I think he's mowing the lawn. So he was standing right here. I walk up to him and he asked me who I was. I said, "Deputy McCarthy, I'm here to investigate a disturbance." And he walked over to the lawnmower and just started it up and said, "I'm not going to talk to you." And I'm like, "Well, you got to identify yourself. I need to know who you are. Are you the landlord? What's the deal?" He goes, "I'm not going to talk to you." I'm like, "All right, well, you're not going to mow the lawn cuz I'm trying to figure this out. I'm not going to identify myself. I don't have to identify myself." I said, "Well, you do, unfortunately. Um can you just hang out with him? He's pretty fired up about search. I'm guessing there's likely something on him." Okay. What is going on? Do you have an ID? I do. I can go get it. >> Wonderful. Why don't we start with that? Could you grab that for me, please? Cool. We'll have him hang out over here in the car. Just till we get stuff figured out. Can you just park right here and hang out in the car? Thank you. See you, buddy. Turn off. Yeah, turn off. Okay. What the heck? No, I know. >> What What the heck is going on? Hey, this is him. They don't want to pay the rent. That's That's the problem. >> Sure. And I'm just trying to figure out why she called us. So that's why we're here. And obviously, he's upset. So I just wanted to figure out what's going on. Yeah, I'm not Perfect. Okay. Connie, Yes. what is going on? So his dad lives here. Who's Who's that? Um my fiance's father. Okay, he lives here. Is he Who else lives here? Um a bunch of people. Okay. So like he he rents uh rooms and garages to with no air and water to some Mexican people. They have a baby, but anyhow, Mox um Officer Mox was here last week. >> Okay. And um so he said that he told us we um if we if we wanted to be here, we are allowed to because we're his dad's company. And so I >> the What the The landlord had said? Yeah, the landlord was giving him a hard time too that day. >> Oh, the tenant had said you guys could be here. The officer said Officer Mox was like, "You know, you guys are here. You're his company. You're allowed to be here." So I said, "Okay." Well, today we were going to get help from St. Vincent de Paul to pay the rent because he wants them evicted. So we're going to get that paperwork together to get it over there. But I was sleeping in there at naked. And um and he walks in. I No knock on the door, no nothing. He just opens his father's establishment where he's living and just walks in the room and starts knocking on the the refrigerator while I'm there naked. "Hey, you got to get out of here." I said, "Excuse me, sir. That is illegal. You're not supposed to Not to mention he turned off the um powered off the the room y'all last night. Had no lights, no no refrigerator. All his stuff went bad. All his food that he had, we had to throw it out yesterday because he powered off the the fridge and the and the power and no hot water. So today we're we're just going to get everything try to get everything situated, but I didn't get enough sleep because I was working. So my boyfriend said, "Well, just stay here. Sleep until my dad gets out of work. We'll get him and we'll get everything going." Okay. And so this guy just walks in the room while I was in there naked and says to me, "Well, go ahead call the cops." I said, "I I'm going to call the cops cuz you're not supposed to just walk in the house and then walk in >> You were sleeping? While I was sleeping. I have it on video. >> Okay. I I was just curious if landlords if they knock and say, "Hey landlord." and they come in. So I guess I was just curious if that occurred at all. Never did. Um I I know it would be tough to know if it did happen if you were sleeping. So that's why I ask. I know I maybe you don't know that. I'll probably talk to him and probably talk to him, but I'm just trying to figure out what's going on. Um So he's the land The guy that's in the back of the car is the landlord? >> I believe so. He is because He's the owner of the house? Okay. Okay. Yeah. Um Have you guys been evicted or served with any eviction paperwork? When was that? Um Okay. When when was that? >> 2 days ago. Okay. And when when did it say you guys were evicted by? It doesn't say. It says we have 5 days to um Vacate? Detest it. Oh, to contest it and whatnot? >> Yeah, there you go. Contest it. So that's what we were going to do. We're going to go down to St. Vincent. See if they can help pay pay um cuz he's asking an absurd amount of $3,600 for one room. So there's something going on because every tenant in here has to pay $3,600. So it's just So we were going to contest it and see what we can do as far as how much to come up with or how much to come >> days to contest it. There was no vacate the premises by this day or time? No. Okay. Um and did he say what he was here for today? He wanted me out. You specifically? Yeah. Okay. Um all right. So the paper the eviction paperwork, do you guys have that here? Uh he has it. I believe it's >> In the car with him? Okay. I'll chat with him then. He lives here too or staying You guys are staying here with the dad? >> With the dad. Some days, yes. Okay. All right. Yeah. I'll just Hi. How's it going? Why do I have to identify myself? Why do you have to identify yourself? You're causing a disturbance. I know. Did you give 24-hour notice before entering the property? I'm not answering any questions. You do realize that if you do I'll talk to my lawyer. Sounds good. Do you understand me? You still not wish to speak with me or provide your name. Sounds good. Hey, how's it How's it going, sir? Do you have the eviction paperwork? I want to speak with the assistant D bro because I got I got the I'm working. I got money. I I want I want to get my place. That's for my father's place, you know? This one here? Yeah, but so I I want to I want to see see my papa is safe being here or not because I want to get out of here with my papa right now, bro. This guy is harassing him a lot, man. Too much. Too much. Too much. So when were you guys served this? He put it in the I get this paper from the door yesterday. So it was posted on the door? Yeah. My father living here like a like a three four week only, you know? It's only one month here maybe. No more than I'm I'll be right back. Okay. I'm just going to hang on to this. So this is the eviction paperwork. She's saying he's possibly the landlord. She doesn't know for sure. She didn't have a name. Um It doesn't matter. Doesn't matter? Yeah. Yeah, I know. This was posted This was dated June 21st and this is the 5-day eviction thing. It says June 21st down here, but it says the 26th at the top. You put on the 26th. Okay. The You're trying to You're trying to investigate that. You won't provide any information to Correct. He There's no exigent circumstances allowing him to enter the residence. I e. water coming out or anything like that. He has no fear that damage is occurring. So he can't enter based on that. He did not post a 24-hour notice. That he won't tell us. So he can't enter. Trespass to dwelling. Yep. You just locked in the front door. Okay. So Yeah, hold on. What Did he call you guys at all and say that he was coming >> Not at all. So he he didn't call you guys within the last couple days to say he was coming or anything like that? >> Nothing. He comes here every day. He was here yesterday at 9:00 knocking on the door. I wasn't there. Um I'm afraid, you know, he had two other men with him. This guy and some other big dude and he was screaming through the door obscenities like "You better get the F out or you're going to learn today." And then that's when the lights turned off and then the hot water and everything else. Okay. >> But his dad, he's such a like doesn't want no problem type of guy. We're like, "Look, we can call the cops and have this reported cuz he's not supposed to shut off your natural You like natural resources." And he says, "No, it's okay." Sounds good. Um Yeah. So this looks like on the 26th this was posted. It is a 5-day thing. It is due to dated June 21st, okay? So as far as you know, you weren't told that he was coming today and trying to come inside at all. So there was no notice of landlord coming. Not to your knowledge. He didn't knock and announce his presence. Okay. Um I just got to chat with him to see if that any of that occurred, okay? Um I'm going to give this back to him. Um Do you have anything else you'd like to add at this point or anything else we should know? So yesterday he was here banging on the door yelling. At 9:00. And then he didn't He didn't come in then? No, he was knocking. He wanted someone to >> Let me ask this. So he came here wanted to talk to somebody yesterday at 9:00. Did you speak to him through the door? No. Did he say he was going to come back tomorrow? No. Cuz if he came If he said that and he comes back 24 hours later No, no. I have it on video as well. But it was all on But he never said he wanted to come in. He just wanted to talk to you. Yeah, he never said he wanted to come in. He said Um my boyfriend was here too. He says um "What do you guys Who's red car is that?" Which is his dad's car right there. And no one answered and then he just said, "Okay. I see I see what's going on." Um "You guys are going to learn today." And then that's when the lights and then the the water And that was that was yesterday. That was yesterday at 9:00 p.m. or 8:15. And that 9:00 p.m. yesterday, okay. And then And then so this morning he came started mowing and just Did you know he was here? No, I was sleeping and he just walked in the room. And so all of a sudden I'm up and he's like, "Hey. You. You don't belong here. You got to get out." And I'm like naked. I'm like um "Okay, but you know that's illegal." And then I started recording and he says, "I don't care. You got to get out." I said, "You're not supposed to come in the room without letting us know." And then he says, "Go call the cops. Go Whatever you want to do." All right. We're back with you. So he was here yesterday. I guess we'll see if he said he was coming back today. So here's that back for you. When when he was here he was here yesterday morning. He's here every day. What >> in the street. You see the mark in my car. Yeah. >> Cuz he didn't let me go inside. So I'm not living here. That's my father. My father is old people and driving truck. He clean record 20 years old. This guy try to make him dirty with my papa. Sure. When he When Let me just ask a question. The landlord was here yesterday. Were you here when he was here? >> I'm inside. I got video. I'm inside the scared because I was outside. Hey, this is not a hotel. What did he What did What did he say about when he was here yesterday? Did he say he was coming back today? He didn't say he's coming back. He said he don't want me here. I mean he said, "I don't want you here at all my my papa too." She don't know him. She is my girl. She don't know nothing about her. She is only living at 4:00 in the morning to sleeping because I taking my papa to work. It's only one car for now. I need to fix the red one for my father, you know? Okay. So So to your knowledge, he didn't say yesterday that he was coming back today. Did he tell either of you that he was coming today? Maybe in the video, but I already watching it. Yeah. Okay. He didn't say He's never He hasn't told either of you guys that he was coming today and was wanted to go inside. Okay. What And your dad, does he know if he was told that he was coming today? Can you just turn the car off? He's saying He never talked to him. He never told him anything about coming. Okay. Hey buddy, do you want to chat with me at all? Um Were you here with him yesterday? Yes. Okay. What time was that do you think? What time we here yesterday? Like We started painting the back gravity. 11:00. At like 11:00 a.m.? Yeah. Yeah, probably 10:00 11:00. Okay. Later morning. Yes. Okay. Um What do you remember what do you remember happening today? Okay. The reason that he mad is because it's one room for only his dad. So three people in one room. Right. And he no want to pay the rent for I think 2 months. No deposit, no rent, he no pay water, he no pay light. So he's not paying light, water, anything. So it's he's renting a room to the dad for one person. Yeah, he rent They haven't paid rent in 2 months, electric or water. I think it's 2 months. Okay. Because we start to work in this house last month. Okay, and so what happened today? We come in. He come in first to cut the grass. And then when I come in, I go to Home Depot so they fight inside. They were inside already? Because okay. Because um he said he knocked the door and nobody answered. Every day nobody answered. Him, the girl, his dad. Nothing. Uh I think that the the court house sent the paper, they take it all and then throw away. And then they pick it up and go to the room. So I know that guy for like 7 years. He's a good guy guy because two people inside is homeless. So he help a lot of people. Yeah. The reason that he look with you is because he's tired for that people. Yeah. No pay nothing. Mhm. So but he's good guy, I swear. Okay. So inside is two homeless people. So when you got here he was already inside yelling and screaming with the landlord. Cutting the grass, yeah yeah. >> Okay. But then he go inside again and he knocked the door and she start to fight. He said and and I tell him what happened Salvador. Man, it's another girl. I don't know I don't know who's that girl. That's the first time I see that girl. Okay. All right. All righty. Yeah, but >> But yesterday you guys were here at about 10:00 or 11:00 you think? Late morning. I don't know remember but Knocking and nobody answered, yeah. We working the back and he no answer. And he knocked the doors and man Nobody's answering. Yesterday yesterday we disconnect the water in the night and she's really You realize you also can't do that. Huh? You also can't do that. Yeah, you can't disconnect electric and water from a a tenant's residence but all right. >> Yeah, but only in the room so Yeah, yeah but you still can't do that. All right. Yep, I'll give your phone to your friend. On the 13th time you're being an [ __ ] daily. You're being I they're almost not even on you at this point. They are. They are. I know you're going anywhere. You're being an [ __ ] No because you're a policeman and you're supposed to share. All right. Keep that in mind. Okay. I know my right. Salvador? That's you? Okay. I'll give your phone to your buddy. You want to see that this phone Okay, buddy. Yep. Can you step out for me? Turn and face the car. Move your feet apart for me. All right, I'm going to search you, okay? I don't consent to a search. That's fine, it's cool. You don't have to at this point. You want your keys to stay here? Give it to my friend. Okay. Stop arguing. I no arguing. I can talk, right? No, you can't argue. >> Yeah, I can but no I can talk. >> And you can't tug yourself around. So when you do that that's why your stuff is going to drop so you got to just stand still. Why you move I going to move, you're the stronger than me. You know that, right? I just told you to face the car, you're the one turning around. So that's why you're the car, you move me. I ask. Do you ever not argue? You don't have that ability, do you? I have my right. I know my right. I know for sure. I know my right. Yeah, that's why you just committed crimes. Where? That's why you're going to jail. What are the crimes I committed? Trespassing and obstruction. Correct. Okay. I know that I know you do. I thought you knew your I thought you knew your I thought you knew your I thought you knew your laws. Yeah, I know. Well, I guess you don't. All right, we double locked. My keys? You give it to my friend. We'll call him over. They're double locked. Fantastic. And they're more than loose, man. They're not even tight at all. Where they were tight. No, they're not tight either. You do realize everything's on camera? So Oh yeah, have a seat. Hop in for me. That's why all this will be admissible in court. Oh, that's where all this is from. All right, watch your head. Okay, this is in reference to case number 2406-017654. Location of this interview is 1516 Shenley Street, Port Charlotte, Florida. The person being interviewed is Connie Marie Montalvo. Montalvo. Okay. Date of birth of 11/13/1979. Connie, do you know the um meaning of perjury? Yes, I do. Okay, perjury can be committed by telling lies or omitting information under oath. It makes a crime in the state of Florida, okay? Okay. Okay. Are you under the influence of drugs or alcohol at this time? No. Okay. Can you raise your right hand? Do you swear affirm the statements you're about to give me the truth, all truth, nothing but the truth? Yes. Okay, can you tell me what happened? Why were why are we here today? Okay, I was sleeping in the in the dad's room waiting At this at this address? At this address 1516 Shenley. Okay. Um waiting for him to get home from work to get everything situated with the paperwork for and all that. Okay, so you're waiting for who to get home? Um the dad, his name is Carlos Garcia. He's the resident that resides here. Okay. And we've been here for more than 7 days now. Okay. Um landlord walked in the room, did not knock, nothing. I'm a very light sleeper. Never knocked, never sensed his presence. I was in there um unclothed and he just walked in the room and said, "You have to bang on the the refrigerator. Mhm. You have to get out of here." And I said >> And the the person you're talking about is the one that was placed in handcuffs and sat in the car? Yes, Salvador. Salvador, okay. Yes, very disrespectful. He disrespected Officer Montz last week as well with that was out here telling us. Very good gentleman. So he came in and woke you up? Woke me up. I said, "How did you get in here?" He said, "Doesn't matter how I got in here, you don't belong here." But the door is locked, you know? Yes. Okay. First thing he said was, "We'll be back for you at lunchtime. Don't open the door to no one." That's the first thing my fiance said before Okay. he left. So I that's how I know he And what time was that about? When my fiance left or when Salvador >> What what what time did he say that he'd be back? Oh, about 12:30 with his lunch. 12:30-ish. Okay. My my fiance. Okay, got you. Mhm. We're we're going to get everything situated with the courts and the eviction and all that. Okay. And so he just walked in and um and so I started recording. I said, "Sir, this is illegal. You're not allowed to come in here without my knowledge or you just broke in the room." And he says, "Well, do what you got to do and call the cops if you want." Okay. That's what I did. Okay. And then how did you guys both end up outside? Because you were both outside when I got here. Well, I waited for the officer. I was on the line with um uh Dispatcher? Dispatcher. Okay. And she said he was turning on Orlando right now. Okay. Which I know is a very close block. So I looked out the window and when I seen the officer um talking to the guy bullying Salvador Mhm. that's when I walked out. I felt safe enough to walk out. Okay. So you're in your bedroom. Mhm. Did he come into your bedroom? Yes, he was inside. And then you guys had that brief conversation then he left. And then I when I you seen I was recording, he said walk and walk out. Walked out of your room and and came back outside. Yep. Okay. Uh anything else that you wish to add, change, or delete from what you've told me or does that pretty much cover it? Um from today's incident, nothing to add. Only thing yesterday he did shut off the power and water, hot water. Now his all his groceries bad and everything else. Okay. That's also an illegal thing you you cannot do as a landlord. Okay. So as far as today, nothing else? As far as today, nothing else. Okay. That concludes the statements. Time is 10:09 a.m. June 28th, 2024. Okay. Said confirmation, right? Okay. Uh We have just one other slight issue, Connie. Um there is an open case on you for your arrest for scheming to defraud or something like that, I'm not sure. So at this time I have to take you in. What is that at? Uh I'll I'll show you but at this time we have to take you into custody. Turn around, please. Can I put on I'm going to give you my phone, sir.
