Stand to be cornered. I'm going to move Well, I'm going to move to this side, then. You move to what side? Okay. You move to this side. That's fine by me. Man, I knew [ __ ] man. See, when we asked you to come out, you didn't want to come out. Now you don't want to be there. I got I have a First Amendment right, which is what? Not to say a [ __ ] word to you. That's right. It's That's okay. So now I got arrested for a first amendment right. Well, no. With my keys out of my vehicle on private property. Okay. Okay. Go ahead. All right. I'm just sitting here at this point. Just like you said. This is a private property, too. So Pretty sure there's a sign no trespassing. So guess what? I guarantee I work right next to them. They wouldn't file a no trespassing. That's at least a few problems right now. I'm going to sit you up. All right. We are going to go inside of your car. Thank god. All right. That being said I'm going to take your license, all right? All right. Knees up. There you go. All right. You want to walk this way? You want to go to the hospital? I I at least wait till that bus closes. What? Um all right. His scooter? Okay. That's how much you can tow. No. He was on it. It was a traffic stop. He refused to identify himself. He took off running. Hopped the fence. Got tased over here. Pulled out probes. Stayed in the car. I checked. Couldn't find him. I doubled back around so we could at least see where he was at. They said, "Hey, he's hiding over there." And then he pointed out that he was in the bathroom. What's What's the deal with him? Just clean him up and Yeah, that's it. You guys have an ID on him or We can It's an expired. There you go. No, it's somebody different. So that's not his ID? That's his ID, but that's not who the scooter belongs to. Oh, the You're talking about the Yeah. I am out of shape. I am [ __ ] Where's that water bottle? I'm [ __ ] hurt. Hello. Yeah, how are you doing? Good seeing you. We're just dealing with some I thought he was going to get your ass. What happened? Some use of force. Good Good seeing you. I like seeing you. Oh, that was def- that was definitely use of force. Well, once he started like pushing with you and like not I was like no no I'm not playing this game. >> Yeah. He already ran from me once. I'm not going to lose him again. He's getting tased. Yeah. I thought I was like to step back. The 36-year-old man was given three charges: resisting an officer without violence, a duplicate charge or a second count of resisting an officer without violence, and a moving traffic violation driving while your license is suspended or revoked. Both counts of resisting an officer without violence under Florida statute 843.02 are first-degree misdemeanors, while driving while your license is suspended or revoked under Florida statute 322.34 is a second-degree misdemeanor. In total, he was given three charges and in court to all charges he entered a plea of no contest. This pretty much means he did not admit guilt, but also he accepts conviction and sentencing as if he's guilty. And well, the judge adjudicated him guilty on all charges. As a result of him being adjudicated guilty on all charges, his sentence was 45 days in county jail plus a $100 fine, $228 in court costs, a $50 cost of prosecution, a $40 investigation cost with the police department, a $50 public defender fee. In total, the man paid around $468 in financial penalties. Now, a lot of times you'll see these First Amendment auditors with valid points. They'll [music] say that you need to have probable cause in order to pull them over, which is absolutely true. But in this case, the man not making a complete stop and then going further to ignore officer commands and ultimately putting himself in a position where he has no ground to stand on isn't the best move if you are indeed legally right in your stance against law enforcement and you want the judge and jury to be on your side. Let me know your honest thoughts down below in the comments on this case. Stay safe out there and I'll see you in the next [music] video. Get on the ground. On the ground. What? Get on the ground now. >> the ground. What? Lay on the ground. Get on the ground. 11-28 out with one of the portal parties at the Americas. Give me their What? Get on the ground. What? You need to get on the ground. >> Cover me. I didn't commit any crime. I didn't Get on the ground. ON THE GROUND. GET ON THE GROUND. ON YOUR STOMACH. WHAT CRIME? WHAT CRIME? YOU COMMITTED a traffic infraction. No, I didn't and I know my rights. And your first amendment rights. I'm not impaired. Yeah, you are. I can push HIM BACK IN THE CAR. I'M NOT. I AM not resisting or doing anything. God. I can't bend that way. Look at my neck. I CAN'T BEND THAT WAY. Stay like that. Damn it. IT FEELS LIKE PISS RIGHT HERE. >> STAY LIKE THAT. YEAH, but it's not probably cuz it's not my first amendment right to put my head in piss.
