That's kind of >> Do not touch me. >> So that's kind of >> me. I'm taking legal action. >> We need you to step out of the vehicle and your mom can come and >> because this is my life, not yours. >> Stop pulling me. >> Step out of the vehicle. >> Wait until my mom gets here. >> No, we're not doing that. >> I am. >> No, but I am. >> On March 17th, officers in Aztec conducted a traffic stop on a vehicle driving with no headlights or tail lights. The driver claims she was coming from a friend's house with her 5-year-old. But the officer immediately notices a strong odor of alcohol coming from her. When he brings it to her attention, she becomes incredibly difficult and refuses to comply, escalating a simple stop into multiple felony charges. >> Hello, I'm officer with the Aztec Police Department. The reason I stopped you is cuz your headlights and tail lights went off. >> And I just like barely even. >> Gotcha. Yep. So you were driving probably I don't know where you were turning off beforehand but I seen you from Aztec Boulevard in Maine till all the way about Wendy's >> and I just noticed and I was just like oh no cuz I was talking to my mom on the phone and I did notice that and uh she's knocking on the door and so I turned them right on and I literally was like pulling off for you to like go around me and I'm like oh wait mom let me call you back cuz he's pulling me over like I don't even know what's happening. >> Yeah it was just for the headlights. Do you have your driver's license and insurance on you? Mhm. >> Awesome. How old is the kiddo? >> She is five. Going on six. >> Going on six. >> We're just getting ready and prepared for her sister who is 17. She's coming from Texas tomorrow. Before you look at my license, I know it has a little bit of action on it. >> I'm not worried about it as long as I'm able to read it. >> Yeah, I'm probably sure that I freaked out my mom because I'm like, "Mom, >> what's up, kiddo?" >> They're pulling me over. was like, "Okay, all right. Okay, bye." They was like, "What? Did I not have my She even said, "Did I not have my seat belt on?" I'm like, "I don't know. >> Where are you heading from tonight?" >> I'm just heading to Florida Vista. I live right there. >> Going home. >> Yeah. >> Where are you coming from? >> I'm coming from a friend's house and then we went stopped by the gas station and just trying to like get everything ready for tomorrow. >> Gotcha. Any drinking tonight? >> When was that? >> It was about 6:00. >> 6:00. Awesome. All right. Go ahead and >> my registration, too. >> I'll just take a look at it. Here is your insurance pack. Okay. Before you eat that, um, how big was that glass of wine that you had? >> 4 oz. >> 4 oz. How? And you said at six. >> Okay. So, I'm smelling a a little bit of an odor of alcohol maybe from that or you might have had more to drink. I don't know, but like can you smell this? Because like I used to smell alcohol on people whenever they were drinking this with me. >> Okay. I mean, I can smell it, but I definitely know what the smell of alcohol is. >> Me, too. I'm [snorts] a bartender and I don't like I literally like I told you like since 6:00 we were having a party over at the house and I ate. I drink a lot of wine. If you take my sable um show, I don't know if it's in my car because I'm sure like different things have been spilled in my car. >> Gotcha. >> I know that recently somebody spoke a beer in my car. >> Okay. So, that may be what I'm spelling, but um just cuz I want to make sure. Are you willing to blow into a PBT? What that is is a preliminary breath test that detects the alcohol content within your exhibited breath. It's not admissible in court. It just tells me kind of where you're at for a time frame. Okay. If you had that glass of wine at six o'clock, I mean, it's almost 10:30 now. It should be either super low or >> that made my >> You're fine. >> And I'm super stressed. >> You're okay? >> Because like this is I feel like it's like not okay. I live like maybe 2 minutes away. My mom is here and I don't want this to be something for my daughter to have to go through. I know we we can go to the back and do everything, but if [snorts] you just >> That's not That's not how things work. >> Okay. But like I just feel like it's not okay. >> Okay. Well, I have to do my job. >> So, under my suspicions is that you have had something to drink. You have your kid with you and I want to make sure that your kid's safe and you're okay to drive depending on what you I I know, but I still have to go through my provisions. Okay. And if I if I deem it, >> I will stay here until my mom gets here and then you can do the test, but I'm not going to go. >> I don't want your mom on on my scene. >> No, but I don't want my child on the scene. >> Okay. Well, I've done many DWI investigations upon other investigations where child are on scene and it's just how it goes. I mean, like I said, you can exit the vehicle and we can walk right here to where she's not in view if you're okay with that. >> It's just a quick breath and if Are are you why are you so hesitant as far as to get a breath? >> Because as far as the information that I've had given you >> as far as I >> and the fact of the matter that me personally, I know that I'm giving you facts. >> Okay. Well, I don't I don't know what you've been doing. I don't know if you've had one glass of wine. What I do have is that you said you drink at 6:00. I smell alcohol from your vehicle and I can't tell if it's from your person. So, if you were to step out and speak to me, maybe I could smell it from there. But if you want to give me the benefit of the doubt, blow into a PBT, >> that's your option >> because I don't want to disrupt your job and at the same time, I don't want to disrupt our lives >> go through like all the things like right now and we're picking up her sister tomorrow. >> And I understand that, but if you're good to drive and you said you had one at 6:00 and that was it, if that was it, you should be either 0.02, 02.01 or 0 cuz that was 4 hours ago and you said it was 6 o right so you should have nothing in your system >> especially if you ate >> is because you had no lights on >> that >> and that is a indicator as far as drunk drivers go there are many signs that we get from drunk drivers >> another sign is obviously the hesitation >> people eat and drink in front of us when we talk to them they take a little bit to think and I just want to make sure you're okay if you're okay to drive >> fine you blow zeros or you blow a 0.01 then I'll have your mom come pick you up >> here and drink and eats in front of you that just indicates that they are a person. >> No and I understand that but it also gives me little indicators to for observation. Does that make sense? >> No, I understand. >> Okay. A lot of times people will eat, drink, smoke cigarettes to try to mask the smell of alcohol. So, those are just like signs that we pick up on. >> Understand everything like because I told Kim earlier like I'm a bartender. You guys have been to my bar before and I called you actually for super like different um situations that I've been in. Where is it? >> It's over in the BFW. And um I understand that just at the same time I'm just like taking a gas because like I understand that you guys if you if we blow a certain percentage you can take us to jail. >> Well it also goes under a whole scope of the totality of the circumstances. Okay. If I deem you not fit to drive >> by the slightest degree I can take you. >> Yeah. And I understand that. So, I mean, >> and I don't I don't think that that's the case. That's why I'm saying if I could just call him home to take my daughter right now. And >> so, do you want to give get a PBT or why do you want your mom to come pick up your daughter? Are you worried that you're going to blow an exceeded amount? >> I don't know. No, I'm not worried at all. >> It's just the indication in general. >> The indication of what? >> That you are thinking that I'm not telling you the truth. The only reason why that I'm eating sex or drinking anything is because that you think that I'm going to blow over. >> I I didn't say you were going to blow over. What I said what I'm saying is that the facts if you had a No, it's just clues that give me an indication of something. I've met people that are on a traffic stop and Hold on. I'm trying. >> Do you see me being somebody that is not able to drive on their own? I'm just going >> I heard I heard that. >> So you say that you understand it us but you're not talking to my mom on the phone and I go oh my gosh and I turn them on and she goes what? And I know that I was like maybe.3 miles from the gas station and I turned my highlights on and she's like what happened? I said I didn't have my highlights on whenever I was driving and I didn't even think that you were pulling me over for that at all. I'm just like I'm literally just right there. >> I I understand that. And if you're okay to drive, then we'll go go that route and we'll deem it that way. And if not, then it proceeds further. Okay. It's a simple exhale breath into a PBT. >> I get it. But I just don't >> If you get it, then it's super simple. All you have to do is get out, give a breath into it, and then you're >> able to talk to each other like >> and I and I am talking to you. I'm letting you know what's going on and what I'm gathering from you. [snorts] Okay? So, >> at all >> and I'm not saying you are, okay? >> But I feel like it >> I'm sorry you feel that way, but I have to do my job and right now I'm doing an investigation >> as a mother and a child. >> Okay. Well, you know, and I get that, but I'm still conducting an investigation as far as a DWI goes. >> I get it. because of what you've stated to me, the odor that I have from the vehicle. And for one, I want her to be okay. >> It might have been something that had been spilling because I had >> No, but like baby, it's okay. It's okay. It's okay. It's okay. >> Here, give me your hand. Give me your hand. >> It's okay. I literally had my boyfriend in here the other day and it did. There was something that spilled. >> Okay. If if that's the case, all you have to do is give a breath and then if depending on where you blow is where we'll go further. Okay. >> Like I said, it's a PBT. It's not admissible in court. I can't tell the judge. >> The reason why I'm worried is because it's like before I left from home, I had a drink. When I went to my friend's house, I had the wine. I know that it doesn't stay in your system that long because I'm not a drink. I am a bartender. I get it. I get it. I want to find I'm sorry that I I don't want to feel like I'm giving you a hard time or anything that I don't even want to have to call my mom if that is the case. >> I don't want to have my picture blown up everywhere if that is the case. I am not abusive to my child and I understand that. But there there are circumstances. So are you going to cooperate with this or not? >> I'm cooperating with you. >> Okay. And can you get out of the vehicle and do you want to give right now? >> Okay. Do you want to do standardized field safari test? if you want me to. But what I'm telling you is let me calm down my daughter in this moment if I can call my mom and help her get hurt. >> So here here's what's going to happen. You're either going to cooperate or my sergeant's going to come out here to come out. >> You want my sergeant to be here? >> Okay. He's already on the line. He's already on the line. >> I don't want to talk to you anymore. >> Why? >> Because I've seen you before and when you've come to my bar, he was someone that I was able to speak to. You were not. >> Okay. I don't remember dealing with you. So, >> you did and I remember you. I can't remember. >> And what was it from? >> It was from when we called you for an altercation. >> Two individuals sitting in our alley. >> Okay. >> And we called you guys to come out to help us. You said you accused my friends that I was taking home and I had just got done. Sab, it's okay. It's okay, baby. It's okay. Don't cry. It's okay. I love you. I love you. I love you. It's okay. It's okay. You accuse them of whatever you accuse them of. You were mad that they were drunk and unlike this is not about them. This was about the situation that was in the alley >> and we handled the situation that was in the alley. My scope of that investig. >> We did too. We told them to leave and they left. Okay. >> And they did not leave. They said that they did not leave. >> They left right after we left. >> Okay. But you were telling >> and we sat there and watched them. You told me and you were mad at the ones that were >> I wasn't mad at anyone. I was investigating to make sure nobody was drinking and driving. That's perfect. >> Ask my manager to go ahead and look at the >> That's perfectly fine. >> Okay, then I want to wait for your sergeant because I don't want to talk to you anymore. >> Would you like to talk to this officer? >> Yes, please. >> She wants to talk to you. >> What's your name? >> Officer Williams. >> First name? >> Justin. >> Thank you. Of >> course. >> So, what's the reason you're not wanting to step out of the vehicle? I'm not understanding cuz you said that you understand everything that we're saying, but yet you're refusing >> our command. Hello. >> Hello. >> I'm pulled over. >> Where are you at? >> I am over at the Domino's Citizens Bank Durango Joe's. Not >> Uhoh. I'll be there. >> More of the fact of the matter that I'm going to have to call my mom. I'm waiting for their sergeant. Fact of the matter is that I left the gas station and I didn't have my I didn't have my lights on. So, I called my mom because Camille's coming tomorrow. You know this I didn't have my lights on and I was past the bridge by the time that I put my lights on. I didn't mean to not have my lights on and whenever I whenever I was Yeah. Obviously. And whenever I turned my lights on, it was right there by like A&W the bridge. These are the two cops that came over to um the VFW whenever I had we had that altercation in the alley. Fact of the matter is that I have Sable with me. They're asking me why I do not want to step out of the car. This the fact of the matter is that I don't want to leave stable in this position and I asked them to h let me have my mom come and get her and they're refusing to let me have help. >> Where does your mom live? >> My mom lives in Florida. I live right by her. And the fact of the matter is that I am not intoxicated. >> You can easily prove that to us. But they said that um and and he says that I can easily prove it to him by blowing the breathalyzer. >> We're doing the standardized field sobriety test. >> The reason why >> So my sergeant's here so you need to hang up the phone. Okay. >> No no no. >> Yes. >> I'm not going to hang up the phone. >> Okay. I got it from here. Hello ma'am. I'm Sergeant Harris with that police with the police department. I need you to step out of the vehicle. Okay. So go ahead and unbuckle your seat belt and then come talk to us out here please. >> Thank you. >> If you fail to do that we're going to remove you from the vehicle. We don't want to do that in front of your kid. >> You can't remove me from the vehicle. >> So, there is case law. When an officer asks you to exit the vehicle, you do need to. >> You don't need to get harsh with me. >> I'm asking you to step out of the vehicle, please. This can go a lot smoother. >> Perfect. >> But at the same time, you don't need to be harsh with me. >> Okay. Well, step out of the vehicle. It's minor saying you've been uncooperative with these officers, so we need you to cooperate with us. >> I'm working with people that don't have empathy or anything at all because >> you're not listening. matter that I told them the situation. >> So, I need you to I need you to speak with me. >> I am. >> Speak with me. Now, whoever's on the phone >> and now he's putting something under my vehicle so that they can >> So, I am going to take your phone from you. >> You're not going to speak. >> Step out of the vehicle. Step out of the vehicle. You need to listen to us or you're going to jail. >> I'm listening. >> Step out of the vehicle right now. You're obstructing the investigation, [clears throat] which is a criminal offense, which you can go to jail for. So, you can either cooperate with us and get out of the vehicle or we're going to force you out. Okay. >> Okay. Give me a second. Sorry. >> Step out of the vehicle, please. >> I don't understand. >> Why do you not want to step out, >> baby? It's okay. It's okay. It's okay. >> So, we can do this all back here away from your kiddo, and an officer can stand right here to make sure she's fine. But you need to get out of the vehicle. >> I think this officer explained to you why we're here. He smells an odor of alcoholic beverage coming from your person. You admitted to drinking wine and you have a kid in your car. >> I understand. >> Step out of the car. >> My first response and responsibility is to my child. >> Okay. Why do you not want to get out of the car? >> Because I explained to him. Did you know the situation? >> Yes, I I'm [snorts] aware of it. He told me. So please, why do you not want to step out of the car? I see it's okay. >> Can you answer that question? I've asked it like three times now. >> Already explained to you. >> Not to me, though. >> Because first and foremost, I'm just headed home. I went to my friend's house. I had like a 6 oz glass of wine. I went to the gas station. My lights were off. And then I was talking to my mom because we had plans. My daughter from Texas is Baby, it's okay. >> So, I'm just standing here. I smell the odor of alcohol coming from you as well. >> And what I told him was that me and my boyfriend were in here the other day and he spilled some beer or whatever it was like whatever. >> Well, your eyes are bloodshot and watery as well, ma'am, which is common. >> I I wake up in the morning when my eyes are bloodshot all day long. >> So, now we're kind of like going off the question of why did you not want to step out of the vehicle? because of the fact of the matter that I have already explained to what is happening. >> So, you requested for our sergeant to come here. So, he's here now. So, maybe you should explain that to the guy that you requested to be here in the first place. >> I started to explain. >> No, you didn't. >> Yes, I did. No, you didn't. >> Yes, I did. You interviewed me just >> unbuckler. >> Stop. >> Step out of the vehicle. >> Step out of the vehicle. I'm not going to play this game. >> There's no games. >> Step out of the vehicle. >> Step out of the vehicle. Can you answer my mom's phone? >> Step out of the vehicle. Stop. >> Mom, I'm okay. I'm in Westside Plaza. Stop. >> Step out of the vehicle. >> Stop pulling me. >> Step out of the vehicle. >> Come to Westside Plaza. >> You guys didn't do this in front of my daughter. Like, >> man, we asked you to get out of the vehicle several times. >> But I've been calm the whole time. Don't touch me. Wait until my mom gets here. >> No, we're not doing that. >> I am. No, but I am. Stop. >> No, you stop. >> She'll be here in 10 minutes. >> You stop. >> Let him go with you. >> You do not do this. >> Mommy, I want to wait for you. >> Maybe you want to wait for the mom to come home. >> What kind of opportunity is this? >> You call the whole time, >> but you're not complying. >> I'm complying. >> I back to the matter that I want my mom to show up. >> So, not in You're not in We need you to step out of the vehicle. Your mom can come and take because this is my life, not yours. >> Let me talk. Your mom can come over here and take the kid, but you got to get out of the vehicle. >> Absolutely. I'm not getting out until my mom shows up. >> Okay. >> Thank you. >> If that's what you want to play, >> and that's fine. Don't >> Don't in front of my child. You guys are acting. >> You're making a choice, ma'am. >> In front of my child. >> Respect my child. Do you see how she's acting because of your actions, ma'am? >> I'm sitting here. >> Well, at this point, you're going to jail. >> Okay. >> Okay. >> Respect. >> I want to live with her. >> You are always going to live with me, my love. Stop. Nana's going to probably show up and come and pick you up. >> Hello. >> Here I am. >> Hello. This is Sergeant Harris with the police department. Okay. >> Where are you at? >> I'm in Flora Vista. >> Are you heading this way? >> What's going on? Yes. Yes. >> What's going on is she's suspected of drinking and driving. She won't get out of the vehicle and it's escalating to somewhere we don't want it to get. >> Okay, we'll be right there. >> Okay. So, when >> we're just >> Who's we? >> What? >> Who's we? >> Husband and I. >> Okay. Whenever you guys get here, I'm going to have you pull behind the very last cop car. I'm going to speak with you there, and there's going to be guidelines on what can happen with when when you guys get here. Okay. >> Okay. What is your name? >> Is Sergeant Harris with the police department here in Aztec? >> Like, I am such an advocate of our community and like you guys have been treated, especially in front of my daughter, especially. >> Ma'am, we gave you options and you didn't comply. So the information that I have given you guys all night is that my daughter is coming from Texas tomorrow and I just want to >> So that gives you the right to do whatever you want. >> That gives you the right to like force me into whatever you think. >> I've done nothing wrong. >> So there's case law. When an officer asks you to exit the vehicle when you're suspected of committing a crime, you have to do what that officer asked me to get out of the vehicle because I didn't have my lights on. >> No, that's not what he said. He he asked the >> fact of the matter that he told me that I didn't have >> I asked you I asked you to get >> I smelled alcohol and then I told him that it right there was Yes. There was a spill the other day. It's not me. >> It's coming from you when I when you're talking I smell it coming towards me >> and I even had him smell my my vitamin C drink >> and like >> the fact of the matter is ma'am >> that far you have to cough like that. Just stop talking to me. >> No, that's not how it works. Wait till my mom gets here. Like seriously, just wait, dude. Cuz I'm just tired of it. You guys are such like toxic masculinity. I hate it. I hate this town. >> The fact of the matter that you guys want to act super right in front of the people that you do, but like >> I didn't make the decision to drink and drive this community and I haven't done anything wrong and I'm sorry. And I am so good. And my daughter 17 years old, she's coming tomorrow. >> Same way. It's okay. It's okay. Just stop. It's okay. I want her to have her. You took my keys. >> Yep. >> Well, I want her to have her window up. >> Okay. Well, if you step out of the vehicle, I'll roll the window up. >> But I'm not giving you the keys back. >> I'm not giving you the keys. >> So hard. It's ridiculous. We give you the cheese bag. You throw it and drive and take off. >> Yeah, right. Like I'm going to do that. >> It's happened before. >> I'm going to do that. >> It's happened before. >> I'm not going to do that. >> You guys are ridiculous. You are ridiculous to even think that. >> Okay. >> Oh my god. [laughter] Like seriously, [crying] >> I can't even think in the fact of the matter. I would never have that speculation of anybody, but I'm not a cop. >> Exactly. And that's happened to us before. That's happened to other officers. >> That's why I'm not giving you the keys back. >> Look, my leg is right here. I am holding her. Do you think that I would be crazy enough to run away like that? >> Thanks a lot. You didn't even answer the question. >> Because every time I answer your question, you slap back with something disrespectful. So why? >> But your accusation. I haven't done anything in dis disrespectful anytime. I'm just telling you guys you're thinking wrongfully and I am not. >> I'm going to explain kind of the process of what's going to happen whenever your mom comes. I'm going to talk to her back there. She's going to come and she'll grab the kiddo and she's going to wait in her vehicle and you're either going to step out willingly or we're going to have to force you out. Okay. So, that's kind of the next >> being forced anywhere. >> Do not touch me. >> So, that's kind of me. I'm taking legal action. That's your prerogative. So, I'm just explaining to you kind of what's gonna happen. Okay. >> Legal action. >> I'm just explaining to you kind of what's going to happen. >> Explaining to you. >> Okay. I've been threatened with it before, ma'am. I'm not worried about it. Okay. >> So, I would respect and accept that you would let me get my daughter out of the vehicle, her in with my mom, and come back and talk to you guys. >> I explain to you what's going to happen. Okay. >> Because I'm not a disrespectful person in general. Well, you're kind of not listening to our orders >> because they've never been in this situation. Well, >> most people just comply and do what they're asked to do, ma'am. >> No, they don't. I know that. >> I can honestly say this is a this is a first >> child molester. I am not anything like that. >> Respectful person that has to do in this community to form the better. I work with veterans. I work at the VFW. I'm a I am yes a bartender but I don't break the laws ever. >> Okay, you are right now called obstruction >> because I want my daughter to be safe. >> That's not why. It's because you didn't comply with our orders to get out of the vehicle >> because I don't I don't want my daughter to be alone right now. I have a 10-minute drive to my house and you guys are >> What kind of vehicle is your mom coming in? And when you talked to her, did you did she say that she was on her way? >> Yeah, she said she was leaving Flora Vista. >> Hello. I'm the sergeant that spoke to you on the phone. So, basically, she was pulled over. She didn't have her headlights on. The officer talked to her, could smell alcohol coming from her breath. So, it's standard procedure. When we have reasonable suspicion of a vehicle and the occupant driving it, being impaired to the slightest degree, we do a DWI investigation. She refused to cooperate and get out of the vehicle. She has a strong odor of alcohol when I was talking to her. She's all over the place in her statements, so there is a reason to believe she is impaired. Um, she did admit to drinking a glass of wine earlier tonight. She's requesting you get her daughter and put her in here. And then she said she would cooperate. If she's not willing to do that, we have to drag her out of the vehicle and place her under arrest. >> Can you just take her home? >> No. >> Unfortunately, it's gone to the point where it's past that. >> Oh my gosh. You look like a princess. >> It wasn't anything. I went to the gas station and my lights were off. And I even told you that when we were on the phone, I said, "Oh no, my lights were off." And I turned them right on as soon as I noticed. And that's what they called me for. But they're treating me like [ __ ] And that's why I didn't comply is because they're treating me like Well, I asked him if we can take you home. And I even told them like I understand I understand all the things like literally there's nothing wrong but they keep pressing like these they're pressing and I already told them that I'm going to take legal action for the things that are done and I don't want you guys to leave because I don't know what's going to happen. They forced my door open, took my seat belt out, took the keys out of the car. If you could if you could put handcuffs, that's what we're gonna do. >> That's fine. Put me in handcuffs in front of my parents and run my daughter. >> Let's not do it in front of your daughter. That's what your mom >> and my dad's going to stay here. Go to the car with Sable. >> Go to the car with Sable. >> No, I'm going to take you home. >> I know. Go to the car. Go to the car with Sable. When I went here, >> go to the car with Sable. 2 seconds. Mom, go to the car. Dad's staying right here. >> I know. You guys go get in the car, please. And they say you're not making the calls. We're in charge. >> Hey, Mary, if you could take Abel, please back to the car now. >> Her name is Sable. I've said it multiple times. Just call me. I don't like disrespect. Of course we all don't like disrespect. We all don't. I understand that. Look at the thing they have under my car. See that? >> Okay, Mary. At this point, I need you I need you to go >> and I'll come talk to you here in a second. Okay. >> Well, we're going to continue our >> We're going to investigate, but I I need you to go over there, please, so we can continue with this. >> And sir, you should take my my belongings so they're not in the car. >> Let's Let's restart. Okay. Now that we've got your daughter out of the way, let's continue with the investigation at hand and we'll go from there. Okay? So, I'm going to have you come step back over here in front of this cruiser that's right behind your car and then we're going to continue the discussion there. I got to get you away from your car, though. Okay. >> Can I give my mom my stuff? >> She'll get the snacks that I just got for >> We'll get We'll make sure everything. >> I don't want you guys to get it. >> They will get it. >> We'll let them get it right now. Please. >> Okay, I'm going to continue the investigation over here and then whatever the outcome, >> whatever the outcome is after that, then we'll go. >> My lips hurt. >> He has my keys. Just give me >> We don't need anything. >> What do you need? >> I just told you. >> Will you ask for snacks and chapstick? >> Yes. >> Where's the chapstick at? >> It's in my purse. >> We'll let him get We'll let him get the chapstick. Okay. But let's go back over here. >> Can he get it before you? I'm not even putting you in handcuffs right now. >> Cooperating his dad to cooperate. >> I am. >> Andrea, do what they're asking you to do. >> We I will let your dad grab your chapstick, but I need you to go back there first and then he'll grab the chapstick and he'll let you apply it. Okay. >> I hear you. >> Don't be dangerous. >> I'm not. There's no danger about this. >> There was no danger at all. Stop. Okay. Get my chapstick. He said that he Okay. Go over there. >> Get my purse. >> Okay. >> No, you don't go through my purse. Give me my purse cuz I know where it is. Like, you know how mom is. She doesn't let you go through. >> Stop talking to me like that. >> I don't need that. I need you to be on my side. Dad, >> talk this to yourself. >> Of course I did. >> Of course I did. I have gifts inside of here for Camille. and money. >> Uhhuh. >> Take it to mom. >> Okay. >> Give it to mom right now and then come right back. You have your license. They have Do they have my license? >> Let me put it in. Okay. Whatever. >> It's just [ __ ] Vaseline. Whatever. Whatever. Like what the I am not a bad person whatsoever. >> We have to follow procedure and I I've given you many many chances >> and we've been trying to work with you and you haven't been working with us. So, now that this situation's revolved, >> I've worked the whole time even though it's taken a little bit longer. I've worked with you the whole time. >> Kind of. >> No, not really. >> The whole time. >> Okay. Okay. So, we'll move on from that. Okay. Your daughter's safe. Your dad's right there. Are you willing to do the standardized field soiety test? >> Yes, I already told you do that. >> Okay. Can I have you place your feet together, arms down by your side? Okay. Do you have any injuries that would hinder you from walking? >> No. >> Okay. Do you wear any contacts, glasses? >> No. >> Okay. Do you have any medical are you on any medical like prescriptions or anything like that? >> I took benadryil for my allergies. >> Okay, so that's >> that's fine. Okay. [snorts] Do you have any traumatic brain injuries? >> I fell in my side one time and cracked my head. >> Okay. How long ago was that? >> No. And then I had a a side bone on me when I was like 10. I don't know. >> Okay. So, do you experience any repercussions from that? >> Other than probably like inflammation every once in a while, >> like brain swelling or >> I don't know what it is. >> Okay. All right. Can you see the pen? >> Mhm. >> Okay. I need you to follow the pen with your eyes and your eyes only. Okay. Can you see it? Okay. Now, just remember, follow with your eyes and your eyes only. All right. Okay. Follow the pen up. Okay. Are you comfortable in those shoes? >> Yep. >> You are? Okay. All right. Let's go right over here. Sorry, sir. Didn't mean to flash my flashlight in your face. All right. We'll use this one. So, if I could have you stand right over here for me. Have you stand on this line just like this. Face me. Feet together. Arms down by your side. Okay. So, you said you were comfortable in those shoes. All right. So, from this position, you're going to take nine heel totoe steps, counting out loud. It's going to look and sound like this. >> I would rather feel better just like barefoot because these shoes. >> If you want to take your shoes off, you're more than welcome to. >> Now that I'm like super nervous with you guys, like it's just that much more. Like, my body has not >> Everything's Everything's calmed down. I had asked you if you had any injuries and you told me no. You said you you were fine to walk. >> My everyday hurts. I'm 40 years old. I'm not going to tell >> nutitional tests that don't have anything to do with walking or balancing. So, we can do those, too. Okay. >> No, even the fact even the fact of the matter, I'm practicing yoga every single day and I don't I can't do everything that I used to do because my body just hurts. >> It >> You guys are just like very forceful and just >> It hurts in general. So, do you in this video? >> Do you want to do the walking? And >> I I hear you, Dad. Take it. >> Do you not not >> Andrea, do you want to do the walking and standing test? If not, we can go to the additionals. >> I can do it. It's just it's just weird because like being in this position of just like extra anxiety just makes my muscles hurt more. >> Okay. Well, take a few breaths and then we'll continue. Okay. Fine. >> Just let me know when you're ready. Okay. I'll let you take a few breaths. Okay, what do you want me to do? >> Okay, so with your right foot on the center of that line, before you do anything, go back to just how your feet together. Okay, I want you to put your right foot in front of your left foot, just like this. Okay, don't move from that position until I instruct you otherwise. Okay, so you're going to take nine heel totoe steps, counting out loud, it's going to look and sound like this. 1 2 3 so on and so forth until you get to nine. Okay, on your ninth step, you're going to take a series of small steps turning yourself back around. It's going to look like this. Just like that. Okay. It's important to keep your legs straight. Arms down by 10034 1006. Are my arms too far? I don't I don't know, guys. >> Okay. Well, I wasn't finished instructing. I don't know if you understood. >> Well, I mean, you had just started when I was explaining everything. So, >> no. So, when I was instructing you, you I just began the test without me telling you to start. It's going to be you can use whichever hand. Okay? You're going to use your thumb and your the end of your fingers. Okay? So, the tips of your fingers. Okay? You're going to start off with the first one, the index to the thumb. Okay? It's going to be one 2 3 4 3 2 1. Okay. You're going to do that three times just as I did. Okay. Do you have any questions? None at all. Okay. You're good to start. >> 1 2 3 4 4 3 2 1 1 2 3 4 4 3 2 1 1 2 3 4 4 3 2 1 >> Three times. >> Are you done? >> 1 2 3 4 3 2 1. I don't >> Okay, >> that [snorts] was three times. >> If you want to put your shoes back on. Do you remember the first thing, one of the options that I gave you when I first talked to you? Remember the PBT? Okay. So, do you remember me explaining it to you? PBT is a preliminary breath test. What it does is it detects the alcohol content with the with your exhibited breath. Do you want to do that at all to kind of see where you're at or because I believe you've had more than just a 6 oz glass of alcohol. >> Told you before you left home. I had a >> What time did you leave home with it being 11:00? >> Told you I had that. >> Did you have anything else to drink? Are you sure? Cuz it seems like you're a little bit more under the influence than you perceive yourself to be. So, do you want to blow into the PBT at all? >> If it's necessary, I guess >> it's it's up to you. It's completely up to you. >> I don't think I need to. >> Well, if you can walk right back over here, then we'll continue. >> It looks like they're probably going to take me to jail. >> We are. If you want to go either right here, that's fine. >> They already told me that we are. >> Yep. Yep. >> So, go ahead and get to the front of my vehicle for me. >> Well, if they do the breathalyzer, they're still going to take me. If I don't, they're still going to take me. What's the chance? >> So, what's the point? >> Going bell her out. >> She'll have to see a judge >> tomorrow morning. >> More than likely tomorrow. >> But it's not it's probably not going to be before that Camila's getting upset in this. >> We can get Camila. >> I know that you can, but this is stupid. Like, I don't ever want my kids to see me. And oh my god. They're going to see it. >> Just don't be >> Cam's going to see it. Every [ __ ] buddy is going to see it. Dad, >> don't be belligerent at all. >> I'm not belligerent. >> I'm pissed off. THIS IS NOT MY REPUTATION. >> This is just naturally belligerent. Don't Don't do anything funny. >> Is that what you said? >> Don't do anything funny. >> I'm naturally belligerent. Stop. I don't want my kids to see me this way. >> Ma'am, we're done. >> I understand. >> We're done. So we can >> That's ridiculous. Don't ever be on my side, Dad. For real. Forever. We're going to do it in front of this vehicle so your daughter has no chance of saying no. >> It's fine. >> No, we've worked with you as best as possible and you've been >> working with you guys, too. >> That's just the thing. I've worked with you guys the whole time. Other than me being like, >> I would disagree with them. >> I'm mad. Okay, you can disagree with whatever you want. >> At this point, let's go by this unit so your daughter has no chance of seeing you in handcuffs, okay? or we're in a hidden country right now. I do not want your daughter to see that. So, yes, please go. >> Whatever you guys want to do. >> Okay, let's go this way. >> Um, I think it's on the hood of that car. So, the thing is when you get to the jail, you're going to have to blow into something. So, we can't have anything in your mouth for 30 minutes. >> I like I told you, I took an allergy medicine earlier, too. So, it's like >> we can't have anything in your mouth for 30 minutes. So, that's why we can't have these drinks. Nothing. I hate that you guys are treating me like a criminal. I I >> It's just our It's our procedures. >> We have to follow them. >> And then we hear about child molesters getting out in two days. >> So that's up that's not law enforcement. That's up to the court system. >> But I feel like it's everybody that >> law enforcement law enforcement has nothing to do with sentencing. We put the bad guys behind jail or behind bars and then whatever happens after that, that's not up to us. So go ahead and get right there. Please >> don't hurt me. If you want to put your hands behind your back, >> I am not like like refraining from any of this. >> So, I'm telling you to do something and you're not doing it. >> But like you need a human being. >> You have been, but you're taking taking and that's it. >> If I'm this super big criminal and >> we're not talking to you as if someone's that's not complying with my commands. >> And you told me that I can't let you do this because you're going to start a vehicle and run off. I can't wait. >> Take the car. >> Just one second. Do you mind going to the back of that unit and then >> I don't know you either. >> Yeah, exactly. >> So, I treat everyone the same. >> Okay. So, can can we just go right here real quick? >> Okay. Can we please walk forward? >> Can I have my taxi? >> Okay. Once we get to the jail, possibly. Okay. >> Gosh, you guys, please, before I even get to the Joe, like >> you just put it's Vaseline, right? >> I did and it soaked right in and I'm licking my lips and my I'm super dry. Okay. >> So, it must be back in your purse or with your mom. >> No, you took it. I never saw you with your dad. >> No. >> Well, you were preoccupied over there. >> And so were you. >> Can you place your arms behind your back for me? >> Do you have a wallet or phone? Anything you want to go with you to the jail? >> So, you want that to stay with them? >> You want your phone? >> Yeah. >> Dad, did you take my chapstick? Can I have some please before I go? >> My lips. >> Put it on your lips. >> You I guess >> sir. >> Yeah, I'm a Thank you for raising. >> Okay. We're not what people call us. Okay. >> Do you want your dad to take possession of the vehicle or Cuz if not, then we have to tow it. >> Yeah. No, take it. >> Okay. Do you have anything on your person? >> Anything in any pockets? Okay. I have to check real quick. Can you >> my card from earlier? But um >> you said you want your gadget in there. >> And that's it. >> Okay. Do you want to go to the back of my unit for me? >> Well, in my cup holder, there's a different chapstick. Can you get it? Cuz I know that one of you guys took it. I don't know if you gave it back. >> I think we gave it back to your mom. But if the one in the car is yours, I'll get it. Okay. Okay. Can we go right back here? I'll open the door for you. Can you just tell my mom really quickly? >> We can have her come over. >> What's her name? Is it Mary? >> Mary. Mary, can you Mary, can you come here, please? I'll let her give you a hug and say what you guys got to say. >> Going to take you to jail. >> Calling me a idiot. Hold on. Sorry. All I did was not I put my foot on. I thought, "Oh, I did." >> Oh, you gave them a hard time. >> I'm not going to leave. >> That's how they leave by herself. >> Well, they weren't going to leave her by herself. >> But she was by herself. >> Why was she by herself? >> Because the way that they were treating me. I didn't want her to be in there. >> I don't know what to do. >> I I don't know what to do. >> Nothing. Just >> You should have called me. You should have called me. called you because I didn't know how to turn my headlights on. >> I don't know. >> We were on the phone. >> I know. We were on the phone. I wasn't doing anything wrong. You was heading home. I didn't turn my headlights on. >> Why did you pull her over? Just >> cuz her her headlights weren't on. Yeah, that's >> And then it turned into this. >> Yes, because I smelled odor of alcohol from her person. >> We had alcohol smell in the car the other day. No, it's from you. And I'm like I literally was like, "It's [snorts] not me." But like if they don't believe that, they don't believe it. And >> well, we got to get going. Okay. So, do you want to give her a hug? >> In my cup holder. Can you bring it? Really? What is it? My chapstick. Your chapstick. Did you take her chapstick? >> She can take it. I can't put You can't have anything to drink or put anything on your lips until you get to jail. Okay. It can go with you, but you're not having it apply to put on before I go. >> Nope. >> Okay. Put it in my pocket. >> I I will take it with you. >> Okay. Give it to him. >> Can we get in the vehicle? I don't want your your daughter's right there, and I don't want her to see this. >> And how am I going to get in? >> I will help you. So, it'll be your left foot first. >> And I've already told you my legs are like super weak all the time. So, God, seriously. >> Yes, ma'am. >> This is insane. >> Those handcuffs aren't too tight on you? >> No. But can I sit like this? >> So, I'm not sitting on >> I mean, you can sit however you want. I just have to buckle you up. Okay. >> Why do you need to restrain me like this? Like, this is >> The seat seat belt is for your safety. understand. But like behind my back, I'm not going to do anything cuz we have them in standard procedure. >> Like >> it's just standard procedure. >> That's crazy. >> Is this the one you want? >> No, I just have to have the cuffs behind my back. >> That's standard procedure. It's hurting you. >> You said that I cannot have them. >> How is it hurting you? >> I'm not doing anything. My arms, my wrists. >> I thought you just said they weren't too tight. You just told me they weren't. But if they're >> But now that I'm sitting there, they're just like doing >> We can put them in front of your your person then. >> Well, that would be amazing. Thank you. So, what happens next? What do we have to do tomorrow? >> Uh, she'll see a judge tomorrow morning. >> What is your name? >> Officer Williams. >> What's your first name? >> I'll give you my badge number. You can step back out and we'll put it in front of you. Do you need help? >> Go ahead and face the vehicle. Now, you can go ahead and get in. Did you give them my phone? They said I can take my phone. >> I have it with me. >> And Camille's flight is >> You can pull off numbers and everything and call everyone. >> You never see me on line. >> I know. Everybody's going to >> I know. It is so stupid. >> But that doesn't even matter. Like the fact of the matter is that I just need to get killed tomorrow. >> Andrea, can you open your mouth for me? >> I heard you. Just give me a second. You guys over people for the strangest things you could have >> for headlights. Headlights are very dangerous. >> Mhm. >> If you don't have headlights or tail lights on, it becomes just a black flash. You know, you could flash somebody. Like I said, it's pulling out right here without headlights. Somebody's driving on the road. >> I don't want to hear all this. I understand. >> So, here's your license. >> Can you open your mouth for me? And then we'll get going. >> The last thing I need is the kiddos's information and you guys are good to go. Where do you want your Visa card? Do you want that with you or in your purse? >> I apologize. >> Why would I let you know? >> Because it's a safe officer safety issue when he comes. >> I was telling him what was going on. Get off the phone now. And he unbuckled my seat and took out my keys and open my >> So, I'm going to read you something real quick. I need you to listen. Okay. Okay. So, you're under arrest for DWI. >> Yeah. >> Okay. The New Mexico Implied Consent Act requires you to submit to a breath test to determine the alcohol >> content of your blood. After you take our test, you have the right to choose an additional independent test. If you choose to take this additional test, you have the right to a reasonable opportunity to arrange for a physician, a licensed nurse or laboratory technician or technologist who is employed by a hospital. >> Because if I say no and I don't take the test, >> then I will read you what happens. Okay? I cannot force you to take our test, but if you refuse, you will lose your New Mexico driver's license or non-re residence oper operating privilege for one year. If you are convicted in court for driving while under the influence, you may also receive a greater sentence because you refused to to be tested. Do you understand? Okay. So, do you want to be tested or no? >> Be tested. >> You'll be tested. Okay. >> You guys can take my card. I gave you medical said that he was that she was going to call me. She hasn't called me yet. You have my phone. No. I told him that I want to keep my phone. >> I've got it. >> You want to call Camille? Just give her a heads up. >> Nothing other than what I told you. >> No. >> Okay. >> Anything else? Cuz we need to go. >> No. >> Okay. >> I've got your ID and your phone. Okay. >> Is that all you want to go with you? And your chapstick. >> And my chapstick. >> You wanted your chapstick to go with you? >> Okay. >> Chapstick. But like, do I need my ID or can you give it to my mom or do I need it? I mean, if you want to have it for when you get out, that's up to you. You don't have to have it. If you want your phone, that's up to you. >> Do you want my phone? >> Okay. >> Adult detention center. >> Where's that? >> On Andrea Drive. Do you know where Andrea Drive is? It's right over there. >> How safe is that place? >> I don't know. I don't work there. >> But you go there. >> Yeah. I >> You guys are snotty and >> it's not snotty. >> Yeah, it is. >> The people who work there protect everyone. You're good to take off. I'll reroute you if it's not there. >> All right. Okay. It's right over here. >> Do you have a tissue? >> They might have one inside. I don't have any on me. >> Nope. You got to Nope. There we go. Almost there. There you go. Nope. So, you got to just like the first time should look all the way around it. You're messing up. So, it's just like blowing up into a balloon. Okay. So, yeah. So, don't try to cover this. Just grab right here and then blow. Make sure your lips get a seal. So, you're not either blowing hard enough or you're not you're letting air escape. No, it's got to be consistent. Take a deep breath and then exhale into >> two things. >> Was that the first time we did it right? >> Yeah, you just have to do two. So, it's just simple as blowing up into a balloon. >> There you go. Just like that. Nope. You got to keep going. Okay. How about we retry one last time? Okay. Don't stop. Just take a deep breath and exhale into it. >> Okay. No. >> Okay. You're trying to block it because you're putting your lips on it. You're not actually doing it. They did it right the first time. >> The first time. Now you changed it up because you probably seen the result of your first breath. >> Okay. Well, you're not doing >> make that accusation >> because you're not doing it the same. >> It's It's not that hard. You did it perfectly fine the first time. >> Look at that. But I'm not going to like do that the next time. >> That's fine. So So what's what's the deal now? >> Okay. So let's try it again. >> There you go. Just like that. Keep going. No, you're stopping your breath and then you're doing that. So, you have to keep a consistent seal around this with your lips in a constant breath. It's like blowing up a balloon. >> Okay. >> Super simple. >> You're putting your lips in front of it. >> And I can do it every time that it's soft. >> You can try again. Are you going to >> tell me how Okay. >> Do you have a restroom? >> You can. We have to do it at the jail. I can't let you use the restroom here. >> I know. They'll get you water at the jail, too. Okay. >> You don't even need water to pay right now. No, I understand. But we have to do it at the jail. Okay. If you could hold it, it's only like 10 minutes. Thanks, guys. >> Later. Can you put your seat belt on for me? Do you still want your chapstick or no? Okay. >> Hold on. >> What? >> Nothing. The last I don't Maybe I was like this the last time they hit me or I'm still super All right. >> What >> you have it with you? >> Yeah. >> So, I'll show you the card. What it does is you give a breath sample and the 82 that you saw is a cal check, which means it's calculating the test from the um breath given. So, you blew a 010 and then a 008. All right. It'll be the door where it says intake. You want more chapstick or you're going to have to give it to them anyways. All right. So, I just got to read you something real quick. Okay. So, this is your notice of revocation. [snorts] Um, it states that your driving priv privileges will be revoked within 20 days. You need to request a hearing. Do you want to [snorts] sign or no? >> Is that what it means? I don't have a hearing. >> Do you need me to read it to you again? >> No. >> Okay. You sign right there. >> The following night, officers receive a complaint from the suspect about how she was treated during the incident. >> Hello. >> Hello. Is this Miss Valdez Gonzalez? Yes, sir. >> Hey, this is Captain Moors with the Aztec Police Department. How are you today, ma'am? >> Hi, I'm doing all right. How about yourself? >> I'm doing okay. What can I do for you today? >> I was recently arrested on Monday night. I just feel like I was not treated very well by the officers and um the decisions that I made upon that arrest or the the initial the reason why he pulled me over was because I didn't have my headlights on. Mhm. >> And I know that I was being safe and yes, I did have my daughter in the car. I pulled over. I think just the way that he was speaking to me escalated the situation a lot more than it needed to be. He was very disrespectful from the get-go. He said that he could smell alcohol on me, which I had explained to him that I did have a glass of wine ear like earlier. >> Mhm. >> And I did have a beer earlier on in the day as well as I had taken some benadryil like midday and that might have affected me. I I wasn't really sure where he was going with that, but the accusations that they kept on putting on me, it escalated the situation and I just started to feel not safe at all. Um, so whenever they asked me to step out of the vehicle, I resisted and I said that I didn't want to step out of the vehicle unless my mom was there to be with my baby girl. And from there they decided to start telling me that if I didn't listen that I was going to be pulled out of my car. And so that escalated the situation more. And I did decide to call my mom to come and get my baby. and they [snorts] just weren't happy that I was taking situ like taking it into my own hands, which okay, I understand and I'm very respectful and I was complying until they started treating me harshly and I understand that it's their procedure to do things a certain way, but it was like they instantly became upset that I just wasn't, you know, complying 100%. % and I wasn't trying to be any types of disrespectful or anything. But um I was told that the reason why I have a charge of battery upon a peace officer is because I pulled my phone away when they tried to grab it. My daughter was in the back crying. Her window was down because she put [clears throat] it down whenever >> we first got pulled over and they had already swiped to my keys for my ignition from the other side. There was three officers at the time. >> I'm not really the one that does that that sends the um videos out, but there's a person here that does that. Let me make sure they're in the office and I'll try to get that to you within the next hour. If you don't have it by say 1:00, please call me back. Let me give you my direct phone number. You got a pen there or pencil? >> Perfect. Let me get it. Um, give me just one second. >> Sure. >> And can you tell me your name again? >> Yes, ma'am. I sure can. It's Captain Morris. It's M O R R I S. And that goes right to my desk. It's almost the dispatch number. Just change your first number to a seven. It goes right to my desk. >> Right. >> So, if you don't have it by like 1:00, give me a holler back. Um, after you view the video today or whatever, give me a holler tomorrow and I'll try to watch it today and then we can talk about it. Sound good? >> Sounds good. I thank you so much for listening and appreciate it. >> All right. Well, um, I'll be hearing from you. Hopefully not this afternoon. Hopefully tomorrow. Okay. >> Sounds good. >> All right. Thank you, ma'am. You bet. Bye-bye. >> Bye-bye. >> The suspect was charged with battery of an officer, child endangerment, DUI, resisting arrest, and driving without headlights.
