Yeah, maybe somebody here. >> Well, that's what I was asking if you want me to do it now. Heat. [Music] Heat. [Music] guest. >> Yes, sir. >> All right, sir. Uh, my name is Major Forest Marks. Uh, in the room with me, I have Major Charles Hubard, Major Mark Hollingsworth, and Miss Donna Cox, and she's here to keep us in between the ditches. Uh the reason we're here uh have a complaint on Zach guest from an incident that occurred on February 21st, 2020 uh in regards to pursuit. Um Zach, just let you know this is being recorded uh in accordance with policy. Um Zach, did you receive a copy of the file? >> Yes, sir, I did. >> It looked complete to you? >> Yes, sir. It looked complete. >> All right. Very good. Uh, Zach, what we're going to do is we'll just turn it over to you, let let you give your side of what happened and then we'll ask you some questions and we'll go from there. Okay. >> Yes, sir. >> All right. Go ahead and start with your story, Zach. >> Okay. Yes, sir. Um, on that day, I was headed home on 5 northbound around the 8 mile marker when I uh saw a vehicle. He uh turned his blinker on to move from the middle lane to the right lane uh directly in front of another vehicle and behind another truck about I'd say within a car two car about a car length two car lengths behind the truck as well as in front of the car. Um, I drove up to the car to see how many people were in the car and to run the tag to know that I was deal with. Uh, or I ran the tag. I got behind the vehicle, initiated my life. At that point, the vehicle merged into the center lane and began to drive. Still not stopping for my emergency lights. Uh, the vehicle began to speed up a little bit. Uh once we got around the 10 mile marker when I went in to pick the vehicle to put a stop to the pursuit. At that point the vehicle sped up not allowing me to pick. Uh during the pursuit I was observing the driver reach around everywhere was in his vehicle under his seat. The driver's seat under the passenger seat and the back seat center console. and the driver began to throw an item out the window that we were not able to discover what it was. Um, I initiated a pit the vehicle again. At this point, the vehicle slammed. I think we were about over 100 miles an hour. The vehicle slammed on its brakes. When I tried to initiate a pit again, um, we proceeded with the pursuit. The vehicle attempted to take a on-ramp as an exit ramp at a high rate of speed causing the vehicle to go through a ditch and wreck out through the south end of a private uh towing company. I got on the service road adjacent with the towing company, got out of my vehicle with my rifle to go uh through where the vehicle wrecked out on foot. Uh, as I proceeded towards the vehicle, the suspect doubled back to his vehicle, got in his vehicle and began to drive, uh, due to the suspect being in his vehicle. I did not want to place my body up against the vehicle, so I doubled back to my vehicle and try to find a way inside the establishment. At that point, the only way for me to get in was through the locked gate. Uh at that time what was running through my mind uh I thought the force of my vehicle would be able to break the chain and lock the gate. I attempted one time at a slow rate of speed bending the gate in and I thought maybe if I did it one more time with a little bit more speed surely the chain and lock would break with no damage to my vehicle. Uh, as I attempted the second time, the lock stayed intact and the fence buckled and went over my vehicle, swapping my light bar off and busting my windshield. Um, as I made entrance into the establishment, the suspect began running to the north end of the uh, lots. I got out my vehicle and was able to take him into custody without any further incident. Okay, Zach, I looked at the file and it looks like uh according to the file, there was probably about $2,200 worth of damage to the fence, a little over $5,000 in damage to your unit. Is that correct? >> Yes, sir. >> Okay. I can tell you one thing. Uh, whoever manufactured that lock and changed that gate ought to have your video as a commercial because I really thought you had it on it. second time. But, uh, in all seriousness, uh, have you learned anything with this? >> Uh, yes, sir. Uh, an action like that should have been used for a violent felon encounter, not necessarily someone fleeing from a uh, as a misjudgment on my part, and used it at the wrong time. I will use this as a learning experience to make better judgment as a trooper. >> Okay. Major Hollingsworth, do you have any followup? Nope, we're good. Okay, Major Humber, >> I would just I would just caution you even to do that with a violent felon. Uh maybe you might want to think twice about ramming a fence with your police car. There's there's other ways to approach that. I'm sure your chain command have discussed that with you. And I think you had plenty of time to to have handled that a little different, Zach. But I think everybody appreciates the fact you're out there hustling and getting things done. and and I know in the future you'll do things differently. So, just be careful out there is all we ask. >> All right. Uh Zach, I'll I'll echo what what Major Hubard said. I'm hearing good things here. You do a good job. Uh we all make mistakes. Uh if you look back over my career, you're going to find things where I I messed up. But, uh the important thing is is is to learn from it and uh adjust and move forward. um have to ask you uh one question. Do you think you violated ASB policy here? >> Yes, sir. I do. >> Okay. All right. Uh Zach, just kind of explain to you the rest of the process. Uh what the command staff review board does is we determine whether you violate a policy or not. Uh that's our only role in this process. uh we'll type up our findings and submit that up the chain of command to Colonel Bryant. Uh I can tell you Colonel Bryant will review the entire file. Uh he's very thorough. Uh I can't give you a timeline as far as when that'll happen. Uh but once he's made a determination and what he's going to do, uh your chain of command will reach out to you and you get this behind you. >> Okay. >> Yes, sir. Uh that file that you you have there, Zack, can you give that to Captain Moore? >> Yes, sir. I can. >> All right. Uh listen, we appreciate your time. Again, keep your head up, keep pushing forward, you know, don't let this this get you down. Uh just learn from it. Move forward. Okay. Yes, sir. Thank you. >> All right, man.
