We have to deal with uncooperative people all the time. But today's cases, we have two suspects determined to make a bad situation even worse. >> Step back over. >> Step back over there. >> In our first case, we have a man that clearly believes he's above the law and refuses to cooperate with officers. >> Nobody's home. >> Are you serious? >> Then we'll see what happens when officers discover a young woman passed out behind the wheel after a night of partying. >> Hey, she's trying to start the car. She's trying to start the car. But first, these officers initiate a motor vehicle stop after spotting a vehicle with an expired registration. >> How you doing, >> Officer Plastic with Police? The reason I'm stopping you. Looks like your tags are expired. Were you aware? >> Yeah, I know you guys were aware already because you guys are always at my house. So, just target me. I >> I don't know you. I've never talked to you. Okay. Your plates are expired. >> Yeah. >> Okay. You got your ID on you? >> Are you the registered owner? >> Okay. Where you heading now, then? >> My house is >> Okay, I got you. All right. Thank you. >> Not that uncommon. People often think they're being targeted or like the police are watching their house all the time for motor vehicle infractions. Not true. >> You got your insurance on you, sir? >> I have pulled it up. >> Yep. Pull it up on your phone. Just need to see proof. Anything illegal or dangerous in the car? Weapons, drugs, guns, anything like that. >> Okay. I'll be right back with you. Okay. >> Do they have kids? >> Yeah. Look at one child in the back seat in booster seat. Oh, there it is. Non-compliance. So, it's mandatory to one, two, you got multiple one open non-compliance. It's the status still showing suspended. You're cleared all day for the um mandatory tow. >> Yeah. Okay. So, you can't even though he's at his house, mandatory tow. >> Yeah, we have to tell the vehicle. >> Okay. >> Per the judge, we have to tow the vehicle. >> Neat little conversation there. This officer is in field training and he's got his trainer with him kind of leading him through it. >> You guys have problems with him before? >> I've never had any I think I may I may have got this vehicle once, but I've never had any issues with him. >> So, we're always out at his house. I've never been there, so I don't know. People say that all the time. Really? Yeah. But I'm like I I've never met you in my life. >> Know what's taking so long? >> I don't I'm not the one that stopped you on the their car that's backing them up. So I have no idea. >> So you don't know what's going on. I can't ask cuz I mean I got my kids at my house is right here. Do you think she can just take her kids in the house? >> Yeah, I'll ask him. Is his house right here? >> Yeah, right down here. >> That's what he's asking. He's like, "What? What's going on?" Taking forever. I'm like, "I don't know." But he's like, "Would his He wants to know if you guys want to let his wife and kid go to the house." >> I'm fine with that. >> Yeah. >> What's up? >> That's fine. >> Okay. >> Yeah. He said if you two want to go down to the house, you're good to go. >> Can Not me. >> No, he's part of the traffic stop. So, he's got a >> So, you know, you shouldn't be driving. Okay. You got multiple suspensions. >> I have driver privileges. >> Okay. Where they at? >> They So, I literally just got all this done. That I got delivered to you two days ago. >> Okay. where the privileges where the privileges at? >> Well, they told me that I would have to go to the BMV. >> So, the way the privileges work, you got to have the privileges with you. And >> they didn't tell me that. >> Okay. And it doesn't show in our system that you have them. I'm not saying you don't have them. I'm just saying it doesn't show for us. So, by the court, I have to site you for it. Okay? It doesn't mean you you can contest it, okay? You can go to court and figure it all out, but for the judge, it's a mandatory tow as well. Okay? I'm just being straight forward with you. I'm letting you know everything now. >> So, we have to tow your car. Even though you're right here, I can't it's nothing. I don't have discretion. Okay? First of all, >> it shows you're suspended under multiple suspensions. >> You literally listen. Okay, hold on. >> So, this officer is dealing with a you shall tow, not you may tow. So, he's got to do it. The guy's a habitual traffic offender and pretty much all of his brakes are gone. He's got to tow it. Also, you hear operators say this before. Well, I had to go to my insurance company, then I had them call the registry or or the DMV. Usually, they just didn't do it. They know that once in a great while there is an error with the state system. That's what this kid's hoping the officer believes. >> Okay. So, I'm going to have you step out and just talk to me out here. I want my phone back. >> Yeah, you can have your phone. Thank you. >> Yep. So, go ahead and step out. I'll explain everything to you. Okay. Okay. Go ahead and step out. >> Yeah. You can record. That's fine. I just need to talk to you out here. >> And you don't need to tow my car because I have family. My house is right here. >> I get that. If it was up to me, I'd let you go. >> In front of my house. >> I don't have Okay. >> I'm not towing my car, bro. >> That's fine. >> You guys, first of all, you guys are harassing me. You literally pulled out of I literally watched you pull out right behind me on purpose because >> you guys been in my house so many times. >> Okay. Well, step back over here. I'll talk to you. Anything illegal or dangerous on you? >> No. >> You mind if I pat you down? Search you. >> Go ahead. >> Okay. Turn around for me. What's >> your bad ID number? >> 42. All by class. Turn around for me. >> What's your whole badge on ID number? >> 42. Turn around. >> Put your hands on your back. Not going to handcuffs. >> I know. I'm just putting my wallet. >> Okay. Hands behind your back. Thank you. You don't mind if I search you? >> No. You're going to go. >> It's crazy cuz if this stuff happened in Cleveland, they don't do nothing. >> So, sit back here. I'll talk you back here. >> Nothing better to do. You guys got to go. >> So you didn't use >> Don't tell me I didn't I didn't get in front of you. >> Okay, you did. Just get the out of here. >> So like I said, get the >> You are being cited. >> My corner is not being Okay. Well, we are going to tow your car. >> No, you're not. It's in front of my house. >> I don't have discretion for the judgment. >> Bro, you're being a [ __ ] You're being a >> Okay, that's fine, >> bro. You really are. Okay. >> You really are. Tow my car in front of my house. My house is right here. You can't tow it in front of my house. If it was in a different area, you can tow it. in front of my house. >> Well, I'm not going to argue. >> I don't give a I'm not arguing with you either. You're not touching my car. >> Okay, that's fine. >> You're not touching my car. I'll sit right here until I promise you nobody's touching my car. >> And I just want you to know I want you No, I'm not going to let you talk. I want you to know I want you to know that this is all being recorded and they're going to know that it's right in front of my house. >> What's it being for? >> Non-compliance. >> So, they can tow it? >> No, they can't for the new driveway. >> Okay. Can I speak to your sergeant? Here's your ticket. >> No, no, no. >> It's refreshing to hear an officer finally tell them, "No, not necessary. You're not speaking to my sergeant." >> Can I speak to your sergeant? Can I speak to your sergeant? Call your sergeant 1265. What's your What's your badge number? >> 23. >> What's your What's your name? >> 23. Right here. >> What's your name? Alice. >> Alice. Okay. Telling me. You're telling me that I can't speak? >> I'm going to arrest you for obstructing. Step up here. >> You're going to arrest me for obstruction. >> If you do not walk up over here, I will absolutely. >> I'm not obstructing nothing. Where am I obstructing? >> Our traffic stop and tell your car. You've already said twice. >> I'm buy my car. I'm not arguing with you. I'm not rising. I'm talking to you. >> Stop up over here, >> bro. Nobody's stole my car. Turn around. >> Are you being serious? >> So many chances. Didn't have to happen, >> but it did. >> Are you being serious? >> Yep. You're going to get >> Put your hands together, bro. I'm not I'm not even >> Bro, this is crazy, man. I agree. This, >> bro, I literally just got my transmission fixed because of this. I just bought that car. I got two kids. I'm a single father, bro. Okay. >> You could have acted like an adult, but now you're saying we're not telling it. You won't move and do what we the lawful that we're giving you. >> My car in front of my car. >> So now you have criminal charges instead of traffic. >> Are you being serious right now? >> Good job, >> bro. Are you being serious right now? >> Absolutely. >> Come on, man. Come on. >> We gave you several resist. >> Listen, I don't have anybody in my house to watch my kids. That's not That's not their mother. That's not my That's not their mother. >> Okay, then we'll call children services. >> What? >> Then we'll call children and family. >> Not getting any better, bud. He was talking about bro listen listen let me just say something I went through I went I went through Listen I went through child services with with my ex-wife bro my ex-boy my ex-wife is a pill head okay I just got custody of my kid please do not >> so how could we have changed this we could have >> now he's sorry anybody out there compiled like the stages of an arrest like denial anger resentment acceptance is acceptance ever in there or does it just go back to anger I guess we'll Wait, listen. Take the car. We're not doing our job. Take the car. I'm sorry. Just take Please just please just >> We told you that. We We gave you how many options to act? >> All I asked you to do was give me your sergeant. That's all I asked. >> I told you no. I told you where to go to where you can go to talk. >> Bro, you're telling me I was one step away from the grass, bro. Please. Please, bro. I I want to go back to my back. You're right. You're right. You're right. 100%. Like a child. >> Are you going to understand why I'm frustrated, man? >> So, people ask sometimes, "How come you can't just unarrest somebody?" Well, from a legal standpoint, unarrests are highly disfavored and we're told almost never to do them. Very few circumstances can it happen. >> We have to tow your car because you have no insurance. >> Please take a seat. Please, bro. Please, man. >> Come on, man. Please. Hey, listen. I apologize. >> The car, man. >> Step in the car. >> Bro, I apologize. >> Step in the car. I'm >> in the car. >> Or we'll help you. Why don't you listen? >> Man, this is crazy. >> It is crazy. You're acting like an 8-year-old. Okay. >> How you doing? >> Hi. Can you tell me what's going on? >> Yeah. So, unfortunately, during the process, we were getting ready to tow the vehicle. He became highly agitated and confrontational uh and refused to let us tow the vehicle. Uh so, we told him that we're going to arrest him for obstructing if he did not remove himself from the vehicle and go sit in the sidewalk. >> Can Can I talk to him? >> Yeah. Get Yeah, give us a second. I don't Just so you fully understand. So, he's going to come with us tonight. >> Is Is there any way we can change that? I mean, like, his kids are alone. >> We gave him several warnings and we told him what was going to happen if he didn't listen and he refused and said we weren't allowed to talk. >> I can talk to him. >> We were kind of past that point. I appreciate you being cooperative with us, but he unfortunately was not. >> Do you want her to watch your kids or do we need to call somebody like the county? Do you want her to watch them? >> Step away from Go over here. >> Yes, it is. We're here. You're not interfering with our traffic stop. Step over by the rock there and you can stand all you want. All right. >> Step over by the rock and you'll be good. Step back by the rock to the world to show what you guys have become. You You're arresting a father right in front of his house. >> That's fine. Protect and serve. Step back over there. Step back over here. >> You can give him a ticket. That's what you guys want, right? The money. >> Do you want to come in with us or do you want to go here? >> Another example of a person that has no idea the situation and is just making judgment calls and accusing the police. >> Where you told me to step back here? How far? >> By the rock. I've told you five times. Now stand there. I >> want you to police officer. Okay. Okay. >> You didn't have that bad. >> Yeah. Yeah. Okay. >> I got you, tough guy. >> You know the video just the the video shows that I wasn't resisting arrest. So you guys got it coming. And trust me, if I was resisting, none of you guys would be able to get me down. Especially all the other. I promise you. >> Talk about tough guys. >> So I hope you guys are ready. >> Have a heart. >> You follow Jesus, right? So you can just you can just break any laws you want to outside your house. >> What happened? Do you even have you been wrecked? >> This guy's going biblical on him. Don't worry, I got your back. What does the Bible say about authorities? Authorities are not a terror to good conduct, but to bad. He is God's servant for your good, but if you do wrong, be afraid, for he does not bear the sword in vain. You can find that in Romans 13. >> We'll just hook this and we'll be done. >> Oh Jesus. So, whoever he he is, when you get your your court release, you can get anything out that you need from the car. But we're not going to stand here while people are yelling and screaming. >> I just want to go to the jail and just >> Okay. >> Protect and serve, right? What the are you protecting and serving by doing this? The state and the city want cash, right? Isn't it all about the Benjamin these days? >> So, what the you get? His his kids are in there crying, bro. >> All about the Benjamins. It said >> it's all about the Benjamins. Remember, >> time traveler from the '90s. >> Shame on all of you. You're a disgrace to Jesus. You're a disgrace to what he stood for, what he risked his life for. All of you Americans are. What are you protecting and serving, man? >> The other motorist from the uninsured driver that's out there. >> Was he was he driving dangerously or did he have expired tag? Guess what? I've driven with expired taxping. Robbed blind of my money. I was living in the car. >> I didn't resist arrest. I didn't resist you guys. I didn't listen to step on the grass. You know what I mean? I'm I'm just letting you know. I know you were there. I know you're aware of what happened, but you're a rookie. You're still learning, you know. >> No, I know. So, I'm I already got this guy bit butting his nose. He's nervous. >> That was my only way to make a living. And if I don't have money, >> got it all figured out on money. How am I supposed to pay to get my back? Huh? >> So, it wasn't for expired plates. So, you can yell about expired plates all you want. That's not why. >> Listen, bro. >> So, you can make up whatever you want. >> Someone else's [ __ ] bro. And imagine it was you in that situation to maybe feel some sympathy. >> Okay. >> I know some people, man. And let's just say you guys, that video has it all on it. >> You're definitely one of those dudes that just let the badge get to your head. Bro, I know you got bullied in high school, but this ain't the way to do it. >> God works in mysterious ways. >> You realize this life is temporary, right? >> The type of actions that you do, the choices you make right now. >> You realize we were trying to wait till people could get his stuff out of the car for brother. I just want you to know that. >> All right. I'm done trying to talk to you. >> Who's doing the judging in this situation? My friend, >> you good? >> Watch everything. God bless. >> Have a good video. >> [laughter] >> We'll get to Mansour's charges in just a minute, but first, these officers have just discovered a woman passed out behind the wheel of her car. >> It's in No, it's in park right now. The vehicle is on. Hot to the touch, and I can hear the engine running. Hey, my my camera's on. I'm going to go grab my car to set the rear. >> Going to be on his way. >> Okay, >> you can honestly cut the lights if you want. She's completely asleep. >> Okay. >> So, um I'm going to keep it as dark and quiet as possible. Jeremy says he's on his way. Vehicle's on in park and she's completely asleep. So, >> it's in park. >> It's in park. Yeah. I just don't want her to wake up, freak out, anding try and get out. >> Can already tell this is a very thorough officer. This is going to be totally by the book, which is good. Night night time. >> Is it in park? >> It's in park. >> Okay. >> Hello. >> Can you roll down your window for us, please? >> Wakey wakey. >> Hi. >> Hello. How are you? >> Good. >> Do you have your driver's license and registration? 16. We know she has no idea what's going on and probably even where she is. >> Not right now. >> Not right now. Where's your Where's Where is it? >> Where's your friend? >> He went to go get food. >> Okay. Who's uh whose car is this? >> It's yours. Is it registered to you or your parents? >> Parents. >> Parents. Okay. >> Why is this a traffic stop? >> What? Uh because you're you're being stopped. Okay. If you >> I'm not anywhere right now. I'm parked right now. >> Yeah, you're right. >> What's your birthday? >> You're somewhere. >> I know when my birthday is. >> I'm I'm asking when it is. >> Why is that? >> I'm I'm just curious at this point. What What When When's your birthday? >> I know when my birthday is. >> I understand. Could you tell me >> why? >> Cuz I'm asking nicely. >> He is. >> I don't want to answer. >> You have to answer. Unfortunately, this is a traffic stop. You have to >> Why is this a traffic stop? >> Marissa. >> Hi. >> Hey, can you hop out of the car for me? >> Why? >> Cuz it's a lawful request for you to exit the vehicle. >> Did you come on out? >> Why is that? >> Cuz I'm I'm lawfully asking you to exit the vehicle, Marissa. >> Why? >> Well, because I have this Supreme Court case law says I'm allowed to ask you to exit a vehicle on a traffic stop. >> Why is that? >> We're in the parking lot. >> Yes. Yes, ma'am. because I found you asleep at the wheel with your engine running. And based on the fact that this is a bar and I watched you walk past me earlier and you appeared to be under the influence of alcohol, I need to make sure that you're able to drive. Okay. >> I don't want to move. >> Okay. You don't have a choice. >> I don't want to move. >> Okay. Marissa, >> please. >> Okay. Here's the thing, Marissa. 22. >> We need to see that you can step out of the vehicle and that you can walk. >> So that we can see that you can drive. >> Do you need any medical attention? >> I don't need medical. >> I don't understand the medical question here. It happens way too often already. It kind of opens the door for her to look like she can go with somebody else and not the police at the end, you know? [music] I know. I think that was premature. >> I don't need medical attention. >> Okay. Where's your your boyfriend is in line getting food here. >> Marissa, >> I can hear you. >> We're being very nice right now. >> I know you can be nice. >> Okay. So, we need you to step out of the car to talk to us >> so that we can see that you are okay to drive. Cuz when I came up, you were slouched over. The car was running and we need to make sure that you're okay. Car's running. She's in control of the vehicle. That's all you need. Doesn't have to be driving around to get a DUI. >> Miza, right now talking to you, I can smell the odor of alcohol and it grows stronger when you talk to me. Okay. You are in actual physical control of a vehicle. Okay. And so right now, I need to make sure that you're okay to drive. Would you be willing to participate in a set of standardized field sobriety exercises for me to determine your ability to drive? Very long pause. I see a lot of comments about why America does field sobriety tests and not just the breathalyzer. In America anyways, these cases are tried really rigorously and it is difficult to get a conviction. So, we try to get as much evidence as possible. So, we do field sobriety for evidence and we also do the breathalyzer. So, we do both. >> Miss Marissa, do you understand the question? >> I understand the question. >> Okay. Would you be willing to participate in a in a set of standardized >> I do not want to deal with my parents right now? >> No. Yeah, you're not dealing with your parents. You're dealing with me. >> I I understand that. >> Okay, Marissa, I have to ask one more time. Would you be willing to participate in a set of standardized field sobriety exercises? >> No. >> Okay. Knowing that if you refuse, you understand that I have to make a determination on your ability to drive based on my observations thus far and refusing to participate in the exercises can be used against you in court. Do you understand? >> You want me to repeat? >> Repeat that. >> Okay. You understand that I have to make a determination on your ability to drive based on my observations this far and your refusal can be used against you as evidence. You understand? Do >> you understand? I'm going to have to make an observation based on I'm going to have to make a judgment call. Okay. So, you understand? >> I can hear you. >> Okay. You understand? >> I'm not getting out of my car. >> Okay. Miss Marissa, do me a favor. >> No. No. No. >> Step out of the vehicle. >> You're under arrest. >> You were out of the vehicle. You're under arrest. >> Resist. >> Dressed like Lady Gaga or something. >> Do not resist. >> Lam, go around. Go around the other side. Why? >> Mercy, you're under arrest. >> For why? >> Do not resist. >> Do not resist. >> Hey, she's trying to start the car. She's trying to start the car. >> No, I'm not. Pull her out. >> I don't want to start my car, >> guys. She's obviously very punk rock. She has to resist. Otherwise, her street cred will be gone. >> Pull her out. Roll over on your stomach. On your stomach. On your stomach. Hands behind your back. >> Do not resist. You're just going to make it harder on yourself. >> Yeah, I got my touch. Don't tense up. Don't resist. >> All right, double locked. >> Yep. >> All right, Marissa, hop on up for me. >> All right, >> she went to sleep again. >> Let me get this. >> So, this is the main jail. So, you're um you'll be able Yeah, you'll be able to contact people. Maner was charged with obstructing official business and resisting arrest. He pleaded not guilty and was released after posting $400 bond. Prosecutors later dropped the obstruction charge, but he was found guilty of resisting arrest and sentenced to 9 months of probation and a $750 fine. Marissa was charged with DUI and resisting arrest without violence. Posted bond and was released. Prosecutors later dropped the resisting charge and the case was resolved through a pre-trial diversion program. Thank you for joining me on this video.
