal right to block the road while moving cows the ranchers pointed to the agriculture code as their justification neither the Texas Transportation code nor the agriculture code explicitly allows for stopping vehicles on the road to move cattle however the ranchers actions did not clearly break any specific parking or traffic laws as they were careful not to obstruct emergency vehicles or block the road entirely the body camera footage indicated that the road was passable during the incident suggesting it's unlikely a court would consider their actions illegal furthermore the agriculture code mentions that hering livestock across highways is permissible which supports the ranchers actions in moving the cows without explicitly violating traffic regulations there for a court would likely determine that the actions of Mr Moses and the other ranchers were legal complete attitude everybody everybody around saw it okay and I wasn't going to put up with that crap and I'm not going to put up with here Chris I'm not going to put up with your attitude either hey I don't need the attitude either all right leave it be if you want to file a complaint go up tomorrow 8 to 5 okay anything else I can help you with let you okay upet I got you and we're trying to deal with something too and you got the road blocked off I'm trying to get Lancaster down here too all right so if it's a little bit high stress could you understand like I said come down tomorrow file a complaint okay thank you all right he file a complaint all he wants my job is not to take attitude from people that are telling me how to do my job that's not that's not my job I don't care what he has to say he was sitting in his truck blocking traffic he not moving any cows I'm fine but dude I'm I'm seriously I'm going to get talked to Wrong by Chris Moses then he comes up in here he's like walk away I'm talking to him like no you're not no that's not how this is going to go they're flying up and down the road on that side by side they're not even supposed to be driving the side by side on the road I guess that's agricultural code too when Mr Moses and his neighbor approached officer Pettit and Sergeant lockart officer Pettit remarked that they shouldn't be driving a side by-side utility vehicle on the road under Texas Transportation code a side by side is defined as a motor vehicle designed primarily for off-highway utility work not recreational use and generally cannot be driven legally on roads except under certain conditions the law specifies that off-highway Vehicles like side by sides can be used on roads if they are involved in agricultural activities such as moving cattle and do not need to display a license plate for this specific use however Mr Moses and his neighbor also used the vehicle to drive to the officers to make their complaint which could be outside the agricultural use exemption it's unclear from the body camera footage whether the side by side had a license plate but even without one its use for agricultural purposes is permissible whether their drive to speak with the officers counts as a violation of Texas law would depend on a Court's interpretation of these actions as within the bounds of agricultural use yes sir um my camera's still on but I guess Chris was I guess trying to help one of the neighbors move cattle so Chris parked his vehicle across the entirety of St back and blocked all the traffic and we had a freaking lanster fire unit trying to get through then after all that was done he came down here and tried to yell at pett again and I was like no it's not going to happen he thinks they have some sort of agricultural exemption that lets them block the road to get cattle across no no he had his little like blues and greens or whatever yellow and green whatever lights he's got on it he was blocking both lanes cuz I guess they were supposed to be moving cattle across the road but and the thing is the fire truck wasn't there yet but it was coming so yeah shout to the boss I was just giving him a heads up that redo talks about to blow up yeah after the incident Mr Moses obtained the body camera footage and uploaded it to his YouTube channel this case was also featured by the YouTube channel lackluster on December 7th 2022 noting that Mr Moses had filed a complaint with the department but hadn't received a response in his video description Mr Moses stated that he consulted with a state trooper and a Texas Livestock agent both of whom confirmed he did nothing wrong and criticized the officer's judgment Mr Moses's YouTube channel documents multiple interactions with the Red Oak Police Department alleging harassment and belittlement by the officers despite these claims in October 2020 2 the Red Oak Police Department honored officer pedit as officer of the quarter for his attention to detail and consistent performance
