Sadly, as a cop, I've seen the consequences of drunk driving firsthand. In today's cases, we'll see two drivers who don't think the rules apply to them. >> You're under arrest for DUI, driving under the influence. >> driving. >> First, we have a man who turns violent when he realizes he's been caught. >> All right, we're done. >> Then, we'll see a woman who just doesn't get it after the cops pull her over for her seventh DUI. >> How much of alcohol have you had today? >> I've only had like a couple. >> But first, officers are called after reports of a dangerous driver before finding a man passed out on the side of the freeway. Whoop, little sleepy time. >> And a Bacardi there on the floorboard. Looks like it's empty. Hey there, State Patrol. How are you doing? >> I'm good. >> How are you doing, man? >> I'm good. >> You're good? >> Yeah. >> Okay. Can we unpark here? >> Yeah. >> Okay. What's going on today, man? >> Oh boy. >> I'm just sitting here. >> What was that? >> I'm just sitting here. >> Okay. All right. Hey, why don't you hop out here for me? We'll make sure we're make sure you get some help here today, okay? >> I do get help. >> What was that? >> I do get help. >> Okay, perfect. I just need you to step out here for me, though, okay? >> Perfect, just step out. >> Why don't you take your seatbelt off for me? I'm Nate, by the way. >> Yeah. >> Yeah, we just had some concerned calls about you out here driving, and I see you're just kind of passed out here. Just want to make sure you're okay. >> Passed out. >> Okay. Why don't you step out here for me? We'll get We'll get some stuff figured out here, okay? He knows what's coming. Is this your vehicle? >> Yeah. >> Yeah. >> I'm not driving. You want me to step out? Everyone step out anymore. >> No, we're going to We've got to get out of the car, man. You're going to come hang out with me here. >> So. Standing near that traffic sucks. >> do you have a question or something or >> Now he's on his phone. >> Well, what I'm concerned about is I I believe that you're you're intoxicated right now, man. You're You're impaired. Okay, well, you there's barf on the floor. You got the open container. You smell like alcohol. You passed out at the wheel. We got driving complaints on you here today. Um I'm hoping that you can just work with me here today. Can you please step out of the car? Do I have to remove you from the vehicle or can you step out for me? >> Okay. I'll step out for you, but I don't want you to do what you're going to do. >> Yeah, I know, man. I don't blame you, man. I get it. So, the trooper has some dead rights here. He's got operation of the motor vehicle. He's got odor of alcohol. He's got slurred speech. He's disoriented. There's complaints about erratic driving. He's got everything he needs. He's just got to try to motivate this guy to cooperate. Here, why don't you step out of your car for me, all right? The reason I'm asking you out is I believe that you're impaired. I'd like to do a few tests to make sure you're not not at all. Are you willing to do any tests for me today? >> No. >> What was that? >> I'm not willing not to. >> Okay. >> 0% chance. >> Cleveland 286, can you roll me another unit here? All right, everything's sent to at the moment. So, right now you're under arrest for DUI. I need you to step out. >> I'm not doing anything. >> You're under arrest. You need to step out. You're under arrest for DUI. >> I'm not doing anything. >> Okay. Cleveland 286, one male 10-83. Uncooperative at the moment. >> Yeah, I I am that cooperative. I am literally not doing anything. >> I am that cooperative. >> I am not doing anything. >> So, the trooper's being smart. He's not in a big rush. He's kind of just buying some time for backup. This guy's in North Dakota. Troopers around the country already work alone most of the time when they're out on major roads. Backup's not always [music] close. So, why not draw it out a little bit and wait till somebody gets closer before you got to grab this guy. >> I need you to out of the vehicle though. That's where we're getting at. You are under arrest for DUI today. >> What? For not doing anything? >> For you're under arrest for DUI, driving under the influence. So, I'm going >> I'm not driving. I'm not I'm not driving. I'm not driving. >> All right. Here's your answer. >> I'm just here to do my job, okay? >> So am I. And my job is not to do anything. That's exactly what I'm doing. [laughter] >> Okay. You're doing a good job at it. >> That's exactly what I'm doing is nothing. Nothing. >> Do you know where you're at right now? >> Yeah. And that's why I stopped. >> What was that? >> That's exactly why I stopped. >> Cuz you know where you're at? >> Yeah. >> Right. Okay. Where did you come from today? >> Uh where I wanted to come from? >> Okay. The reason I came out to talk to you today >> So what? So why did you stop me because I stopped? Don't you [ __ ] tell me to stop because you told me to stop. >> No, here's here's how this >> No. [ __ ] [ __ ] You can't [ __ ] >> Well, you want to come talk to me? >> Yeah. >> All right. Perfect. There we go. Come on out. Stand over here in my car. >> Well, I'm not I'm right here. You told me to [ __ ] stop because you told me to [ __ ] stop. So, I stopped. >> Worry about that traffic. >> Can't stop. >> Perfect. Let's go this way. >> Yeah. And see, that's why it's so [ __ ] perfect. >> Let's go this way, please. Come on. Step out. >> For what? >> What was that? You're under arrest for DUI, man. >> For what? What for what? What a DUI? Make another excuse. >> an excuse. >> Yeah, you are. >> I'm just trying to walk away. I'm just trying to >> So what? I wasn't even [ __ ] driving. I sat right here. >> I I'm glad you you think that. >> No, I was that. >> Ooh, there we go. ABPO, assault and battery police officer. Not a good move. >> All right, we're done. >> Cleveland 286 We're fighting. We're fighting. >> Man, were they lying down in the car? >> Cleveland 286 Send me another unit. We're fighting right now. >> No, we're not. >> Step it up. >> We're not. >> Get on your back. >> [snorts] >> Dude, I'm I'm trying to do what you want me to do. >> Here the trooper is gassed already. I mean, it doesn't take long when you're trying to restrain somebody, when you're fighting the adrenaline dumps, you will get out of breath quickly. Hence, him trying to wait until backup got there to go hands on with the guy. >> I'll get out. >> Whatever you want me to >> No, you won't let me [ __ ] do it. >> We're not moving. You punched me in the face, dude. We're done. We're not messing around. >> Look, look, look. >> No. No, no, no, we're past that. You're >> He's got to be careful. This guy's like twice his size. >> [snorts] >> There we go. Some sheriffs here. >> Hey. >> How the [ __ ] you want to do this? Do you want to wait for backup? >> Hey, I'm good with you. >> I'm fine with you. >> The guy's trying to kill me, man. >> Do you want to wait for him? >> him >> Yeah, I'll go get my handcuffs. Yeah. >> Hobbling time. >> Clear. >> Get him off his stomach. >> I'm not even He's not >> Put your hands behind >> He's pretty good at this though. >> Look, my hands are right here. >> Put it behind your back. >> Going to hobble that cop's leg right in there. Quite the place to have your leg stuck. >> You got to work with me on this. >> Okay. >> What you going to do? >> Let me up? >> Oh, there goes the Bacardi. >> What you going to do? Let me up? >> You got to get him off his stomach. >> What you going to do? Get me off my stomach? >> How do you want to do it? >> What? >> Hey, why don't we just have him go to the center? >> Stand up. >> We'll turn him around and straighten him out here. >> Yeah. >> You got to love the constant commentary these cops are trying to strategize how they're going to get him out, and the guy's just laying it on. What a masterpiece. >> Let's try and >> Watch his head. Watch his head. >> I got him. I got him. >> Got his head. >> I got his head. >> Whoop. There's the body camera. >> Whoa. >> Not cool. >> Another ABPO. >> That's two. That's two felonies today, boys. >> Saul? >> Stop it. >> Saul? >> What? >> These things I don't give a [ __ ] about [ __ ] felonies. >> You think that's a >> Dumb dumb dumb dumb. >> You. I have 10. Who gives a >> All right. You open your car door and we'll put him in there. >> What you going to do? Let's fight. >> Just put him up. >> Hurry up and just >> No, he's >> What you going to do? Let's fight. Dummy. >> What you going to >> Okay. >> You. What you going to do? Let's fight. >> We'll just slide him in with him. We'll get him in the >> You can't even get me up. A bunch of weak >> All right, on three. >> Oh, a couple >> the car or did it take six of you guys? >> My gosh. >> A bunch of weak >> How you want to do this? >> That's one of the major problems with having a pickup truck for a cruiser. Sometimes it's difficult to get people in the back, especially when they're not cooperating. >> No, I'm not trying to run. >> That's what I thought. >> What do you >> You're acting like you are. So what? >> Dude, this mother right here, dude, I'm going to beat you up. You wet my pants. I'm going to have to beat you up. This this dude right here asked me politely to do it. >> Hey, you keep the talking, man. Just shut the [ __ ] up. Shut the Dude, shut the [ __ ] up. Does anybody have a normal cruiser? There we go. >> I'm going to go get checked out, but I still got to do piss test. What >> Is that from That's from him. >> Where? >> On his hands. >> Uh, handcuffs. >> Okay. >> Put his hands on the wall. >> Jeez. >> Jeez. >> Gross. If you are exposed to blood or other bodily fluids or hazardous material, in most states there's a state form for it, an exposure form. You go to the hospital, you talk to the doctor and they figure out if you're really at risk or not. I don't know if he needs that here. Just sounds more like the guy put his hands in his mouth, which is just kind of yucky. >> Good thing is you're good you're good with it getting in your stomach cuz your your stomach acid will kill it. >> You are leaving your vehicle here and right now >> Now, you're working with the doctor there. >> I'm trying to be good with you and decent with you. >> So am I, man. That's why I'm just saying. I don't need to be driven anywhere. That's why I pulled off to the side. You know what I mean? >> I hear you. >> Like I was doing the right thing. Like I pulled over, I went to sleep, and I have somewhere to go. Like I was trying to go to >> Except the driving part. Well hammered. >> So I and went to sleep, and that's what I was supposed to do. Responsibly. That's exactly what I was supposed to do. I was perfectly good until you woke me up. Your guys' job is up. >> It can be. We'll get back to Angelo's charges in just a moment, but first the cops spot a car driving erratically with a smashed rear window. When they run the plates, they find out the owner is revoked and has an active warrant. >> Uh so it's something because your license is revoked and you got a smashed out back window. Do you have a driver's license, registration, proof of insurance? >> It just went out. Somebody I just called my boyfriend to tell him that somebody took it out. >> Got you. >> I'll call him right now. >> You don't need to call him. Yeah, really. What are you doing? Who's open containers? >> Not mine. >> Whoops. Not yours? >> Not mine. >> No. >> Not me. Not me. That's right. And I do. This is my car. >> Well, if it's your car and you're driving, you're the captain of that ship, and if there's open containers, that's a problem for you. >> I'm not doing anything bad. That literally just happened. Call my the person that owns the car, which is my boyfriend. >> You just said you own the car. >> I did. You own it both. >> Ah. >> The registration. Registration. Do you want me to take you to where they took out my stuff? >> No, I'd like your driver's license, registration, proof of insurance, please. >> No insurance. I'm definitely not drinking. They are This just happened. I >> [laughter] >> Please call my boyfriend cuz I told him, "Please call the insurance cuz somebody took out my windshield." >> The guy in the passenger seat is like, "Come on." >> That's not my car. >> Okay, well, it's half full. >> Not mine, though. >> But you still have open containers in a car. >> It's not mine, is what I'm saying. Do you want me to tell you the truth? >> That'd be nice. >> No, it's okay. >> Well, all right. Are you because, I mean, you're saying that it's >> there. I just picked it up where he lives because I was drinking the day before, left it there, and I called my old man because that's my man, and I said, "Please call the insurance because somebody took out my windshield." >> just leave it. >> That's where I'm going. >> leave beer in your car? >> Yes, I'm not doing it, but I want to go home because I literally just called them. I said, "I'm going home." >> Exactly. Is that Jessica? >> Yeah, she's suspended, has ignition interlock. Yeah, and no open containers inside the car. So, just step right out. Hey, girl. She doesn't seem like she's going to be cooperative. I'm just going to grab her. It's probably going to be a little rough if we do that. >> So, if you don't know, a interlock device is for someone who's had like a bunch of DUIs, but got their license back, but can only operate a car that has a breathalyzer attached to the ignition. That's the only car you can drive, and they're very sensitive. You can't even get in the car if you have alcohol on your breath. It usually will set them off. So, she's now driving a car that doesn't have that device, which is another charge. >> You mind coming this way? She's not going to be cooperative. >> I'm trying to go home. I'm going to drop him off. His house is where >> You're trying. >> it happened. I just called my old man, and I said, "Please, is there insurance >> right? Jessica, can you step out of the car. >> All right. >> That's up Stop reaching around. Just step out of the car. You're under arrest. >> Yeah, jeez. >> It's okay, baby. >> Get out. >> You can go. >> Why am I being arrested? >> Your license The guy wants to get out of there. Suspended in two states. So, how much >> She knows. >> Just step out of the car. >> Please don't let them take my car. >> Okay. It's in a private parking lot. Just step out. >> I'm getting my stuff. >> Step out. Stop reaching around in the car. >> I need >> Stop. Stop. >> I need my wallet. >> You can wait a minute. Or for county one in custody. >> I need my >> Okay. >> Can I get my boots? >> Yes, we'll do that for you, okay? We'll do that for you. >> Like I have an issue. >> A few issues. >> I left my car at this place because I was too drunk last night. And I didn't >> Shocking. >> could drive. So, you guys cannot take me into custody off of that. I have to get a DUI. >> No, you can't. >> Okay. >> She does have rights. >> It's on her now. >> that and I can call a ride. >> You want your boots? >> Or I have to have like a 0.08. >> No boots, ma'am. >> No, no, no. >> Are you willing to provide me a preliminary sample? >> Yes. >> Okay. I appreciate that. Once we >> You can't take me because I have that. >> No. >> You're being taken because you have a suspended license. >> Yeah. >> And an ignition interlock requirement, which you don't have in your car. >> take me for that. >> Yes, I can. Right now, you're not under arrest for DUI. You're under arrest for the other stuff. >> Okay, but >> Want to blow? Ready? And blow. Blow. Blow. Keep going. Keep going. Keep going. Keep going. Keep going. Keep going. No. >> That hurt. >> So, she stopped before giving a full sample there. Pretty common. A lot of people, they want to cooperate, but don't want to give you the sample. I've had people like like puff into it. I've had people suck on it before. >> That's what she said. >> And they just go, "I I don't know. It's just It's It's not working. I can't give a sample." Or they have some excuse why they can't do it. It's a little game. >> I'm very sick of my lungs right now. >> a seat right here. >> Her lungs. >> That's fine. >> I don't want you to cut your foot on glass or something. >> tow the car cuz my boyfriend will come get it. Please. I don't have a DUI. >> Inside your foot in. >> I haven't been drinking. I'm mad because I left my car at the freaking crackhead's house because I gave them freaking >> .05. All right. >> .05. So, I can only speak to where I work. A .08 is per se drunk driving. Like you're presumed intoxicated. A lot of people don't know, but a .06, .07, you can still be charged and you can still get a guilty on that. You just have to really present evidence that shows that they were intoxicated by alcohol. It's very difficult to do. Usually, you go with a .08 or above, but you can still dabble with .06, .07. Anything below that, it's pretty much out the window. You're not charging DUI. >> I gave them a ride. >> Okay. >> Get in. Don't get in my sh one piece of [ __ ] >> Okay. I think we it'd be the smartest option. >> to do or I'm not going to get screwed over right now cuz I'm a little irritated because I had that punk ass with me. >> Who's the punk ass? >> Well, he is the reason that that the took out my sh >> I'm a little surprised he let him just walk off, but he was just a passenger, but they had the containers, doing an investigation. They could have made him hang around a little bit, maybe ID him. >> What's his name? >> I don't know. >> I want to make sure that your car and your belongings don't get tampered with any further. >> it's fine. My guy will come get it either way. >> Okay, but we have to contact him. >> Okay, call him. >> Do you know his phone number? >> Yes. >> Can you tell me his phone number? >> Yes. >> Perfect. I will grab my >> But, do not tell them I'm in here for DUI. >> Okay. >> Tell them it's just for revoked. >> Okay. He will be on his way. Uh, he said she's on drugs and been drinking non-stop. >> That might change things for that DUI charge, so we'll see. >> So, um, I'm going to take her to the jail. And I'll have them change it to a DUI. >> Did you say where he's going? >> No. I told him when you called him she started distracting me. I'm going to get her I'm going to get her out. >> Okay, sounds good. I was thinking blood draw anyway cuz if even even if it was partial and she only had 0.5, it doesn't explain her behavior. She's sweating for no reason and I I bet she >> and vehicle registration stuff's in there, too. >> Thank you. >> Maybe something else on board. >> Hey, see, I'm freaking hot back here. >> Yeah, I do. I have it cranked. >> All right. So, all right. Do you notice how my lights are on? You need to You need to turn off my lights. >> Okay, so your boyfriend's on his way to pick up the vehicle. >> I know, but he might take a while, so can you please or tell you where it is when you go >> We'll change this to a DUI. >> That needs to be dealt with. >> This has got to stop. >> All right. >> This has got to stop. >> 102, 104. >> The male opened up her purse and there's a meth pipe in there, so I was going to collect that. >> There you go. >> Yeah, I got a a baggie in there, too, so give me one more second. >> What's your relation to her? >> I don't even know anymore. This uh 10 years of a >> This poor guy. >> disaster. >> Gotcha. >> She wasn't even She wasn't even supposed to be driving. I left with a neighbor cuz we went out in the woods and then I noticed when I got home the car was gone, so I tried to call her and call her and call her. Nothing, nothing, nothing. >> Okay, so I can't like dump out stuff from my Can I Can I pull stuff out then? >> Yeah, if you want to open that wallet, but that's just not something I can do because we have >> No. She's not even supposed to be uh >> driving >> driving and she's not supposed to be drinking. She did 9 months in Lewis County and then she did She had three DUIs in Columbia County and did jail there and then she got transferred to Washington County and she's been out since She's been out 2 months now. >> Okay. >> Wow. >> It's never This is This is an everyday thing. And I tried to get her out of the house. I tried to do it, Victor. It's just a big It's a disaster. >> Woo, sounds like it, my man. So, yeah, most states get three or four DUIs, it turns into a felony. Sounds like that's where this lady's at. >> It's an absolute disaster. Cuz she's been doing this and they always They always say, "Oh, we can't search it. We can't search it." So, I'm glad I was here and I was like cuz I knew she's been doing stuff the way she's acting so I was like >> know who she's been hanging out with? >> Just random people. >> Randoms? >> Yeah. She'll pick up people from Those people that are in front of Walmart and pick those people up. Yeah, just random. >> They'll be three gross misdemeanors and a felony. >> Okay. >> So, whatever happens happens. I'll be up to the court. >> What's the felony just because she's had so many? >> Yeah. >> I was going to say, "Yeah, this has got to stop." >> Yeah. So, she'll see a judge tomorrow then it'll be up to the judge as to what they want to do. >> Okay. >> Okay, brother. Thank you. >> Yeah, thank you. Appreciate it. >> Do you think I should like push charges on the people that did that to my >> Yeah, if you know who broke your window >> Oh, I can take you there. Unless I'm to be and Joe longer than I have >> She's tweaking. >> I don't have warrants, so I'm very confused. >> You do? >> Hey, I have I want you to be honest. >> You do have a warrant out of >> Yeah, yeah, that's that's been there for a long time. They don't ever want me to I can't be extradited is what I'm saying. >> It has been there a long time, 2 years. >> Yeah. >> Okay. >> So >> Hold on. So, we didn't do this out in the field, but I want to talk to you, so I'm going to read you your rights, okay? Do you understand your rights as I've read them to you? >> Yes. >> With these rights in mind, do you still wish to speak to me? >> Sure. >> Okay. So, obviously, there's open containers in the car. >> Not mine. >> reeks >> Not mine. >> I can smell alcohol on you. >> Him, and the place that they took out my freaking windshield. >> So, what How much of alcohol have you had today? >> I've only had like a couple, and that's it. >> Okay. Have you had any anything else, any medications, any drugs? >> Well, my my own medication. >> What type of medication? >> I take blood pressure, and I take for anxiety. >> Okay. Any prescription or illegal drugs? No meth, cocaine, crack? Heroin, fentanyl? [snorts] >> Bro, that got out of my freaking ride. Yeah, they do. >> She's telling on her friends. >> No, I don't know anybody's name. >> Okay. >> And that >> [snorts] >> So, what >> They took out my windshield. >> Well, so here here's what we're going to do. We're going to So, you're going to wait in here. We'll do a blood draw. And then >> we don't do a blood draw and just give me that, and I'll just take it. No, because I think you are just trying to me over, and I'm like >> I'm I'm not. I'm doing my job." >> I don't want my blood drawn. >> Okay. So, if you >> I already did a blow. >> Okay. If I have a warrant to do a blood draw, and then you don't cooperate, then I'm going to take you to St. John's, and that's where they hold you down and do a blood draw. >> done that. Been there, done that. >> Okay. Well, if that's >> been there before. >> Okay. Well, I'm Like I said, >> I just want to be able to go home. >> Right now, you're under arrest. >> Yeah. >> And I've explained your rights to you. You told me you understood. >> want me to have a blood draw. So, what >> No, I'm telling you what I'm doing. I'm going to apply for a warrant to do a blood draw. >> if >> [snorts] >> What if What if You need to know the story >> Gosh. >> before you just like throwing me under the into the dog. >> Hello. >> Hi, Officer. >> This is Jessica. >> Jessica, I'm on my way. >> Looks like she consented. She wasn't uncooperative. They were just having trouble, and she was She's making some involuntary movements. >> Look at this setup. There's like a cop phlebotomist. This is unbelievable. I I work with nothing like this. This is nice. >> If If what you're telling me is true, and the meth that was in your purse, and the meth pipe wasn't yours, >> No. >> Okay. >> That's my boyfriend. He doesn't He's got a good job. He works at BG. We're not like >> nice guy if you're getting possession charges for him. >> No. >> Oh, she didn't have a boyfriend. That's not your old man. Oh. >> No, I was just giving him him a ride. >> Like I said, if there wasn't If there wasn't sufficient of narcotics, >> And it was his friend that blew my freaking So, >> What do they What do they What do they >> And that lives with him, too. >> What do they have against you? >> Player hating freaking They're females. >> Don't hate the player, hate the game. Alongside her seventh DUI, she was charged with driving with a revoked license, ignition interlock violation, and possession of a controlled substance. Angelo was charged with driving while license suspended, DUI, refusal to submit to a chemical test, simple assault on a peace officer, contact by bodily fluids against law enforcement, and resisting arrest. Unfortunately, I was not able to find court records for either of the suspects, but a FOIA request has been sent, and I will pin a comment with an update when it comes in.
