Baby, it's my fault. I I deserve it. I made him jealous, but I didn't know he was going to show up. What did he say when he left? He said you move and I will shoot this gun at you. My fault. My fault. My fault. I'm sorry. >> On January 1st, 2025, an officer began interviewing a woman with visible injuries at a hospital in Las Cruces, New Mexico. She said her partner had hurt her, yet she kept apologizing for making him angry. As the officer tried to reconstruct the night, [music] her answers kept returning to what she believed she had done wrong. >> I'm sorry. >> No, you you You don't need to say that anymore, okay? >> I'm sorry. >> You don't have to say that anymore. >> I'm sorry. I didn't mean to I I I didn't mean to I didn't mean to like the way I didn't mean to make him angry. I didn't mean to I didn't mean to I didn't mean >> [laughter] >> I don't say that anymore, okay? >> I'm sorry. I didn't mean to. >> Okay. I need to take some pictures of your face, okay? >> No, please. >> I have to. >> [laughter] >> It's okay. Just close your eyes, okay? You don't have to open your eyes. Just close your eyes. >> [music] >> I didn't mean to I didn't I Like how do you say like Like make him very angry. I didn't mean to I didn't mean to >> [laughter] >> I'm sorry. I didn't mean to I didn't mean to I'm sorry. I didn't mean to I didn't mean to I didn't mean to I swear. >> [crying] >> I'm sorry. >> You don't have to say sorry, okay? >> I >> Just take a deep breath. I'll cover you right now, okay? I'm dropped. I did um see video footage of the Crown Vic pulling up um with both of them in it. Um and then she's seen a couple of minutes later knocking on the door and then he's seen uh in the vehicle by himself like waiting to see where she's at like looking for her and then he drives off. >> But [laughter] there's cameras at the >> I I did see the I did He's He showed me Your cousin showed me the footage of when the car pulled up. >> Ew. >> And he showed me when >> And I took off. >> when you got out and when you went inside, okay? He's been He helped me a lot, okay? >> That was so horrible. I started to I took it. I saw >> Her apologies don't decide legal responsibility. Even if she made him angry, that wouldn't legally excuse the force she described. The officer can document her injuries, but investigators also need details they can check independently. I know you said you I know you said you were in an apartment in an apartment, right? >> I was I wasn't at his place because I trespassed. I'm trespassed by the >> Okay. >> [snorts] >> But it was in a different complex and yeah, it made him jealous, but I I didn't He was going to show up. >> Did Did anybody see when he pulled you into the car? >> Yeah, multiple The girls that were there we had my phone. >> Okay. Do And you don't know their numbers? Do you know their names? >> Except [snorts] the owner of the house, but it's I don't remember what apartment complex it was. Like I mean, I know what apartment complex, but I don't know the number. >> Okay, what apartment complex was it? >> It was like it was so when we >> [laughter] >> When you get there, it's in the back. It's in the back. There's going to be a truck there, but it's in the back. I don't I didn't see the number. >> But do you remember what street what street is it the apartment that you were at? >> No, I don't. I'm sorry. >> You don't know what street it was? Do you know what the apartments are called? >> Oh, it's right there on like it's like kind of like we're behind like where Young's is at a little bit. >> Okay, behind Young's Market? >> It's like around Young's. It's around Young's. I'm sorry. He has Darian has my phone. He has my phone. Sorry. >> [laughter] >> It's okay. It's okay. >> If I had my phone, I would tell you guys. Wait, Darian has my phone. >> Okay. >> He has my phone and everything. >> [laughter] >> Well, we're trying to find him right now, okay? So, if we find him and we find your phone, we'll give you your phone back, okay? >> I'm not worried about my phone. It's just I can't I can't give you any >> [laughter] >> information? Can you give me anybody's name that saw them? >> Um my My tia was there. >> What's your tia's name? >> [clears throat] >> Her name is Yvette, but I don't know her last name. I It's because she's really good friends with my mom. >> Okay. >> But she was there. And then the owner there is Gabe. But I don't I The way he goes through like Instagram is GG. >> Okay. >> [snorts] >> And how old is Gabe? >> I I didn't mean I didn't mean to put Darian in all I swear I didn't mean to. >> [gasps] >> So, I didn't mean I I I I betrayed him. I I I didn't mean >> [laughter] >> to. >> Miss Martinez, so I I still need information from you, okay? So, I I need you to start from the very beginning of what happened, okay? >> Okay, so around like eight like seven or eight in the evening me and him like we were talking and everything. And yes, I he invited me to the house, so that's not pretty much me trespassing at the house. >> Okay. >> So, he was talking [clears throat] to me and everything. And then I told him I was like, "You know what? When your dad gets here, take me to the house." Like to my mom's house. But my mom right now, [clears throat] she's at the hospital. She's actually here. >> I love you. >> I love you. >> Okay. >> So, when I took off, yes, I I did go with my auntie. I went to my auntie's house. >> And this is Yvette? >> Yeah, Yvette. >> Okay. >> And I went with her to Jax. And even um the bouncer, I mean not the not the bouncer, the bartender over there at Jax, he saw me. >> Okay. >> And his name is Austin. And he knows my dad. So, he saw me there. So, I've been there all night till 12:00 until they closed. And then >> [snorts] >> I went with my auntie Yvette and then Gabriel and then a couple of his friends. And yeah, I did to get a little bit mad because he was over there talking about gangs. Like he was talking about gang-related >> Who was? >> Um my friend Gabriel, the one that I went to the house with. >> Okay. >> The apartment. And I got a little offensive because I I don't like that. So, I did tell Day about it. Because obviously Day's in a gang and everything and I know if I trusted him, you know, maybe he would he would have protected me. And then >> [laughter] >> I did I didn't tell him I Yeah, I I don't know Yeah, I was I was dealing with some girl and then at the same time I was like sending her videos and I didn't know if I sent him my location or not. So, when I did, I guess >> To Darian? >> Yeah. >> While you were still out at Jax? >> Yeah. No, when I was at the apartment with Gabriel. >> After you had left Jax, when you were at the apartment, you were sending him stuff? >> Yeah, I was sending him stuff. But it was just me. I was just like I I just trying to be with Darian, but the girl, though. With the girl, like like Gabriel wasn't there, but the girl was there. And I went outside with the girl. >> [laughter] >> I didn't mean to, man. I didn't mean to. I just wanted to to be near you, you know what I mean? You know when you love somebody so much and when you care about I care about somebody so much, you just want them near you, you know? And that's what I wanted. I wanted Darien near me. >> Uh, so then you you and your friend go outside, right? >> Yeah, we went outside. >> Do you remember her name? >> No, I don't remember her name. I just barely met her that night. >> Okay. Okay. So, she's not somebody that you know already. >> No. >> Okay. So, then you guys it's just you and her that go outside? >> Yeah, it was me, her, and then um I guess her cousin. And she was tripping out because she she didn't realize where her keys were at. And then that's [snorts and clears throat] when Dave pulled up because I guess I I sent him my location. I'm sorry. Okay. It's my fault. >> And he shows up in the car, right? He shows up in >> up in the in the Crown Vic. >> By himself? >> Yeah, by himself. >> Okay. >> And then he he grabs me by the back of my neck and he like tosses me in the car and then that's when he started acting crazy. And we did pass a cop a couple of times in the Crown Vic in the back. And they didn't do nothing. They didn't pull him over or nothing. >> Um, was he driving crazy? >> Yeah, he was driving crazy. He even He was trying to stop properly, but he was also driving crazy and I looked at the cops when and because it's like a fishbowl, like, you know, like there's tinted windows or nothing. >> [snorts] >> And I was trying to like tell them like I was trying to look at them as much as I can, but they didn't look. But I tried so much. >> And then when you said he pushed you by your the back of your neck into the car. >> He grabbed me from He grabbed me by my neck. In the back of my neck and he like threw me in the car. Like literally like >> Do you remember what door he threw you in through? >> passenger seat. >> Okay. >> Passenger Passenger seat. I hit my head. Even when we were driving, I I didn't have a seat belt at all. I didn't have a seat belt at all. And I hit myself on the dashboard and everything. Like I And he even hit me on the on the side of all the way like my ribs and I couldn't breathe and then he even hit me on my arms and then >> And that's was him punching >> me on my face and then he hit me with his gun. He even put he pointed his gun at me. >> What did he say when he was >> He said, "You move and I will shoot this gun at you." He said that he he [laughter] But then he said that it was my fault because I I deserve [laughter] it. >> You don't. You don't deserve it. Nobody deserves something like that. >> [laughter] >> I lied. I lied. I even lied about me being pregnant. I I I mean, I'm pregnant right now, but I I >> You're pregnant right now? >> Yes, but I >> How many months are you? >> I don't know. >> Okay. >> I don't know. I I barely found out cuz I took pregnancy test and it came out positive. >> Okay. >> That's why he was mad at me. >> When did you take a pregnancy test. >> Okay. >> [snorts] >> I did a pregnancy test before Christmas day. >> Okay. So, just recently. >> [laughter] >> I'm telling you right now, nobody deserves this. It doesn't matter what lie you told or anything like that. Nobody deserves to get >> but nobody's going to believe me. That's why he gets away with everything. No matter if they don't arrest him. He He Everybody gets away with everything. >> I'm sorry you feel that way, but it's not that way all the time, okay? I get it. Sometimes that does happen where he won't get arrested or anything like that. It does happen. I'm not going to lie. >> Yeah, but by tonight, he's not going to get arrested. He's going to be free. >> don't know that. >> to do this to every single girl that he beats with. He's going to be free today. And then, even if you guys don't find him at the house, he's going to be free because he's running away from you guys. >> Okay. So, then I know we're going to go back in back into what happened, okay? So, then he he throws you into the car. He grabs you by your neck, throws you in, you hit your head. You say you hit your head on the dashboard, um and he's punching you on both sides of your ribs. He's punching your face. And then, he grabs a gun, and then he hit you with the gun first or he grabs it and tells you if you move, he's going to shoot you. >> Yes. And his gun is like where the um like where your gun like the way your gun is the the slider is like the top of the slider it's um >> [snorts] >> it is silver. >> Okay. >> Like you can see your face through it. And then, the rest of the part of the gun is purple. >> Okay. >> So, that's his gun either. When you guys get there, he's going to hide it. I'm telling you, he's going to hide it. I'm telling you. So, even no matter where he hides it or he finds somebody to come and get it right away, that's what he's going to do. That's all he does every single time. >> And then so then during this time when he's hitting you he has a gun with you. He's driving the whole time. >> Yeah, he's driving. He's driving or he stops. And there's multiple times like people will go and see us, but they don't call the police. >> Her account finally gives investigators something to chase. The relationship also matters under New Mexico law. Dating partners count as household members even if they don't live together. If evidence supports what she says, striking her with a handgun could fit third-degree felony aggravated battery. Pointing the gun while threatening to shoot could fit fourth-degree felony aggravated assault. Forcing her into the car and holding her there while he drove could add false imprisonment, another fourth-degree [music] felony. Proving any of it is harder than it sounds because the worst of what she describes happened inside a moving car with no one else in it. >> remember where you guys stopped? >> I don't remember, but the only thing I remember was stopping at the drive-thru so he could That's all I remember because I was looking outside like not outside the window, but I was looking like in between like I was just I was sorry. >> I'm sorry. You don't have to say sorry when you're >> No, I'm sorry because I I I I aggra- I aggravated this. It is my fault. He is looking down at me. I'm beat up and I'm I'm I'm bleeding from my nose. But I told him I was bleeding from my nose. I told him I was bleeding from my nose and he said no, you. This is what you get. This is what you get. And so sorry. I'm sorry. I'm pretty sure he's dying. >> No, no. I'm just trying to get as much information as possible, okay? >> [snorts] >> I know, but >> [laughter] >> I didn't you guys get anything? >> There's There's other officers out there right now, okay? >> But you looking. the furniture cruiser is gone. They're at the house. He's probably driving everywhere else. >> Well, they They already know what he's in. They already know what crime he's in, okay? >> And yeah, and it has an exhaust on it. You can hear the exhaust. >> Can I Can I see the sides of your your ribs? I mean, you have like a cut right here, okay? And you have a lot of blood on your face, but it looks like dry blood, okay? Let me see the inside of your mouth. Okay. Let me take a picture of the inside, okay? Just open your lips up like that, how you have it right now. And then you You said you can't think of any of their numbers, right? And you can't think of the address. >> does he have my number? He has my number. >> And what? You can't remember the address, but it was somewhere behind uh Young Spark. Okay. And then you don't know their last names, either, right? You don't know Ebit's last name or Okay. Is the PT Cruiser red? >> No. >> Yeah, okay. That car's there, but the the black car's not there. No, my Okay. All right. Um so, the sergeant's calling the detective right now. >> Is this dad or his dash? Yeah, his dad is specifically asking >> Okay. I I I'm not sure about the residence, um but they're calling a detective right now to see what the detective wants to happen, okay? >> But he's But I'm not going to get in trouble because he invited me. >> You're You're not going to get into trouble. >> Because I'm no trespasser, but he invited me to the house one time. >> Okay. Uh I highly doubt that they're going to care that you were trespassing there, okay? >> He called the police. >> Comcast is at not over there where Buffalo Wild Wings is, but the other Comcast where I used to be at. >> On Idaho? >> On that Yeah, on that >> Like near the Salvation Army? >> Yeah, the Salvation Army. >> Mhm. >> So, it's right there and there's going to be like a a like not a public park, but the uh >> A bunch of mobile homes? >> Like the trailer park there in that hidden park area. >> Where it's like in the corner kind of? Yeah, and it's like dirt road? >> Yeah. >> okay. >> Or Avenue of the Americas where Dominos is at, like right across the street there's a Comcast >> park? >> Yeah, that little park right there and then there's that house right there >> On the corner? >> with the >> [music] >> It's a a It's a um It's a Nissan right there. And he's either right there or he's probably hiding cuz he has like really needy friends. He drives everywhere he can. >> You don't think he'll leave the city? >> No, he won't leave the city. >> No? >> No. >> Okay. >> But he's probably hiding and I'm pretty sure he'll go back to the house. Yeah. And I I doubt if he'll answer, but if you keep calling and calling he'll pretty much answer. >> Okay. >> But Like I don't want him I I kind of do want him to go to jail for everything that he done to me because one, he invited me to the [music] house. I did not trespass. He invited me. And we did talk to each other. We were conversating with each other and everything. And yeah, I did call him. >> Yeah, one second. Hold on. So, you you have a lot of dried blood, okay? But as far as like an injury injury, just the the one on your the bridge of your nose It's >> This is like a big cut. Or a little cut. It just looks big. >> My face is pretty as [ __ ] [music] >> I think once you clean it up, you're good to go. To be honest, as far as the rest of your body, you're bruised up, girl. >> Um this is the place I live. So, when I took the pregnancy test at home, I like before Christmas, that's when I found out I was pregnant. >> Okay. >> And then >> [music] >> Yeah, I mean, they took a bunch of blood from you, so I think they'll be able [music] to tell what's going on. >> The photographs show her condition when police interviewed her. What a photo captures is the damage, not who caused it. Investigators can compare her account with witnesses, surveillance [music] video, car, her phone, and any gun they recover, but none of that reaches the thing she keeps coming back to, her own fault, and no investigation is built to fix that. >> I'm just like it's just absolutely stupid because like, you know, what I'm saying? Like, we've been together for many years. So, obviously he was with me drinking, but at the same time, like, I am this well. I just do the wine. >> Were you guys separated right now, or you guys are like together? >> We were together, but he invited me to the house. >> Yeah, but like right now, you're not You guys aren't like separated, like >> We weren't like separated, but we were like having a a >> A break? >> A break. Like, not a break, but like we were like arguing a little bit, you know? But, at the same time, he told me that he was done with But, then at the same time, like he did invite me to the house. His dad knew I was there. >> Has he Has he been physical with you before? >> When I called you >> So, what do you What do you feel? >> It's because the I mean, yeah, he does get physical with me, but his emotions and the way he is like without him being so angry. >> But, it doesn't matter. but you know, I you I know you're a big girl and you know that there's people out there that don't do that, okay? >> Yeah, and like now like this is the worst part he's done to me. >> And honestly, it's just going to get worse if you stay. That's just the truth. >> That's the thing though, like yeah, I I did make him a little jealous, yes. But, with the girl but with the girl I'm I'm fine. Like, why would you get pissed off over a girl? Why? But, at the same time like it doesn't mean for you to like And he didn't care. He just kept going until when we stopped when I had my opportunity to actually >> Get out? >> Get out? >> Mhm. >> was over there. I said, "Okay." And now look. Just run away from you guys. You guys can't catch him unless you guys stay out there at his house. And you guys actually see him because he goes through he goes through the alley. >> Through the back way? >> Yeah, through the back way and he goes and the where the the tents are. And his dad's there. I know his dad's there because his dad's been there since like um since he's since like probably Saturday or Friday. >> Okay. >> So, his dad's there. His dad's there. I pretty sure he's going to be like, "Oh, no, she's laying this and that." I don't know what's going on. No, what's going on is that your son did this to you. >> Mhm. >> That's what's going on. >> Yeah. >> Yeah, it's my fault. I shouldn't have contacted him. But, he has my phone. Like literally, he has my phone in his car. >> Mhm. >> You're not >> he have kids or anything or is this his >> It's just one of them. And I'm pretty sure he has his location. >> There's no mirror in the bathroom or you didn't look? >> I didn't look. I'm scared. >> Okay. >> Like I'm I'm I can just feel it but >> Well, I mean it it's pretty swollen. >> Is this hurt? It hurts. So bad. My chin right here on this side. And then my nose right here. And then my my ribs and then my my stomach they hurt. >> Well, I mean you're bruised up literally everywhere. Your arms, your back, your face. >> And then it just sucks because I don't want to call my mom because she's in the hospital. Like she just My mom she just recently got her teeth taken out. So, and then she got colon cancer. Cuz she has what? She has her teeth taken out and then she has thyroid cancer and colon cancer. And then I don't really think that I actually have is cancer. And then I don't know. I I I don't know what I'm doing. I don't I don't know what except my mom I can't go to the emergency room. >> Um so we have advocates that work with the police department. I'm going to give them your information. I know you don't have a cell phone. Um but hopefully >> Well, can I please get that phone back because I I paid it myself. Like he shouldn't like I really thought I had it. >> Yeah. There's help out there. I know you like for the most part you're pretty much on your >> Is there any way I can go to Miss Yavelli? And okay so I have court custody court on Friday for my daughter. >> Okay. >> Is there any way if today I probably go to Miss Yavelli? >> You can when the doctor comes to talk to you talk >> But will I get in trouble for for going to Miss Yavelli when I have a court date and I I probably might lose my daughter because of it. >> No, I mean I I I really don't think so. >> [laughter] >> I would try and get in contact with maybe an advocate here so they can get you a number to the court. Um that way you can call them and let them know that you're going to go to Miss Yavelli and that you have a court date. That way they can let the judge know. I know what you mean. I know what you mean. But that's that you have to do your part on your end to try and find um a number that way you can call them. I can even look one up right now and [snorts] write it down for you. Um what court is it? Is it district court? >> Um third third judicial district court. >> Okay. Let me look a number for you and I'll give it to you, okay? >> And yeah I I really don't want to I don't want to lose her. >> Um >> Even though she's with my Nina and they have temporary custody of her. >> No, I get it. >> But I don't want to I really don't want to lose my baby. >> Just um just just call when they open cuz they open at 8:00, okay? So you're going to have to call when they open and let them know. Um but you have to let the doctor >> I really don't care. >> I'm sorry. I was being cooperative and >> You're okay. I I get it. >> [snorts] >> I can't expect you to be 100% cooperative when you just went through what you just went through, okay? >> An advocate has a different job. Police investigate the reported assault, while advocates can help with safety planning, emergency shelter, protection orders, and court access. In Las Cruces, La Casa provides those services to domestic violence survivors. None of that resolves the conflict she keeps circling. Does she want him arrested, or does she still believe he can change? >> It's like, yeah, I I was wondering if the neighbor cousin over there like I mean like I might My cousin-in-law. But it's just because I felt like he When I would tell him stuff, he would understand. It's just >> [clears throat] >> I didn't mean to be like that with the guy, you know, when they were trying to bring me in. Like I I really did it. It's just I kind of It's just they looked so familiar to him. They kind of did. Or if they're brothers, like the sound of his voice. It's kind of like him. I just felt like he was right there next to me. I I really did. I didn't know how to react, except being stone giddy and so stubborn. I Yeah, I don't want him to go to jail but at the same time that he shouldn't have done this to me. Like he should have talked to me. And he should have told me like why were you sending me those pictures or videos or conversations, you know? Instead he wanted to He wanted to hit me with his fist, like his fist and his And his gun. Like my head is like swollen from like right here on the back of my head. Like my Why would he Why would you want to do that? You say you love me and everything. But why? Now I don't have nobody except my mother in the hospital. Like you know how my mother is. And he is out on bond. He is. But like I don't I didn't want to call the cops but my cousin called the cops. No, I mean he had no choice. And I told him please just don't call cops. Just can you please try to get my phone back and call somebody else? But he didn't He couldn't care. And he saw how my face was. I I haven't seen my face He doesn't care to see my face right now. I just want to be able to be you know maybe Yeah, people say it's the best for us to be together but at the same time it says I know he can change. I know he can. >> But it's not for you to If he can change he's got to do it on his own. He's an adult. He doesn't You You can't do that [music] for him. Does that make sense? You have your own things to deal with and the last thing you need to do is deal with him. >> Like, what if I am carrying this kid? Like, what can they do? >> Yeah, I mean, I'm That's a difficult situation, but you have to take care of you and if you are pregnant, you and the baby first. >> He's running away from you guys. And he's not there at the house. He says he can't catch you. >> You know, but eventually everybody gets caught. >> Yeah, but with him, he's not going to be able to get caught because he's passed the cops several times in his car with the crown vic all fully black except the top part because he's still finishing it and then with the exhaust, like it's the only crown vic that has a loud exhaust. That sound is like all crazy and no cop ever stops him. And I'm scared. I don't know where he's at. He's probably back at the house. I don't Like, I just want him locked up and doesn't get released at all. Yeah, not because of my baby He shouldn't be doing this to any female. Like, yeah, okay, you want to go with somebody else, that's fine. Go with somebody else and love them or care for them, but don't do what you did to your baby mama. Like, don't do that just because you're mad, just because she's messing with the other girl. Like, no. >> I have good news. and I have bad news. The good news is I don't think it's your heart. The bad news is I think >> I don't know. I don't know what else to do. The only thing that I can do is just try to maybe call my phone. Maybe he'll answer it. Uh we have a the detective's on his way. He's going to talk to you. And he's going to probably ask you almost everything what I did, okay? Um just give him all the information you can and then we're going to go from there. >> Does my face look that bad though? >> No. I'm telling you it's a little dry blood, okay? Like your cheek right here is a lot of dry blood. Like you have dry blood You can probably take it off like with like water and stuff. >> This is This is all I think about is just like my >> phone. iPhone. >> And then like a couple days ago like um like 2 days before cuz you see I did throw myself outside the car and probably all of my >> Give me one second. >> Excuse me. >> Can I check the documents? Do you want to tell me about something like that? My name is Detective Davis and this is my detective partner. >> Oh. Is it hurting? >> That's my daughter. >> Oh. >> That's what a diligent system can do for you. Give us a call and get started with your home. >> I'm sorry. I'm sorry. I'm sorry. I'm sorry. I'm sorry. >> The interview ends with her injuries documented, her account preserved, other officers look for the man she described. Her self-blame never disappears, and neither does her conflict over whether she wants him arrested. Tell us in the comments which approach you think would have worked better, and [music] why.
