Yeah, I've bit her to get her off me. After that didn't work, she took her forehead and she slammed it right into the end of my nose. >> We have public calls that she committed >> to get her off me cuz she was physically sitting over the top of me. >> Police don't usually get called back to the same house twice in one day over a cell phone, but in New Mexico on January 28th, 2025, that's exactly what happens. The first call looked like a simple argument over a phone and a charger. Kind of thing officers can't do much about when they come back, both of them agree it turned physical. What they can't agree on is who started it. >> What happened after we left? Oh, [ __ ] She's gathering all over the place. She wants Now she wants the cell phone that that she turned off and I won't let HER HAVE IT. >> OKAY. >> YOU called 911. >> Uh-huh. >> Which is a good thing. >> Did she do that? >> SHE DID THAT. >> WHAT WAS SHE DOING WHEN SHE did that? >> Well, she was gathering on my side of the bed you know, to charge the phone and she And um I was trying to take it back away from her so that she can't get it. Um and then after that didn't work, she took her forehead and she slammed it right into the end of my nose. And I'm still >> a headbutt? >> Yeah. >> Okay. >> And I'm still seeing stars and it hurts so bad. >> Okay. You want the fire department to come check you out, make sure you don't have like anything weird going on? >> Um if they could. >> Okay. >> I don't think I need an ambulance, but paramedics or somebody to look at it. >> Dispatch our 55 pieces. >> Um but she's in the house and I don't know if I press assault charges on her if they could do a uh medical check on her while they have her. >> Well, well, medical checks and charges are two different things. >> Yeah, that's what I thought. >> There's criminal and mental health is >> Yeah, that's what I was afraid of. >> Mental health people sometimes make crimes, but it's not like a you go to the hospital instead of going to jail type thing. >> Yeah. >> Do you mind if I take a picture of your your bite mark there? That looks pretty >> Yeah, and it hurts really bad. >> And then she got you in the nose right there, you said? Anywhere else [snorts] that she hurt you? >> No, just those two places. I left the room and came to call you guys at that point. >> Okay, and you're able to get the phone that works? >> um well, no, I have the one that doesn't work, but I can still call 911. >> Oh, 911 still? Oh, okay, I got you. >> Yeah. >> And this was still all over the phone? >> Yeah. >> She's She's still arguing about the phone? >> Yeah, she wants this phone from me. She don't want me to have it at all. >> And what what side is the bedroom on? Is it this side or that side? >> It's this side. >> It's this side of here? >> Right inside that where the air conditioner's at. Those two windows is where the bedroom's at. >> Okay. And so, she was You guys were fighting over the phone. >> Yeah, she pushed me. >> pushed you, and then did she grab your arm and bite or what did >> Well, I WAS REACHING FOR THE I HAD MY HANDS on the phone, the charger, and she had her hands on the charger. >> So, she just bit your side? >> So, she just bent over So, she just bent down and bit my arm trying to get me to release the charger. >> So, she So, you're just holding the charger and that's when she bit you? >> she just bent down and bit me. >> It wasn't like you were like pulling her hair It was You were holding the charger when she >> And she just jumped out >> And she bit me trying to get me to release the charger. >> And then after she bit you, she That's when she head butted you? >> Yeah. >> Okay. >> So, I had the charger the whole time. I didn't have her at all. >> And and who had the phone? Was it you or >> Yeah, the phone's been in my pocket, but she wanted me to give it to her, and I wouldn't give it to her. >> And then you wanted the you needed the charger. >> But I need the charger to be able to charge the phone when it goes low. >> And then she wanted the charger not let you use it. >> She wanted to keep a hold of the charger to make sure that I can't charge the phone. >> So, she's kind of trying to hold it hostage, kind of. >> Yeah. >> Okay. And when it wasn't going her way, she bit you. >> She bit me. >> And then head-butted you. >> Yeah. But, she'd already tried to get a hold of my purse. She was going to steal my purse. And I got that back away from her. And it's just been >> one thing after another. >> Yeah. >> Do you need to sit down or anything? I know you said you're kind of >> No, it just it just hurts real bad. >> It just hurts. >> And you know, I seen stars there for a while. >> And then did did you just come outside and call or >> Yeah. >> Okay. >> Yeah, I left her in the bedroom. She's probably gathering up all kinds of stuff on my side of the bed. >> Okay. You guys sleep in the same room or >> Yeah. >> Okay. Um do me a favor and hang out right here. I'll have the the fire department to come check you out. They can run some like vitals. They can probably clean up your your bite mark cuz you know, you don't want to you don't want to get it infected >> it's almost like she went down farther cuz there's even um like holes down here. >> Yeah. Will you stay out right here? Let me do some stuff on my computer real quick, okay? >> A fight over property can stay civil all day. Once it turns physical, once there's an angry, unwanted touch, it becomes battery. And that's the line the officer now has to work from. >> Okay, I'm going to come talk to you over here, okay? Is it okay if I come over here? Any weapons in the home or anything I should know? >> She has some guns over there. >> Okay. >> Um I don't know. I'm not allowed to. >> No? Okay. Just do me a favor, just don't >> Um I really want you to stand on the line so that I can make sure that I'm being treated fairly this time. Okay. >> Yeah, that's fine. You can put the phone down whenever you need to. Just make sure you don't reach for anything, okay? And we'll be good. Okay. What do you have right here? Is it like a bag? >> It's my purse. >> Okay, just don't reach in there. >> I don't understand that. >> I know. I'm asking you not to reach in there. I'll put it right here, okay? >> reach for anything else. >> Okay, I know. So, what's what's going on today? >> She got my face after you guys came out the first time. >> Okay. >> I told you she assaulted me. She jumped out onto my back over a cell phone. >> Okay. And this happened the first time we came? >> Right before you guys came in the first time. >> Okay. >> And the officers thought it was funny >> [snorts] >> because I think [clears throat] she really needs to be put on psych hold. I mean, she has to label her meds as to what they're for. >> Okay. >> Uh >> So, what happened after they left? >> I came in to grab my phone cuz I was going to go up to Nissan and straighten out what's going on with my car. >> Okay. >> And when I asked her for my cell phone, she looked at me and she said, "You don't need it." >> Okay. >> The account is in my name, my name only. All the devices are under my name and my name only. And I've already part of the tablet stolen because she would not hand that over, either. >> Okay. >> So, I don't need it. >> So, you came over here to charge your phone and >> I came over here to get the cable to charge my phone. And that's when she started um getting on top of me, trying to yank stuff out of my hands, and claiming that I did not need to do anything, that I paid for everything and all this other crap. She refused to get off me after I told her to several times. >> Okay. >> And when she still refused, yeah, I bit her to get her off me on her left wrist, inside. >> Okay. >> When she still refused to get off me, I head butted her in the damn nose to get her off me cuz she was physically sitting there. >> So, where were you guys exactly? In this spot right here? >> Yeah. >> And she was How was she? Like >> Over the top of me. >> Like sitting straddling over you? >> She was damn near laying on top of me. >> Okay. And what was What was the purpose? What was she trying to get from you? >> She was preventing me from charging a phone so that I could call you guys. Because the first time you were out here, you thought it was so funny. And I told you if she assaulted me again, I was going to defend myself. >> Okay. >> So I did. >> So I guess what I'm not getting is So we left. Like >> Okay, well that's why I'm asking you these questions, okay? So we left and you were going to call us right back and she just started jumping on you. >> was going to go up to Nissan to get my car. >> Okay. >> Because Nissan's been holding it. >> And she was refusing to let you call Nissan? >> refusing to give me any kind of phone, period. She has my phone. >> Okay, that makes more sense. I was trying to figure out why you were calling in the first place. >> to give me any [snorts] of my property. >> Okay. >> Back. >> All right. >> I started because she had If you look in that um middle pocket there the stuff that's in this loose was in her purse. >> Okay. When you bit her, you said it was her left wrist? >> Left inside wrist. >> So she was She was facing you or how was >> Yeah, she was facing me. Literally like facing me right here. >> And was she like sitting on this desk? >> Damn near, yes. >> Okay. And [snorts] so you bit her and then what happened after you bit her? >> She still refused to get off of me. And I kept telling her to get off of me. And she still kept fighting over a stupid phone cord, not wanting me to charge this one so that I could call you guys for help. >> Okay. And then >> And after that since she would not get off me, you're damn straight I headbutted her in the nose cuz her face was right here. >> Okay. All right. So initially she was stopping you from calling Nissan, and then you told her you're going to call them. >> me from calling anybody. She said I did not need a phone, I did not need my tablet, I did not need anything. >> Okay. All right. Uh let me wait till the other officer's done talking, and then he'll come in here, and we'll figure everything out. What's the plan after this? Like, are you going to >> I want her arrested. >> For? >> Really? If I have to headbutt somebody to get them out of my face, there's a reason. >> Okay. I understand. Cuz you said you want her arrested. I don't know if there's anything else that occurred, right? >> I think she needs to be put on a psych hold. >> So, let's I'm asking you this. If there is if we do have to leave without charging anybody, are you >> be leaving without charging anybody, officer. >> Okay, ma'am. Well, I'll come back and talk to you then in a little bit. I'm trying to help you out as much as I can. >> trying to understand why she can assault me. >> I get it, but I'm trying to figure out what >> also a disabled adult. >> Yes, ma'am. So, you're trying to contact Nissan, right? >> I'm trying to get up there to get my car. >> That's what I'm asking. So, if if any worst-case scenario, we can't arrest anybody, you Can I give you a ride to Nissan? >> Um >> Would that be a possibility? >> Maybe. >> Just so we can separate you two. I get it, but again, I'm trying to figure out the end game here. And how we can help you out as best as we can. >> here is this >> Okay. I'll be right back, okay? >> Self-defense has a real legal test. In New Mexico, it only holds if she reasonably feared she was about to be hurt, the force she used matched that threat, and she wasn't the one who started the fight. >> This female got in an argument with her daughter who's inside. Um she got bit pretty good on the the wrist, and I guess she got a headbutt in the nose. >> Okay. So, does that mean she seen stars? Kind of. >> The officer has to weigh whether biting to get free was proportional or whether it went past what the law allows. >> All right. All right. >> He head butted you on the nose or on her forehead right in the nose. >> Got it. Okay. All right. We'll see We'll check out your nose, okay? You can put pressure on it. Does that hurt? >> Yeah, a little bit. >> Yeah? >> Not a whole lot, but a little bit. >> All right. Okay. >> [snorts] >> Looks great. What about the bite marks? Were there bite marks? Those ones? Let's check those out. Was it both arms or just one? >> Just the one. >> Okay. Nothing on the other side? >> this this is from That was different. No, this >> All right. Go ahead. Look at this part right here. I'll probably wait till >> [snorts] >> Whatever feels comfortable for you. All right. There you go. How long was it this? >> Uh about uh 40 minutes now. >> All right. Let me check your eyes. Did you lose consciousness when you got hit in the face? >> Pardon? >> Did you lose consciousness? >> No. No, just lost all stars. >> You lost all stars. Okay. Okay. You don't want to go to the hospital with me then? >> No, I don't >> I'll check out your eyes though, okay? So, there's only so much we can do. Thank you. That makes one of us. >> [laughter] >> Um so, uh there's only so much we can check out here. We can't do X-rays obviously and you know there's uh >> Yeah. I just >> You need to wash your pretty dirty. You don't want that getting in your eye. Uh she can clean it with some warm water. I mean, it's not necessary. I'm not saying like put some antiseptic of some sort, some mild soap. Just to clean it out, get it before I leave. >> What's your phone number, man? >> So, we can hear earlier. I mean, you bought a and it was kind of a civil deal with cell phones. She was claiming that she jumped on the back and all that stuff. She could break Like she was she walked she's like So, it was one of us like Well, we were trying to tell her like there was nothing we could do like there was nothing we could do with it. She got quiet. She's like, "Fine." Well, when she comes around we'll do something. I threatened you. Yeah. And they are Now she's happy. >> Left? >> We're still arguing about the phone situation. And she has the phone and the chargers in their bedroom. I guess they share the same bed. >> Yeah. >> And she's trying to get the charger. So, she's like, "No, I'm going to keep the charger." Like holding a hostage. And then that she just wanted to come The head over here. The wrist and then head bumped her and the nose nose is cracked. And she said she kind of saw stars. And she came outside and she called 911. And then on the corner of the nose she called right after. And I told the dispatcher she's like Yeah. So, this is what she said she did. >> Yeah. As soon as you guys left I went to charge my phone so I >> She said, "No, that's my phone." And then I hit her before She she's on top of me. So, to get her off of me I bit her. She still didn't get off me so I head bumped her. >> What does she mean on top of you? She's like on her? >> She said that she's facing cuz So, there's a like the Yeah, there's a little gap between the bed. So, I'm assuming her mom like straddled her. >> Oh, like trying to get around? >> Yeah, to get over her and grab the phone. >> To get the To get the charger? >> Yeah, she said yeah. And then There's a little gap between the wall and the bed so she couldn't get to it. >> Okay. >> Yeah. Yeah. >> Huh? >> But she threatened to do it before we left, too. What was it she tried to do? She said it was her apartment over there. Phone charger. She wouldn't let her get it fixed up. She was 1080s to the wrist. She said that >> there talking to dispatch. >> Is she working? >> Yeah, she's not mad at me because I laid it out for her last time and >> No, like >> Cuz she was mad because we're taking her to a feeding. >> Yes, ma'am. >> Yeah, not yet. I'm working on it. >> Uh no, ma'am. I won't do that right now, okay? >> For what? >> Okay, I You can't get the the drink from the fridge if you like. >> So, you don't want to go to the hospital? >> No. >> Yes, ma'am. >> I still like him though. >> Okay, yes, very much. I appreciate it. >> When two people give opposite stories, the officer needs something solid to go on. A bite leaves a mark, and a mark is proof in a way that words never are. >> So, let me explain what's going to happen now, okay? Is based on what happened earlier today, the threats she made towards you, and calling dispatch and seeing what she did to you, you telling what she did to you, and you have a bite mark and a red nose, consistent with everything that you've done, we have probable cause that she committed battery against a household member, okay? And in New Mexico, it it it it doesn't matter if the victim wants to pursue charges or not, the state is the one that actually pursues charges because it's a family deal, okay? Um so, she's going to go to jail. All right. She's going to get charged with battery against a household member. I know you brought up the fact of like maybe she can get some mental help or something like that. Maybe this is what could be ordered by a judge or something when the judge reviews this case. Maybe they can look at it and be like, all right, cool. Instead of jail, maybe she needs to go get some type of treatment, which includes a medication. Maybe she needs a therapist. Maybe maybe the judge can actually look at the case and be like, instead of jail, we need to look at a different alternative thing to make everybody better. You know what I mean? Cuz you are mother and daughter. You guys have a relationship. You live together. All that stuff, okay? So, you know, we're not just trying to throw people in jail and forget about them. >> Is Is there any way that you can make sure that she leaves her cell phone here? >> Um I can ask, but I can't like start pulling stuff out. If she wants to take the cell phone with her to the jail, you can take it to the jail. >> Um The reason I'm asking is since mine is turned off, >> Mhm. >> that way I can call and try and get this started. >> Mhm. >> Um and that way we can maybe move forward with getting her out. >> Yeah, like Like I said, we we can ask if we can leave the cell phone here, but I I can't With property, we we can't We don't have any say so, really. >> Yeah. >> Um if she wants to take it with her and you don't have a phone besides the one that you can call 911 with, I would recommend like maybe get with the neighbors, call a friend, be like, "Hey, can I borrow your phone? I need to make a phone call real quick." Blah blah blah blah. Just get something set up in the meantime, okay? >> Yeah. >> Um do you have any questions what's going to happen right now? All right. Well, I'm going to go talk to my partner. We'll We're going to get her put in handcuffs, okay? If you can just do me a favor and stay out here. When we bring her out, don't look at her. Don't Just pretend she exists cuz we don't want her to >> my dogs. >> Yeah, we we don't want her to get more amped up and cause a bigger scene than what it needs to be, okay? >> And you'll need to clean up the dog mess. >> Yeah, I figured. >> The moment an officer decides to make an arrest, that call isn't something you can undo with the scene. Disagreeing with it is fine. Physically refusing to go is its own crime. And in New Mexico, that's resisting, evading, or obstructing an officer. >> Oh, hell no. You are not going to arrest me. >> Yes, for battery against a household member, ma'am. >> Excuse me. My name is on that lease just as much as hers. And the next time she gets >> It's not anything about a lease. >> She got on top of me and assaulted me. So, I defended myself. And you're going to arrest me? >> Would you like to take this bag with you to get with you? >> Oh, it's going with me because I want >> They won't accept it at the detention center but I can grab your purse for your uh >> Oh, that's bull. Somebody needs to come in here now. >> Okay, so I'm asking >> Cuz I'm being arrested for defending myself. >> going to do is take your wallet and your phone, okay? Is there anything else you would like us to take? >> Yeah. I'd like a real officer here that understands the law. When your own mother No. >> You ma'am? >> No, hell no. >> to walk to the car, okay? >> Then I hope she's under arrest, too. >> She's not under arrest. >> Why? >> Because she did not commit battery against a household member. >> I live here. >> I understand that. >> Check my ID. >> It doesn't matter. I believe you live here. >> I have lived here longer than she has. >> And household member doesn't mean that you live together. It's your guys' relationship. It's a mother-daughter relationship. >> And she never should have been on top of me attacking me in the first place. >> All right, ma'am. We're going to walk this way, okay? >> Then I would like another officer here, please. >> It's not how this works, ma'am. >> Female officer now. >> It's not how this works. >> Yes, it is. I am a female. SOMEBODY HELP. HELP. >> GET UP. WHO'S I'M NOT >> Hell no. I saw her commit a felony. No, you are not. >> You can get charged with resisting arrest. >> Then arrest that right there. Cuz I pressed charges on her. You didn't hear me I'm going to sue your ass. >> For what? >> Because you are hurting somebody I didn't earn home. >> Is there a medical emergency right now? >> I'm about to. >> All right, have a seat inside. Have a seat inside. >> No. >> I'll explain you why exactly you're getting charged with. Have a seat inside. >> I shouldn't be charged with anything. >> Have a seat inside. You'll be charged with resisting. >> Then take the cuffs off cuz I can't get in there without my hands. >> So, pick up your left foot. You can do this. >> Pick it up. >> Really, sir? >> Yes, ma'am. Put it in the car. And then I'll help you get in. >> [snorts] >> No, you will not. >> [clears throat] >> So, you want to pick up that charge of resisting? >> [snorts] >> Then arrest her as well. >> Yes or no? >> I cannot get out. I cannot get in that car without use of my hands. >> Turn this way. Pick up your left foot. >> Sir. >> I'm showing you the easiest way to get in. >> And the easiest way for me to get in is with my hand. >> Well, that's not going to happen. >> You want to re-cuff me, then cuff me. >> be two options. You can get charged with resisting and I'll help you get inside the vehicle or you can get inside the vehicle on your own. >> I have a heart condition. >> This is the last time I'm going to give you this this option to get inside on your own will. Either way, we're taking you down to >> Then call an ambulance now. >> You're not going to go inside an ambulance. >> Well, when I pass out >> You want to call one? >> Because my heart rate's getting too high. >> 37763 So, we're calling one for you. You still need to sit inside. They're going to ask you to do the same thing. They're not going to sit you in their car. >> I can stand here just fine. I'm no threat. >> you don't need an ambulance if you can stand here just fine, right? >> You guys want to keep talking. Cuz you know what you're doing is illegal. >> day. >> You are detaining the wrong person. >> 37763 You're not detained. You're under arrest. >> For what? >> Battery on a household. >> You said if I went back out here to check on the >> I get you and your mom to listen to me. I get you. >> She attacked me first. And I defend myself, I'm the one getting charged with battery. >> So, I was going to explain that before you interrupted me right now. You and your mom were arguing over phones. We were out here initially. cops. >> Yeah. >> and that's okay. You guys can argue over whatever it is civilly. >> Well, he shouldn't have been laughing at me the whole time. >> you bit her and headbutted her is when you took it to the next level and that's why you're getting charged. >> Because she would not get off of me. >> You guys were both going for the phone and reaching and arguing for the phone. >> And I was on the phone. >> to bite her and you decided to headbutt her. >> So, what? I'm supposed to just let her smother me? >> That's not how this works, ma'am. >> Then explain it to me. >> You guys are obviously both going over a phone, right? You decided to bite her. >> a phone because she would not give me my devices back. >> Okay. Again, I need you to have a seat inside. I explained you why you're under arrest. We can argue that in court if you like, but that decision's made already. Okay? So, we need to go through the process and I don't want to see you pick up another charge for just simply not getting in the car. >> I don't see why there's a problem if there's an ambulance on the way. >> Who owns the phone, whose name is on the lease, none of that changes the arrest. What she's actually arrested for is the force she used and no argument over who owned what makes that go away. >> What do you mean? You're going to They're going to have you sit down so they can check your vitals, too. So, you need to sit down in the car. Either way, you need to sit down. >> Then I'll sit right here. >> Pick up your feet and sit in the car. >> I can't. What part of medical issues >> What medical issue is stopping you from sitting in the car? >> I'm just saying how swollen my legs are. >> Okay. Well, then I can help you pick up that foot if you like. >> I'd rather you not touch me and I'd rather you get your hands off me now. >> That's not how this works, ma'am. You're not You're under arrest right now, okay? You're not calling >> I'm handcuffed and I'm sitting down. >> Yeah, but how are we going to escort you? How are we going to drive you over there? >> Drive me where? >> To the station. Or to the detention center, whatever this officer decides to do. >> Can you tell them that my vitals are out of control? >> No, but we're having an ambulance on the way. >> Well, when I pass out cuz I can't breathe >> I would prefer you sitting down if you were [music] to pass out rather than fall standing up. And that's why I asked you to sit inside the vehicle. They're on their way as well. I just told you. >> And I hope they really are. >> I've been extremely patient with you, ma'am. I just don't know why you're not working with me. >> Okay, you see the way I'm breathing? >> Still no excuse to not sit in my car or sit in the officer's car. >> I'm about to have a heart attack. >> Okay. >> Or pass out. Or do you guys have any kind of medical equipment? >> We have Narcan if you took any kind of drugs. And I'm certified in CPR, but >> Sir, I really need to get some fresh air now. >> You're sitting You're outside the vehicle, ma'am. >> Sir, can somebody please come explain this? >> Explain what? >> Why I'm having a breathing episode. >> Do you have any medical conditions I should be aware of? >> Asthma. >> Okay. >> Sir, I am about to pass out. Officer, >> I'm I'm keeping an eye on you. Okay? I've been watching you this whole time. The ambulance is on the way. >> Sir, could you please please uncuff me? I will not go anywhere. >> That's not how this works. >> Sir, I really need to get my arms out from behind my back. Now? Please. >> Do you have a a belly chain? No? Can you stand up with your real fast? >> Sir, >> Yeah. >> I have to stand up. >> Okay. >> Please uncuff me. >> I think I do. You do. So we can relieve you of that issue. He's He's going to get a chain that way he can bring the cuffs to your front, okay? That way it's a little bit more >> Can I get some fresh air, please? Please hurry and uncuff me. >> He's He's getting the chains. >> No, No, I need to brace myself so I can do my breathing. Please. I will not hurt you guys. I am no threat. So, please. >> If you were to sit in the car >> I can't. >> relax. >> I can't. Until I get my breathing under control. And if you would You know where my heart rate's at. Feel my heart rate. If you think I'm lying >> to go under your arms, >> I'm not joking. >> So, are you going to want me to put the cuffs in the front? >> Yes. >> Okay, then I'm going to have to reach around you. Pick up your arms. There you go. All Face me, please. >> You cannot put that tight. >> It's not tight. Stop. >> Yeah, she's under arrest. >> She's saying that she's having anxiety and asthma heart problems. >> Take a step towards me. Can you help me with the cuffs real fast? >> I'm having trouble breathing. >> Yeah? Okay. We'll take your vitals and most likely if anything is going on >> You got to take them off. >> Please. >> The officers will take you to the hospital, okay? >> I need an ambulance here now. And I need that metal off of me, please. >> Okay, can we get your arm so we can check her vitals? >> Do you guys have any water? >> Unless she's Unless you hook her up and there's ice. You're crazy.
