on Thursday November 23rd 2023 at around 12:20 a.m. a Bernal Lilo County Deputy was out on routine Patrol when he noticed a black pickup failed to stop at a stop sign the deputy began following the driver before observing the driver failing to maintain his Lane and failing to stop at a second stop sign the deputy initiated a traffic stop at the golden Carell parking lot at the intersection of 56 7th Street in Quail Road right through it we'll be at coil in 57 New Mexico boy boy Lincoln Nora 68 it's a black Dodge Ram pickup one inside we'll be pulling into the uh golden Crow [Music] hello sir hello how are you not too bad no not too bad can you have your license registration Insurance please don't no no no you don't keep your keys out just give me your license registration Insurance okay what that's it give me your license please I said you have it in the wallet I don't have it I saw it I saw it on that right there open your open it I saw it's right here the driver initially told the deputy he had four beers to drink but then changed his answer to only having one beer no sir give me your your license you're not going to have you had anything to drink tonight sir yes you have how many of you had to drink uh at least about four about four what four beers four beers can I have your keys please okay now give me your driver's license please I need to identify you I don't have it I me I'm about to tell you something important you under arrest for driving under the influence of an intoxic liquor or drug the New Mexico implied consent act requires that you submit to a breath test to determine the alcohol content of your blood I won't do it after you take our test you have the right to choose an additional independent test if you choose to take this additional independent test you have the right to a reasonable opportunity arange for a physician a licensed nurse or laboratory technician or technologist who is employed by a hospital or physician of your own choice to perform the additional chemical test the cost of this additional test will be paid for by the law enforcement agency do you get to take our test no I cannot force you to take our test but if you refuse you will lose your New Mexico driver's license or non-resident operating privilege for one year if you are convicted in a Court of driving while under the influence you may also receive a greater sentence because you refuse to be tested do you understand do you understand yes okay do you agree to be tested no all right so based on your refusal you're going to get charged with aggravated DWI that's fine phone okay court records show yai had been sentenced for his 4th DWI a month prior New Mexico state law requires a person to be given a mandatory 6-month jail sentence after their fourth DWI the judge in that case sentenced yai to one year in the Metropolitan Detention Center but put him on community custody release for the duration of the sentence just 43 days later yazzi was arrested for this DWI yazzi is currently Behind Bars awaiting trial for
