He's literally a still victim of domestic violence. >> She was like, "Just a few scratches." And I was like, "Well, that's more than a few." At some point, she could get a criminal damaging charge. State of Ohio requires us to make an arrest if we can determine a primary aggressor. >> It's the early morning of April 28th, 2024 in Ohio. And police roll up on what sounds like a fight between a couple. The first few minutes don't give them a clean answer. Both of them have a different version of the night, and only one of those versions fits the marks on her neck. >> Hi, guys. What's going on? >> I don't Okay, well, I don't Can I like get out and talk to you? >> Absolutely. Whatever you want to do. Want to sit here? There you go. >> Um okay, well, I don't know. My mom's always like a big calmer calmer when stuff happens, but I don't like I don't really know like what he's like going to do. Like we were in there and we got in like a really big fight and he was like choking his lamb and doing all of that and like >> Like to you? >> Yeah. And then Yeah, I got pepper sprayed in my face. >> He pepper sprayed you? >> Well, I was He was trying to get my car and then I was trying to pepper spray him and then it blew in my face. >> Okay. >> It was my first time using it. >> Fair enough. >> Yeah, I learned my lesson. >> It got bad enough inside of you that you wanted to pepper spray him. >> When it was out here because I was trying to leave and then he was coming out at me and then I was like, "Just like go away." And he had took my phone, ran inside, and yeah, it was just a whole >> He has your phone still? >> No, I Yeah, now Yeah. I now have my phone, but >> Did you say he destroyed your car, too? Or his car? >> It was I mean, kind of. I'm not going to lie, I went and did his car in anger, too, but yeah, this is what he did to my car. >> What did you do to his? I have to ask. >> Just a little bit of key on the side. >> Which one's his? >> The blue green Acura. >> The one right That one right here? >> Yeah. I don't know if you can see it very well. >> Is that the key mark right there? >> Yes, it is. >> I mean >> That's the best view. I don't know if that's >> When was that? After everything? >> It was Yeah, I pepper sprayed him, and then I pepper sprayed him, I think. >> All that was after what happened inside? >> That was after because he was like, "Get out. Get out." I was like, "I just want my phone. I want my purse. Like, let me grab my glasses. My glasses broke." I was like, "Okay, let me put the glasses on. Like, just like let me drive home cuz I don't want I didn't think my mom would answer. I tried to call her, and nothing was happening." And yeah, I mean, I I don't know what is going to be the outcome of all this. I don't want to get him in trouble or anything. >> What all did he do to you inside? Physical acts? >> It was Oh, yeah, and then he like banged my head into it, and like I had a huge bump and everything. >> You got a good one over there. You got something that I busted open here on your >> Might be a pimple. >> Oh, I mean, but there's blood there, so something caused So, something caused this to happen. Throwing things and just the whole nine yards. He was really really drunk. He was out from like 3:00 p.m. till literally just got home, and I was up all night just like >> Do you want the medics to check out your eyes? >> Do they have like anything to make it better? It's just still like >> It was pepper spray in her eyes. >> Do you have any milk? >> We don't have any. >> It's okay. I can go home and get some milk if you don't have it on you. >> Uh the subject's only requesting the medics if they can do something about the pepper spray in her eyes. If not, then she's just going to have to go home and deal with it. So, if they want to come up, they can. >> We'll tell them. And then this one's hurt. This one's terrible. My brand new car. >> Is there anything else that you are you getting any more out there? >> No, no, I think we're good. >> We told the medics what you said. I'll let you know here if they're going to come up and check you out. >> Oh, okay. >> I mean, usually they don't have anything special in their ambulance for eye wash. >> That's what I was like, I don't know if you guys have like a special solution you can just Okay, do you need anything from the apartment? You work tomorrow? >> I mean, I'm guessing I'm not going to work tomorrow because I have to be up in 2 hours, so no, but I mean, I have my purse and my phone. >> Yeah, I'm fine. >> Get in the car and I can take you home. We can >> Yeah. >> I mean, I don't know what you guys are doing. >> was going to say. I don't know what all needs to happen. >> We obviously have a few more things we need to do before you can leave. We'll get you out of here soon. Do you live local? >> Yeah, literally across the street. >> Right now, officers have a damaged car and injuries nobody's explained, and only one of those is going to matter tonight. Alaina Woods, you said? Okay. >> Oh, I'm sorry. It's okay. >> No, I was combining Alaina Chase and Alaina Woods, so >> Well, everybody does that, right? >> Alaina Woods, got you. Um >> Yeah. >> So obviously we got to go and talk to him real quick, but so is he going to tell me that you hit him? >> I mean >> Other than other than what you're claiming, like I'm sure when he's holding you down doing certain >> Yeah, I'm sorry. Hello. >> She She sprayed pepper spray and it got a little bit of the back splash into her. >> the first time trying to >> So, just wanted anything that can help that sensation, otherwise Yeah, um >> Any milk? >> Uh is is your eye or like just your whole side? >> this. It's kind of getting better now that I'm blinking and stuff, but it's like in my armpit, but other than that, I'm Yeah, I mean, it's going away now. >> Lots of water. >> Yeah. >> Yeah. Lots of lots of water. >> Stand in the shower. >> Well what I'll say about that is be careful about that cuz if it's in your hair and rolls back down >> Oh, yeah. >> So I would try to get as much as you can out before you just go stand under the water cuz if not you might get a second. >> For sure. I mean the wind is I'm feeling a little better now. >> Yeah. >> Okay. >> That stuff's no joke. It gets It gets everywhere. So. >> Yeah. Oh my god. >> Um. >> Oh. Oh. Is that them? >> Huh? >> I just want to make sure you're okay. >> She had a few marks which we're going to we're going to photograph and everything. >> Okay. >> Did you When you had the sandal on your neck did you lose any consciousness or having difficulty breathing? >> I was definitely having difficulty breathing. Yeah, I think that's like probably what the neighbors heard was like a very unpleasant kind of noise but yeah. Well I >> You're not right now, right? >> Huh? >> You're not having difficulty breathing right now. >> No. I mean I was like hyperventilating after but that was fine. >> Okay. Did Did you hit your head hard on anything? >> Yeah, he was like smashing my head and he was like no not lose consciousness but like I had a huge bump and my head like was like hurting so bad I was like trying to see but I also had to put my contacts in. >> Okay. Okay. Fine. Okay. >> Yeah. >> Okay. Well >> I think >> we can run you down the street to Brady if you want the doctors to look at you. >> it's probably okay. I mean as long as bump goes away and whatever I'm good. I'm fine. >> Okay. >> And then >> If uh if you start to get nauseous, if you feel like you need to vomit, uh if you're excessively tired, >> Yeah. >> trouble focusing and anything like that, those are all signs of a concussion. >> that's the first thing you always >> Yeah. So just just keep an eye out for that. Um be very honest with your mom if any of that stuff starts. If you If any of that stuff happens it doesn't mean that's like life threatening or anything. It just means that you might have a concussion so it's something to keep an eye on. >> Okay. Cool. >> All right. >> Yeah. Thank you. Thank you. Thank you. >> Um we just need to get some basic info, okay, and then I would like to state that >> One of us will be in there to finish up. And then so >> That's what I told her. I was like, "He's getting himself a charge." Like, "You can't do this and expect anything." >> And I will say obviously that's Um we got to do this stuff. If he sees his car, he may want her charged for keying a car. I'm not I'm not doing I'm not doing anything with that tonight. If he want If he requests it, I will talk to the prosecutor >> Okay. >> what they say. I mean, obviously he did it to her and then she retaliated to him. That's fine. But tonight we're focusing on just the domestic part of it. >> That makes sense. Yeah. >> And then at some point, she could get a criminal damaging charge for the car, but that's not our priority tonight and I don't >> It's really minor. That makes sense. >> It's like a traffic ticket. >> Okay. That's fair. >> What's her phone number? >> There's a reason he asks about passing out and trouble breathing. In Ohio, squeezing someone's neck hard enough to choke off their air became its own felony back in 2023, a charge called strangulation. Those two questions are how he figures out if that line just got crossed. >> So, he's explaining to your mom um for all these cases being You and him are boyfriend-girlfriend? >> We are. Yeah. >> How long? >> Yeah, it's three months. >> A year in March. >> And you living together here? How long? >> Almost a month. >> All right, so it was a year in March but dating and you living together about a month. >> Okay. >> So, obviously this is domestic violence. Get a victim on the report. We have required paperwork we have to do. Basically just a victim's rights packet and domestic violence packet. We normally we do it on scene, but since you're going to be going with your mom tonight we explained to her we're going to have her go ahead and head to the police department and he told her how to get there and one of the other officers is going to meet you guys on station and start that paperwork and then him and I are going to go address it with Diego. I know you said you don't want to get him in trouble, but the state of Ohio requires us to make an arrest if we can determine a primary aggressor. And based on what you he's going to go to jail for domestic violence, okay? I know you don't He caused harm to you with visible marks, that's why I say. And currently Well, I And I understand the emotion and stuff, but the bottom line is he did it to himself, okay? It's It's no fault of you. What's happening to him tonight I know, but this is one of those things where the state takes very seriously and so do we. So, like I said, Abs- absolutely. And the fact that there's marks, we have to have someone take pictures of you two to document the injuries. That's part of the packet we do. We We have to attach more or less full body pictures of face, hands, neck, any And then take specific pictures of each individual injury, which would be couple marks that we can see, but we'll explain all that on station. Um like I said, in no fault of you, he's getting arrested, like I said. And like it's nothing you did wrong, it's nothing that you were telling that you want him charged. It's I already told your mom, even if you would have said even if you would have decided not to tell us what happened tonight, she told her, she told us. It won't have changed anything. He's still going to go to jail, okay? Like I said, it's Saturday night, so he'll be there at least till Monday, but he's an adult, we don't call his parents. He can He can make a He can make a phone call himself once he gets out to the jail. And then, part of the paperwork there obviously explain you have a right to protection order, all that kind of stuff, but that's something they'll discuss with you guys on station. And then one of us will come there and finish the paperwork with you while the other one of us takes him out to the jail and charges him with charges and everything, okay? I know you're emotional, it's okay. I understand. But like I said, it's the bottom line is he did this and he's the one that has to face it. Especially with his dad being in jail for the same thing you said. So. >> Hey, do you have an apartment key on you? >> Uh yeah, I do. >> Is it locked? Do you think? >> Probably, yeah. It's locked. >> If he doesn't answer, you give us permission to open it up? >> I guess so, yeah. That's his >> Okay. Can we just keep the key and return it to you on station? >> Yeah, I mean I'm not going to be driving >> That way we don't hold you up. >> You're going with mom, then we'll just bring it with us. >> Am I allowed to like have you a purse or something? >> He's not doing anything. >> No? >> You don't want to be there. >> I know. It's okay. >> All right. >> It's okay. >> All right. You guys want to head to the police department there and someone will meet you there and then we'll meet you back there, okay? >> All right. Does he have any weapons in there at all? >> No. >> No. >> Okay. >> The backpack. Yeah, the one up in the back one on the >> Okay. >> All right. >> All right. >> Before we leave, can you take pictures of the both of the cars, too? >> Oh, yeah. >> Yeah. While I take him out to the jail. If you don't mind. >> Yeah. >> Like I said, I'm >> Which one is this from? The backpack. And oh, they just did it to each other. >> She admitted she did it as soon as he did it to her. >> Oh gosh, dude. >> She said just a few scratches and I was like, "Oh, that's more than a few." >> Holy moly. All right. >> I mean, do you think it's wrong for me not to charge her tonight if you want to or should I? >> Oh, yeah. Don't charge her tonight. Yeah. >> going to charge her tonight with all this going on and then that's why I explained that there's a chance you could >> Yeah. >> get it later. So. >> I'm not I'm likely I'll I'll say open door and he's up. I'm probably not going to talk to him too much. I'm just going to hook him and take him. You okay with that? >> Yeah. >> That's why the officer keeps pushing on how long they've lived together. Under Ohio law, this only counts as domestic violence when it happens between family or household members. And a couple sharing an apartment clears that bar. The second it does, a different set of rules kicks in. And whether she wants him charged stops being the question. >> Didn't she say backside? >> They're not upstairs. >> The 113's right here, but didn't she say Did Did she say backside? >> She did say downstairs. Or was she saying like this backside? >> Hey, hon. >> Okay. >> Yeah, we're fine. >> Okay. >> I assume they're on the back. This goes to the same apartment. >> That's what she said. >> Okay. And what apartment? >> No. When you run his license, does he have a different address on there? >> I'll check the license and the Jeep. >> That must be it. >> Neighbor apartment 559 101. >> Yeah. How many letters you have on there? So, it's probably easy to forget. >> On phone, you don't know if this is 113? >> I think she's got to be up, too. >> You don't know why this wouldn't be a house key? It's all the same, you know. >> 713 for sure, and it's the little golden one. >> You're clear. >> 113 >> It's 114. >> You're clear. Thank you. >> Sorry. 114 >> Yep. >> This paper probably inaccurate. >> On the counts of someone's trying to get in. >> Well, then we're all over the place. >> Diego! Didn't I say this one for a reason? >> No, he did those two. So, it is described back side. That's why I was >> Yeah. Camera was 113. >> She gave us the key, and it's not working in that one. >> And it's also not described as >> What? >> Getting the unit right is worth the delay. Force the wrong door or open one without authority, and anything found inside can be thrown out later. So, they slow down and test the key because the only person who can answer for those marks is on the other side of it. >> We feel like she described 114, but we're just trying to confirm that with the key. Diego! Diego! >> Hello. >> Come out here. This police department. >> Oh. >> You all right? >> Yes, sir. >> What's up, man? >> What's up, bro? >> How are you? >> Good. How are you? >> Oh, it's toasty in here. >> It is toasty. I couldn't sleep, man. I'm sorry about that. >> What is that glass? Watch where you're walking. That's glass. >> glass. >> Okay. >> I already swept it and I just decided to go to bed instead of cleaning up. >> Okay. All right, man. So, what happened with you and your girl? >> Yeah. >> All right. Can we >> Talk about it if you guys would like to. >> It would >> Um That's fine. >> All right, everyone. All right. >> Yeah, it just >> What happened? >> Um nothing really. Officer, I went out and with my friends and she wasn't there, so we had a little conflict. Uh She was here all night and I came home like 2 hours ago. And we had a conflict and things didn't go our way. >> When you say you had a conflict, what does that mean? >> You see the house? >> I mean, is there more to it than just stuff being trashed? >> Well, this is how I came home, but it's fine. I'm going to clean it up. There was nothing. We've had this happen before, but like not at here at um my house. Like we used to live together, but um not at my mom's house, but not over here. >> Anything physical? >> No, sir. >> Can Can you tell me how she got the marks on her? >> Sir, I promise on everything I love I would not This is my girlfriend. >> I understand. >> This This happened before. We've had fights, not like this. I went out with my friends, so obviously we weren't on the same page. I was I'm off this weekend. She's not. She has work tomorrow. >> I understand. I mean, she's obviously giving a different version. She has visible injuries to her neck. She had a bloody spot on the underside of her face here. >> Officer, I I promise you on everything I love I would not touch her. This is the girl that I would marry. I love to death. This is not like Officer, I'm telling you. No. >> Do you have any injuries on you at all? >> No, sir. >> Any marks on your neck, your face? >> She did have the pepper spray and I did get sprayed on my back. >> Yeah, no. >> But it's all good. I just thought I'd go to bed and just sleep it off. >> What about the cars? >> What about it? >> Her car and your car? >> Uh >> Her all of the mail? Her keys? She You keep her car, she keep your car? >> She She has done that plenty of times. If you actually look at my car, you will literally see a bunch of scratches. >> I understand, but >> from her. >> Hers are new. >> Huh? >> Hers were new. >> Yeah. >> Did you key her car tonight? >> Not tonight. >> Not tonight? There were still paint shavings on it. >> No. I was talking about the hood. >> Yeah. >> Nowhere else, just the hood. >> Just the hood? >> Just the hood, yeah. >> Tonight? >> Not tonight. >> When did that happen? >> Weeks ago. >> Okay. And what about yours? There's new ones on it. >> Is there? >> I mean, the ones on her car look new, too, so maybe I'm wrong about both of them, but >> I don't know if there's any new It's the >> Given the history we have looking at that car left. >> It was gentlemen. It was >> The doors are fine. >> Yeah, they're going to change you out, so >> Yeah, you have to get a more or less a gallon out there, but just want to make sure you have lights on it. >> What about water? Cuz I drink water consistently. >> You You have water out there. >> Yeah, they have lots of stuff. >> Now, obviously, you can't take that bottle with you, but they'll have but they have water for you. It's not like you're going to be in isolation. >> only thing I can get it when I leave. >> Yeah. >> Yeah, just the >> Like I said, we just powered it down so it's not dead when you get out. Uh credit >> Yeah. >> No, they're up the road a little way, actually. Actually, you can't even take it in anymore. So, it it that changed. >> we have to inventory >> We have to inventory property, so leave it here, or else you might not get it back for a while. But at least it'll be here waiting on you when you get out. >> Yes, sir. >> Do you have keys? Like apartment key and stuff? >> Yeah, I do. >> That way you have that. It's all right. >> Oh, okay. >> I mean, I don't know, man. >> I work hard for this and I come home to this and I'm going to jail and everything. Like you got to >> You got both >> From my standpoint, man. Come on. >> Listen, I I'm hearing you out. Like I said, our hands are I'm Our hands are tied with stuff like this, man. >> I know. >> And like I said, I would like to be able to read minds and know exactly what she said wasn't true or what you're saying is true, but we can't, unfortunately. All we know is >> I could >> what she claims matches what's on >> I love you. That's what she has to say. >> Denials are the norm on calls like this. What the law makes the officer do is pick a primary aggressor, and so far the marks fit her story far better than his. >> All right, you want to throw that stuff in your pocket there? Put your shoes on so you can walk. >> And there's a bunch of scratches, but mostly it's from her. >> Okay. >> But this is the person that I love. Like I just >> And I understand She was very emotional about what she was telling us what happened, but I'm >> I'm sorry cuz I'm not going to lie to you guys. I've I've I've had officers come to my mom's house. We had altercations. >> I understand. >> And it was called and we worked it out. We're we're fine. And then tonight my house is just >> Which we'll make sure we obviously cameras are on. We're going to do a little walk to show everything. Did you do this or she do all this? >> She did. >> So everything inside here she trashed? Okay. >> It wasn't even that bad, but then I looked and then I noticed the flowers I got her from a couple of days ago. Um >> Yeah. >> Yeah, so I got my game set up and stuff, but nothing's nothing's like destroyed or broke. Like I This is all going to be swept clean all tomorrow. We're looking brand new. >> If you had your best guess if you had to guess something that happened during all of this, what would have caused her injuries? >> Officer, I I >> But I'm only asking. >> Man to as a like I'm I would not do this to her. >> I would hope not, but like I said, she was very emotional telling us this stuff and her feelings obviously sound pretty sincere. >> each other. Like we >> But she gave a very, very different account of what had happened. She's not really disputing the key, she's not disputing some of this stuff, but your actual interaction between the two of you is what she's >> We've had this happen times and times. Like >> But I don't think she's ever claimed that you laid your hands on her. >> She claimed that she did. >> And she has injuries supporting what she had said. That's why I'm trying to give you a chance to tell me >> I'm telling you the truth, officer. I did not >> Well, I'm not saying you're you're lying to me. I'm asking you to give give me a reason why you how you think she could have got these marks otherwise. >> Officer, I was not home all day. This is what caused the altercation. I came >> What? I know she said that she had got home from the bar and everything and that's when it started. But the stuff that's there >> Yeah, I >> that doesn't look old. I mean I mean she's She still has a spot. She said it was likely a pimple, but it busted open. It's pretty close to a couple other marks on her neck. >> Well >> And and the blood was barely dry on her face. >> Officer, I'm telling you right now I would not cuz like this is my girlfriend. This is the person that I've been with for years. Like >> Right. >> We've had this happen. We've had altercations. We just got this apartment a few weeks ago. I'm not trying to get evicted. >> She said not even a month. >> Get >> Okay. >> Like this is a whole thing. I was just trying to sleep off I thought it'd be good. I did not know you guys would come here. I did not know this was going to be a whole thing. I just tried to sleep it off. I just tried to keep peace going. Can you leave? >> [sighs] >> I don't want to leave. >> And she was planning on it and mom picked her up and we got called here and I guess and now we're addressing some of the things that we saw and unfortunately she is claiming violence happened against her and has marks supporting it. And obviously I'll give you a chance if you want to fill out a statement where I can document what you told me on here. >> want to like I know does she document or like is she like this is like a charge thing or something? >> This is where he gets to explain the marks and it is the whole ball game. A clean reason for those injuries and the night ends very differently. He doesn't give one. So, to clarify, you are going to get arrested tonight, man. You're going to be going to jail for domestic violence. >> Are you serious? >> She did not want to press charges. >> Officer >> But the state has to pick up the charges when a statement's made that has injuries supported. >> But I I Officer, I don't know I don't know no no. >> We weren't here, so we can't determine exactly what happened. Unfortunately, a statement's given and injuries on her neck and face support the allegations and that's unfortunately we can't sit here tonight and be like I don't think it happened that way. All we can go off of is what she claims and then what the injuries show. >> But if you were to just talk to her, did you would >> We did and she told us in pretty good detail about what had happened. >> We got I ain't told a little This is has happened. >> sound little. >> This is not like >> In her eyes it wasn't little. >> but it's not like hands on like this is like something that we would do like I did not do this. >> And I want to believe you, but unfortunately, I have to take tonight I have to take the side of what her story is with the injuries. So, you are >> Well, what injuries? So, I did not see anything. >> She has like almost like a blood blister on what would be her right side of her neck, redness over here, spot here, some of her acne got busted open here. She claims that you put your hands on her throat, you had slammed her head on the ground, you had slapped her, said a lot of different things. >> Officer >> All leading up to >> not be telling the truth right now. >> I wouldn't lie to you about something like this, man. I mean, I have no reason to lie to you. And I If I could sit here and take your word for it, I would, but unfortunately, state of Ohio requires us to make an arrest when a story given matches some of the evidence at hand, which is the injuries are consistent with what she said. >> Officer, [clears throat] this is this this is like literally a mistake. You're telling me right now you're Hold on. Like I'm not trying to like >> I'm listening. >> You're saying you're going to put me in handcuffs? I'm going to go in there and I'm going to go to jail tonight? >> Yes. I want to be straight with you. And I guess that I can't take your word for it with the presence of injuries on there. I'll give you a chance to fill out a statement at the jail. You can do word for word what you want or I can document everything you told me tonight. She's doing the same. She's filling out a statement about it. >> But officer, you're telling me I'm staying the night in jail like for days? Like I'm just going to rot in jail? Like for nothing? >> It's It's Sunday morning. It's Sunday morning at 4:00. You'll be there till Monday morning. >> And then this is going to be on my record for >> And then the judge will determine >> This is going to be on my record for life? >> Only if you get convicted. That's a whole new step. But this is just the >> Officer, this is big. >> It is. It is right now. >> This is happening in the court. This is like We've had had fights before. This is not how it's gotten to this, officer. >> Hey, you're innocent till proven guilty. Go in there and say what you want to say to the court and the attorney do, you know, do whatever you have to do. we wanted to treat you like a criminal, we would have came in and just hooked you right away. I wouldn't be standing here in your hot ass apartment talking to you about your side of the story. >> I haven't been here all day. Like I just >> I was just trying to lighten I was trying to put a little bit of light in the situation, man. That's all. >> Officer, >> But I got to ask, do you have any white socks or anything you want to put on? Because you need something for the jail for your jail shoes. >> I can't go to jail. >> You're going to be >> You are, man. >> I can't go to jail. >> Go Go and stand up there. >> Seriously? >> Yep.
