his flashlights to warn other drivers for Speed radar on the road and was stopped by the police who saw this although there is no Supreme Court case on the flashlight issue according to similar decisions in local courts this is considered expressive conduct and protected by the First Amendment however the issue we deal with in this video goes beyond the law and is the behavior of of the situation we're used to seeing a man was driving down the road in two cars with his friend when he saw his friend being stopped by the police and he pulled over seeing this the policeman said that he had to leave because he was concerned about safety well I'm with him we're together just do your job I'm with him what I'm good right here are you pulling me over or both of us I'm fine right here you're not pulling me over right are you pulling me over you and 75 miles hour no we're not I got my cruise on you're on camera too driver's license and registration please you're lying but you're pulling him over right you and him both you just told me you were pulling him over so yeah well he was going 87 you were going 85 tell you to I got myu give your driver's license and your registration and insureance now you got to give me a minute for the registration but here's my license and you realize that how how can you see my speed when he's right in front of me you're following him so here's what I did I hit my front radar on him he was going 87 as soon as he passed it went to 85 on you I'd never stopped the radar uhhuh that's the way it is do you have a a pren out of that now when I make traffic stop if you don't do as I say by pulling to the front of him behind I'm trying to do I'm trying to make sure yeah it is cuz it's officer safety you're obstructing my safety is not a so I want you to pull the front of him you're not behind me me the I can make sure that I can you quote me the the law for that the code I'm not going to P you the law for that then there is no law for order it is a lawful order TR stop you see the issue here is the police making up reasons to detain people they usually do this against people who stand up to them or rather against people who know their rights and resist the police's extortion of those rights we can clearly see that the police whine like a 2-year-old baby because you don't get their way and try to create evidence to incriminate the other person even if the evidence shows otherwise that's why I can't help but wonder how many citizens were victimized when body cameras were not used there has to be a code for for officer safety there is no code I don't care just like there's no code for public sa why is it that you do what I tell you to I'm with him okay it's not safe for me to just pull up ahead I don't exactly go to FR people because if you had a gun or something like that you could always what are you so scared of what you mean one am I scared of that's the way we we maintain our off think everybody's out to get your total the Justice Court your violation is for Speed you're going 85 and 70 and they give you a violation Citation for and a 70 what's your name and badge right down here what's your name and badge number are you going to fail to identify I'm not going to fail to identify I'm providing you the information identify please verbally the wells Justice Court the phone number is right there and ver identify please it this other you're not a cop if you don't verbally identify you're not a c your options and your instruction pay to contest whichever you choose my information your supervising officer huh who's your supervisor my information is down here I'm providing that information to who's your supervisor have a safe day yeah who's your supervisor who's your supervisor and you didn't you didn't verbally identify this cop had no intention of stopping that man because if he wanted to he would have done it in the first place but the man waited for his friend at at an appropriate distance based on the law and because he did not obey the police he was subjected to such a behavior and of course a fine as Revenge a 22-year-old man Freedom Christopher fendler stopped at a supermarket before going to work but did not remove his motorbike equipment he was then allegedly warned more than once by the store manager for safety concerns but he did not care according to the store manager the police then arrived on the scene hey bu you got some ID on you hey hey you have some ID on you hold what's up you have some ID on you take your helmet off while you're walking around in the store and you're just ignoring them what are you talking about man you think I'm I'm talking just take your helmet off you're not going to speak with us with your helmet on okay all [Applause] right what you make your purchas uh everything man yeah so he said that he had music playing in his helmet right right now stood right there yes it is I live in the mod okay so did you see the manager basically walk up right to your face and ask you to take off your helmet how do you not see that I saw him talking but he's got a headset I'm standing right next to you right next to you I came up and I said sir thought you were going this way I didn't hear you I said stop I follow you halfway throughout the store let me let me ask you something what's the what's the purpose of keeping the helmet on it's just faster to get to work man like I said I'm on my way to work where do you work at work at Jim Click right there okay so you walk through the store what' you buy I bought sandwich a Gatorade two peaches a scrubber I think four pens that toothbrush okay that's SI so you just kep everything on here see keep the helmet on you walk around I do safe way I go the other Safeway I go fries when I go to the bank I mean he knows I know cuz I I ride he he rides it's not it doesn't take much effort to take it off put it back on I mean it takes maybe like five seconds 10 seconds if it doesn't man but I've never had any issues where it was like take it off or or sign saying that you need to have it off and like I said that's why the manager asked you to take it off like I said I didn't hear him I had music play you didn't see him staying right Fredy I saw you there and then I saw you talk but like again you have a headset on so I can't put my hands on you to get your attention I standing right next to you just like I'm standing with the officer come to me stood right in front of you just like I'm standing here I said I need you to stop and listen to me you totally ignored me and kept walking I got Associates that were upset and concerned because you're walking around with a backpack with a helmet nobody knows who you are but I made a I'm concerned about the safety of my associ even if their claims about the store manager's warning are not true some incidents that occurred close to the date of the incident explain their fears about this issue however I cannot say the same about the behavior of the police later in the video You're argument of person and I am not the person you want to argue with you need to take and you need to go like this and pull your head out of your ass because you're walking around in a store hiding your face there's shooters that go on all over the place this man comes up to you and you want to play you got a little Senate headpiece going on that you can't stop you need to listen to learn not listen to reply you need to turn that little switch off in your brain that you want to run your mouth and argue every time somebody tells you something because this is disturbing of Peace you can go to jail and not go to work so what's the choice you're going to make hardhead you're going to quit walking around businesses with a helmet on scaring the hell out of people to where you got massive cops all over the place r outside waiting for a shooter to come out laugh but that's where we're at so pull your head out of the store don't come back to Walmart come back to Walmart manager anyone sees you you get arrested for that it'll be on the camera when keep in mind if you come in here again you'll be arrested and you book you book for trespassing and stands what he's telling you your trespass from Walmart it's a national system you're not just trespass from this Walmart trespass from all Walmart's and Sam's Clubs okay cool understand that if something happens and you get pulled over or stopped in one of them other ones for wearing your helmet for stupid stuns like that you'll find yourself sitting in time didn't have to be like that but how many other people you see going into business walking around with a motorcycle Hing out especially with the shootings in detona and freaking um op passages happening your goal is people are going to be on edge they're going to be scared they're going to be worried okay you got someone that walks in wearing a motorcycle helmet and has a backpack with military camouflage they're going to think otherwise they're not going to think it's just some law bies see how that looks it's like it's kind of like common sense I mean like I said he rides I ride I always take my helmet off I mean what's does it really save you that much time today it didn't you medic health issues or anything holdie tell me how old you are tell me how old you are okay you're acting like a little child how many times did you ask him to leave at least five six just like like he's ignoring you I walk I walk half the store with them following him right to his side to ask him I I told many times that you officers are coming out there just I'm thinking he has five six times leave the store I would say espe the current behavior you're asking allore five or six times walk right next to just like we're you're under arrest and trespassing you were told to leave the store and you didn't want to take my jacket off NOP I you leave your jacket wait which way am I turning all right you have the right to remain silent anything you say can will use against court of law you have the right to the presence of attor Prior questioner if you canot aold one will be appointed for you do you understand those rights all right you have a SE back those prescription glasses see yes okay perfect the police's treatment of Mr Christopher violates his first and Fourth Amendment rights and his unprofessional behavior towards him is of course another matter but if they had admitted that Mr Christopher had not heard the store manager because he was listening to music from the beginning of the incident and left him alone after a little warning I am sure everyone would have happily moved on but they preferred to escalate the incident because they thought that since we have come this far let's at least punish him for it according to the decision signed by the US District Judge on the 16th of February the case which lasted for 3 years was dismissed the judge accepted the opposing party's argument that the plaintiff Mr Christopher had failed to disclose any damages alleged in the lawsuit and also failed to show that there was a genuine issue for trial and the case was
