intoxicants okay coming from you have SL speech so at this time I believe that the wheel and hi okay so the reason for me asking you to step out of the car is one you are detained right now you're not who is actively driving according to state law a person can be charged with DUI if they are in actual physical control of a vehicle while Under the Influence this means that even if the car isn't moving simply being in the driver's seat with the engine running is enough for an arrest the key factors officers look at include is the person in the driver's seat is the engine running does the person have access to the Keys in this case all three conditions were met but was this enough for a DUI charge if you don't perform the task then there's no way for you to dispel our alarm his alarm
