I asked you right there. So, I do need your license and your insurance. >> I can show you that. >> I I've been waiting. Yeah. >> Can I get your badge number? >> You will get that after you give me the identification that I asked for first. I asked you for your identification. >> Call yourself. I know my >> I gave you my >> I will give you my information once you my shelf. Your >> your sheriff? >> My sheriff? I don't work for the sheriff's office, ma'am. I work for the city of the county police department. Call whoever. >> I need your license and insurance. >> Call your Call your person that's >> He's right here, actually. >> Yeah. You're not cuz it's a white shirt. Call your That works. We're not in Chicago. >> Call your white shirts. >> If not, I don't have it. I don't get it. Call your white shirts. Yes. Record this [ __ ] >> Record this [ __ ] cuz he just sit and watch my car go out and me starting my car back up and then he stopped me at this stop sign to come up in here to go home. >> We need you. >> Record that [ __ ] Cuddy. >> Record that. >> You need to identify yourself. You're going to be arrested. That's your >> Okay. Arrest me then. >> Okay. Come here. You're under arrest. >> Yeah. Let me get my stuff. >> It's okay. You're under arrest. But you want to find your back. You >> record it. Record it. >> You told me you're under arrest. >> Okay. That's fine. I'm compliant. I'mma do that [ __ ] though. >> Okay. >> It's fine. >> That's fine. You obstructed a lawful order. >> You told me to rescue. >> So that means you're clear. >> I didn't tell you to do none of that. But I got my license and everything in this car. >> You recording me, >> girl? Record. Get my stuff out my car. turn around for me >> because he saw me starting my car back up and then he started like I guess following me. So now when he followed me I guess he thought that my c insurance everything is insurance and my car you just haven't been listening about. No baby everything is insurance that's in there and I recorded everything too. >> Got it. >> Um you're at least being arrested for obstructing a peace officer. >> Um I love >> uh me. You didn't provide your name and I asked you multiple times. >> You're very serious. >> Also, we're going to talk more once we get to the police department. >> Serious. And I'm giving you my name for what? I live in this complex. This is a private complex. There's no way that you should be arrested in. But that's fine. I'll take that for it, too. >> Okay, that's fine. >> Once detained, Valentina's strategy is to refuse, argue, and then demand a sheriff, still keeping up her crazy charade, hinting at obvious intoxication. Once I take the handcuffs off, put your hands on top of the counter for me, please. >> Sir, I can sense about the hands. >> I'm telling you what to do. >> Thank you. >> So, thanks. >> Like this? >> Yep. Once I said I said once the handcuffs come off. >> Well, thank you very much. Now, can you take your coat off for me? >> Yes, I could. And what the female? >> Nope. Go ahead. I'm not going to search you right now. >> The female. >> I'm not going to search. Can you pick your coat off the female? Cuz if I'm getting >> I'm not searching you right now. Can you pick your coat up for me right now? >> If I'm getting under arrest. >> Nope. I just wanted you to take the coat off. So, real quick, while we're standing here, I'm going to read this to you since you are under arrest. Okay, >> that's fine. >> Okay. You have the right to remain silent. Anything you say can be used against you in a court of law. You should have stayed there when you arrest me. Too bad I don't hear you. Oh my god. Uh uh uh uh uh uh. Call your manager. It's not going to happen, love. I know my rights and y'all is not going to play with me. Sorry. Uh uh uh uh uh uh uh. Y'all put them handcuffs on me. Then tell me my rights then so I'm able to walk up out of here right now. Please don't play with me. Call your manager. Hello. >> Are you ready to act like a grownup? >> Hello. Help. Help. Okay. So, you're going to be charged with DUI as well, >> baby. So, ain't no DUI cuz you won't see me. Well, you won't even let me talk to you drinking >> based on your behaviors. You're going to be you're leading me to believe that you're under you put the handcuffs on. >> I didn't ask you any incriminating questions. So, I'm reading your rights now. Are you willing to impossible love? Stop. Get somebody up in here cuz I ain't trying to hit. You didn't bring me my rights when you put my handcuffs on. That's what you're supposed to. I told you I needed to be a police officer. >> You don't know the law. >> Well, you going to have to >> How come I don't? Because did I ask you any questions once you're in custody? I'm going to school. >> No, I did not. >> Did you not see it on my record? I'm going to school right now. It >> doesn't show that on your record. Going to school right now. You clearly know nothing. Can you listen to what I'm trying to tell you when you put my handcuffs on? You did it. You waited till I got here. Could I talk to your supervisor? Ma'am, nothing. Ma'am, nothing. I know my rights. I know my rights. >> If you're going to school, I would probably drop out now cuz you're going to fail terribly if you think you >> Well, I didn't yet in that class. Well, that's >> So, do you want to know what class I'm going in? >> No, I don't. So, are you going to listen? >> You supposed to You supposed to umize me. >> Miranda? You don't even know the word. There's no way you're top of the class. >> I know the word. I just can't pronounce it. So, that's not nothing that you should judge me with. But you supposed to put the handcuffs on me. You supposed to do that when you put the Can I talk to your supervisor? Hey, you can put >> Well, you didn't like him cuz he wasn't wearing a white shirt. No, you can leave the code on the counter. I didn't tell you where you could put that. >> Okay, you can put me in the seal. I need you ask him, do you supposed to me >> take your necklace off? We could do some tests then if you're okay with that. >> I'm going to wait till my lawyer come. >> Okay, that's fine. >> Can I call somebody? >> Uh, not right now. >> Cuz I promise you I got a lot of lawyers. >> Okay, that's fine. And I'm going to do all of that. >> Oh, that's Yeah, I would recommend it. >> Oh, really? They will? >> Yeah, they need to get paid, too. So >> Mhm. They will. >> Yeah. >> You just worry about where you're going. >> Okay. >> Besides you mandizing me, >> manizing. >> Yeah. You have the right to this and that. When you did that, you should have did that when you put my handcuffs on. That's how that goes, too. >> So So I don't know. I don't know if you're very familiar with case law, but with Miranda, it's once you're in custody and I ask incriminating questions. >> You should have did that before. >> Oh, okay. >> Did that cuz you saw it on that one. >> Why did you arrest me for again? >> Oh, for obstructing obstructing a peace officer. I gave you a lawful order to find your name because legally because you're on a traffic stop. Because you were stopped in the middle of the roadway. >> Hey. >> Hello. [Music] You need me to take this out? >> Give me a second. Don't. >> So, since you clearly don't like us, if another name is what again? >> I'll give it to you. Just give me on the paperwork. Yeah. Hey, wait. Yours. Valentina, >> I need yours, too. >> Yeah, we'll put both of them on there. Valentina, question. >> No, I'm going to take it there. >> If uh if we had another officer come in to see if you're intoxicated, would you be willing to do some tests? >> I mean intoxicated. >> Yeah, because I believe that you're under the influence of alcohol. I don't know why you do because you smell alcohol. Your eyes are glassy and you're stuttering your speech. >> I do smoke. >> Okay. When did you Okay. >> And I did that when I was where I was just at. And I pulled up to come back to my unit. >> Mhm. >> Which where I live. Where you pulled me over at cuz that's where I live at. >> Sure. >> Um Yeah. >> Okay. Would you be willing to do tests? >> No. >> Okay. All right, let me search you real fast. >> While Valentina insists she's sober, the cop points out she reeks of alcohol, her eyes are glassy, and her speech is slurred. What's worse is that during the breathalyzer test, she barely exhales like she's scared to hurt the machine's feelings. >> Uh, yeah, you'll get a chance to make phone calls, just not at this moment. >> I want to go to the press charges and all of that. >> Yeah, it doesn't work like that. You can file a complaint, but >> you being an officer, they tell you that you're supposed to Mirandaize your whatever it is. You're supposed to do that with them. You're supposed to tell them what they're being arrested for. You're supposed to tell them um you have the right to remain silent. Everything used against you should be, you know, and I did it. I just got arrested at that. Okay, Valentino, do you want to go in one of these cages or do you want to go in this cell where you can have like a bathroom and stuff? >> You might have to pee because you've been drinking, so I don't know. >> I haven't been thinking. >> Keep going. Don't stop. There you go. Don't stop. Don't stop. Okay. >> So, uh, now what this means is that technically since it was three tries, it would be a refused test. Would you want to try again? What? >> Yeah. So it the machine only allows you three tries, but if you're willing to try again to show >> because the machine shows it was an insufficient sample. So it just means you weren't providing enough oxygen. Okay. So would you like to try again? We could set the machine up again if you'd like. >> I'm out of my physical. >> That's crazy. And I just did this all this time. I was willing to do it. >> Sure. I denied it >> because it was an insufficient which means not enough amount of breath. Yeah. So that's just what that means. So are you willing to try again or no? >> Yeah, I will try it again. >> Okay, we can set it up again. It just takes a minute to set it up and we can try again. So So if you look at me real quick just to listen to me. So deep breath and then continue to blow until the machine will click and then you're good to go. But if you if you don't do it strong enough or if you don't do it long enough, the machine's going to say that you're not trying. Even though you might think you're driving, you just got to do it the way the machine wants you to do it. You know what I mean? Six failed attempts later, it's officially recorded as a refusal, which is legally just as damaging as failing. Valentina's night ended in handcuffs with charges for obstruction, DUI, and no insurance. [Music]
