I yanked the door back and walked it as fast as I could. I have two small kids in my car. >> I You lied to me. >> Me? >> Yeah. I just watched a video of what you actually did. >> What' I do? >> You went up to their car and opened the door and reached in and grabbed her. >> I did not. >> I just watched a video. Don't call me a liar. Opening the car door and going after the person is is somehow acceptable. >> Where are you from? That that's acceptable. >> No one should have to do that with their kids in the back seat. >> Okay. >> My children witness this. A parking lot dispute took a shocking turn when an angry driver decided to breach the safety of a family vehicle. With children sitting in the car, the woman didn't just yell through the window. She forcefully yanked the victim's door several times and reached inside. When police arrived, the aggressor played the victim, insisting she was the one being harassed and denying she ever touched anyone. >> Hi. >> Hi. >> So, what was going on? I was caught in the handicap spot and I went to back out cuz I was leaving and this car just came zooming past me and I was out and she she went over here by the day. So, as I came out, her boyfriend got out of the car and I said, "Why would you cut me off like that, you saw me pulling out and she's proceeding to take pictures of me." >> Mhm. >> Which I, you know, the windows are dark, but I was like going like this, and that really was it. So, I don't know. You know, she never responded, but it annoyed me because I mean, she just zoom by and then as I was trying to get out, she was like on the horizontal >> and they're gone. >> What? >> And they're gone. >> No, she's over there. >> The white >> Volkswagen. >> M. Okay. So, she never >> So, I just >> threatened you or anything like that or >> No. No. >> Okay. >> All right. What was your name, ma'am? >> It was just a verbal thing with me asking why, you know, why would you do there and cut me off? >> Yeah. >> I was halfway out and you could see. >> What's your name, ma'am? >> Mary Mandaglio. >> All right. Well, let me go talk to them. It just seems like you guys had a verbal thing and no crime or anything. All right, so you're good to go. Let me go talk with them. >> All right. >> She pulled up next to us as my husband was exiting the vehicle and said a bunch of derogatory stuff to to myself or my husband and I told her, you know, just go, lady. >> And she pulled right in front of my car and blocked me in, proceeded to get out of her vehicle, come over to my door. I recorded the entire incident. >> Mhm. um and yanked my door open, scratched me all the way down my arm. >> Show me the video. Can I go stop or wherever you want? >> I'm still shaking. >> I yanked the door back and walked it as fast as I could. I have two small kids in my car >> and everyone came out of the bait shore to see if I was okay. I was just trying to get anyone's attention from inside the store >> and she just thought it was hilarious. >> Okay. All right. Wait here for me. >> So, did you ever scratch her or anything? >> Did I? What? >> Did you scratch her? >> Scratch her? I didn't I didn't even get near her. I don't even I didn't even know scratch her. >> I'm just asking. >> Of course not. Okay. >> Did you pull on her car door and stuff like that? >> Did I what? >> Pull on her door. >> I put my window up against I put my hands up against the window cuz she was filming me. I don't know where she got scratched from. I never was in contact with her. >> Okay. >> No, never. >> I You lied to me. me. >> Yeah, I just watched a video of what you actually did. >> What did I do? >> You went up to their car and opened the door and reached in and grabbed her. >> I did not >> I just watched a video. Don't call me a liar. >> I did not grab her. >> I just watched a video of you opening her door and reaching the video. >> I don't have to show you the video. I can just take you to jail. Step out of the car. >> I never grabbed her, officer, ever. >> She's got a scratch in her arm and you you opened her door. I never >> You opened her door >> and then reached in. >> I never ever >> I don't care what you have to say at this point because I just watched a video, >> right? [laughter] You never said any of this occurred a minute ago, right? >> Because it didn't happen. >> I just watched a video. >> Well, it never happened. I never ever touched her. I didn't know. >> Okay. Then why did you break into her car to commit a crime? I did break into opening a door and breaking into a car. I did not. >> You didn't tell me any of this when I just talked to you, did you? >> Because I didn't do it. >> Okay. The video shows me different. >> Okay. So, now what? >> Oh, no. >> Stand over there. >> Um, what >> is there a pet in the car? What is that? >> No, that's my uh >> Okay. >> I have groceries. >> Oh, stand over there. >> I have groceries. That's it. >> Okay. >> So, it's your choice. Do you want her to go to jail? Do you want to pursue charges? >> Yeah, I do. Okay. Because no one should have to do that with their kids in the back seat. >> Okay. >> My children witnessed this. >> I need the Can you email that video to me? >> Yeah. >> I just can't believe that she did that. >> And you were parked right here the whole time when she >> I was parked in front of the beach store. I pulled down after the emergency department told me to get away from her. >> Mhm. >> You know, someone who you think was older than you would have a little bit more sense. And I said that to her. I said, "I have kids in my car. Please. >> All right. And you were you were sitt >> My husband, he came out of the vape shop. >> Okay. Were you in the car when were you in the car when she was doing that? >> I was I I went in the vape shop to literally buy some vape juice and literally when I went in to look around, I seen her right in front of the car. So, I ran back out. >> Go ahead and play the video for my body cam so it it's at least recorded that way. If >> my husband's phone, I actually didn't even have mine on me. I'm glad he left it in the middle of the car. Are you okay? >> And you tried to pull the door back closed? >> Yeah, I pulled the door back closed after she had reached in and locked it. That's my husband coming out of the store. >> All right, I'll be back with you. >> Thank you. >> So, what actually happens? >> I'm sorry. So what actually happened? >> That's what actually happened. >> So if there's video showing other >> I >> you can't do no. Stay right here. Stay right here. >> I opened the door. >> Why? >> I opened the door. >> I'm asking you why. >> I opened the door to ask her >> why she cut me off. But I didn't touch >> She slammed the door. >> Do you think that's a mature way of handling things? >> Of course not. >> Why would we do that? Why would we enter or try to open or even touch somebody else's property? >> It's a a a moment of, you know, somebody >> somebody cut you off and >> it was it was wrong. >> You do that. >> It was wrong. But I'm sure that it was not a good thing. But you know, you have to also understand that what she did wasn't >> Okay. Somebody cutting somebody off is completely different than somebody touching another person's property or person. >> There's a big difference, sir. >> I get it. >> I get I get it. >> All right. So, she does want to pursue charges. >> I'm sorry. >> She does want to pursue charges. >> She does. >> Yes. >> Okay. Do you have any reasons for your actions of opening her car door and reaching in? I I >> don't say you didn't do it again because that was a lie the first time. Okay. So, I'm going to give you a chance to tell me the truth. >> If I open the car door, but I never at the >> It shows you reaching in. >> The video shows you reaching in. >> Pulled the car door. >> Yeah. Which rightfully so, cuz you were reaching in. >> No, I wasn't. >> I watched a video. >> I never reached in. >> She pul You reached in and she pulled the door shut. >> Never. I would never grab a a car ever. >> Okay. And you would never open a car door either. Right. >> Okay. >> Which you lied to me about to start with. >> Okay. All right. >> Right. >> Okay. >> This is my first day. Okay. And when I watch a video, it's that simple. Right. >> All right. Well, I apologize. And it was just a moment of >> No, there's no apologizing. Her kids are in the back of the car and everything else. You You >> children in the car? >> Yes. Well, her windows are so black. I didn't see any of that. >> Well, maybe you shouldn't have done any of that to start with. >> Absolutely. >> Over over a simple parking lot beef. >> Well, >> you do realize how innocuous this whole thing seems and your actions are just way over the top for what occurred. >> Well, when I think someone is just >> You're going to go to rear end me. >> You're going to go block them in, open their car door, and assault them. >> I got anxiety. And >> there's no anxiety. Anxiety mean you left. You got anger. >> Well, I'm sorry. I It wasn't meant to be that way. I'm absolutely sorry. >> It wasn't meant to be, but you did it. >> Well, it was a moment of not thinking. >> No, I don't have to let you go talk to her. You just assaulted somebody. I'm not going to let you go talk to her and assault her again. >> I didn't assault her. I mean, you make it sound like WX. >> You make it sound like I, you know, >> that >> I'm not like that at all. >> I didn't, you know, you you're making it sound assault like I >> assault is touch. >> Make it sound like what? >> You make it sound >> Wait. No, no, no. Back up. Tell me. Tell me I'm wrong. >> I didn't say you were wrong. >> You You're telling me I'm wrong. You're making You're sounding like blocking a car in, opening the car door, and going after the person is is somehow acceptable. >> Where are you from that that's acceptable? >> I didn't go in. >> Where are you from that that's acceptable? >> Well, it's not acceptable. >> There you go. Answered your own question. No. >> What we call? Hm. >> What we call? >> Why? >> Cuz I want to know. >> Why? >> Cuz I want to know who you're calling. So I don't have to worry about someone coming here. >> Oh, I'm hot. >> I'm not joking about that. So who are you calling? >> Hi Wanita. Where are you from? Where? Why? What's wrong with you? Were you sleeping? >> It closed at 7. >> Huh? >> It closed at 7. >> Oh. >> Um, I had a confrontation in the parking lot with some girl that cut me off uh near Publix >> and and there are three police here. So, I don't know what's going to happen. >> Well, don't come down because um I >> I'm at Publix on Pizza. >> We good. >> Huh? Okay. Bye. Oh, Peppa. My niece is going to come and I want her to take my groceries. Would that be all right? She can take the grocer. Oh, you're going to have to ask the other deputy. >> Oh, well, >> car is getting towed, though. >> I'm sorry. >> Your car is getting towed. >> Why? >> Cuz it cannot sit here. >> Well, can I talk? >> Nope. >> He told me I could leave. That's why it's sitting here. >> So, unfortunately, after reviewing the video, we determined that a crime occurred. >> Well, couldn't you? >> I can't. Nope. Cuz then I'm liable for everything. We do not do that. Said your niece is on her way. >> I'm sorry. >> Your niece. >> What about her? >> She's on her way. You said >> where does she live? >> Northport. >> Huh? >> Northport. >> If she can beat the tow truck here, then she can have the groceries. If not, we're not going to sit around and wait. >> Say it again. >> If she beats the tow truck here, but we're not going to sit around and wait for her to get here. If the tow truck's here. >> Mhm. >> What's up? >> I'm going to take this old lady to jail. >> Are you? >> All right. Go ahead and take the push off for me. >> Okay. And turn around. Face the car. Yes, you're going to change the seat. Thank you. >> Poor man. >> Well, no. You did the job. >> Okay. go with you to the jail. >> Okay. All right. >> And I know you think that you didn't commit a crime and that uh everything is just fine, but uh you did commit a crime. >> All right. All right. There's nothing else on your person. >> Okay. >> 115. >> Let's walk over to my car. >> Copy. >> All right. I'm going to get the seat belts and put seat belts on you. Okay. >> Can I ask you why he like take everything out of my purse? >> Because it's going to the jail with you and we're searching it because if there's any contraband in there. >> Oh, I see. >> Yeah. We have the right to search your car, everything once you're arrested. >> I understand. >> Fourth Amendment doesn't cover it. Okay. >> Okay. All right. Now, on your arm, I see some scratches. Looks like uh looks uh it's starting at your shoulder and coming down. >> Yeah, cuz she reached into like a grabbing manner. >> Yeah. And it looks like uh like one line kind of there's a couple more down. >> She had like dagger nails. >> Trying to get the like I can see that there's two lines in there. Just trying to get a good angle where it shows both of those. But it's still it's it's a contact. So, um All right. And >> sorry I couldn't say that back. >> It's okay. Uh and your two children were in the car. Yeah. >> And but they weren't harmed or anything like that. The back door wasn't open. >> Yeah. The back door wasn't open. I think she was just targeting me. >> Okay. And then after it happened, that's when your husband was walking out cuz you see in the video him walking up. >> Yeah. He was coming out of the vape store. Okay. >> That that everything had happened like in a matter of seconds and then he came out. Okay. Is there anything And obviously you do want to pursue charges against her for battery. >> Yeah. >> Okay. >> No one should have to go through that with their kids in the car. >> Right. >> All right. Is there anything that we spoke about off tape that we haven't spoken about on tape? >> No. >> Is there anything you wish to add, change, or delete from your statement? >> No. >> Okay. This concludes the statement. >> All right. Uh we'll be back with you. My partner will bring over some uh uh paperwork for you really quick. Um >> it's just uh paperwork saying you've been a victim in the of a crime in the state of Florida, what your rights are as a victim and so on. And um your name is essentially going to be left out of reports is only going to appear in report once uh and then redacted. It's called Marcy's law as do with a case that happened up in Tampa. >> So it won't be like on my permanent record that I assaulted or anything. >> No, there there's a record of it. >> Okay. >> But if somebody does a public records request, your name doesn't appear in it. If they do a case if they do a records request of the case number. >> Okay. >> But if they do a records request based on your name, it won't come. >> So I was going to say I've been driving for like 13 years. I've never >> No. So it's not Yeah. People have this idea what a permanent record is, what it is, and what is >> I have no idea. I've never even been to jail. Yeah. Just cuz you have a contact of law enforcement doesn't mean it's negative. >> Okay. So all right. >> Thank you, sir. >> Yep. Just a minute. All right. So what so what this is this is you will be notified if she's released when she's released from jail. Normally it applies for domestic situations where people are known but she doesn't know you. She doesn't know where you live or anything like that. >> Thank goodness for that. >> So the charges are going to be actually burglary and battery. >> Why burglary? >> So opening the car with the intent to commit a crime is a burglary. >> Wow. >> So all right. So this is um Marcy's law and the the crime she was intending to commit was battering you. out. Um, >> this like breaks my heart that someone would do that to another woman. >> Well, what really bothers me is kind of the cander she had of just not really caring. >> Definitely a learning moment. >> All right. And just uh your signature here and I'll be given this little booklet. And you get that and you get one of these. >> Are they going to get like port rings and like stuff like that? >> Uh, it depends. Uh, it can be where it goes to court, but it's really simple with the video and everything else like that. Nine times out of 10, they just plea out. >> So, um, >> yeah, it's really simple. >> Deputy Joseph. >> All right. >> Thank you. >> You're welcome. >> I appreciate what you do. >> Thank you. >> Have a great night. >> You too. >> Yeah, she's in the back of the car. >> Why? >> She's being arrested. >> For what? >> Burglary and battery. >> Burgling. >> Burglary. Yes, ma'am. So why >> she burglarized the car? What do you mean? >> What are you talking about? >> Opened a car that is not hers and battered the person inside. >> Can I cop? >> No, not right now. >> Okay. So, what happened? >> So, now she goes down to the jail. >> Okay. So, what happened though? >> I just I just told you. >> But open a car like to attack someone to steal the car >> to an intent to commit a crime. >> Well, what's the crime? Battery. Battery is a crime. Therefore, it is burglary. >> That right. >> It is burglary. >> How? How is that? >> Under what statue? Like, how does that work? >> Under what do you mean what statue? You cannot open somebody else's vehicle with the intent to commit a crime. That is >> what was the crime ready to do? >> She opened the car and committed battery once inside the car. So she got out her car and walked over to another car and opened their car door. Is that what happened? >> Exactly. >> Yes. >> And this all started because of what? >> So I'll tell you, I don't have to tell you, but I will tell you >> uh a what I told her was a trivial parking lot argument where they cut each other off in a parking lot. and she felt she had to go serve justice on her own. >> Yeah, it's unacceptable. >> So, can I have her car, keys? I can move her car. >> No, the car is going on the tow truck. >> Yeah. No, the car is getting towed. >> Oh, the car is getting cold. >> Yes. >> And where is she going? to the jail. Charlotte County Jail. >> And where is that? >> That is on Airport Road down upon a Gordon. >> Okay. So, will she get there tonight? >> No. First thing in the morning. >> So, she has to stay there overnight. >> Yep. She'll go to first appearance with >> I can talk to her. >> No, >> not at all. >> No, because she was a very rude person and she doesn't cry. >> Well, I'm trying to understand it, too. But maybe >> despite the woman's insistence that she was the victim, the video evidence told a different story. Officers confirmed she forcefully opened the car door and scratched the driver's arm during the altercation. Consequently, she was placed under arrest and faces charges of battery by intentional touch or strike and burglary of an occupied conveyance for entering the vehicle uninvited. She remains presumed innocent until proven guilty.
