She had a chair and she won and smacked you right in the face. She like slap you in the face or what? What kind of chair we talking about? Something caught me in the back of the head. It's a metal chair by Yay Big. Like kid chair. Holdable chair. Was a child in the car. That's her kid, not yours. That's her kid. We ain't got no kids. Not one kid together. Hey man, I'm going to give you this. I know you said you don't want to press charges. Yeah. I'm still going to document everything just because she came up to a public place, you know, acting crazy. So, while the officer was still at the scene, an employee alerted him that the woman had returned to the garage. 45, can you come back over here, please? Hey. Hey. My none of that. I won't hear none of that. I don't want to come out of that. I don't you trying to get you out yesterday. Stop put my hands on you. I can never put my hands on you yesterday, man. Come on, man. My kid is in the car. We got somebody we can call. Call for what? Your kids. For what? You're under arrest. For what? For damaging property. Simple as you're not damaging nobody. Simple battery. I'm not even going to take me to death. You made this decision, not me. Who is Homry to you? Talk to me. Can I go tell my kids I see them later? Can I go tell them later, please? Please go tell them I see them later. Huh? Please go tell my kids I see them. Who's going to get your kids? I don't know. Can I call somebody? Oh no. I got to look at my phone. I got to look with my mom. My phone. Go find this Nissan centure that she drove. Nissan picture. And you're driving with uh no reg no suspended registration and no insurance as well. But I ain't worried about I ran your tag. I've been here because you came up here, acted a fool, caused a whole scene, they called the police, and you left. And you had the audacity to come back with your kids. And now, if I don't have anybody to get your kids, I can call defense. No, don't do that. No. Can I talk to my kids? Can I please talk to my kids? Hey guys, y'all doing all right? Yeah. Okay, good deal. Okay. Uh yeah, we we found we found where your mom's at. Um just bear with us one second. We're going to you make sure everything's uh okay and then we'll go from there. Okay. I'll let you guys know what's happening. Y'all doing okay, y'all? I see you got some nice fudge round snacks. Good stuff. Is that for Is that for after lunch? Those are good, aren't they? You want your kids to see you in handcuffs? I just want to tell them I see them. How many kids do you have? I have two. Can you please just let me go? They're five. I can't let you go when you come up here acting like that. And we got a whole domestic violence thing issue going on. You say he busted you up yesterday? Did you call the police? Y'all live together? Who is he to your boyfriend? How long y'all been together? She She got her kids in the car. I I don't want to move the car. Yeah. I don't I don't want to press nothing against you. If he let you go, take your kids and go home. That's all I'm asking. I don't want to press no charges at all. So, he doesn't want to press charges against what happened to him. The issue is that you came up to a public business and acted like this. Okay. So, that's what we call a victimless crime. Disorderly conduct. Acting out like that in a public business. Okay. one 95 and then I gave you very stern multiple commands to stop and you did not listen to me. K is K is sitting inside the car. I don't want to leave them over there sitting in the car. Gotcha. Another officer. I mean is did Is you good, man? Did you good? Like you sure you got your kids in the car, bro? All this I'm calling for, bro. Take your kids and go home, bro. That's it. I got my window fixed. I I'm like I'm not doing nothing left on nothing. My fixed is done. Like it is what it is. 55 Delta line 56 regular unoccupied. That's all I want you to do. I I ain't even want this [ __ ] to go this far, bro. I just want you to take your kids, get in your car, go home, and relax. That's it. Like you trying to do all of this. Now look, now look at this. If I was nasty, I would have pressed charges. I ain't pressed charges. When he bust my lip, I was trying to get you. I was accidentally bust your lip. I didn't touch you. You put your hands on me. I did not touch you. Come on, man. I hear you out and I'm I'm track. If I If I tried to move my way today, I probably would have busted your lip. I'm trying to get out. Just wait over there. I promise before anything I told him I don't want to press. Okay. trying to let her just go ahead and Did Did he explain that? It only depends on what y'all's relation is. Yeah, I like my girlfriend. Okay. Something like that. Like I the same thing yesterday. Yeah. I try to move her out my way. Now I can't move her out my way because then that'll be domestic violence. You know what I'm saying? And all this and that by me trying to keep her off of me. She come in the shop trying to attack me with different things. I got you. And me defending myself might cause me to go to jail. Now defending yourself. No. No. I mean, I I understand the apprehension cuz sometimes, especially when it's a woman, it comes off as Yeah, I get that. Yeah. I think the car, right? I think so. Sit down. You sit down. Are you hanging out with the kids or you need me to over there? Okay. All right. I just want to leave him alone. We think we thinking levelheaded having a bad day. I know. What is your relationship to Omry? We've been together for almost two years. Two years. Y'all never lived together. Just dating. Here's where we're at right now. Misdemeanor charges. He doesn't want to press charges. This doesn't qualify as a domestic violence thing. So, we're going to She's going to search you. You're going to go in the back of the car right now. We're not going to jail. You're going to be released and you're going to be able to drive from here. Okay? But if if things change as far as anything else from you, then you may have to go to jail. So, I just need you to cooperate with us. Get this all this paperwork done and then you can go. Okay. Sound good? You are going to be banned from this this shop though. Okay. So, that means you cannot come back. If you come back, they call us. You'll just be arrested on the spot just for being on the property. Okay. You just search her. Put her in my car. All right. Go ahead and have a seat. All right. Officer M will be back out here with you. Okay. Hey, is it is it DVA or No, it's not. It is, but it's not. It doesn't qualify underneath. He's hanging out with the kids. Is that Is that you with that? Yeah. Okay. They don't They don't live together. They've been dating. Don't live together. Don't have any kids. Hey, we can't let her drive from here. So, you know how you saw the tag was suspended and everything? Yeah. The actual car also suspended and no insurance. So, it's got to get to Okay. Okay. So, your vehicle, you can't drive from here. It's got a suspended tag and no insurance on it, which means that it cannot legally be out on the road. Okay. You have somebody else that can call and pick you up. Okay. Well, just think about it for a minute. Okay. No insurance registration. So, you can at least hit her with some citations. So, it's driving. She was though. I mean, you have it on good authority. She left based on the original call and she came back, right? Yeah. To me, it's the same as a 26 bolo. Hello. So, as as you might imagine, we we know your car can't be driven. It's got no insurance kind of registration. So, you can't drive it off the lot. If I go Well, with your permission, can I get your phone and bring it over here so you can get a call to get somebody ride over here? Okay. That car has the wrong tag and it's got no insurance on it. So, she can't drive that car away from you. Um, so she's asking me to get her phone out so she can call for a ride for her and the kids. The tag belongs to her other car. She only had one car. Well, she used to have apparently a Nissan Sentra because her name is Chantel, right? Chantel. Chantel. Yeah. The tag goes to a a uh a Nissan that was in her name at some point. Hello, mama. Are you at work? Yeah. I need you to come and get me from the job. Mama, come get me. Oh my god. What's going on? The police right here. The police. You call the police for me cuz I can't try to fight him. Boy, on camera. Yes, ma'am. Okay. You busy? No. Can you come and get me before you be um busy? Where you going? Right here. I can't drive it cuz I don't got no insurance. They called the police on me cuz I tried to fight him. All right. I got to put some clothes. All right. She's about to be released. You don't want to press charges. So, there's no charges for the damage in here and trying to hit you. The issue is that, like I said, she came up to a public place acting like that. So, it's disorderly conduct. She calling somebody to come pick her and the kids up because her car don't have no insurance or nothing like that. I I ain't trying to do all that. It's messing with two women that got me messed up like this and I I She got feelings on me. She was charged with disorderly conduct and banned from the property. After receiving her citations, she was released at the scene. Hey everyone, it's Trent, prior deputy sheriff patrol sergeant and canine handler. And these domestic violence calls are just the worst, especially when you have two innocent children involved that are left to just sit in a car while their mother goes and wres havoc inside of an automotive shop. So domestic violence laws can vary slightly from stateto state in terms of the requirement that is going to make it mandatory for law enforcement to make an arrest. So, in the state of Georgia, in the city of Savannah, where this incident took place, it is a stipulation and requirement in the Family Violence Act for people that are currently in a dating relationship or have been in one in the past. It makes it a requirement for them to either live together or have lived together prior for it to fall under those domestic violence laws that makes it a mandatory arrest on the law enforcement side of things. But because this guy says, "I don't want to press charges. I don't want to be the victim of a crime. We didn't have any we don't have any kids in common. We never live together. We don't currently live together. And therefore, I do not want her to go to jail. So, we see very clearly that these cops don't make an arrest of any kind because in order to have a crime, for the most part, it is situational dependent. It is crime dependent. You are going to have to have a cooperative victim. It says that they want to be a victim. If you don't have that, then you don't have a case that you can take to court. So, the fact that his vehicle got vandalized, he had stuff thrown at him and it sounds like he got hit by her as well. He doesn't want to be the victim of any of these crimes and then usually as a cop, you're just going to be taking a documentation report on the incident, which is what this officer did in this situation. However, in a state like California where I policed, it doesn't matter if somebody cohabitates or not. If you live together in the past or you currently live together, if you're currently dating, the only requirement is that you had dated in the past. And if you do anything that is going to qualify as a domestic violence related crime, it is a mandatory arrest no matter what. So if this incident in this video had taken place in the state of California, that girl would have been going to jail regardless of if this guy said that he wanted to be a victim or not. Additionally, on top of that, it wasn't notated in these officers reports. So, I don't believe that they did this, nor do we see it in the body cam footage, but they still, in my opinion, should have contacted DFS, Department of Family Services, or in if depending on the state you're in in California, Child Protective Services is the entity that we would have notified in a situation like this. The fact that she thought it was totally normal to leave her her two very small children in a car alone while she went in to commit crimes that potentially could have landed her in jail, in my opinion, warrants a notification to Department of Family Services and let them know like, hey, this is the environment that these children are in. And based on her behavior, it is a possibility that she's done something like this in the past. We also don't know what else she's doing if she's out there doing things like this. And the fact that she came back, like this officer said, she she had the audacity to come back after what she had done the first time just shows you that she is not in her right state of mind. And the neglect that her children are going to have to face, especially if they're able to see or hear these incidents transpiring. And of course, that is going to have potentially a profound effect on them as well. And that is going to be it in this one. See you guys in the next one. [Music]
