making 911. Where's her emergency? I'm a felon. I'm trying my best to do that for her. I need somebody to come get her. I need somebody to come get her out of my house cuz if I go to jail, she got to go. >> What's your address again, ma'am? >> Making y'all please get her. Can y'all get her? I got a screwdriver in my hand. Y'all come get her. Come get her. >> Come get her, y'all. Please. Please come get her. Come get her. Come get her. Y'all come get her. >> Can y'all please come get her? Come get her out my apartment. I'm telling y'all now. Come get out of my apartment. >> I don't care if she stayed there. You know what I mean? But >> who apartment is it? >> It's my apartment. >> But sir, I'm going just be honest. She used to be a correction officer. She also was a peace officer. She on the ocean. You know what I mean? So get what? If I was to hit her back, I get in trouble. I'm a felon. I'm just being honest. Like she tried it before in Atlanta and when the police and stuff got there, they was like um they they even allowed, you know, her to be in there and try to, you know, throw me out type and everything. And I was like, "What the hell?" I was like, "Y'all not even allowed to do that." >> And they were like, you know what I mean? So I don't play around with it. >> Also, when you get in there, you going to see my heat press. I pay $300 something dollars for it. You going to see it on the floor broken and all type. You >> know what I'm saying? What What kind of work she do now? She um well she's I think she she had to go through some kind of little tribunal thing to get her credentials back or something or to keep them. >> So she's still doing that kind of work. >> Um well well not currently but >> what car she driving? >> She she dried a she drive a black she a black Nissan. >> Okay. So now what? Tell me what your problem. >> She like oh I got furniture in here. They going they ain't got no choice but to let me stay. I said Ken a them folks ain't about to let you keep hitting on me. I said I can't hit you back and you know that. I said you ain't going to keep [ __ ] hit me. I said, "You're not about to keep me. I'm telling some like we like we got the arguing. I had end up, you know, going to Verizon to try to get my nephew on on one of my business accounts." And so, you know, when I went back, I said I said I said, "Why the you not answering the phone?" I said, "Important." This girl was like, "Why the you in my face?" I said, "Ken, how am I in your face and you was on the bed?" I said, "Baby, I'm not in your face." I said, "You just like that because that dude used to hit you." But I said, "I'm not him." I said, "I'm a girl." I said, "I don't hit on nobody." She was like, "No, this girl started h my faith cuz I told her I need her out of my house. I'm not about to keep being abused my own. I'm not going through that. I'm a felon. Guess what? If I hit her back with her, guess what? I get in trouble folks in Canada already showed me that I shouldn't be in car no 3 hours. I shouldn't be in car. I've been calling all the folks back to back like that. How I don't give a and I got furniture here. I'mma out ride anyway." So she literally done picked up my heat press off the side of the floor, done got it, slung it down by the table. No, she say while she on the phone, like while I'm on the phone with 911, she going to say, "You did that. I didn't do it." And this girl laughed in my face. Like Like come on now. You know I make t-shirts. >> How much the heat press cost? >> The the heat press ain't nothing but like $300 and some dollars. It's a regular heat press, but I make t-shirts from it. You know what I'm saying? So man, if you go in there, you see a lot of rigged up. You see all kinds of man like when you going like when you go in the house yourself her name Kima Mitchell like when you go in like I ain't let me tell you something I do not even play no police game man like when she when she called the police the first time in Fton like I'm literally coming back to the house I said why you call the police baby. She's like oh I called the police cuz you said I couldn't get my stuff. I said girl please I don't give about you can't you know what I mean? She talking some um she talking about some N. The police going to tell her tell me something. Oh well technically if it's your stuff you can get I said sir I don't have no problem with her getting her stuff. So you know we done moved down here to making this stuff. Guess what? She on the same she told some um she told him some I can easily tell them what I want type girl. You can't tell them folks it's a different ball game baby. They not on that. You know them people in Atlanta baby. This the country. You in my city. You not about to do me any kind of damn way. me in the this girl don't hit me in the ear. I was like like on some punch me in my ear. I said, "You know what? >> Y'all like get the fire." >> No. No. Actually, I don't hit her back. I said, "You know, I'm a felon. I'm a fella." You know what I mean? So, I told her, I said, "If I hit you back, I get in trouble." You know what I mean? And she know that. Like, like, let's be real. Like, and I'm not, you know, being funny or anything, but she's a girly girl and I'm out here looking at how I'm looking respectfully. So, when the police get here, guess what they going to say? They going to automatically assume that I'm the aggressor. You know what I mean? Like I done even told my boss and let him know know that you was coming or whatever. He would allow me to go back to work. That's how bad we be getting too. Officer like that's how bad I have to come home and worry about whether my about to be broken cuz I got to replace the TV for the third and fourth time. She threw the TV on the floor now. Heat press when you walk in. You going to see it all out of whack. Like you you can't be here and >> I can't even work. I can't work like that. I'm not coming home, >> right? Like like you can you can hear the 911 call. Like if you hear like the lady the lady even said, "No, we see that she broke. She not about to stay here and be hitting on me and stuff too. I'm not doing that." Like come on now. Ain't nobody about to keep dealing with that. Like she hit me on my ear. Like I don't care. Like as as big as I am, man, I got to be bled up and smaller than you. She bigger than me. But guess what? Guess what she got on me? Under oath. She under oath. >> Yeah, under oath can go to jail, too, though. >> And guess what? Also, when she pulled kind of when she pulled them when she she pulled them down, police said forget what they did. They played in my face. I promise you they did it. Like certain stuff I kind of sort of keep cuz the Xbox she threw it in water. I had two iPads. I had bought her one. >> Oh, the iPad and stuff I put back in here. Like the Xbox, man. She threw the She had threw the Xbox like, you know what I mean? And I got it and I tried it and it worked. You know what I mean? So when she seen me on it, okay, cool. Next thing I know, get a TV. She threw it on the ground. Move, move, move, move, move. >> So tell me what you got. >> I don't know. >> I see the stuff on the floor. >> What's your name? >> Why? I'm out here for a domestic call of you hitting on her and fighting her and throwing stuff around. What is your name? >> I'm not going to give my name for one and for two, I feel like you should ask her why she called and why she feel >> she's already talked to me outside. >> Well, I guess you know all your answ. >> So, according to what she said then you guilty. >> According what she said don't mean nothing. What she said is what she say. I can say >> and we all know that. >> So, >> so you said you said she was eating on you. She even hit you in the ear. She put you a heat press and all that kind of stuff. >> Correct. >> I want to go to jail. >> I'm not going to jail. >> Come on, Mr. B. Don't do that. >> Well, I mean, you know, you know, you can't be in here throwing stuff around and all that kind of stuff. You can't do that. >> This is her stuff. >> I'm pretty sure this is my stuff. >> Who stuff is? >> Well, that's my this her sofa and that's her bed. >> But that's my heat press. >> The table. She purchased broken but you did get hit. >> Yes, sir. She did hit me in my No, >> you don't want to press your You don't want to go to jail. >> I don't want I don't want her here. I'm not Listen, I'm not about to be folded up in my own house. >> I'm not about No, son. She not You want to go? >> I'm not about to be folded up in my own house. I'm a felon. I do. >> All right. Well, you got to come. >> I got to go for what? >> I have I'm going to leave the residence. I have to get >> uh if you ain't on the lease, you got to go. >> Y'all can't make me get out. >> If you ain't on lease, you got to go. >> Make me get out of here, though. >> If you ain't on lease, you got to go. >> But it's funny cuz you already know that. >> No. What? >> You already know. You can't make me go no. >> If you're not on lease, you got to go. >> Okay. You got to go, too. If you're not on lease. >> Oh my god. >> Yeah, that's crazy. >> No, cuz I know you're messing up. >> So, one of y'all one of y'all got to leave. And it's basically you. >> No, cuz one thing about it, y'all are going off what the first person said. Y'all did not ask me no questions. Y'all >> I I just did. >> You didn't say nothing. You still didn't say nothing. I asked you when I came in right here. >> Ask me what my name is. It doesn't matter. >> Okay. Well, the bottom line is you got to go. We're for working tonight. >> I ain't got here yet. >> Oh, might not be. It's your birthday. >> Okay. When can you take your clothes off? I need your shoes off and I need Hey everyone, it's Trent, prior deputy sheriff, patrol sergeant, and K9 handler. All right, so there's a few different things I'm going to be clarifying for you guys in this video. So, I just want to start off by saying domestic violence laws and tenency right laws can vary from stateto state in regards to what law enforcement is legally allowed to do or mandated to do. It kind of just depends on the area, but for the most part, you don't need to be on a lease or even pay bills. If you've established tenency somewhere, some states require that it's a minimum of 30 days consecutively. Some do not have that requirement, but in most areas, if you've established tenency, then the only way to permanently get someone out of that residence is to go through the civil eviction process and get that signed off by a judge. And when these officers go inside this apartment to talk to the suspect, I believe the reporting party said that her girlfriend, the suspect, was prior law enforcement. And based on this first initial interaction, I can clearly see why she is no longer in law enforcement. She doesn't even know the laws. So, this first officer asking her for identifying information. In a situation like this, and he clearly says that they're there for a domestic violence related call, you absolutely have to provide your identifying information. And failure to do so can automatically warrant an arrest for delaying or obstructing the investigation itself. What was also funny for me is if she had been prior law enforcement, which I'm leing to believe that's not the case, was that she was demanding this cop's badge number. And if she had been, she would know that that doesn't do you any good whatsoever. And also, it's going to be in the report. But for cases like this, domestic violence related stuff, you're not going to be interviewing the suspect with the victim just sitting there on the couch. Depending on the circumstances, the area where you're at, it can alter how you go about your investigation. But in this situation, the best course of action was to remove the victim and have her go in the bedroom with the dog so that they could try to establish a line of communication with this suspect. And then in terms of the vandalism element, you're really not going to be doing anything with that as a cop because if two people are cohabitating together, it's shared property for the most part at that point. And typically in law enforcement, we're going to tell somebody, "Look, if your girlfriend broke your stuff, but you guys are living together, we can't sit here on scene and establish who owns what. You're going to have to take that up in civil court and sue them civily if you want money back potentially for whatever they broke that belonged to you." And then the reporting party not wanting to be a victim, just wanting her to leave and not actually get in trouble. That is very, very common where somebody will call 911 for a domestic violence related incident and then cops show up, make an arrest, and that's not what they want. Theoretically, these officers also could have charged the suspect with domestic violence or family violence. Since it is the state of Georgia, they chose not to do that probably because at the end of the day, they knew that they weren't going to have a cooperative victim when it came time to go to court. Some states it's a mandatory arrest no matter what for domestic violence. It kind of just depends on the area just like with everything else. And that's going to be it for this one. See you guys in the next one. >> She was charged with criminal trespass, obstruction of officers, and simple battery, but remains innocent until proven guilty. [Music]
