But when police arrived, they quickly realized this wasn't even a customer. The man was identified as Gregory Robinson Nesmith, and according to staff, things had already escalated. >> Hi. What's your magic? Did you? Okay. What was he angry at, do you know? >> Um, pretty much that we're not getting any free food. >> Okay. So, he's just mad and just irate. >> Yeah, pretty much. >> Did you guys tell him to leave >> Yeah, I told him to leave. Yeah. >> Okay. >> And then he started pretty much threatening us or threatening you. >> And did anybody get hurt or battered? >> No. No. >> Um What kind of how How close did he get like where where were you guys and where was [music] he? >> I was probably about right here. >> Oh, okay. Can I go over there? >> We had some guests but they were just over there in the parking lot. So, I was just talking. >> Okay. Or just right >> Yeah, I guess a lot of people were calling me. >> Oh, yeah? >> Yeah. So, we can I just get your name real quick? He's over there at Corbett. So, I'm just going to go with him real quick. >> Yeah, it's Nia. N I A. >> Is that your first name? >> Yeah. And my last name is B O. >> B O? Yeah. B O. And then uh birthday? Imagine you're right. Yes. All right, sounds good. All right, we'll go see if we can find him. All right, thanks. >> After being denied free food, Nesmith allegedly became aggressive, making threats toward both employees and customers inside the restaurant. Officers quickly locate Gregory as he's seen casually walking around campus, seemingly unfazed by what had just happened. And but once they make contact, things take a turn almost immediately. What Gregory says next is something you don't hear every day, and it sets the tone for everything that follows. >> Hey bro, what's going on? You got ID with you? Need to talk to you. >> Okay. >> Show me some ID. >> Show you some ID? I don't have any. >> Do you have anything with your name >> watching up to me like >> You're aggressive, sir. I can tell by your demeanor. >> I'm not being aggressive. We've had several calls on We've had several calls on you. >> Okay. I'm speaking out loud. Okay. You hear me? >> Huh? >> You heard me? >> You did not. >> If I had an ID I'd produce it. I already see you. I came up to you cuz I know where you go. >> down, all right? >> All right, and you too. So what you going to do? Put me in cuffs? >> Play or not. >> I already told you. >> No, you haven't told me your name. >> Do you not know my name on the ground? >> No, I don't. >> What's the chosen one's name? >> Do you have your Do you have >> What's the chosen one's name? >> What is your >> Then you're denying my god. >> What is your >> You're denying my father. You're denying me. So, you're denying Gregory Robinson Niesmith Jr. I'm talking to you, sir. You understand? >> Okay. >> Get out of my way. >> Thank you, Gregory. >> You're welcome. Don't ever [ __ ] talk to me ever again. >> Do you have anything with your name on it you can see? >> No, I don't, sir. >> Anything with your name on it? >> No, I do not. >> In just a matter of moments, the situation escalates far beyond a simple disturbance call. And in the end, Gregory was right about one [music] thing. He was chosen for something, just not the way he expected. Because that choice turned out to be a one-way trip straight to jail. From the jump, the suspect is non-cooperative as he verbally lashes out at the officers. What he says next is one for the books. >> Uh where do you live? >> What do you mean, where do I live? >> an address here? >> I'm from heaven, but uh no, I do not. >> you Where do you stay at night? >> out of Georgia, if you want to know that. >> Georgia? >> Ask the right question, please. >> What is your last name again? >> Uh Gregory Niesmith, N E Smith. >> Smith? >> Yes. >> Is that two words? >> No, it's one. N I Smith. Like your knee, but the K and the E is silent. You know, like that knee. >> Okay. So, it's K E? So, K E? >> No, N I. K is silent. Y'all always forget about the K, but you know you want to try to bring it up now. So, do not, you know. >> Do you know your driver's license number from Georgia? >> No, I do not, please. >> Uh what what's the last address you lived? >> Uh I'm not sure. I'm not sure, you know. >> Where do you live Where do you stay here in the last week? >> You're trying to ask That's TMI. I live The whole planet is, you know, my but I live in my kingdom, man. >> So, where do you stay at night? >> You mean where I stay at night? >> Where do you sleep at night? >> Shining on the other side, just like I'm shining on this side at night. >> Okay. Yeah. So, uh >> told you you be too much information. >> Yeah, so we're calling about Panda Express is calling because you were over there threatening people. Is that correct? Were >> you being aggressive like like you were with the officer? >> I'm just doing what I'm supposed to do. >> Well, Panda Express doesn't want you at their store ever again. So, we'll just give you a trespass card for that. So, you can't you just can't go over there or you can get arrested for >> Yeah, that's what they said. >> So, then we we also have to trespass you from the whole campus because people are calling here complaining that you're being aggressive towards them. So, you'll be trespassed from Panda Express, but also all of NMSU campus. >> Okay. >> I want them to know whoever called. >> What's that? >> I said whoever called. >> Yeah. >> But I understand. >> All right. Yeah. >> So. >> Officers inform Gregory that Panda Express wants him officially trespassed from the property, meaning he's no longer allowed to return to that location. But that doesn't sit well with him. For someone claiming to be the chosen one, this isn't the outcome he expected. And [music] his response only makes things worse. >> He's going to go get the trespass. He's going to get >> I'm not going to I'm not going to sign it. >> No, you don't need to sign it, but I need to I need to hand it to you. >> I don't want it. There ain't nobody else handing me one and you're not going to hand me one, sir. >> Okay. >> I'm going this way, sir. >> No, you can't go to NMSU. You have to go across the street to Las Cruces. >> Can I walk all the way around? >> This is campus. >> So, take a detour. >> On the other side of that building is Hold on a minute. We got to write >> Am I being detained? >> Yes, you are. >> Why am I being detained? Detained isn't cuffs. >> I just told you. >> Detained isn't cuffs. >> detained. >> you want to be what? Why are you going to swing on me? >> to give you a We're going to Are you Are you going to swing on me? >> No. >> I'm not going to swing on you. >> I'm asking you, then why are you standing like that? That's an aggressive stance. >> All right. So, so is that. >> Cuz I'm walking off. >> Okay. I don't want you to walk I don't want you to walk You're being detained. >> And I do not have to [ __ ] state here. >> you and tell you to give me this. >> You just have to give me the paper. I really didn't even have >> We just need to show you the form. >> Do you understand? >> I don't give a [ __ ] about that form, that paper. You're tres You're trespassed from NMSU. >> You're looking at the word right there. >> You're trespassed express. Do you Do you >> you your paper? >> Do you acknowledge that I trespassed you? >> I don't acknowledge none of the [ __ ] you just said. I don't even knowledge you. I told you you're denied. >> All right. So, we're just going to hand it to you. >> It quickly becomes clear Gregory has no intention of cooperating. As officers try to speak with [music] him, he begins making statements that raise serious concerns about his state of mind. >> He's mad because he wants to suck [ __ ] You know? Now you ain't even talking about a person. Individual. So, don't think it is disrespectful, ladies. But if you taking it offensive, then obviously you don't give a [ __ ] California. Showing your back. Every one of you. Cuz I took that. Let me throw this up. >> Do you have a local address? >> Right to go to jail, [ __ ] that. Right to go to jail, I got the right to walk away. I'm not being detained. >> You get paid for that? Not yet. >> You get paid for that? >> You want to give it to me. What am I doing? Why? You ain't even get How am I being arrested for trespassing? You trying to serve me a piece of paper, bro. Yeah, cuz you want to give me a piece of paper like it's a [ __ ] marriage. It ain't no marriage, sir, and I'm not being aggressive. So, why are you arresting me? Why are you arresting me? You want me to walk y'all? You want me to walk y'all? I'm not doing that. So, I'm going in jail instead? You just pulled up on me, so I'm not trespassing. I have the right to freedom of speech just like they got the right to record. And I don't I just got here, bro. I've never been here before, so how do I know I can't be here? Huh? You can't be here, sir, that's why you are putting hands on the king right now. So, why are you arresting >> Stand right here. >> Cuz I don't have to be a detainee. >> Okay. >> You're not a danger and you're not a >> Yes, you're arresting me for nothing. Why are you grabbing my dick, sir? Why are you touching my ass? Huh? Why are you touching my ass? They shouldn't be touching me, sir. You're arresting me for no reason. >> No, you're not. >> Yes, you are, sir. You want to give me that paper, see? >> Yeah, you're still going to get it. >> Yeah, and you're giving me a piece of paper that I'm getting right now. So, how am I being served with trespassing but being arrested at trespassing the same thing. Sterling, Colorado did the same thing. And I won every [ __ ] case. >> Get in. >> I won every [ __ ] case, [ __ ] >> Get in. >> You're a hoe, man. You're being a hoe in your heart, man. Look, I'm telling you the truth, man. I'm telling you the truth. You can cuff Go ahead, man. I don't know why you're sitting me in there, bro. I'm not aggressive. I speak. >> Yeah, you are. >> And you know cuz you No, I'm not. >> You got to talk to me respectfully. >> You just said it. Yeah, you are. No, I'm not. That's assertiveness, sir. That's assertiveness. I'm speaking freedom of speech. I'm not being rude. I'm smiting you. I'm smiting you in a holy way. >> Gregory, still referring to himself as the chosen one, continues voicing his frustration as he sits in the back of the patrol car. During transport, he goes on an extended rant, clearly upset about being arrested and unwilling to accept what's happening. Even with the situation under control, the tension doesn't let up. >> You know that I like disorderly conduct? My man, my father's dead. Okay, then. If I do it disorderly, bam, case closed. Everyone that [ __ ] with me is going to end up in jail. I [ __ ] did that. Better site release me. Right on site, you go free. You had no problem You had no problem taking me there. He got no problem with just releasing me. Again. Again. Mhm. Just like what was in the back. Damn. Love and hate. Try to tell them. Look at this. My way. You just can live in a life of love and hate. Make a muscle. Cuz my actions don't always control somebody. They judging my actions. How you going to judge me? I am the law. Not above the law. I am the judge. [ __ ] I'm over every [ __ ] judge. You know? You know? It's like if you eat you just really lose. Why? Cuz the devil was on foot. You pooped it out. Picked some new gear. And you went down the toilet. You know what I'm saying? It's like That's my point. I told them. This Listen. Take me to jail for smiting. Take me to jail cuz I didn't want that [ __ ] piece of paper. It don't mean [ __ ] There's a damn tree right here. That's why I don't There ain't no other police. Give me one. What's the difference between you and him? There ain't no difference. You're saying you're better than him? You ain't better than nobody. I'm not better than you, and you ain't better than me, [ __ ] Listen to this piece of [ __ ] And there's literally no toilet, no water, no nothing. Not even us. Enough. This is nothing. Don't even look at It just don't exist. That's what he does to me. Don't even pay attention. I was questioning him doing him right. Why? Cuz I know damn well he That is some dumb ass question. It's just like that one person. I'm walking down the street the whole time. He's on the right and left side. I'm walking on the right side and just like that. Him and me crossed the whole time. We got phone poles there. And here to damn from the driveway to the apartment complex. I crossed from the right side. He got on the left here in the road. I walked on the right side and the guy from the rear view mirror, he is still going your way. He goes, "Ah!" We just crossed the on the wrong [ __ ] side. This is like when I'm walking through on the block. They do all sorts of [ __ ] through on the block. They do all sorts of real mean [ __ ] and you're out. >> All right, Gregory. This is what's going to happen. You're going to come out of the car. We're going to walk in the door over here, all right? Go ahead and come on out. >> Just when it seems like things might calm down, they don't. As Gregory is brought in for processing, he becomes argumentative all over again, launching into another rant. This time focused on his fears about what might happen next. Even at this stage, the situation remains tense, showing how quickly things can escalate when emotions stay high. >> Keep going straight all the way down. There you go. Stop right there. I'm just going to check your pulse for you. Make sure they're all right, all right? Can you just bend over at the waist just a little bit so I can reach the pulse? >> I'll turn around so you can do it. I don't want to bend over in front of you. >> It's on the other side. >> I don't like you behind me. I'm not I'm not I just don't want to. I will squat down for you, bro. I don't mind doing that. But you're not going to have me bending over with you standing behind me. I ain't no [ __ ] [ __ ] >> Stand up. >> What's wrong with you? >> Stand up. >> No, cuz he wants me bending over at the waist. >> Stand up. >> As he even sees it. >> Stand up. >> HE WANTS AN ASS. This [ __ ] DESERVES A POWER BOTTOM DEPARTMENT. THAT'S WHAT I'M TRYING TO TELL YOU. I'M NOT EVEN BEING AGGRESSIVE. >> LOOK. >> I'M all relaxed. >> That's right. >> Look. >> You want to act like a gentleman? >> I am. You trying to get ME TO BEND OVER AT THE WAIST IN FRONT OF YOU. [ __ ] >> SIT DOWN. >> LOOK. [ __ ] YOU, DUDE. [ __ ] HERE. >> Gregory continues yelling from inside the holding cell, showing no signs of calming down. In the end, he was chosen, just not in the way he claimed, facing charges of trespassing and disorderly conduct, along with being banned from Panda Express locations. >> What is going on? >> You know what happened right there? >> That's my mister. You can use it. I can get a hold of him right now. THEY COMPLAIN EVERYTHING, RIGHT? WHAT IS GOING ON? HE DOESN'T HAVE SOME PATIENCE. >> SOMETIMES it's nice. >> I know.
