Why am I being trespassed? >> Cuz Walmart wants to trespass. >> Okay. I have a I'm I'm really trying to get a wine. >> Walmart can decide who who they want to do business with and who they don't. >> So you said your brother was here to return something. >> Yeah, he came. Oh, I think his girlfriend he had went to go drop his girlfriend off in the police off and I guess she had something in the box or something. I don't know exactly where it was. Yeah, we're going to go to Walmart. So we're going to return something. So I thought, okay, cool. I came here. I was going to buy a speaker, a jacket, and he wanted to, like I said, he was going to return it and exchange it. So, I had gotten the box that he was going to exchange. So, I went to I'm waiting in there for me. He didn't come. He didn't come. Okay, I'm going to go to the car as soon as you start at the car with the box. I came to the car. The car's locked. I'm I'm trying to call him. He's not answering. >> So, y'all y'all came in together? >> No, we didn't come in together. No, we did not. He was at the car door because uh the passenger was doing the car. The boat is messed up. So, we have to pick We have to pick up the gun and close it. I don't know how to work this car. >> All right. So when I went to the car I'm waiting for him last I don't see him. So I'm like damn it's a lot of police up here. I walk around the side. I heard his voice. I'm like hi brother. They like oh your brother's grown enough he can't he can't answer for himself. So I'm like okay. Yeah exactly. I don't know. They're not telling me exactly what he did or what or whatever. But I told him he came here to exchange something. I I mean I guess they got my ID. They said I'm going to be transparent from Walmart for a whole year. I'm like yeah. They said I am. >> Um, who who who? No, not me. I don't know what they're doing with him. I don't You feel me? I don't know what they're doing with him. If anything, I got Uber. But if I don't know, like I said, I don't know what they're going with. I'm not going to leave him up here like that. You feel me? I'm I'm in the baby section looking for something for the for the baby. I'm like, "What the fuck?" >> Oh, it's forever. >> Oh, okay. Well, make sure you further explain that cuz I told him one year. >> You got to do that. So, from this Walmart, they don't want you back here ever again. Okay. They're trespassing you forever. That's for this Walmart. >> Not a one year, forever. That's just this Walmart. So if you want to go to one other one, you go one other one cuz you can't come back to Walmart. Okay. >> He's going to jail. >> So So it's like, hey, so it's like this. If that's my buddy right here, and we go to his friend's house or something and I act to fool >> and then the friend kicks us out, >> right? >> You know what I mean? So can I get the keys? >> No. He said it's some chick's car. If she's not here, we can't give her give you call her. >> No. We're about to leave in 10 minutes. All right. Both of y'all, they they don't ever want to come back. Okay. >> Yes. I will give you information about anything. >> I don't need to know anything >> for anything, man. I'm trying to >> The thing is I don't >> I'm just a I'm just a slick sleeve patrolman, sir. >> I understand that. I don't need to know anything except responding to calls, sitting in a resource rally box office to prevent crime and that's it. >> This is what I'm trying to do, sir. I'm trying to do the best that I could. >> Well, I'm sorry to say, but your best isn't good enough. If this is the best you can do, it's not good enough because it's not in compliance with Florida State statute. So, if this is the best you can do, it's not good enough. >> And bro, if you're already saying you're working with a judge to get out of prison, you know, your next charge, why would you go do something? I wasn'ting thinking, man. I didn't even think >> I for I think you were thinking send you for >> Did he tell you or how long? >> 12 years >> for 80 something, man. >> So I think you were thinking you're just not thinking, >> right? >> I can't, man. >> I came, man. 12 years, man. My son going to be there, man. My first kid. I did not know. I thought I was going to go to jail regardless. >> Okay. So, you made the decision that you would rather fight and run than go to jail. >> I don't want to go to jail. >> And you purposely and you just you, you know, >> 12 years. >> Okay. >> It wasn't like you just ran and gave up. You kept fighting. I saw on the ground. >> Yeah. If you came in here, we could have maybe done like an NCA or something. If you admitted to everything, then we could have done NCA, but you're dragging us in the parking lot. We're fighting with you. You're not really >> When did you start being sorry? Was it as soon as the handcuffs went on? >> No. Time went sad. >> Yeah. I didn't tell you. I didn't I miss my first. It was amazing. Please work with me. >> I told you we could have done that. >> I don't want to go to death for years. >> Yeah. >> Oh my god. >> I I did look in those pockets, too, but I'll double check. You don't have anything that's going to catch you an extra felony, right? >> In the car. Come on. >> Please, sir. Get in the car. Yes, sir. Yes, sir. >> Legs front. >> Why you sir? Please get on. Face me. Please, sir. >> I can't hear. >> I can't. >> We're past that. >> I told you already. I explained it. >> Where was he? Sir, >> can't do that. >> Oh my god. In total, the 33year-old man received $95 from his fraudulent mattress return, and as a result was given three charges. Resisting an officer without violence, which is a firstdegree misdemeanor. Petty theft, which is a secondderee misdemeanor, and resisting merchandise recovery, [music] which is also a first-degree misdemeanor. Resisting an officer without violence is a first-degree [music] misdemeanor. lying when someone obstructs or resists a law enforcement officer performing their duties without using physical force or violence. Even though the officer did sustain a minor cut, the suspect didn't use physical force against officers. Officers [music] charged him with resisting an officer without violence, likely due to it being an easier charge to prove. Petty theft under Florida Statute A12.014 is when you're involving property valued under $100. And resisting merchandise recovery under Florida Statute 812.015 15 typically involves resisting or interfering with a merchant or loss prevention officer trying to recover stolen merchandise. The suspect's third charge, resisting merchandise recovery, was dropped, but the man was adjudicated guilty [music] on petty theft and resisting an officer without violence. This case didn't resolve itself immediately, and as a result of waiting for his judgment, the man spent 71 days inside [music] county jail. Aside from this 71 days, the man's actual sentence isn't available. But for resisting an officer without violin, the maximum charge he could spend additionally in jail is 1 year. And for petty theft, the maximum charge is 60 days in jail. Let me know your honest thoughts down below in the comments.
