Days later the victim, Koby Clifton Wiebe plead no contest in the case. Judge Franklin was indicted on felony charges for the threats by a grand jury, but Van Zandt County Prosecutor Tonda Curry dismissed the charges against Franklin, claiming that she's not entirely sure she has enough evidence for a jury to convict. Rather than presenting the evidence and allowing a jury to decide, Tonda Curry made a decision on her own to not even allow the case to be presented to a jury, and dismissed the charges with an agreement that Franklin would plead guilty to disorderly conduct in a completely seperate case. Franklin was given deferred adjudication for that guilty plea, so in 12 months there will be no conviction on his record. He can return to the bench immediately. Judge Franklin has already previously been given a sweet deal with defered adjudication by Van Zandt county prosecutor Tonda Curry.
